4 First condition - measures to achieve compliance with the limit values for NO 2 before the initial attainment date For the purpose of assessing whether appropriate measures have been taken at national, regional and local level to achieve compliance with the limit values, information on measures taken before 2010 and on their effect is required. Please complete the information in Form 4A, Annex to Form 5A and Annex A to Form 7 by listing the baseline level projected for 2010 and specific measures which were taken before 2010, including their expected effect on NO2 emissions and NO2 levels in ambient air. This information can be provided also by completing Form 3B. FR14N10 Please list the missing zone FR14N10 with the required information in Form 5A. In Form 5A it is stated for which zones it was expected that compliance will be achieved in However, a quantitative level is missing. Please provide the expected concentrations in 2010, if possible. Second condition measures to achieve compliance with the limit values for NO 2 before the new deadline in 2015 at the latest FR14N10, FR19N10, FR35N10 Please fill in the requested information in Form 5B relating to the codes of measures, timetable of implementation, indicators for monitoring the progress, funding, total costs and estimated levels before the extended date of compliance. In Annex B to form 5, quantitative information on the total impact of measures is requested. Please provide, as far as possible, the quantitative total impact of measures. In Annex B to form 7, the impact of individual measures is requested. Information on the effect is missing in relation to compliance by the date of the extended deadline. Please provide, as far as possible, the impact for individual measures which will also indicate whether the contributing sources have been sufficiently addressed by measures. It is essential for demonstrating that this condition is satisfied that a baseline level is provided for the exceedance situations at the expiry of the exemption period. Form 4B must therefore be appropriately completed and the baseline level must be expressed as an estimated absolute number. In filling in Form 4B, please ensure that the baseline includes existing Community measures, and the measures taken to achieve compliance by the initial attainment date, i.e. the measures set out in Form 5A (excluding any measures also included in Form 5B). The baseline is needed to determine the magnitude of any gap between the limit value and the level expected at the end of the exemption period. If there is a gap, the pollution abatement measures specified in Form 5B should serve to close that gap. Please note that those measures should not be included in the calculation of the baseline. 5

6 Third condition Air Quality Plan & consistency with requirements of Part A of Annex XV of the Directive It is stated in the document " ITEC-0064_demande report valeurs limites NO2 Ó 2015.pdf" that the AQ plans are in revision or elaboration. Please confirm for each zone whether the AQ plan available can still be considered the up-to date AQ plan according to Article 22(1). If a new plan is being developed, please state when it will be available and adopted. If an updated plan is already available please provide an electronic copy. FR14N10, FR19N10, FR20N10, FR26N10, FR35N10 According to Article 22 (1) of the Directive, an AQ plan is required for a time extension notification. In those zones AQ plans are not available and are requested. Please provide the missing AQ plans. Fourth condition Status of implementation of Union air pollution legislation in Part B of Annex XV of the Directive and consideration of certain measures in section 3 of Part B of Annex XV of the Directive According to Article 22 (1) of the Directive, information is required as to whether certain measures have been considered for implementation in connection with the attainment of air quality objectives. In Form 6, no information is given related to the measure "Emission control equipment for sm and medium sized stationary combustion sources / replacement of combustion sources", which is explicitly listed in the Directive. Please provide a specific measure. If not such measure is planned in the respective zones, please provide a justification why this is the case. In Form 6, please ensure that one measure is listed for each sub-category of sub d. If a certain type of measure has not been planned please provide a justification why this is the case. In Form 6, please ensure that at least one measure is listed for each zone and for each sub c., e., f., g. and h as well. If a certain type of measure has not been considered please explain why the measures are not appropriate for reducing 6

7 pollutant levels in the exceedance situations concerned. Please note that measures under sub h. have to go beyond implementing the requirements of other directives (IPPC, LCP, WID). An air quality plan (plan or programme) is required within two years following an exceedance of the limit value. Therefore it is important to know when the first air quality plan (plan or programme) was adopted. Please provide the year of adoption of the first air quality plan (plan or programme) in Form 9 and include evidence on the adoption, e.g. a decision of the city or regional council. Please also provide information on the short-term action plan, if such a plan was developed. Form 9 should contain information on those instations which jointly contribute significantly (> 3%) to the exceedance situation. Please confirm whether or not any IPPC, LCP or WID instations jointly contribute > 3 % to the NOx level at each exceedance situation. If IPPC, LCP or WID instations do jointly contribute >3%, please provide information on these Directives in Form 9. In the context of its reports under the national emissions ceilings directive, France has indicated a projected exceedance of the emission ceiling for its emissions of nitrogen oxides in In the Annex to Form 8, please assess the importance of this exceedance in relation to the achievement of compliance with the limit values for NO2 specificy for the notified zones. 7
