2 BEFORE THE FEDERAL ENERGY REGULATORY COMMISSION APPLICATION FOR PRELIMINARY PERMIT October 22, ) Cherokee Rivers Company, LLC hereby applies to the Federal Energy Regulatory Commission for a preliminary permit for the proposed Lower Coosawattee Hydroelectric Project, as described in the attached exhibits. This application is made in order that the applicant may secure and maintain priority of application for a license for the project under Part I of the Federal Power Act, while obtaining the data and performing the acts required to determine the feasibility of the project, and to support an application for license. 2) Location of the proposed project: State: Georgia County: Murray Nearby Town: Calhoun Stream: Coosawattee River 3) Name, address, and telephone number of applicant: Cherokee Rivers Company, LLC 390 Timber Laurel Lane Lawrenceville, GA Name and address of each person authorized to act as agent for the applicant in this application is: Robert Davis 390 Timber Laurel Lane Lawrenceville, GA ) Applicant is a corporation desires preference under Section 7(a) of the Federal Power Act, if applicable. 5) The proposed term of the requested permit is 36 months. 6) All land at the project site is currently owned by the U.S. Corps of Engineers. 3 STATEMENT PURSUANT TO 18 C.F.R Pursuant to 18 C.F.R of the commission's regulations under the Federal Power Act, Cherokee Rivers Company, LLC provides the following information: 1) Identify every person, citizen, association of citizens, domestic corporation, municipality, or state that has or intends to obtain and maintain any proprietary right necessary to construct, operate, or maintain the project: Cherokee Rivers Company, LLC, intends to obtain all proprietary rights necessary to construct, maintain, and operate the project. 2) Identify with names and mailing addresses, every county in which any part of the project would be located and any Federal facilities that would be used by the project: Murray County Carter's Reregulation Dam County Offices U.S. Army Corps of Engineer P.O. 4 1) Dams, Spillways, Penstocks, and Tailraces: EXHIBIT ONE PROJECT DESCRIPTION The site of this project is the site of an existing dam. New penstocks and a new tailrace are planned. The Carters Reregulation Dam located approximately 60 miles north of Atlanta forms the tail pond for the Corps of Engineers Carters Dam Project. The existing reregulation dam is used to store water for pumping operations, to attenuate power discharges from the existing turbines at Carters Dam, and to control minimum flow releases from the project. No power is currently produced at the reregulation dam. The major features of the existing dam are a four bay gated concrete spillway with non-overflow sections tying to earth and earth embankments on either side. The proposed project would add four 8 foot diameter penstocks, approximately 420 feet long penstock through the left bank of the non-overflow section of the dam. The penstocks would terminate at a proposed new powerhouse structure. A new tailrace of short length would be excavated between the proposed powerhouse and the existing tailrace of the reregulation dam. 2) Powerhouse: A new powerhouse founded on bedrock would be added between the penstock and the tailrace, approximately 250 feet downstream of the dam, on the left bank of the existing tailrace of the reregulation dam. 2A) Appurtenances: A new trash rack, stop log, and intake would also be constructed. 3) Number, surface area, storage capacity, and normal maximum surface elevation (mean sea level) of any reservoir that would be part of the project: The lake created by the dam is approximately 870 acres. Its storage capacity is approximately 17,210 acre-feet. The lake is primarily used for purposes stated above. The average flow over the reregulation dam is 1217 CFS. Surface normal operating pool elevation of the lake is approximately 677 feet (MSL). 4) Number, length, voltage, interconnections, and age and condition of any primary transmission lines that would be part of the project: In order to interconnect with existing transmission lines near the project, 1/2 mile of new transmission line is required. The required voltage of this line is to be determined.

5 5) Average annual energy production and installed capacity, hydraulic head, and the number, rated capacity, age and condition of turbines and generators: The installed generating capacity of the turbine-generators is expected to be 4500 kilowatts. Average annual energy production is expected to be 16,500,000 kilowatt-hours. One turbine and one generator would be used. The make and type are yet to be determined. Hydraulic head and design flow-rate are expected to be 33 feet and 1200 CFS, respectively. 6) Lands of the United States: All property at the project site is owned by the U.S. Corps of Engineers. 7) Wild and scenic rivers: The Coosawattee River is not included in the National Rivers System as a scenic and recreational river. 8) Wilderness Areas: No areas within the project boundary or in the project vicinity have been designated or recommended for designation, pursuant to the provisions of the Federal Wilderness Act, as wilderness or wilderness study areas. 9) Other information demonstrating in what manner the proposed project would develop, conserve and utilize in the public interest the water resources of the region: Power produced by the proposed project would be a clean non-polluting source of energy, and would help offset the use of coal and other fossil fuels by electric utility companies in Georgia. All power generated at the project is proposed to be sold to the local electric utility. Power generated by the project represents an economical source of electricity for utility customers in Georgia.

6 EXHIBIT TWO DESCRIPTION OF STUDIES Studies, investigations, tests, or surveys that are proposed to be carried out, and any that have already taken place, for the purposes of determining the technical, economic, and financial feasibility of the proposed project and preparing an application for a license for the project. During the term of the preliminary permit, the following studies/tasks will be completed: 1) Optimization and finalization of project design. 2) Secure and finalize power contract with local electric utility. 3) Finalize all costs of the project and secure financing. 4) Secure any state and local permits which may be required. 5) Determine and meet all state and local requirements concerning water use, etc. 6) Complete and file license application. 7) No new roads would be required to conduct studies, or during construction of the project. 8) Consult with the Corps of Engineers and all other appropriate agencies. EXHIBIT THREE STATEMENT OF COSTS AND FINANCING 1) All costs of permitting and licensing would be born by the applicant to the extent that the applicant is liable for such costs. 2) Engineering and licensing costs are anticipated to be approximately $50, ) Applicant intends to begin financing arrangements upon approval of preliminary permit and finalization of costs and design. 4) Electricity produced by the project would be sold to the local electric utility company, and will help supply the electricity demands of the local utility s customers. 7 Attachment #1 PROJECT LOCATION The Lower Coosawattee Hydroelectric Project is located on the Coosawattee River approximately 1.5 miles upstream of Carters, Georgia in northwest Georgia, and approximately 50 miles southeast of Chattanooga, Tennessee. The reregulation dam is located about 1.8 miles downstream from the main dam of the Carters Project. Both dams are located in Murray County.
