INTRODUCTION Bihar State Road Development Corporation Limited, Government of Bihar has decided to improve/upgrade the sections of MDR/SH in the state of Bihar under the procedure of External Funding Agency. The work would be taken up for upgradation on corridor concept. Therefore, corridors include strengthening (in adjoining stretches) in addition to widening in order to have a better facility in a long continuous stretch. As a part of this endeavour, the Authority has decided to widening and strengthening of Baysi-Bahadurganj-Dighalbank ( Project Road ) section of SH-99 The project intends to widen the existing carriageway to 2-lane carriageway configuration, strengthening / reconstruction of existing pavement, rehabilitation and widening of the existing bridges, construction of new culverts, bus stops, truck parking areas, and road junctions. Project Road Description Baysi-Bahadurganj-Dighalbank ( Project Road ) situated at north-east part of Bihar and is a section of SH 99, having total length of 75.2 Kilometre. The project road lies between 87 44' (E) to 87 51' (E) longitude and 25 51' (N) to 26 26' (N) latitude. The project road falls under Purnia and Kishanganj Districts in the State of Bihar. The start point of the project is at Km 0/000 at Baysi village and meets with NH-31 at Km 433/500 and project road terminates at Km 75/200 near Dighalbank village. Salient Features of the Project Road The existing total length of project road is Km and proposed length is Km The project road has single (3.75m) to intermediate lane (5.5m) with 0.5 m to 1.5 m shoulders on either side of the carriageway. Indo-Nepal Border is approx, at 2 km radial distance from end point of the project road 24 m to 30 m ROW is available throughout the section, whereas in Kishanganj District only few Land Acquisition Maps were available in RCD office, indicating that existing ROW is 24 meters. During the study of various Land Acquisition Plan and Village (Revenue) Map work it was observed that the authentic ROW varies from 5 m to 30 m. The project road alignment traverses through plain terrain all over the length, The existing road passes through predominantly agricultural and built-up (urban settlements) sections. The road passes through many important towns/settlements namely Baysi, Amour, Rauta, Barbatta, Kochadhaman, Sontha, Bahadurganj, Tulshia, Tapu, Harwadanga etc. The drainage condition along the project corridor is very poor and needs to be improved. The existing shoulder slope does not facilitate proper drainage and water stagnation on the shoulders is a common problem specifically in monsoon. There are 5 Major Bridges, 18 Minor Bridges, and 27 Culverts exists along the Project Road. The project intends to widen the existing carriageway to 2-lane carriageway configuration km length of bypass is proposed along Bahadurganj town

3 Proposed TOR Page 1-3 The subproject has limited impacts on land as the acquisition of land is confined to one bypass location and the locations where available ROW is not sufficient to accommodate the proposed widening/ two-laning of the road. In addition to the land acquisition requirement, the resettlement impact for this subproject includes 1305 structures, however out of that 824 no. of structures belongs to non-titleholders (encroachers, Kiosks and squatters as temporary structures) living or earning their livelihoods within the existing ROW. Acquisition of approximately ha of land as per initial assessment done. Most of the land likely to be acquired is agricultural to accommodate the proposed improvements. B. SCOPE OF STUDY The Scope of Surveys and studies for the project including all engineering aspects, environmental and socio-economic aspects of the projects are included in the ToR for feasibility studies. The salient features of the scope are given hereunder: i. Review of all available reports and published information about the project road and the project influence area; ii. Environmental and social impact assessment, including such as related to cultural properties, natural habitants, involuntary resettlement, environmental features and impact, environmental mitigation and management plan, Resettlement and rehabilitation plan, etc. iii. Public consultation, including consultation with Communities located along the road, NGOs working in the area, other stake-holders and relevant Govt. Departments at all the different stages of assignment (such as inception stage, feasibility stage, preliminary design stage and once designs are finalized). iv. Detailed reconnaissance; v. Identification of possible alternatives in selection of expressway alignment, evaluation of different alternatives comparison on techno-economic and other considerations and recommendations regarding most appropriate option vi. Traffic studies including traffic surveys and Axle load survey and demand forecasting for next thirty years; vii. Inventory and condition surveys for road; viii. Inventory and condition surveys for bridges, cross-drainage structures and drainage provisions; ix. Detailed topographic surveys using Total Stations and GPS; x. Pavement investigations; xi. Sub-grade characteristics and strength: investigation of required sub-grade and subsoil characteristics and strength for road and embankment design and sub soil investigation xii. Identification of sources of construction materials; xiii. Detailed design of road, its x-sections, horizontal and vertical alignment and design of embankment of height more than 6m and also in poor soil conditions and where density consideration require, even lesser height embankment. xiv. Detailed design of structures preparation of GAD and construction drawings and cross drainage structures and underpasses etc. xv. Identification of the type and the design of intersections; xvi. Design of complete drainage system and disposal point for storm water xvii.economic and financial analyses; xviii. Contract packaging and implementation schedule.

