18 Qualified Person s Statements and Certifications As the qualified person, I certify that: A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. A phase two environmental site assessment of the RSC property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary. As of 214/11/11, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that would interfere with the type of property use to which the RSC property will be put, as specified in the RSC. Ground water sampling has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. As of 214/11/11, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the RSC property meets the applicable full depth generic site condition standards prescribed by section 36 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this RSC is filed, except for those contaminants (if any) specified in this RSC at Table 2, Maximum Contaminant Concentrations Compared to Standards Specified in a Risk Assessment. As of 214/11/11, the maximum known concentration of each contaminant in soil, sediment and ground water at the RSC property for which sampling and analysis has been performed is specified in this RSC at Table 1, Maximum Contaminant Concentrations Compared to Applicable Site Condition Standards. I am a qualified person and have the qualifications required by section 5 of the regulation. I have in place an insurance policy that satisfies the requirements of section 7 of the regulation. I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry. The opinions expressed in this RSC are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location. I do not hold and have not held and my employer TERRAPROBE INC. does not hold and has not held a direct or indirect interest in the RSC property or any property which includes the RSC property and was the subject of a phase one or two environmental site assessment or risk assessment upon which this record of site condition is based To the best of my knowledge, the certifications and statements in this part of the RSC are true as of 214/11/11. 33 Updated Phase Two ESA Conceptual Site Model March 19, Northumberland Street, Ayr, ON File No INTRODUCTION The following document presents the Phase Two Conceptual Site Model for the Property identified as 18 Northumberland Street, Ayr, Ontario. The Phase Two Conceptual Site Model is part of the report titled Updated Phase Two Environmental Site Assessment, 18 Northumberland Street, Ayr, Ontario prepared by Terraprobe Inc. for Woodhouse Ayr Enterprises Inc. It is noted that during the Phase Two ESA field work, a chloroform exceedance in the ground water at the site was identified which was caused by a municipal water leak on the adjacent Northumberland Street. This exceedance occurred in only the second (November, 213) of two sampling events that were originally conducted; during the first sampling event (April, 213), all three wells were non-detect for chloroform. Additional ground water sampling was conducted during 214 that confirmed the chloroform was present, but no potential source of the chloroform was identified on-site or on neighbouring properties. When contacted, the Region of Waterloo Water Services department confirmed that there was a known leak in their system directly to the east of the Phase Two Property. The leak was reportedly fixed by the Region by October 2, 214. None of the ground water results from the Property exceeded the 25 ug/l limit (Table 2) which is referenced in the MOECC s publication Guidance for Addressing Chloroform at a Record of Site Condition Property. 1.1 Property Description The Phase Two Property (Property) is located on the west side of Ayr Street and north of Bute Street in the village of Ayr. The Property covers an area of approximately 9.5 ha (23.5 acres) and is currently vacant and undeveloped. Previously, the Property was occupied by a Maple Leaf food processing plant. The Property location is presented on Figure 1. The Phase Two Property information is provided in Table 1.1, below. Relevant information from the report is provided below: Report Title Phase One Environmental Site Assessment; 18 Northumberland Street, Ayr, Ontario Report Date January 14, 214 Prepared By Terraprobe Inc. Prepared For Maple Leaf Foods Inc. Project No The Property covered an area of approximately 9.5 ha ( acres), with a built area at that time of approximately 4,7 m 2 (5,6 ft 2 ). The Property had been used for food manufacturing purposes by Maple Leaf Foods Inc. The Phase One ESA involved the following main tasks: A records review of historical site use and activities for the Phase One Property and for the areas within approximately 25 m. Interviews with available individuals having knowledge of current and/or historical site activities. A reconnaissance inspection of the Property. Evaluation of the information and documentation. The Phase One Environmental Site Assessment was completed in compliance with O.Reg. 153/4 (as amended) and identified six Areas of Potential Environmental Concern (APECs) for the Property. The APECs are identified in the APEC Table. The Phase One Environmental Site Assessment concluded that a Phase Two ESA would be required. Terraprobe Page No 3

