2 New Act. on Certain Measures in Relation to Environmental burdens Contaminated sites in Slovakia September 1 st 2007 Environmental Burdens (contains contaminated soil, rock and groundwater which can coast high human health risk and environmental risk, except environmental damage) Directive New Act. on Certain Measures in Relation to Environmental burdens adopted on January 1 st 2012 Environmental Damages (contains damage on soil, water and protected species and habitats) the Directive 2004/34/CE Act. on prevention and remedying of the environmental damage adopted on September 1 st 2007

Operational Program Environment missing definition Environmental burdens in National legislation, missing mechanisms/system of financial liabilities, Solution blocked EU funds 1. Amendments of the Act. on geological works defined - new terms connected to EB. 2. Adoption of the Act. on Certain Measures in Relation to Environmental burdens establishes - mechanisms/system of financial liabilities, - identification and clasification of EB.

4 New Act. on Certain Measures in Relation to Environmental burdens The Method for Determining the liable Person The method is based on furtherance polluter pay principle. 5 New Act. on Certain Measures in Relation to Environmental burdens When can be a person, whose activities has caused an environmental burden, exempted from financial liability? 1. the state has undertaken to remedy an EB Originator EB was created as a result of waste disposal in accordance with a valid permit. 2. OP Legal successor at least one of the following criteria is declared: all undertakings for the improvement of the condition of the environment,or all agreement concluded under other legislation have been fulfilled the state has undertaken the liability to remedy an EB EB was created as a result of waste disposal in accordance with a valid permit.

6 New Act. on Certain Measures in Relation to Environmental burdens When can be a person, whose activities has caused an environmental burdens, exempted from financial liability? 3. OP Owner of real estate it is not possible to determine, if it is proven that: acquired the real estate through inheritance and did not continue in activities that lead to the creation of EB After acquiring: did not continue the activity that lead to the creation of EB AND could not has been aware of EB After acquiring: continued the activity that lead to the creation of EB BUT did not damage the environment or human health (Report of groundwater monitoring).

7 New Act. on Certain Measures in Relation to Environmental burdens Identification and classification of an EB The identification of EB includes: its classification, the completion of a record card for EB. Annex No. 1 Contents of the record card for an EB Annex No. 3 Classification of the EB The classification of EB is: an evaluation of the risk represented by EB (value K), the consequent urgency of geological works. EB Information System of EB low priority for solution K<35 medium priority for solution K = high priority for solution K>65

8 What is ISEB? - serves for collection of data and for providing information about the EB. Its development represents as an outputs of the projects: 1. Systematic Identification of Environmental burdens in the Slovak Republic (during years ), 2. Regional Studies of Environmental Impacts of the Environmental burdens in Selected Regions (2010). IS the ISEB freely accessible to the public?

Register of environmental burdens 1958 sites (information on distribution, character and predicted risk level of the identified EB), REG A - containing records of probable environmental burdens (953 sites) REG B - containing records of environmental burdens (292 sites) REG C - containing records of remediated and recultivated sites (713 sites) Register of professional competence Register of geological licenses issued to sole traders Register of geological licenses issued to legal entities Atlas of Remediation Methods for Contaminated Sites (basic information about theoretical and practical issues of implementation of remediation methods, 2011)
