Lal Kansal, Member, SEIAA At the outset, the Environmental Engineer (SEIAA) welcomed the members of the State Environment Impact Assessment Authority (SEIAA) in 41 st meeting. Item no : Confirmation of the proceedings of 40 th meeting of SEIAA held on The proceedings of 40 th meeting of SEIAA held on were circulated to all concerned vide letter no dated No observation has been received from any of the members. As such, SEIAA confirmed the said proceedings. Item no : Authority. Follow up action on the decisions of the 40 th meeting of SEIAA held on It was seen by the State Level Environment Impact Assessment Item No Application for Environmental Clearance under EIA notification dated for developing a commercial project namely "India Trade Centre" in the revenue estate of Village Bharonjia, Mullanpur Sailba Majri District SAS Nagar by M/s Bhanu Infrabuild (P) Ltd. The SEIAA observed that: 1. M/s Bhanu Infrabuild (P) Ltd. has submitted an application for obtaining Environmental Clearance under EIA notification dated for developing a commercial project namely "India Trade Centre" in the revenue estate of

2 Village Bharonjia, Mullanpur Sailba Majri District SAS Nagar. The project is covered under category 8 (a) of the Schedule appended to the said notification. 2. The case was considered by the SEAC in its 57 th meeting held on , which was attended by the following on behalf of the project proponent: (i) (ii) Mr. Mukesh Bhatti, Senior Manager of the promoter company Sh. Sital Singh, Environmental Consultant, M/s CPTL Enviro-Tech, Chandigarh. Sh. Sital Singh, who is the Environmental Consultant of the project proponent, submitted the following documents, which were taken on record by the Committee: The proof of ownership of land. The permission of CLU for construction of office-cum-commercial centre in an area of acres. Topographical map of the area showing contour plan Photographs clearly indicating that substantial construction has been done at site. A map showing various features within a radius of 500 meter from the project site and as per this map there are 4 no. brick kilns at a distance of 210m, 230m, 310m and 430m from the periphery of the project site. Analysis reports of the ambient air monitoring got done by M/s Chandigarh Pollution Testing Laboratory, which indicate that the concentration of various pollutants such as PM 2.5, PM 10, SO 2, NO 2, and CO is within the prescribed standards. Also, ambient noise monitoring has been got done from the said laboratory and the analysis results indicate that the noise levels during day and night times, have been measured as 60 db(a) leq and 44 db(a) leq, respectively, against the prescribed standards of 55 and 45 db(a) leq. The analysis report of groundwater reveals that the groundwater of the area is potable in nature. 3 The construction schedule (PERT/CPM Chart). Affidavits for ; a) Constitution of Environment Monitoring Cell b) Use of ready mix concrete or use of fly ash during construction. c) To provide Fire Fighting System d) To provide wind breaking curtains and water sprinkling system to minimize dust emissions. e) To provide adequate safety measures for the construction workers during the construction phase. The Committee noticed that the noise levels measured during day time are exceeding the prescribed standards. The Committee further observed that the project proponent is required to submit certain information/data before making presentation of the project proposal. The decision of the Committee was conveyed to project proponent vide letter no dated The project proponent vide letter dated Nil submitted the reply of the observations, the details of which are as under: Sr. No. Documents/data required Reply submitted by the project proponent 1. Submitted only a copy of the Master Plan. In future we will abide by all the rules and regulations and we are very sorry for the same. 3. Whether the site of the project is conforming to the siting criteria laid down by the Govt. of Yes.

4 Punjab, Deptt. of Science, Technology & Environment, vide Order dated NOC issued by the Punjab Pollution Control Board under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, Permission of CGWA for abstraction of groundwater 6. Calculations showing as to how consumption of water has been calculated and explain as to how 16 KLD of treated wastewater will be utilized for irrigation of green belt during rainy season. 7. Details of components of the STP to be installed. 8. Proper contour plan since the plan submitted by the project proponent is totally sketchy one. The project proponent has submitted a copy of NOC issued by Punjab Pollution Control Board vide letter no dated This is not applicable to the promoter company. The project proponent has mentioned that he has 1 acre of land area adjoining to project site which belongs to the company. Additionally, a copy letter no dated issued by GMADA, S.A.S. Nagar has been submitted, in which it has been mentioned that as and when the sewer will be laid by GMADA, total discharge from said project will be allowed to discharge in the trunk sewer after its treatment through STP, to be installed by M/s. Bhanu Infrabuild Private Ltd. Submitted a copy of the feasibility report. As per this report a STP of capacity 50 KLD consisting of collection tank, screen chamber, SAFF reactor, secondary tube settler, treated wastewater sump, dual media filter, softener and sludge drying beds, will be installed to treat the wastewater. Submitted a photocopy of the relevant portion of the toposheet.