36 Updated Phase Two ESA Conceptual Site Model March 19, Northumberland Street, Ayr, ON File No INFORMATION FROM THE PHASE ONE ENVIRONMENTAL SITE AEMENT 2.1 Areas Where Potentially Contaminating Activity has occurred The following potentially contaminating activities (PCAs) were identified in the Phase One ESA completed for the Property: The Phase One ESA for the subject Property identified the following potential environmental concerns: #28 - Gasoline and Associated Products Storage in Fixed Tanks (2 locations) #3 Importation of Fill Material of Unknown Quality #18 Electricity Generation, Transformation and Power Stations #8 Chemical Manufacturing, Processing and Bulk Storage #46 Rail Yards, Tracks and Spurs The PCAs were deemed to cause the APECs listed in Section Areas of Potential Environmental Concern The following areas of potential environmental concern (APEC) resulting from the potentially contaminating activities were identified by the Phase One ESA: APEC-1: One former oil UGST and one former diesel AGST were located at the north side of the plant building. There was also a small chemical storage room located just inside the north side of the building. APEC-2: Fill soils were expected to be located underneath the former plant building APEC-3: Former fuel AGST and storage drums which were located at the south side of the building. APEC-4: Location of former electrical transformer near the southeast corner of the former building. APEC-5: About 3 m south and 4 m southeast of the Property, there were two historical industrial-use properties (Livestock Feed Stores). APEC-6: A railway line runs east to west, about 2 m south of the Property. The locations of the APECs are presented on Figure Subsurface Structures and Utilities No underground utilities (telephone, gas, etc.) are currently located at the Property that would enhance horizontal migration of potentially contaminated ground water. One buried pipe used to run from the main plant building to the far west side of the Property, where Maple Leaf Foods had a small wastewater treatment facility, and an on-site domestic septic system (tank and tile field) was located at the west side of the main building. Both the pipe and the septic system were removed during building demolition in 214. Terraprobe Page No 4

One underground fuel oil storage tank was present at the north side of the building. One water supply well was located at the northeast corner of the Property (but was decommissioned in 214). The downward migration of possible contaminates was possible in these locations. The Property is covered with a soft surface cap (grass and soil). As such, infiltration of storm water from the ground surface would occur when a precipitation event occurs. This could cause the downward migration of possible contaminates. Terraprobe Page No 5

38 Updated Phase Two ESA Conceptual Site Model March 19, Northumberland Street, Ayr, ON File No PHYSICAL SETTING OF THE PHASE TWO PROPERTY 3.1 Site Stratigraphy The Phase Two ESA investigation comprised the following items: Drilling of eight (8) boreholes in 213, and three (3) boreholes in 214 to depths of 3 to 8 metres below ground surface Installation of 3 groundwater monitoring wells in 213 and 3 monitoring wells in 214. The three wells which were installed in 213 were decommissioned when the former buildings were demolished. The three new wells from 214 were installed to permit additional ground water sampling in connection with a chloroform exceedance which was discovered just before demolition started. Submission of selected soil samples from the 213 boreholes to AGAT Laboratories for chemical analysis of the contaminants of concern as identified in the Phase One ESA Survey of all monitoring wells to a geodetic benchmark Development of all monitoring wells Measurement of ground water elevations to determine ground water flow direction Submission of groundwater samples from the monitoring wells (213 and 214) present on the Phase Two Property to AGAT Laboratories for chemical analysis of the potential contaminants as identified in the Phase One ESA Detailed geological information for the site is presented on the borehole logs in Appendix A and cross sections are presented on Figure 7 and Figure 8. The geology is summarized below Surficial Materials The ground surface of the Phase Two property is covered with a combination of grass, pavement and soil Fill Materials All of the boreholes in the vicinity of the former building envelope encountered a surficial layer of earth fill or disturbed native soil that varied in thickness from.5 to 1.5 meters below existing grades. The earth fill material consisted of sandy silt till Native Soil The earth fill was underlain by a deposit of native till at all of the borehole locations. The till comprised sand, trace to some gravel and cobbles, and trace to some silt. This material is characterized as being brown/grey and moist. Terraprobe Page No 6

