7 EXECUTIVE SUMMARY The 220kV Cau Bong Hoc Mon Binh Tan transmission line subproject has a total length of km with 59 supporting towers and a 22m wide RoW. The line starts from the Cau Bong 500kV substation located in Tan Phu Trung commune, and ends at Hoc Mon 220kV substation in Tan Chanh Hiep commune of District 12, Ho Chi Minh City (HCMC). Work on the subproject was initiated on 10 June 2014 and is expected to be finished in September 2015 but as of 31 December of 2015, 76.5% of all work has been completed. The progress was not significantly made in this period due to the delay in issuing the support and compensation policies applied for the subproject according to Land Law 2013 by the HCMC s People Committee. Construction activities of contractors at sites during the period of July to December of 2015 were not remarkable. Contractor PCC1 dragged about 3.5km from tower 4 to tower 15 and Contractor VNECO finished about 1.5km wire from tower 29 to tower 34. Beside this, Contractor VNECO constructed tower No. 24 located in village 8, Binh My commune, Cu Chi district. The above activities were done because of the successful negotiation made by the contractors with the affected households. Environmental safeguard monitoring in July to December 2015 period has shown that the contractor s environmental compliance is good. The outstanding issues in implementing the CEMP, resolved environmental issues and the issues to be addressed in the next monitoring period are summarized below. Contractor s compliance with the CEMP The contractors PCC1 and VNECO have agreed with the affected households (AHs) on compensation and land clearance before execution, and strictly complied with the implementation of the CEMP and the technical measures that are approved by SPPMB. In terms of implementation of the mitigation measures to address the negative impacts on environment at the sites, the contractors implemented activities that include: watering the exposed dry land near the residential areas during the foundation excavation; controlling noise and vibration during working time and ceasing all construction activities during the relaxation time of residents; storing the excavated land tidily within the site boundary; gathering the construction materials neatly without negative impacts on traffic; collecting, classifying and selling the construction wastes for recycling and the wastes left for disposal to local landfill without littering the surrounding environment. In terms of health and safety of the workers and local communities, the contractors PCC1 and VNECO were in compliance with the regulations of CEMP, particularly: all migrant workers have registered as the temporary 1

8 residents to local authorities, respected local cultures and have a good relation with the communities; all workers have been educated to improve their awareness on social diseases especially HIV/AIDS; the contractors have issued the labor safety regulations and provided the workers with protective equipment and reminded them to use it when working at the site. All wiring workers were provided with mobile first aid kit with necessary medicines and assigned health staff working along with them at sites. Resolution of environmental issues Under Requesting Letter No. 5309/AMN-DB issued by SPPMB on 27 July, 2015 on overcoming all environmental issues found in 2 nd quarter 2015, Contractors VNECO and PCC1 had surmounted the shortcomings before 15 August of 2015, concretely: - Contractor VNECO dredged the sedimentation and reinstalled the irrigation pipes at tower No. 18, village 7, Binh My commune, Cu Chi district and the irrigation system has been functioning. - Contractor PCC1 totally collected and transported all abundant soil and debris to local landfill. The environment surrounding Tower 3, Lang Cat village, Tan Phu Trung commune, Cu Chi district were rehabilitated to its original conditions. - Contractor VNECO leveled off the site of tower 34, village 1, Dong Thanh commune, Hoc Mon district to make it good in drainage and satisfied the affected household of Huynh Van Hit. During the fourth quarter, both Contractor PCC1 and VNECO provided the workers with a mobile box of medicines and tool kit of first aid to ensure first aid is made when a vital accident occurs before transporting to the nearest health station. Environmental issues to be resolved in the next monitoring period During the time of waiting for completing the work, several sites of the towers located near communities have become the temporary landfills for locals. The environment surrounding the towers was polluted by garbage. Typically, the site of tower No. 17 near Tho Nam Sang Environmental Company, Binh My commune with a huge of wastes affected the landscape and also became a favorable habitat for insects and pathogens. Recommendations It is suggested that the contractors should work closely with the commune regarding this matter and also to post warning sign on the tower against dumping of wastes on the towers. Before handing over the line to an operation unit for management, the contractor VNECO should rehabilitate the environment surrounding the site of tower 17 to its original condition and ensure sanitation and landscape. 2