Explain the reasons as to why the noise levels are on higher side during day time and what mitigation measures will be taken to bring down the noise levels within the standards prescribed by the Board. 10. Compliance of the guidelines laid down by the Govt. of India, Ministry of Environment & Forests, vide Office Memorandum No /2008- IA.III dated for high rise buildings, in case, the same is applicable. 11. Compliance of the environmental regulations as regards to EMP. The ambient noise levels during day time are on higher side due to construction activities in the nearby areas. There is a proposal to provide green belt all around the project site to bring down the noise levels within the standards prescribed by the Board. Submitted a copy of the provisional NOC issued by the Divisional Fire Officer, Fire Station, SAS Nagar vide letter no. 525 dated Submitted 4. The case was considered by the SEAC in its 63 rd meeting held on , which was attended by the following on behalf of the project proponent. a) Sh. Mukesh Bhatti, Chief Manager of the promoter company. b) Sh. Deepak Gupta of M/s Jal Vayu Consultants, Mohali c) Ms. Rupinder Kaur of M/s Jal Vayu Consultants, Mohali, environmental consultant of the promoter company Ms. Rupinder Kaur informed that she filed a CWP no of 2012 in the Hon ble Punjab and Haryana High Court, which came up for hearing on before the Hon ble Court and the interim order passed by the Hon ble Court are that the benefit of interim orders in terms of the order dated passed by the High Court of Karnataka shall be admissible only to the petitioner. She also submitted an undertaking stating as under:

6 That I, Ms. Rupinder Kaur w/o Sh. Deepak Gupta is sole proprietor of M/s Jal Vayu Consultants, having its registered office at plot no. 294, Industrial Area, Phase IX, Mohali, Punjab. That M/s Jal Vayu Consultants is engaged in environmental consulting activities including conducting Environmental Impact Assessment Studies and Baseline studies required for Environmental Clearance of certain category of projects as per EIA Notification, 2006, of Ministry of Environment & Forests, Government of India. That the Ministry of Environment & Forests have stipulated requirement of NABET accreditation for consultants to enable them conduct EIA studies. That Jal Vayu Consultants has filed CWP of 2012, with Hon ble Punjab & Haryana High Court. That in response to the CWP, Hon ble High Court through its interim orders has granted stay on applicability of requirement of NABET accreditation on M/s Jal Vayu Consultants. That following persons have been authorized to represent M/s Jal Vayu Consultants; a) Mr. Yash Pal Jain S/o Sh. Lachhman Dass Jain b) Mr. Deepak Gupta S/o Sh. (Late) Hardyal Gupta c) Mr. Vishal Duggal S/o Sh. Raj Kumar Duggal That now onwards all the above mentioned representatives are authorized by M/s Jal Vayu Consultants, to make presentations and submissions regarding EIA related activities. The SEAC took the above noted documents on record and after deliberations, the Committee decided to permit Sh. Deepak Gupta to present the case/ reply of observations honoring the orders of the Hon ble Punjab and Haryana High Court, subject to legal opinion and advice of the MoEF since MoEF has been pleaded respondent by the petitioner. Thereafter, Sh. Deepak Gupta presented the reply to the observations of the SEAC as under:

7 o The total land area of the project is acres in which office-cumcommercial centre will be constructed having total built up area of sq m. o As per Master Plan, the site of the project is located in the Mixed Land Use Area in which residential activity is permissible as per the byelaws of the Master Plan. o Permission for change of land use has been granted by the Deptt. of Town & Country Planning for construction of office-cum-commercial centre in an area measuring acres in the revenue estate of Village Bharonjia, District SAS Nagar. o The cost of the project is 29 crores. o Due to criteria fixed by the SEIAA for water consumption rate and utilization of treated wastewater, the water balance has been amended. As per amended water balance, about 46.8 KLD will be the water requirement out of which 33.8 KLD will be met from ground water by installing tubewell and the remaining 13 KLD will be met from recycling of treated wastewater. o The site of the project is located in the in Sialba Majri Block, which has been declared as critical block by the CGWA and as per guidelines of CGWA, there is no need to obtain permission for abstraction of ground water upto 50 KLD from CGWA for such type of block. The quantity of water to be abstracted is 33.8 KLD which is less than the threshold quantity for the critical area, as such, the promoter does not require to obtain the permission from CGWA. o About 38 KLD of treated wastewater will be generated, out of which KLD will be used for irrigation of green area, 13 KLD for flushing purpose and remaining 5.72 KLD will be discharged into sewer, during summer season. In winter season, 10 KLD will be used for irrigation of green area, 13 KLD for flushing purpose and remaining 15 KLD will be discharged into sewer. In rainy season,13 KLD will be used for flushing purpose and remaining 25 KLD will be discharged into sewer. o Green belt will be developed in an area of sqm, which will be irrigated with treated wastewater.