39 Updated Phase Two ESA Conceptual Site Model March 19, Northumberland Street, Ayr, ON File No The sand and gravel layer was then underlain by a deposit of native sandy silt till at all of the borehole locations with the exception of Borehole 5. The sandy silt was encountered at depths ranging from 3.7 to approximately 6. meters below grade. The sandy silt is characterized as being brown/grey and wet Bedrock Bedrock was not encountered during the Phase Two ESA. The depth to bedrock was inferred from water well records in the area and geological mapping. The bedrock in the area is located at a depth of greater than 4 m below grade. 3.2 Approximate Depth to Water Table The ground water levels at the Property were measured on several occasions in 213 and 214. The ground water is encountered in the sand & gravel/silty sand interface zone. 3.3 Site Hydrogeological Characteristics According to Freeze and Cherry (1979) and the Ministry of the Environment (1997), the typical hydraulic conductivity of the strata investigated at the Property is of the strata investigated at the Property are: Earth Fill (sandy silt) 1-6 m/s to 1-8 m/s (aquifer) Native Soil (Sand and Gravel) 1-4 m/s to 1-6 m/s (aquifer) Native Soil (Silty Sand) 1-2 m/s to 1-4 m/s (leaky aquitard) Salina Formation (dolostone/shale) 1-4 to 1-8 m/s (aquifer) The horizontal hydraulic gradient of the groundwater for the Phase Two property was determined to be approximately Approximate Depth to Bedrock Bedrock was not encountered during the Phase Two ESA investigation. The approximate depth to bed rock is 4 m below the ground surface based upon published geologic mapping and MOE well records. 3.5 Section 41 or 43.1 Section 41 of the regulation (Environmentally Sensitive Areas) does not apply to the Phase Two Property. Section 43.1 of the regulation (shallow soil property or water body) does not apply to the Property. 3.6 Soils Placed On, In or Under the Phase Two Property No soils have been imported or placed on, in or under the Phase Two Property since the Phase One ESA was completed in 214. The depth of fill which was encountered during the Phase Two ESA borehole investigation is presented on cross-sections of the Property on Figure 7 and Figure 8, and also on the borehole logs in Appendix A. 42 Updated Phase Two ESA Conceptual Site Model March 19, Northumberland Street, Ayr, ON File No CONTAMINATION IN OR UNDER THE PHASE TWO PROPERTY 4.1 Applicable Site Condition Standard The applicable soil and groundwater Standards for the Property were determined to be those in Table 2 of the April 15, 211 Ontario Ministry of Environment (MOE) Soil, Ground Water and Sediment Standards for use under part XV.1of the Environmental Protection Act for Residential/Park/Institutional land uses in a potable ground water condition for coarse grained soils. These are considered to be the applicable Standards for the following reasons: The Property will be developed to include residential use. Soil at the Property was determined to be coarse-grained (predominantly sand) Bedrock across the Property is located at a depth of greater than 2 m. The Property is located in an area that obtains its potable water from ground water sources. The Property is not located within an area of natural significance. The Property does not include or is adjacent to an area of natural significance or part of such an area The Property does not include land that is within 3 metres of a surface water. The soil at the property does not have a ph value less than 5 or greater than Media Investigated Based upon the potentially contaminating activities identified in the Phase One ESA for the Property, it was decided that sampling and analysis was required for both soil and groundwater on the Property. No surface water was present on the Property; therefore, sediment sampling was not conducted. The Contaminants of Potential Concern associated with APEC-5 include PHCs, BTEX, VOCs, and metals. Boreholes BH6, BH7 and BH8 were placed in proximity of this APEC area to confirm soil quality. Monitoring Wells MW6 and MW7 were placed in this APEC to confirm ground water quality. APEC-6 Off-Site: Nearby Railway Line The Contaminants of Potential Concern associated with APEC-6 include PAHs. Boreholes BH5 and BH7 were placed in proximity of this APEC area to confirm soil quality. Monitoring Wells MW6, MW1-14 and MW2-14 were placed in this APEC to confirm ground water quality. 