9 1.1 Project background 1. INTRODUCTION To carry out its plan to expand power generation, transmission and distribution capacity to meet the rapidly growing electricity demand throughout the country, the Government of Vietnam has requested the financial resource from a Multi Tranche Financing Facility (MFF) funded by the Asian Development Bank (ADB) to invest in the power development program. The program will include the physical investments in transmission and distribution of power with an expectation to (i) facilitate power transfers, (ii) remove transmission bottlenecks and (iii) reduce transmission losses and voltage fluctuation. To deploy its master plan on the national power development, the 220kV Cau Bong Hoc Mon Binh Tan transmission line subproject is invested under the Tranche II with a total budget of around 18 million USD 1, 2. NPT is the executive agency and SPPMB is the implementing agency for the subproject. 1.2 Project scale and description The 220kV Cau Bong Hoc Mon Binh Tan transmission line subproject has a total length of 15.59km long with 59 supporting towers and a 22m RoW, 11m from either side of the center line. The line starts from Cau Bong 500kV substation located in Tan Phu Trung commune, passes Tan Thanh Dong, Binh My communes of Cu Chi district, Dong Thanh, Thoi Tam Thon of Hoc Mon district and Tan Thoi Hiep commune, and ends at Hoc Mon 220kV substation in Tan Chanh Hiep commune of district 12, HCMC. Total I, II, III ,940 (Source: Feasibility report PECC-2, 2012) According to the IEE of the Cau Bong Hoc Mon Binh Tan transmission line subproject approved in December 2012, construction activities that could potentially cause adverse impacts on environment in the subproject areas include: (i) Excavating 59 tower foundations with a total of 83,880m 3 of 4

11 excavated earth and rock is. The average excavated material of each tower is about 1,421m 3, and all earth and rocks will be temporarily stored within the construction site and will be used to fill back the tower foundation after the concrete reinforcement complete; (ii) Gathering construction materials such as iron, cement, sand, stones to sites for concreting the towers each tower requires 360m 3, and the total volume of concrete required is 21,272m 3. The materials will be transported by trucks to prepared sites as closed as possible to the constructed tower based on its specific conditions such as available bare land and access roads ect. (iii) The requirement of land for the RoW that is about 327,381.5m² 3 which will be under restricted land use. The number of houses within the RoW is 433. All affected houses under the RoW satisfy with the safe clearance requirements and are not required to be relocated. 776 houses with metal roof located within 36m from the line centre will be earthed to ensure safety from electromagnetic fields. A total of 25,546.5 m² land is required as the permanent use for constructing the towers, most of which is agricultural land and therefore no affected households have to be relocated. Although the route is mostly located within the outskirt of HCMC to minimize negative impacts on residential areas and facilities on the affected land, it crosses the electric line of 500kV three times at sections of DD2 G2-1A, Cau Bong 220kV connection and Cau Bong 110kV connection, the low voltage transmission line with 34 times at sections of G2-2 to G2-3 (04 times) from G2-5 to DC2 (30 times), the roads with 29 times at sections of G2-1 to G2-2 (01 time), G2-2 G2-3 (02 times) and from G2-7 to G2-15 (26 times), the canals with 06 times at sections of G2-1 to G2-2 (02 times), G2-2 to G2-3 (03 times) and G2-7 to G2-8 (01 time) and the river with 01 time at G2-5 to G2-6 section; In terms of biological environment, the majority of affected land under the RoW is agricultural land, of which the paddy field land accounts for 40%, vegetable growing accounts for 20%, and mixed cropping mainly of trees accounts for 5%. There is no original habitat, significant wildlife, conservation areas and significant invasive species within the project area. For physical cultural resources, there are several temples and other public infrastructures within the vicinity of the transmission line corridor. However, the distances are quite far from transmission line and none of these structures will be affected by the project activities KV Cau Bong- Hoc Mon Binh Tan subproject RP,