8 o o o o o o o o o The total quantity of solid waste generation will be 248 kg/day, which will be collected and stored at single collection site, from where it will be taken care of by GMADA/MC, Mohali. A permission has been granted by GMADA vide no.5888 dated to the effect that the solid waste will be collected at single point, from where it will be taken care of by the GMADA/Municipal Corporation after the requisite fee deposited by the project proponent. The total load of electricity required for commercial project will be 2500 KW, which will be taken from the PSPCL. There is a proposal to install DG sets as a standby arrangement of power supply, which will be provided with acoustic enclosures. The run-off from roof top will be charged into groundwater by providing rainwater harvesting system and run-off to be generated from other areas, will be discharged into storm drain of GMADA. The E-waste generated will be stored in an isolated room and will be sold to the authorized recyclers. Used oil to be generated from the DG sets will be managed & handled as per the provisions of the Hazardous Wastes (Management, Handling & Transboundary Movement) Rules, The parking facility will be provided for 414 ECS. The construction was started as the project proponent was not aware of statutory requirement of Environment Clearance under EIA Notification dated He submitted a copy of the resolution passed by the Board of Directors of the company in compliance to Office Memorandum dated of the MoEF, which was taken on record by the Committee. The maximum height of the building shall not exceed 100 m and the nearest fire station is at 6 Km from the project site. The width of the approach road is about 60 m. Thus, the project is complying with the guidelines for high rise buildings laid down by the MoEF vide Office Memorandum dated Permission has been obtained from Govt. of India, Ministry of Defense vide

9 o o o letter dated , in which the height of the building has been restricted as 100 m above ground level. The monitoring of groundwater, ambient air and ambient noise level have been got done from M/s Chandigarh Pollution Testing Laboratory, Mohali. The analysis report of groundwater reveals that the groundwater of the area is potable in nature. The analysis report of ambient air reveals that the concentration of various pollutants such as PM 2.5, PM 10, SO 2, NO 2, and CO in the ambient air is within the standards laid down by the MoEF. The noise levels during day and night times, have been measured as 60 db(a) leq and 44 db(a) leq, respectively, against the prescribed standards of 55 and 45 db(a)leq. The ambient noise levels during day time are on higher side since construction activities were going on during the period of monitoring. There is a proposal to provide a green belt to bring the ambient noise levels within standards laid down by the MoEF. About Rs.40 Lacs will be spent for implementation of EMP during operation phase and Rs.11 Lacs/Annum will be spent on account of recurring charges for the EMP. Following activities under the corporate social responsibility and 1% of the total project cost has been earmarked for these activities: i) Distribution of books and bags in the nearby villages. ii) Health camps will be organized for residents of the nearby area. iii) Trees will be planted in the nearby villages by providing free saplings. iv) Job preference will be given to the people of nearby area. The Committee deliberated upon the case and observed that the project proponent has already started the construction activities of the project, which is a violation of the provisions of EIA notification dated Therefore, in compliance to Office Memorandum dated of the Ministry of Environment & Forests, New Delhi, the project proponent has submitted a resolution to the effect that the violation of the Environment (Protection) Act, 1986 for starting construction activity without obtaining environmental clearance under EIA notification is not intentional and will not be repeated in future. The Committee further observed that the project proponent

10 has provided adequate and satisfactory clarifications of the observations raised by it, therefore, the Committee awarded 'Silver Grading' to the project proposal and in light of aforesaid resolution, decided to forward the case to the SEIAA with the recommendation to grant environmental clearance to the project proponent for construction of office-cum-commercial centre having 19 floor excluding ground floor and basement, in an area measuring as acres in the revenue estate of Village Bharonjia, District SAS Nagar of subject to certain conditions in addition to the proposed measures. It was also decided to recommend to SEIAA to send the case to the Govt. of Punjab, Department of Science, Technology & Environment for initiating action under the Environment (Protection) Act, 1986 due to starting the construction activities of the project without obtaining Environmental Clearance under EIA notification dated In compliance to decision taken by the SEAC, the MoEF, Northern Regional Office at Chandigarh has been written vide letter No dated to give the legal opinion and advice in light of order dated of the Hon ble Punjab and Haryana High Court submitted by M/s Jal Vayu Consultants, Mohali to the effect that as to whether the said consultancy firm can be allowed to present the project proposal before SEIAA/SEAC, Punjab. 6. The project proponent was requested by the SEIAA vide letter no dated to attend its 41 st meeting on Following were present on behalf of the project proponent in the said meeting of the SEIAA: i) Sh. Mukesh Bhati, AGM of the promoter company ii) Sh. Deepak Gupta, of M/s Jal Vayu Consultants, Mohali, Environmental Consultant of the promoter company. Sh. Deepak Gupta, presented the salient features of the project proposal before the SEIAA. The SEIAA noted that Secretary (SEAC) has sent a copy of the observations raised by Sh. Malvinder Singh, Member (SEAC) on the proceedings of 63 rd