Strip plan indicating the scheme for carriageway widening, location of all existing utility services (both over- and underground) and the scheme for their relocation, trees to be felled and planted and land acquisition requirements including schedule for LA: reports documents and drawings arrangement of estimates for cutting of trees and shifting of utilities from the concerned department; xx. To find out financial viability of project for implementation under BOT and suggest the mode on which the project is to be taken up i.e. either on BOT or under funding from Government of India. xxi. Preparation of detailed project report, cost estimate, approved for construction drawings, rate analysis, detailed bill of quantities, bid documents for execution of civil works through budgeting resources. xxii.design of toll plaza and identification of their numbers and location and office cum residential complex including working drawings xxiii. Design of weighing stations, parking areas and rest areas. xxiv. Any other user oriented facility en-route toll facility. xxv.preparation of social plans for the project affected people as per policy of the lending agencies/ Govt. of India R&R Policy. C. PROPOSED TERMS OF REFERENCE FOR EIA STUDY Study Area A detailed study of all the environmental features falling within the immediate corridor of impact, which has been considered as 500 m on both sides from centerline of road. The other sensitive environmental issues such as protected areas notified under wildlife (protection) Act 1972, critically polluted areas as notified by Central Pollution Control Board, notified eco-sensitive areas, interstate boundaries and international boundaries, water bodies of ecological significance, etc, will be identified within 10 km from the alignment. The detailed information shall be collected from the right of way as well as the area falling within 500 meters on the either side Road will mainly be collected from primary sources and the other environmental features within 10 kms aerial distance as explained above will be collected from secondary data sources. Rapid EIA study would be carried out for the proposed project in accordance with the Environmental Impact Assessment Notification, 2006 and amendment thereof as well as EIA Manual. The EIA study will include the following aspects: 1. INTRODUCTION This section shall mention the project name brief description of the project purpose, nature, size of the project and its importance to the region and the country; profile of the project proponent; and the exact geographical location of the project. The land description, i.e. village, tehsil, district, state and extent of the land must be mentioned clearly. Any litigation (s) pending against the proposed project and/or any directions of orders passed by any court of law/ statutory authority against the project is to be detailed out. In case of expansion /modernization of the road project, the environmental compliance status for the existing road should be explained. National standards and codes of practice of Indian Roads Congress (IRC) and Ministry of Surface Road Transport & Highways pertaining to environmental issues, which are relevant to the proposed project, should be furnished.