4.4 Chloroform from Municipal Water Leak The results of the laboratory analysis indicated that on the first sampling event (April, 213) the ground water on the Property did not exceed the Ministry of Environment Table 2 Standards for any of the parameters tested. On the second sampling event (November, 213), again no exceedances were found except for a new exceedance for chloride in MW7. The new wells were installed towards the centre of the site to avoid them being damaged during the ongoing building demolition activities. The new wells were sampled on three occasions (April, October and November, 214), with no exceedances of the Table 2 MOE Standards identified except for chloroform. The former buildings had been vacant and empty since at least 212. Since the March/April, 213 sampling results for both the ground water and the soil had been non-detect for chloroform, it was concluded that there may be a new, off-site source of chloroform present. A site inspection was conducted on July 6, 214 to search for potential sources of the chloroform. The conditions on-site and on neighbouring properties had not changed, and no obvious potential source was identified. The local municipality was contacted to determine if there had been a water leak in their system nearby. It was confirmed by the Region of Waterloo Water Services department in July, 214 that there was a known leak in their system directly to the east of the Phase Two Property. The leak was reportedly fixed by the Region in about early October, 214. Correspondence from the Water Services department is provided in Appendix B, and Figures 11, 12 and 13 provide further details regarding the chloroform levels at the Property and the approximate location of the water leak. The MOECC s publication Guidance for Addressing Chloroform at a Record of Site Condition Property allows for the use of a higher Standard for chloroform in the event of a proven municipal water leak that affects a Property. The higher Standard for sites with potable water is 25 ug/l. This Standard was applied for this investigation. All of the results from the site were below that limit. 4.5 Areas Where Contaminants are Present The Phase Two ESA used the Soil, Ground Water and Sediment Standards for Use Under Part XV.1 of the Environmental Protection Act (April 211). APEC-1 On-Site: Former Oil UGST, Diesel AGST & Chemical Storage Soil samples from Boreholes BH1, BH2, BH3 and BH4 found no exceedances of the MOE Table 2 Standards for the Contaminants of Potential Concern. Ground water samples from MW4 found no exceedances of the MOE Table 2 Standards for the Contaminants of Potential Concern. It is concluded based upon the soil and ground water sampling conducted as part of the current investigation that there are no Contaminants of Potential Concern above the MOE Table 2 Standards at this APEC location. However, the fill soil sample from BH1 did find exceedances of the Standards for EC and SAR, as shown on Figure 9. After the above-noted exceedances were found, approximately 18 cubic meters of fill soil was excavated and removed from the Property in the vicinity of BH1. Confirmatory soil samples were obtained after the soil was removed and were submitted for laboratory analysis. No exceedances of the MOE Table 2 Standards were found in the confirmatory samples, as shown on Figure 1. Ground water samples from MW6 found no exceedances of the MOE Table 2 Standards for the Contaminants of Potential Concern. It is concluded based upon the soil sampling conducted as part of the current investigation that (after the soil removal activities) there are now no Contaminants of Potential Concern above the MOE Table 2 Standards at this APEC location, but formerly two contaminants were present (EC and SAR). APEC-3 On-Site: Former Fuel AST and Storage Drums Soil samples from Boreholes BH6 and BH8 found no exceedances of the MOE Table 2 Standards for the Contaminants of Potential Concern. Ground water samples from MW6 found no exceedances of the MOE Table 2 Standards for the Contaminants of Potential Concern. It is concluded based upon the soil and ground water sampling conducted as part of the current investigation that there are no Contaminants of Potential Concern above the MOE Table 2 Standards at this APEC location. It is concluded based upon the soil and ground water sampling conducted as part of the current investigation that there are no Contaminants of Potential Concern above the MOE Table 2 Standards at this APEC location. 4.6 Contaminants Associated with Each Area No Contaminants of Potential Concern were identified in the ground water above the applicable Site Condition Standards (with the higher chloroform Standard being used) at any of the APECs upon completion of the investigation. No Contaminants of Potential Concern were identified in the soil above the applicable Site Condition Standards at APEC #1, APEC #3, APEC #4, APEC #5 and APEC #6. Two contaminants (EC and SAR) were identified in the fill soil at APEC #2 during the Phase Two ESA investigation. The fill soil at APEC #2 extended to a maximum depth of 2.4 m below the existing ground surface. The fill soil at the exceedance location was excavated and removed. Confirmation soil samples were obtained after the soil was removed and were submitted for laboratory analysis. No exceedances of the MOE Standards were found in the confirmatory samples. 4.7 Medium in Which Contaminant are Associated Earth fill, native soils and ground water were investigated as part of the Phase Two ESA. No Contaminants of Potential Concern were identified above the applicable Site Condition Standard in the native soil or the ground water during the investigation. Two contaminants were found in the near-surface fill soils. The fill soils were therefore a medium with which contaminants were associated. The fill soil with exceedances was subsequently removed from the Property. Terraprobe Page No 16