11 meeting of SEAC held on and has requested to consider his observations in the next meeting of SEAC. The Authority further noted that this case was recommended by the SEAC after considering the same in its 63 rd meeting held on , but the proceedings of the said meeting of the SEAC are yet to be confirmed. Furthermore, the SEAC in its 63 rd meeting decided that the MoEF, Northern Regional Office at Chandigarh be written to give the legal opinion and advice in light of order dated of the Hon ble Punjab and Haryana High Court submitted by M/s Jal Vayu Consultants, Mohali to the effect that as to whether the said consultancy firm can be allowed to present the project proposal before SEIAA/SEAC, Punjab. In compliance to said decision of the SEAC, the MoEF has been written vide letter no dated , but the response is yet to be received from the MoEF. Therefore, this case is not fit to be decided at this point of time. After detailed deliberations, it was decided that: 1. The case will be considered as and when confirmation of proceedings of 63 rd meeting of SEAC held on is received from the SEAC and response of the MoEF is received in connection with letter no dated written by Member Secretary (SEIAA). 2. The Chairperson (SEAC) be requested to intimate the confirmation of the proceedings of 63 rd meeting of the SEAC in respect of this case as soon as 64 th meeting of the SEAC is held. 3. A reminder may be written to the Northern Regional Office of the Ministry of Environment & Forests, at Chandigarh in connection with letter no dated requesting to give legal opinion and advice in the light of the order dated of the Hon ble Punjab and Haryana High Court submitted by M/s Jal Vayu Consultants, Mohali to the effect that as to whether the said consultancy firm can be allowed to present the project proposal before SEIAA/SEAC, Punjab. 4. The case may be deferred till the reply regarding the above is received from the Ministry of Environment & Forests and SEAC. 5. The project proponent may be informed regarding the above.

12 Item No Application for environmental clearance under EIA notification dated for developing a Residential Housing Project namely King City in the revenue estate of Village Dahrian, Tehsil Rajpura, Distt. Patiala by M/s Parsvnath Developers Ltd., The SEIAA observed that: 1. M/s Parsvnath Developers Ltd. has applied for obtaining environmental clearance under EIA notification dated for developing a Residential Housing Project namely King City in the revenue estate of Village Dahrian, Tehsil Rajpura, Distt. Patiala. The project is covered under category 8 (a) of the Schedule appended to the EIA notification dated As per application, the details of the project are as under: The total plot area of the proposed project is 37 acres (1,49, sqm.) and the built-up area of the project is 50, sqm. The expected cost of the project is Rs.150 crore. The project includes 246 residential plots, 252 dwelling units in group housing, one commercial plot, a community centre and school. The proposed site has been approved by Deptt. of Housing and Urban Development for residential land use. There will be about 824 KLD consumption of water for various activities, out of which 369 KLD will be met from treated wastewater and remaining of 455 KLD from the ground water by installing a tubewell. There will be about 601 KLD generation of wastewater. A common STP based on SAFF technology of capacity 1200 KLD to treat the wastewater of this residential colony and residential colony adjoining to it being developed by M/s Homelife Real Estate (P) Ltd., will be installed. About 263 KLD, 87 KLD and KLD of treated wastewater will be used for various purposes such as flushing, horticulture and cooling required for DG set, respectively. The remaining wastewater will be discharged into a natural drain. There will be about 2.71 T/day generation of solid waste, which will be converted into manure by adopting vermin-culture technology.

13 Rainwater harvesting system will be provided for recharging run-off of roof top into groundwater. About 4000 KVA of power load is required, which will be taken from Punjab State Power Corporation Ltd. and 1 no. DG set of 250 KVA will be installed alongwith acoustic enclosure to supply the power for basic amenities during failure of power supply. 2. The case was considered by the SEAC in its 40 th meeting held on , wherein, it was decided that the project proponent be asked to submit the complete documents and the case be placed in the next meeting. 3. The case was again considered by the SEAC in its 41 st meeting held on , wherein, the representative of the project proponent informed that it has applied for permission for abstraction of groundwater to CGWA and submitted the following documents during the meeting:- Permission of change of land use (only licence to develop colony issued under PAPR Act,1995). Water and sewerage connection permission. After detailed deliberations in the matter, the Committee decided that the project promoter is required to submit the following informatio / data: i) Carry out ambient air quality monitoring as per notification no. GSR.826(E) dated issued by the MoEF from MoEF / NABL accredited laboratories and shall submit the analysis results to the Committee. ii) Permission from competent authority for collection and disposal of solid waste. iii) Permission from CGWA for abstraction of groundwater. The decision of the Committee was conveyed to the project promoter vide letter no dated The SEIAA/SEAC became non-functioning in the State of Punjab due to resignation of Chairmen of Authority & Committee. Thus, the case was sent to MoEF for further consideration. Thereafter, the SEIAA / SEAC for the State was

