Drawing on an undergraduate degree in GeoEnvironmental Engineering and a master s in Mineral Processing, he puts highly technical knowledge and experience to work for his clients, counseling them on environmental compliance and risk management. Years working with environmental law have convinced Phil that contending parties can reach a middle-ground sweet spot that brings together business interests and environmental objectives, creating a win-win outcome. His relationships with technical consultants and state and federal regulators also help clients reach their environmental, natural resource, energy, and sustainability objectives. Phil advises clients on air permitting, water permitting and hazardous waste, as well as investigation, remediation, and redevelopment of contaminated properties. He also brings a wealth of experience in the Emergency Planning and Community Right to Know Act. Phil is a frequent lecturer on environmental and renewable energy topics before environmental professional trade groups and attorneys, including the Federation of Environmental Technologists. Experience Real Estate and Corporate Transactions Represented family-owned regional bakery in the sale of its assets to a publicly traded company. Represented owners in $12 million sale of 16 Wisconsin cemeteries and a granite monuments business to NYSE-traded company. Project Siting, Permitting, and Regulatory Compliance Counsels national telecommunications provider with environmental due diligence for projects and has developed strategies for client to properly manage materials generated during construction in efficient manner. Wastewater, Waterways and Wetlands Advises clients with NPDES and WPDES wastewater and stormwater permitting and compliance, including pretreatment and low-impact development practices. Counsels clients on waterway and wetland permitting and compliance and water quality certifications under the Clean Water Act 401 and 404, Chapter 30, state and federal wetland programs, and Army Corps of Engineers regulations, and with wetland mitigation bank agreements. Endangered Species Advises clients on state and federal endangered species consultation processes and helps clients obtain incidental take permits. Environmental Assessments/Impact Statements Guides clients through NEPA and WEPA process, preparation of environmental assessments and impact statements, including cultural and historical preservation issues.

3 Experience Air Advises utilities, oil and natural gas pipelines, manufacturers, metal fabrication and coating facilities, and motorized equipment manufacturers on Clean Air Act permitting and compliance for major and minor sources, annual compliance and monitoring reporting, potential to emit (PTE) and NSR historical analyses, RACT, NESHAP and NSPS applicability, NR 445 state air toxics and RMP. Engines Counsels clients, including equipment manufacturers, with motor vehicle, nonroad and stationary engine requirements, including compliance with transition programs, engine replacement, antistockpiling, contract manufacturing, and importing and exporting. Site Investigation and Remediation Counsels clients, including developers, banks, credit unions and businesses, on investigation, reporting and remediation of contamination, including coordination and evaluation of Phase I site assessments to ensure compliance with All Appropriate Inquiries. Advises clients on planning and review of Phase II investigations. Negotiates access agreements. Prepares applications for off-site liability, historical fill construction, lender liability exemptions, and storage tank registrations and removals. Advises on remediation and site closure strategies. Hazardous and Toxic Materials and Waste Advises clients on compliance with hazardous waste storage, transportation and disposal regulations, universal waste requirements, CERCLA contribution and cost recovery claims, Pollution Prevention planning, PCB Mega Rule, RCRA permitting and financial assurance requirements, and California's Proposition 65 regulations. Enforcement Assists regulated industries with environmental reporting and recordkeeping, compliance audits, self-disclosure, corrective action and responses to agency notices of violation and information requests. Negotiates with regulators to obtain fair resolutions to alleged violations.