The higher potable ground water Standard of 25 ug/l was therefore applied to the Property, and none of the water samples tested exceeded this higher limit. 4.8 Information Known about Each Contaminated Area Two Contaminants of Potential Concern were identified in the fill soil at APEC #2. APEC #2 was located in the envelope of the former building on the site. The fill was likely associated with moving native soil around the building area during site grading and construction. The fill soil was removed and subsequent soil sampling confirmed that the contaminants are no longer present. No Contaminants of Potential Concern were identified in the native soil or the ground water in this APEC. No other contaminated areas were identified on the Property. 4.9 Distribution of Contaminant No Contaminants of Potential Concern were identified in the native soil or ground water upon completion of the investigation. Contaminants of Potential Concern were previously identified in the near-surface fill soils in APEC #2. The exceedances (EC and SAR) were found at one borehole location (BH 1). The maximum depth that the contaminants were identified at was at 1.2 m below the existing ground surface. The location of the exceedances are indicated on Figure Reasons for Discharge of Contaminant The discharge of the Contaminants of Potential Concern (metals) at the Property was likely associated with site grading and construction of the original Maple Leaf Food plant Migration of contaminant The Contaminants of Potential Concern which were formerly present (EC and SAR in near-surface fill soils) were associated with the historical placement of the fill underneath the building. These contaminants were unlikely to have migrated elsewhere Climatic or Meteorological Influences on Migration The Property was covered by a soft cap (fields and grass). Climatic or meteorological influence on migration of potential contamination on the Property could occur. Since no Contaminants of Potential Concern are currently present in the soil and ground water, there is no possibility of future migration of contaminants. Terraprobe Page No 17

As such there is no possibility for soil vapour intrusion of contaminants into future buildings Relevant Construction Features of Buildings Currently there are no buildings on the Property. No Contaminants of Potential Concern were identified in the soil and ground water upon completion of the investigation that would be affected by the configuration of future buildings on the Property Building HVAC Currently there are no buildings on the Property. No Contaminants of Potential Concern were identified in the soil and ground water upon completion of the investigation that would be affected by the configuration of future buildings on the Property Subsurface Structures and Utilities No subsurface structures are currently present at the Property. Future subsurface structures and utilities associated with the proposed residential subdivision do not have the potential to affect the distribution and transport of the Contaminants of Potential Concern, as the contaminants identified in the fill soil have been removed from the site. Recent results showed the presence of chloroform and traces of dibromochloromethane in ground water samples obtained from wells located on the south portion of the property. Both of these substances can be created when chemicals added to municipal drinking water during treatment and purification (e.g., chlorine) react with natural organic matter. Generally, when these substances are encountered in ground water, it is a result of municipally treated water being released into the subsurface through a leak in the supply infrastructure. There was nothing in the history and previous uses of the property or surrounding area that would suggest a source other than a water leak. The wells where these substances were detected are located on the south portion of the property Samples taken in March, 213, showed no detections. Samples taken in November, 213, and March, 214, showed detections, which may indicate that the leak occurred relatively recently. Based on the prevailing ground water flow direction, to the southwest, we believe the origin of the leak to be somewhere along Northumberland Street, within about 1 m north of the railway tracks.