14 constituted by the MoEF vide Order dated , accordingly, the case was returned by the MoEF to the SEAC/SEIAA. 5. The case was considered by the SEAC in its 43 rd meeting held on and the Committee observed that the project proponent is required to submit certain information / data before appraisal of project proposal. The representative of the project proponent, present in the meeting, informed that the said documents/data will be submitted within 7 days. The Committee agreed to accept the request made by the representative of the project proponent and decided to defer the case till the reply of the observations, is received. 6. Thereafter, the project proponent vide letter no dated , submitted the reply of the observations of the SEAC, the details of which are as under: Sr. No. Documents/data required Reply submitted by the project proponent 1. The promoter has not submitted any permission from the competent authority for the disposal of inert components of solid waste. 2. The proposal of the project proponent to discharge treated wastewater into natural drain is not permissible. As such, the project proponent is required to submit detailed scheme for utilization of treated wastewater. The inert waste will be treated by providing on-site facility and submitted a proposal in this regard. About 481 KLD of treated wastewater will be generated, out of which KLD will be used for flushing purpose, 87 KLD for horticulture, KLD for DG set cooling and remaining KLD for irrigation of agricultural land of different owners. 3. The project proponent has not submitted MoU executed between M/s Homelife Real Estate Pvt. Ltd., and M/s MoU executed between M/s Homelife Real Estate Pvt. Ltd., and M/s Parsvnath Developers Ltd to the effect to utilize STP to

15 Parsvnath Developers Ltd., to utilize the facility of STP to be installed by M/s Homelife Real Estate (P) Ltd. as facility to treat its wastewater. 4. The project proponent has not yet submitted permission granted by the CGWB for abstraction of groundwater be installed by M/s Homelife Real Estate (P) Ltd. as facility to treat its wastewater, has been submitted. Permission of CGWA granted vide letter no. 407 dated for abstraction of groundwater to the tune of 455 KLD has been submitted. 6. The case was again considered by the SEAC in its 53 rd meeting held on , which was attended by the following on behalf of the project proponent: i) Ms. Veena Tripathi, Asst. Manager of the promoter company ii) iii) iv) Sh. Rohit Sharma, Sr. Executive of the promoter company. Ms. Purba Chatterji, Environmental Consultant, M/s Perfect Enviro- Solution Pvt. Limited, Delhi. Ms. Shikha Gaur, Environmental Consultant, M/s Perfect Enviro- Solution Pvt. Limited, Delhi. Ms. Purba Chatterji, Environmental Consultant, M/s Perfect Enviro- Solution Pvt. Limited, Delhi, who is the Environmental Consultant of the project proponent, presented the reply of the observations of the committee. She informed that no industrial unit is located within a radius of 500 m from the periphery of the project site and no construction activity has been started at site. The Committee noted that as per water balance submitted by the project proponent, KLD of treated wastewater is to be utilized for irrigation of agricultural fields by the different farmers, but the promoter company has not submitted any agreement made by it with the owners of the agricultural fields. The Committee further noted that this mode of disposal is not a permanent one, as such, the promoter is required to adopt permanent mode of disposal for the treated wastewater. Besides, the committee noted that the project proponent has not submitted proper details regarding EMP and CSR.

16 After detailed deliberations in the matter the Committee observed that project proponent is required to submit certain information/data before appraisal of the project proposal. The said decision of the Committee was conveyed to the project proponent vide letter No dated The project proponent vide letter No. PDL/strategic planning/eia/2433 dated submitted the reply of the observations of the SEAC, the details of which are as under: Sr. no. Observations raised by the committee members. Reply submitted by the Project Proponent. 1. The project proponent shall purchase an additional land area adjoining to the premises of the residential colony to develop the same as per Karnal Technology, so as to have permanent mode of disposal for the treated wastewater or adopt any other environmentally sound mode of disposal for the quantity of wastewater, which is proposed to be used for the irrigation of agricultural fields of farmers. The treated wastewater will be utilized for the following purposes: i) The treated wastewater will be utilized for irrigation of 14 acres of agricultural land of the farmers. The project proponent has submitted a MoU executed between the promoter company ie M/s Parsvnath Developers Ltd and the farmers. ii) The project proponent has also submitted a copy of the letter vide which request has been made to NHAI to use the treated wastewater of the residential complex for plantation along the NH. 2. Environmental Management Plan indicating the following: a) All mitigation measures for each item-wise activity to be undertaken during the construction, operation and the entire life cycle to minimize adverse environmental impacts as a result of the activities a)submitted