12 Figure 1: Layout of 220kV Cau Bong - Hoc Mon - Binh Tan 1.3 The objectives of internal environmental monitoring The objectives of internal environmental monitoring are as follows: - Monitoring the environmental compliance of subproject s construction activities with both policies of ADB and the Government. - Monitoring the construction contractors to comply with the mitigation measures in accordance with the approved EMP and CEMP. - Recommending measures to improve the effectiveness of mitigating the environmental negative impacts during the subproject s construction period. - Identifying environmental impacts not predicted in the design stage, and recommending measures to mitigate the impacts. 6

13 2. INCORPORATION OF ENVIRONMENTAL REQUIREMENTS INTO PROJECT CONTRACTUAL ARRANGEMENTS 2.1. Environmental law, regulation and standards - ADB s environmental safeguard put in effect on January 01, 2010; - Law on Environment, 2005; - Circular No. 22/2010/TT-BXD regulating labor safety in executing constructions issued by Ministry of Construction on December 03, 2010; - Decree No.59/2007/NĐ-CP on solid waste management dated April 09, 2007; - Decree No.14/2014/NĐ-CP dated February 26, 2014 regulating detail on the implementation of Law on Electricity and Power Safety; - QCVN 26/2010/BTMT national technical standard on noise - QCVN No 05/2013/BTNMT national technical standard on ambient air quality - QCVN No.27/2010/BTNMT national technical standard on vibration - QCVN No.08/2008/BTNMT national technical standard on surface water quality - QCVN No.09/2008/BTNMT national technical standard on underground water quality 2.2 Environment Institutional Responsibilities Duties of the related stakeholders in the institution SPPMB - SPMB works as an implementing agency, appointing its Supervision Engineers (SEs) from the Technical Department that will bear overall responsibility for supervising construction contractors in both civil works and implementing the EMP; assigning its Environmental Officers (EOs) from its Resettlement Division that will be responsible for implementing and monitoring EMP during the subproject phases. Under the support from the International Environment Specialist (IES), EO of NPT and NES, the SPPMB SEs and EOs will be in charge of the following duties: SPPMB environmental officers (EOs) Supporting SPPMB to approve the CEMPs Introducing the contractors to sites; Supporting and gathering monthly reports prepared by contractors on compliance with the implementation of CEMP; Collaborating with the NES to conduct monthly regular site visits and conduct quarterly workshops on the compliance with the ES policies of the subproject and the improvement awareness of the project staff and contractors on occupational and communal health and safety. 7

14 Preparing monthly, quarterly and mid-year reports on coordination implementing the EMP and EMoP to be submitted to ADB, NPT; SPPMB supervision engineers (SEs) Supervising the construction contractors both in technical works and the implementation of EMP; Reviewing monthly compliance report prepared by contractors before submitting it to SPPMB. CONSTRUCTION CONTRACTORS The construction contractors have the following duties: - Mobilizing its human resources include (i) Site Engineer (SiE); (ii) Environmental, Health and Safety Officer (ESHO) and (iii) Community Liaison Officer (CLO) and necessary materials and equipment to implement the mitigation measures effectively at sites; - Developing its CEMP before starting civil works to be submitted and approved by SPPMB; - Meeting with SPPMB SE & EO at sites to ensure that the contractor s assigned staff have understood and committed to implementing the CEMP; - Maintaining a Control Record available as requested for any inspection made by SPPMB SE and EO; - Preparing monthly compliance report submitted to SPPMB. NATIONAL ENVIRONMENT SPECIALIST (NES) The NES has the following duties: - Supporting SPPMB in compliance with the ES policies and in coordinating implementing the EMP and EMoP for the project. - Building capacity on the implementation of the EMP and EMoP while improving the awareness on occupational and community health and safety for the workers and contractors; - Supporting SPPMB EO in preparing the quarter and mid - year internal monitoring reports on environment; Layout of Internal monitoring arrangement Based on the institutional arrangement for implementing the EMP and EMoP concurred by ADB in December 2012 (IEE, 12/2012), a layout on the internal environmental monitoring is presented in Figure 3. 8

