Report Purpose: To seek Councl's endorsement of the proposed amendment to the Bylaw Notce Enforcement Bylaw No. 3749, Strategc Goal: Ths report supports the corporate strategc goal of enhancng sustanablty of Cty servces and nfrastructure, and achevng excellence n Cty governance. Background: On July 3'^ 205, the Commssoner of the Greater Vancouver Water Dstrct declared that the Metro Vancouver regon s now n the second stage of the comprehensve four-stage Water Shortage Response Plan (WSRP). Stage 2 was actvated n response to declnng reservor levels due to the unusually hot and dry weather. The addtonal waterng restrctons n Stage 2 are ntended to decrease water demand and ad n sustanng reservor levels for prorty needs such as drnkng water and fre protecton. Upon revew of the Bylaw Notce Enforcement Bylaw, staff have dentfed the need to have addtonal tcketng mechansms avalable to enforce contraventon of the Water Shortage Response Plan (WSRP) Bylaw No. 370, 2005 beyond Stage waterng restrctons and to be prepared for the potental progresson to Stage 3 or 4 restrctons. 2 Page 2 July 0, 205 Dscusson/Analyss: Stage 2 and 3 Restrctons The actvaton of Stage 2 of the WSRP calls for each muncpalty to enhance water conservaton efforts n muncpal facltes and parks and devote resources to comprehensvely advertse and enforce Stage 2 of the WSRP. Under Stage 2 restrctons, lawn sprnklng s restrcted to one mornng a week based on the odd or even-numbered property address, as compared to three mornngs a week under Stage. The restrctons also affect water-play parks, publc and commercal fountans, power washng, golf courses and muncpal parks. Stage 2 restrctons were last actvated n August of 2003, whch was pror to the adopton of the WSRP Bylaw. Metro Vancouver s currently conductng modellng that wll help proect how long the regon's water supply can be sustaned at the present demand levels. Ths nformaton wll help establsh the lkelhood and tmelne of enterng nto Stage 3. Metro Vancouver has ndcated that t s mperatve that demand levels drop sgnfcantly over the next few weeks to avod advancng to Stage 3- An actvaton of Stage 3 restrctons would prohbt all forms of lawn waterng usng treated drnkng waterng and would have addtonal restrctons for car and boat washng, pressure washng, and water play parks. Water exempton permts for new lawns and for nematode treatments would also be voded. A summary of the four WSRP stages s ncluded as Attachment A. Proposed Amendments to the Bylaw Notce Enforcement Bylaw The proposed amendments to the BEN Bylaw nclude escalatng fnes that ncrease ncrementally n accordance to the four stages of the Water Shortage Response Plan Bylaw. The current Bylaw only allows for a $75.00 fne and does not ncorporate the four stages of the WSRP. To facltate the effectveness of enforcng the Stage 2 restrctons and beyond, staff recommend that Councl gve frst, second and thrd readngs to the proposed Bylaw Notce Enforcement Bylaw Amendment Bylaw No. 4580,205, whch s attached to ths report as Attachment B. 3 Page 3 July 0, 205 Enforcement and Educaton The Envronmental Servces Dvson (ESD) and Customer Servce staff are experencng elevated levels of complants and nqures related to the actvaton of Stage 2 of the WSRP Bylaw. Three full-tme Water Conservaton Bylaw Offcers are currently respondng to each complant through ste vsts and are also patrollng neghbourhoods to observe and enforce waterng restrctons. Tckets are beng ssued for any observed volatons to the WSRP Bylaw and warnngs are no longer beng ssued under the Stage 2 restrctons. Addtonal support has been enlsted through other ESD staff as well as Bylaw Offcers from the Bylaw Enforcement Dvson to ensure that enforcement of the WSRP Bylaw s carred out 7 days a week. ESD s also workng wth Corporate Communcatons to provde frequent updates to the communty va socal meda, the Recollect app, the Cty's webste, and local meda. In addton, Metro Vancouver has a comprehensve outreach plan and s provdng frequent updates through ther webste and socal meda outlets. Fnancal Implcatons: The Water Conservaton Program s an annual program funded through the Water Utlty. The Cty may notce a slght ncrease n tcketng revenue through the ncreased fne amounts; however, ths s not antcpated to have any sgnfcant mpact on the budget. Concluson: The proposed amendment to the Bylaw Notce Enforcement Bylaw No. 3749, 2006 wll allow staff to effectvely enforce the Water Shortage Response Plan Bylaw beyond the Stage l waterng restrctons.