17 of the project. b) Compliance of various environmental regulations c) Steps to be taken in case of emergency such as accidents at the site including fire. d) For how long period the project proponent will be responsible for implementation of EMP and the name of the person(s) responsible for implementation of EMP. e) Capital & recurring cost for the EMP per year and the details of funds for the same. f) Name of the individual person / organization, who will be responsible for implementation of EMP after the lapse of the period for which the project proponent is responsible. b) submitted c) submitted. d) M/s. Corporate Social Responsibility indicating various activities to be undertaken, provisions of funds for the same, the period for which the same is to be implemented and the person(s) responsible for the implementation of the same. M/s. Parsvnath Developers Pvt. Ltd has already taken a step towards corporate social responsibility and operating the same in the name of M/s. Parsvnath Foundation. The foundation mainly focuses on health, hygiene and education of marginalized families also actively involved in mainstreaming them. The CSR initiatives for the site will be managed by the person appointed by M/s Parsvnath Foundation from time to time

18 and the person will be responsible for the implementation of the same. 8. The case was considered by the SEAC in its 58 th meeting held on , which was attended by the following on the behalf of the project proponent. i) Sh. Rohit Sharma, Senior Executive of the promoter company. ii) iii) iv) Sh. Amit Kumar, Manager of the promoter company. Smt. Roshini, Asstt. Manager of the promoter company. Mr. Sashank Arora, Environment Consultant of Indtech House Consultants, Delhi. Mr. Sashank Arora presented the reply of the observations before the SEAC but the committee was not satisfied with the submissions made by the representative of the project proponent to the effect that a MOU has been executed between the promoter company and the farmers for using treated wastewater of the residential colony for irrigation of their agricultural fields having area 14 acres, due to following facts: a) The farmers cannot utilize the treated wastewater invariably for irrigation purpose due to limited use especially for Rabi Crop and during no demand period. b) The farmers can terminate the MOU at any time and at that time the promoter might not have authorized mode of disposal for the treated wastewater due to which promoter may adopt any other unauthorized mode of disposal. As regards to utilization of treated wastewater in the plantation area to be developed along National Highway with the permission of NHAI, the Committee noticed that the promoter company has not yet worked out as to how much area will be available for utilization of treated wastewater and has not submitted permission issued by NHAI. However,the committee was satisfied with the details of EMP & CSR.

19 The Environmental Consultant of the promoter company informed that the maximum height of the building block will be 18m and the width of the approach road is more than 100 ft, thus, the width of the approach road is in accordance with Office Memorandum dated of the Ministry of Environment & Forests, for high rise buildings. He further informed that NOC from the Fire Department mentioning the distance of Fire Station from the project site, is yet to be obtained. After detailed deliberations in the matter, the SEAC decided to defer the case till the project proponent submits proper reply of the aforesaid observations. The decision of the Committee was conveyed to the project proponent vide letter no dated The project proponent has submitted the reply of the observations, the details of which are as under: Sr. No. Observations of the SEAC Reply submitted by the project proponent 1. We have executed MOU with farmers to utilize the treated waste water in their agricultural land measures 14 acres. The total water requirement for the said agricultural land will be 312 KLD, 101 KLD and 28 KLD during summer, winter and rainy seasons, respectively, as per hydrolic loading of 5.5 lt/sqm/day, 1.8 lt/sqm/day and 0.5 lt/sqm/day. 2. The farmers can terminate the MOU at any time and at that time the promoter might not have authorized mode of disposal for the treated wastewater due to which promoter may adopt any other unauthorized mode of disposal. In case the MOU signed with the farmers does not work, then the treated waste water will be discharged into drainage line.

As regards to utilization of treated wastewater in the plantation area to be developed along National Highway with the permission of NHAI, the Committee noticed that the promoter company has not yet worked out as to how much area will be available for utilization of treated wastewater and has not submitted permission issued by NHAI No reply has been submitted 4. The case was considered by the SEAC in its 63 rd meeting held on , which was attended by the following on behalf of the project proponent: i) Sh. The treated wastewater to be used for flushing purposes in the commercial area, community hall and school will be about 118 KLD. Therefore, the total treated wastewater to be used for flushing purposes will be KLD ( ) say 318 KLD. The entire proposal has been designed to utilize the treated wastewater for flushing purposes for the quantity as calculated above, therefore, there will not be any deviation while implementing the project proposal. There will be about 586 KLD generation of wastewater, which will be treated in a STP and at the outlet of STP about 528 KLD of treated wastewater will be available.