15 ADB IES NPT SPPMB SE NES EO Contractors Support lines Report lines Figure 2: Layout on internal monitoring arrangement for environmental safeguard Assessment of coordination in implementing the CEMP of the subproject from July to December of 2015 It is assessed that the coordination of implementing the CEMP has been properly performed by SPPMB s staff and its related contractors. SPPMB s EO and SE - EO worked closely with the NES in coordinating implementation of the EMP and EMoP; - Supported SPPMB in requesting the contractors to make a corrective action plan to surmount the shortcomings found in the second and third quarters SPPMB s technical department (SE) worked as a construction supervision unit that carried out their tasks in supporting the contractors in implementation of the construction measures and the environmental performances at sites, while signing in the monthly environmental compliance report prepared by the contractors before submitting to SPPMB. 9

16 NES During the period of July to December of Visited the construction sites on August 24-28, 2015 to follow up the corrective action plan prepared by contractors, resolving the shortcomings found in the second quarter monitoring trip. - Visited the construction sites on December 09-14, 2015 to follow up the corrective action plan prepared by contractors, resolving the shortcomings found in the third quarter monitoring trip. - Worked closely with contractors through and Phone calls to collect the monthly environmental compliance report of contractors. Analyzed the reports to identify both the environmental compliant performances and difficulties that the contractors had met when implementing the mitigation measures. Based on that NES could facilitate them to carry out the measures effectively in the coming months. - Summarized the environmental issues and work progress of contractors in July, August, September, October and November of 2015 to ADB s environmental specialist; finalized the 2015 second quarter environmental safeguard internal reports and 2015 first mid-year environmental reports to be submitted to SPPMB, NPT and ADB. CONSTRUCTION CONTRACTORS: - Complied with the environmental safeguard policies and the implementation of the CEMP appropriately; - Cooperated actively with the NES in supervising the implementation of EMP and EMoP at sites, receiving the recommendations from the NES and SPPMB EO on the environmental safeguard and carrying out its corrective action plan to resolve any shortcomings effectively; - Prepared and submitted its monthly environmental compliance report to the NES and SPPMB on; In summary, the coordination of implementing the CEMP was properly performed among the assigned staff. As a result, the constructor s environmental compliance is good and no complaints related to the environmental performances at sites have been made so far. 2.3 The incorporation of environmental consideration into project documents The environmental consideration has been incorporated into the project documents such as EMP/IEE and bidding and contract (B&C) documents as stated in Table 2 Table 2: Summary of the environmental requirements in EMP/IEE and in B&C documents 10

Demarcation and clearing of RoW and ancillary facilities Preparation of site: excavation, removal and disposal of unusable (incompetent) materials Dust management Noise vibration and Waste water at construction site Environmental requirements in the EMP/IEE - Sites are located so that they do not interfere with the welfare or social cohesion of surrounding communities - Site is limited to reduce unnecessary clearing of vegetation. - Sanitary soakage areas from offices and camps to be sited so that effluent is treated. - No discharge of grey water or sewage allowed to surface water systems. - Workshops to be provided with oil and water separators. - Fuel storage areas not to be located within 20m of watercourse. - Contractor s storage facilities may need to be surrounded by a security fence. - Concrete batching areas to be provided with bunds to control movement of runoff to waterways. - Define the 22m RoW width. - Identify trees to be removed within the RoW and arrange for these to be approved for removal. - Limit area to be cleared - Areas to be defined by a clear boundary. - Clearing boundaries should be shown to machinery operators. - Removed vegetative material to be offered to communities for use as fuel wood; - Limit area to be excavated. - Topsoil to be removed and stored for re-use. - Excavated incompetent material to be disposed of outside and away from the work area. - At completion of work dumping areas to be re-top soiled and re-vegetated. - When dust is carried towards residential areas or becomes problematic on-site, the contractor should apply dust control measures; - If particularly noisy activities are required work may need to be limited to daylight hours. - Noise not to exceed 55dBA at boundary of any residential area between 6hr and 21h00 and 45 dba between 21h00 and 06h00; - Not allow to discharge waste water directly to water body surrounding the site ; 11