5 Proposed TOR Page PROJECT DESCRIPTION This section shall cover following information: Broader details of the project, location and alignment. Relevance of the project in light of the existing development plans of the region/state. Project coverage, master plan, phasing and scope. Description of alternatives considered to avoid rehabilitation and resettlement issues. Procedures and criteria adopted for selection of the alignment of right of way and alternative alignments considered Overall suitability of the identified alignment and the proposed activity in light of the existing environmental laws and deviations, if any Description of road alignment, broad geology, topography, connectivity, demographic aspects, socio-cultural econ8mic aspects, villages, settlements Details of land acquisition, rehabilitation of communities / villages and their present status Technologies used for design, construction, equipment and operation Resources, manpower, time, frame, etc. required for project implementation Estimated cost of the project, environmental cost. 3. ANALYSIS OF ALTERNATIVES (TECHNOLOGY & SITES) In case the scoping exercise indicates need for alternatives, this chapter shall include: Description of various alternatives such as locations, layouts of technologies studied Summary of adverse impacts of each alternative Selection of alternative. 4. DESCRIPTION OF THE ENVIRONMENT The Baseline data on various environmental features shall be collected both from Secondary and Primary sources from field surveys and investigations in order to describe the environmental settings of the project area. The data on different environmental components along the project corridor would be collected followed by site reconnaissance in order to establish environmental condition of the project area. Land Environment Topography data will cover terrain slope, inland topography, land use pattern, habitation, cropping pattern, forest cover and sensitive places. Soil data will include type, classification, and characteristic of the soil along with the quality parameters like ph, Electrical conductivity, sand, silt, clay, texture, moisture retention capacity, infiltration rate, bulk density, porosity, organic matter, Nitrogen, Potassium, Phosphorous, lead, iron and organic carbon. Geology data will provide information on rock type and sub soil layers. Meteorological data Meteorological data covering maximum and minimum wind speed, wind direction, rain fall, relative humidity and temperature for last 10 years period will be collected from the nearest IMD Meteorological station. History of special weather phenomenon like cyclones, cloud bursts, etc. will be collected from the nearest meteorological station for a period of 10 years.

6 Proposed TOR Page 1-6 Ambient Air Quality Ambient air quality monitoring will be carried out along the project stretch covering different category of land-use, viz. residential, commercial/industrial and sensitive zone like schools, college and hospital along the road with a frequency of twice a week for one month at different locations covering the sensitive locations. The ambient air quality monitoring will be carried out with respect to Particulate Matter (size less than 10µm) or PM10, Particulate Matter (size less than 2.5µm) or PM2.5, Sulphur dioxide (SO2), Oxides of Nitrogen (NOx) and Carbon Monoxide, by following the MoEF 2009 guidelines. Water Environment Ground and surface water samples will be analyzed for ph, dissolved solids, BOD, DO Coli-form, and heavy metals. An inventory survey of all water bodies located within 500 m on either side of the project road sections will be carries out. The information on ground water table, the ground water availability in the project area, the exploitation of ground water studied will be collected from secondary sources. Noise Environment The noise monitoring will be carried out at representative locations along the alignment of the project covering sensitive locations such as residential, hospitals, schools etc. The noise monitoring will be done for 24 hrs at each location. The night time and day time equivalent noise levels will be generated for each monitoring locations to have an idea of noise pollution levels in the study area. Biological Environment Terrestrial and aquatic ecological studies will be conducted along and within the proposed ROW. Common trees, shrubs, other vegetation, common fauna, rare and endangered species will be identified, surveyed and studied. The roadside trees within the proposed ROW will be surveyed including botanical & vernacular name of trees species, girth wise enumeration, etc. Ecological sensitive locations, such as Wildlife Sanctuary, National parks, bio reserve, etc will be identified within 15 km either side of project road and studied (if any). Socio-economic Details Study of demographic details including population, schedule caste, schedule tribe, literacy, occupation pattern, economic condition, health status will be collected along the project road. 5. ANALYSES OF POTENTIAL ENVIRONMENTAL IMPACT & MITIGATION MEASURES The environmental impact assessment will be conducted in accordance with the requirement of the Ministry of Environment & Forests (MOEF) norms and guidelines. The collected primary and secondary data will be compiled and analyzed to establish a comprehensive database and assess the existing baseline environmental condition. All potential direct and indirect influence due to the proposed project will be addressed. The scope of work will not be confined only to alignment but the impacts due to the associated construction activities will also be assessed.