22 The NHAI vide letter dated has accorded permission for development of green belt in an area of sqm along National Highway for utilization of treated wastewater. This area will be developed as per Karnal Technology in which hydraulic loading of treated sewage can be applied in the range of 300 KL/hectare/day to 1000 Kl/hectare/day depending upon climatic conditions, permeability of soil (which in turn depends upon the soil texture, structure, presence of permeable layers of soil profile and exchangeable sodium percentage of soil) and type of trees to be planted. A MOU has already been signed with the farmers for utilization of treated wastewater in their agricultural land in an area of 14 acres. Further, green belt to be developed in an area of 19, sqm within the premises of the project site, will be irrigated with the treated wastewater. Out of 528 KLD of treated wastewater, 318 KLD will be used for flushing purposes, 106KLD will be used in the green belt to be developed within the premises of the project site and 104 KLD in the green belt to be developed in the NHAI area in summer season. In winter season, 318 KLD will be used for flushing purposes, 35 KLD will be used in the green belt to be developed within the premises of the project site, 101 KLD in the green belt to be developed in the NHAI area and 74KLD will be given to the farmers. In rainy season, 318 KLD will be used for flushing purposes, 10 KLD will be used in the green belt to be developed within the premises of the project site, 98 KLD in the green belt to be developed in the NHAI area and 102 KLD will be given to the farmers. No construction activity has been undertaken at site. The monitoring of groundwater, ambient air and ambient noise level have been got done from M/s Eco-Pro Engineers Pvt. Ltd., Gaziabad. The analysis report of groundwater reveals that the groundwater of the area is potable in nature. The analysis report of ambient air reveals that the concentration of various pollutants such as PM 2.5, PM 10, SO 2, NO 2, Pb, CO, Ammonia, Benzene, As Ni, Ozone and Benzopyrine in the ambient air is

23 within the standards laid down by the MoEF. The noise levels during day and night times, have been measured as db(a) leq and db(a) leq, respectively, against the prescribed standards of 55 and 45 db(a) leq. The run-off to be generated from roof-top will be recharged into groundwater and the run-off to be generated from other areas will be collected through peripheral drains and discharged into nearby natural drain. The layout plan was approved by the Department of Town and Country Planning in the month of June,2006 and licence to develop the colony was issued by the Competent Authority of the State under the PAPR Act,1995 on without imposing any condition to the effect that the promoter is required to obtain permission for CLU, but in the said licence a condition was imposed to the effect that the promoter shall deposit EDC as per provisions of the PAPR Act,1995.Thus, the project promoter is not required to obtain permission for CLU. Furthermore, the site of the project is located in the mixed land use area as per Master Plan of Rajpura. After detailed deliberations in the matter, the SEAC observed that the project proponent has provided adequate and satisfactory clarifications of the observations raised by it, therefore, the Committee awarded 'Silver Grading' to the project proposal and decided to forward the case to the SEIAA with the recommendation to grant environmental clearance to the project proponent for plotted development having 246 residential plots & one commercial plot and construction of group housing, commercial complex and other community facilities having total built up area of 50, sqm, in an area measuring as 37 acres in the revenue estate of Village Dahrian, Tehsil Rajpura, District Patiala, subject to the following conditions in addition to the proposed measures: PART A Specific conditions I. Construction Phase i) Consent to establish shall be obtained from Punjab Pollution Control Board under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 and a copy of the same shall be submitted to the Ministry of Environment & Forests / State Level Environment Impact Assessment Authority before the start of any construction work at site.

24 ii) iii) iv) All required sanitary and hygienic measures should be in place before starting construction activities and to be maintained throughout the construction phase. A first aid room will be provided in the project both during construction and operation phase of the project. All the topsoil excavated during construction activities should be stored for use in horticulture / landscape development within the project site. v) Disposal of muck during construction phase should not create any adverse effect on the neighboring communities and be disposed off after taking the necessary precautions for general safety and health aspects of people with the approval of competent authority. vi) vii) viii) ix) Construction spoils, including bituminous material and other hazardous material, must not be allowed to contaminate watercourses and the dump sites for such material must be secured, so that they should not leach into the ground water. The diesel generator sets to be used during construction phase should be of low sulphur diesel type and should conform to the provisions of Environment (Protection) Act, 1986 prescribed for air and noise emission standards. Vehicles hired for bringing construction material to the site and other machinery to be used during construction should be in good condition and should conform to applicable air and noise emission standards. Ambient noise levels should conform to prescribed standards both during day and night. Incremental pollution loads on the ambient air and noise quality should be closely monitored during construction phase. x) Fly ash should be used as construction material in the construction as per the provisions of Fly Ash Notification of September, 1999 and as amended on August, 2003 (This condition is applicable only if the project is within 100 Km of Thermal Power Station). xi) xii) xiii) xiv) xv) xvi) xvii) Ready mixed concrete should be used in building construction as far as possible. Water demand during construction should be reduced by use of premixed concrete, curing agents and other best practices. Separation of drinking water supply and treated sewage supply should be done by the use of different colours. Fixtures for showers, toilet flushing and drinking should be of low flow either by use of aerators or pressure reducing devices or sensor based control. Adequate steps shall be taken to conserve energy by limiting the use of glass, provision of proper thermal insulation and taking measures as prescribed under the Energy Conservation Building Code. The approval of competent authority shall be obtained for structural safety of the buildings due to earthquakes, adequacy of fire fighting equipments etc. as per National Building Code including protection measures from lightning. Provision shall be made for the housing of construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, disposal of waste water & solid waste in an environmentally sound manner, safe drinking water, medical health care, crèche etc. The housing