Disposal of site waste Storage and handling of fuel and lubricants Community Safety from increased vehicle movements Workplace health safety and Environmental requirements in the EMP/IEE - Make a discharging canal surrounding foundation holes to collect runoff water to be reduced its turbidity before discharging it into water body surrounding the site ; - Not allow to spill oil and fuel from machinery to site; - Apply soil conservation and erosion protection technologies. - Avoid operating machinery in adverse ground conditions. - Protect and vegetate newly excavated areas as soon as possible - All waste materials to be collected and sorted; (i) those that can be recycled and (ii) those that need to go to an approved landfill site for disposal; - All fuel storage areas to be securely fenced and provided with oil and water separators. Fuel hoses and shut off valve to be locked. - Fuel should be stored in properly sealed containers. Regularly check its locks to prevent fuel from running over to environment. - All refueling to be done at least 20 m away from waterways by trained personnel - All waste oil and oil filters to be collected and if possible recycled, otherwise to be disposed of to landfills - The contractor is to train refueling personnel in these procedures. The contractor is to have developed an accidental spill handling action plan - All vehicles to be properly maintained and operated in accordance with road laws. - All loads to be properly secured and fugitive loads to be covered. - Drivers to be fined if safety requirements are ignored. - Contractor to abide by: Vietnamese Labor Code as amended Workers to be provided with safe working environment including: - Erect warning signs and barriers around work areas - No drugs or alcohol allowed on-site - Noise and dust to be controlled. - All workers are provided with safety equipment appropriate for the task in which they are employed. - To be supplied on-site for workers: - Potable water, chemical toilet, changing place with 12

19 Environmental issues Chance discovery of archaeological and cultural sites Clearance and rehabilitation of Construction sites and removal of contractor s facilities. Public access to site Community and worker health and safety Environmental requirements in the EMP/IEE clothes storage, and washing and showering facilities. - Work statements prepared for each activity - Prior to entering site for first time workers are to be introduced to site and site hazards explained together with explanation of work site safety procedures. - Medical and first aid facilities should be provided together with a person qualified in first aid. - No known sites. Chance discoveries are to be notified to the SE who will advise the EO. EO to advice on procedure for dealing with chance discoveries. - All solid waste should be removed from sites and disposed in approved landfills. - All contaminated soil should be removed. - All sites to be rehabilitated and restored to original condition. - Drainage should be re-established. - Environmental rehabilitation should be included as part of final inspection before payment made. - Erect warning signs and barriers around work areas. - Site can only be accessed to with permission of contractor. - Guide carefully visitors who are allowed to visit sites and provide them with personal protective equipment; - Promulgate, educate workers on the social problems. PROGRESS ON SUBPROJECT IMPLEMENTATION The contract of constructing the 220kV Cau Bong Hoc Mon Binh Tan transmission line subproject was signed on February 14, 2014 between 13

20 SPPMB and the Association of PCC1 and VNECO at a Contract No. 040/HĐXL-BQLDA-PCC1/VNECO, of which PCC1 is head of the Association. Work on the subproject was initiated on 10 June 2014 and is expected to be finished in September As of 31 December of 2015, 76.5% of all work has been completed. The progress was not significantly made in this period due to the delay in issuing the support and compensation policies applied for the subproject according to Land Law 2013 by the HCMC s People Committee. Construction activities of contractors at sites during the period of July to December of 2015 were not remarkable. Contractor PCC1 dragged about 3.5km from tower 4 to tower 15 and Contractor VNECO finished about 1.5km wire from tower 29 to tower 34. Beside of that, Contractor VNECO constructed tower No. 24 located in village 8, Binh My commune, Cu Chi district. The above activities were done because of the successful negotiation made by the contractors with the affected households. The subproject s construction progress is summarized in Table 3. ENVIRONMENT COMPLIANCE MONITORING 4.1 Environment compliance at construction sites During period of July to December of 2015, the monitoring result showed that both Contractors PCC1 and VNECO complied with implementation of the mitigation measures at all sites. The complied activities include watering to keep moisture at the exposed dry land during the foundation excavation; controlling noise and vibration during working time and ceasing all construction activities during the residents rest time; storing the excavated land tidily within the site boundary; gathering the construction materials neatly without negative impacts on traffic; collecting, classifying and selling the construction wastes for recycle and the remaining wastes are disposed to local landfill without littering in the surrounding environment. Besides, contractor VNECO applied technical option to prevent landslide when excavating foundation tower located in a weak ground base and compensated statistically any damages caused by the construction to the household who was affected. The contractors PCC1 and VNECO were in compliance with the 14