7 Proposed TOR Page 1-7 The following aspects will be given due importance during assessment of impacts and recommending remedial measures: Alignment of the project road and topographical changes Roadside drainage to avoid water logging, erosion & environmental degradation Impact on soil along the project road. Impact of solid waste generated and solid waste management plan Impact on borrow area and quarries Impact of road safety Impact on ambient air quality due to air pollution during construction activities and vehicle movement. Impact on noise level during construction activities and vehicle movement. Assessment of impacts of road construction on ground and surface water sources in the study area Impact of solid waste generated during construction phase of the project. Nature, quantity and disposal of construction spoils, wastes and waste water. Impacts of flora and fauna and ecological resources due to construction and operation of the project Public health & sanitation, and occupational health & safety of construction workers Impact on safety of local people during construction and operation phases. Road safety features to avoid accidents need of underpass, service road, etc. Population affected and socio-economic impacts. 6. ENVIRONMENTAL MONITORING PROGRAMME Summary matrix of environmental monitoring, for all phases of the project i.e., construction and operation. Technical aspects of monitoring for achieving effectiveness in mitigation measures. Requirement of monitoring facilities and methods adopted. Frequency, Location, parameters of monitoring. Compilation and analysis of data and reporting system. Procurement schedules and budgets in detail. Training requirements. Laws, regulation and enforcement related to speed, alcohol and vehicle safety should be reviewed. Institutional framework for road safety should be prepared. Post accident emergency assistance and medical care to accident victims should be provided. 7. PROJECT BENEFITS It should bring out details of benefits by way of: Improvement in the physical infrastructure and road access, Employment in social services due to quicker and safe mode of transportation, Employment potential- skilled, semi-skilled and unskilled labour-both during construction and operational phases of the project with specific attention to employment potential of local population as well as necessity for imparting any specialized skill to be eligible for such employment in the project, Reduction in traffic congestion in the city/ town / and other locations, Development of tourism. Reduced pollution, vehicle maintenance, fuel saving due to better quality of roads,

8 Proposed TOR Page 1-8 Over all development in economy and improved lifestyle, Environmental cost benefit analysis, if recommended by the Expert Appraisal Committee at the scoping stage. 8. ENVIRONMENTAL MANAGEMENT PLANS (EMPS) Based on the impacts predicted, separate EMPs for the construction package shall be prepared. The EMPs shall fulfill all requirements of GOl, MOEF. The scope of EMPs shall include. Design modifications recommended by the project EA, along with chainages, Recommendation of feasible and cost-effective measures to prevent or reduce signification negative impacts to acceptable levels, Identification of opportunities for enhancement of environmental quality (of specific locations, water bodies, scenic areas, etc.) along the project corridor, Formation of specific or sample plans, such as those for management and redevelopment of quarries, borrow pits and construction camps, Detailed specification of bill of quantities, execution drawing and contracting suggested, for the pre-construction, construction and operation stages, Suggestion of good practices for construction and upkeep of plant and machinery, responsibility for execution and supervision of each of the mitigation and enhancement measures identified in the project EA, Description of implementation arrangement needed for the project, especially the capacity building proposals, Specification of environment supervision, monitoring and auditing requirements, specifying parameters, reference standards, monitoring methods, frequency, duration, location and reporting responsibilities. Listing of all the mandatory government clearance conditions, and the status of procuring clearances, and 9. SUMMARY & CONCLUSION (SUMMARY EIA) Summary EIA shall be summary of the full EIA report condensed to ten pages at the maximum. It should necessarily cover in brief the chapters of the full EIA report: Introduction, project description, description of the environmental, anticipated environmental impact & mitigation measures, additional studies, environmental monitoring programme, and project benefits environmental management plan and disclosure of consultants engaged. 10. DISCLOSURE OF CONSULTANTS ENGAGED This chapter shall include the names of the consultants engaged with their brief resume and nature of consultancy rendered. 11. STRUCTURE OF EIA REPORT The EIA report will follow the structure as per EIA Notification, 2006 and will consist of the following chapters: 1. Introduction 2. Project Description 3. Analysis of Alternatives (Technology and Site) 4. Description of the Environment 5. Analyses of Potential Environmental Impact & Mitigation Measures