25 may be in the form of temporary structures to be removed after the completion of the project. II. Operation Phase i) The installation of sewage treatment plant (STP) and adequacy of disposal system should be certified by Punjab Pollution Control Board and a report in this regard should be submitted to the Ministry of Environment & Forests/State Level Environment Impact Assessment Authority before the project is commissioned for operation. The discharge of treated sewage shall conform to the norms and standards prescribed by Punjab Pollution Control Board for such discharges. The project proponent shall not discharge the treated/untreated wastewater into any drain in any case. ii) The project proponent shall treat the wastewater of the project in the STP of 1200 KLD capacity to be installed by M/s. Homslife Real Estate Pvt. Ltd in its project to be developed adjoining to the project of the proponent and both the parties shall abide by the terms & conditions of the agreements executed on and between them.further, both the parties will be jointly responsible for installation of STP in time, compliance of effluent standards, proper disposal for treated wastewater and compliance of the provisions of the Water Act,1974. iii) iv) The project proponent shall provide electromagnetic flow meter at the outlet of the water supply, outlet of the STP and any pipeline to be used for re-using the treated wastewater back into the system for flushing and for horticulture purpose/green etc. and shall maintain a record of readings of each such meter on daily basis. Adequate & appropriate pollution control measures should be provided to control fugitive emissions to be emitted within the commercial complex. v) Adequate treatment facility for drinking water shall be provided, if required. vi) vii) viii) ix) Rainwater harvesting for roof run-off should be implemented. Before recharging the roof run-off, pretreatment must be done to remove suspended matter, oil and grease. However, no run off from gardens/green area/roads/pavements shall be connected with the ground water recharging system. The solid waste generated should be properly collected and segregated. The recyclable solid waste shall be sold out to the authorized vendors and inerts shall be sent to disposal facility. The Bio-degradable solid waste shall be adequately treated as per the scheme submitted by the project proponent. Prior approval of competent authority should be obtained, if required. Hazardous waste/e-waste should be disposed off as per Rules applicable and with the necessary approval of the Punjab Pollution Control Board. The green belt design along the periphery of the plot shall achieve attenuation factor conforming to the day and night noise standards prescribed for residential land use. The open spaces inside the plot should be suitably landscaped and covered with vegetation of indigenous species/variety.

26 x) The project proponent should take adequate and appropriate measures to contain the ambient air quality with in the prescribed standards. The proposal regarding mitigation measures to be taken at site should be submitted to the Ministry of Environment & Forests/ State Level Environment Impact Assessment Authority within three months. xi) xii) xiii) xiv) xv) Incremental pollution loads on the ambient air quality, noise and water quality should be periodically monitored after commissioning of the project. Application of solar energy should be incorporated for illumination of common areas, lighting for gardens and street lighting in addition to provision for solar water heating. Traffic congestion near the entry and exit points from the roads adjoining the proposed project site must be avoided. Parking should be fully internalized and no public space should be utilized. A report on the energy conservation measures conforming to energy conservation norms finalized by Bureau of Energy Efficiency should be prepared incorporating details about machinery of air conditioning, lifts, lighting, building materials, R & U Factors etc. and submitted to the respective Regional office of MoEF, the Zonal Office of CPCB and the SPCB/SEIAA in three months time. Environment Management Cell shall be formed during operation phase which will supervise and monitor the environment related aspects of the project. PART B General Conditions : i) This environmental clearance will be valid for a period of five years from the date of its issue or till the completion of the project, whichever is earlier. ii) The environmental safeguards contained in the application of the promoter / mentioned during the presentation before State Level Environment Impact Assessment Authority/State Expert Appraisal Committee should be implemented in letter and spirit. iii) The entire cost of the environmental management plan (i.e. capital cost as well as recurring cost) will continue to be borne by the project proponent until the responsibility of environmental management plan is transferred to the occupier/residents society under proper MOU after obtaining prior permission of iv) the Punjab Pollution Control Board. The project proponent shall also submit six monthly reports on the status of compliance of the stipulated EC conditions including results of monitored data (both in hard copies as well as by mail) to the respective Regional office of MoEF, the Zonal Office of CPCB and the SPCB/SEIAA. v) Officials from the Regional Office of Ministry of Environment & Forests, Chandigarh / State Level Environment Impact Assessment Authority / State Level Expert Appraisal Committee / Punjab Pollution Control Board who would be monitoring the implementation of environmental safeguards should be given full cooperation, facilities and documents / data by the project proponents during their inspection. A complete set of all the documents submitted to State Environment Impact Assessment Authority should be forwarded to the CCF, Regional Office of Ministry of Environment & Forests, Chandigarh/State Level Environment Impact Assessment Authority.