21 approved procedure and process of dragging wire to ensure safety and no damages to the surrounding environment. In terms of overcoming the environmental issues, in the third quarter of 2015, both PCC1 and VNECO surmounted the shortcomings found in quarter 2, 2015 under the requesting Letter No /AMN-ĐB dated 27 July of Concretely - Contractor VNECO dredged the sedimentation and reinstalled the irrigation pipes at tower No. 18, village 7, Binh My commune, Cu Chi district and the irrigation system has been functioning. - Contractor PCC1 totally collected and transported all abundant soil and debris to local landfill. The environment surrounding Tower 3, Lang Cat village, Tan Phu Trung commune, Cu Chi district were rehabilitated to its original conditions. - Contractor VNECO leveled off the site of tower 34, village 1, Dong Thanh commune, Hoc Mon district to make it good in drainage and satisfied the affected household of Huynh Van Hit. In the fourth quarter of 2015, Contractor PCC1 and VNECO provided the workers with a mobile box of medicines and tool kit of first aid to ensure a first aid made when a vital accident occurs before transporting to the nearest health station. Beside of the achievements, several adverse environmental issues in the quarter 2 nd of 2015 were found and needed to be resolved. The negative impacts and the mitigation measures taken by the contractors in both quarters are summarized in Table 4. The workers dragging wire were provided with the technical knowledge, adequate labor protective equipment including clothes, caps, gloves and shoes as regulated. They also provided adequately the wiring workers with a mobile first aid kit and assigned a health staff to work along with them. All houses located within the RoW were connected to the earth as required. The achievements and some issues in terms of occupational and communal health and safety in the period of July to December of 2015 are summarized in Table 5. 29 6.1 Conclusion 6. CONCLUSION AND RECOMMENDATIONS Implementation progress: As of December 31, 2015, the implementation progress achieved about 76.5% compared with the overall plan. The progress in this period was insignificant because of the delay in the compensation and site clearance of subproject. The EMP and EMoP were properly performed by SPPMB and its related contractors, which is in compliance with both environmental policies of ADB and the Government. All involved parties mentioned in the institutional arrangement fulfilled their assigned tasks. The SPPMB s staff and its contractor s workers have improved their awareness on the occupational health and safety as well as the community health and safety throughout the training workshops; The environmental safeguard monitoring results in the period of July to December of 2015 have revealed that the constructor s environmental compliance is good. The outstanding issues on implementing the CEMP, the resolved environmental issues and the issues are planning to be addressed in the next period are summarized as follows: The contractor s compliance with the implementation of CEMP The contractors have agreed with the AHs on the compensation and land clearance before execution and strictly complied with the implementation of CEMP and the technical measures that are approved by SPPMB particularly; - Watering the exposed dry land located near residential areas to prevent dust from coming out. - Noise and vibration was controlled by suspending work at noon time from 11h30 to 13h30 and night time from 21h to 06h; - Public traffic was not disturbed because of materials and excavated soil stored within the site boundary; - Construction wastes were collected and sorted for recycling, otherwise to be disposed to local dumpsites; - Mitigation measures were applied to prevent landslide when excavating foundations near residential areas and compensation was made to any damages caused by the construction. - Environment at sites were properly rehabilitated when construction completed; - Compensation was made to farmers who lost income caused by the delay in the cultivation seasons of farmers or deterioration of land quality; - Dragging wire ensured safety and no damages to the surrounding environment. 23

30 In terms of health and safety of the workers and local communities, the contractors were in compliance with the regulations of CEMP, particularly: - Promulgate, educate workers on preventing HIV/AIDS; - The camps were located at the ventilated and safe places, which was equipped with garbage bins and hygienic toilets; - Workers were adequately provided with personal protective equipment and force them to wear during working time. - Provide means of first aid, medicines at site and camps for workers and assign health staff working along with the wiring workers at site to be ready to respond to emergency cases. - Well communication was made to the affected communities to resolve any environmental issues coming out during construction time.
