1 NOTIFICATION OF ADDENDUM ADDENDUM NO. 1 DATED 6/18/2002 Control Project RMC Highway PA1502 County BEXAR Ladies/Gentlemen: Attached please find an addendum on the above captioned project. Included in the attachment is an adendum notification which details the changes and the respective proposal pages which were added and/ or changed. Except for new bid insert pages, it is unnecessary to return any of the pages attached. Bid insert pages must be returned with the bid proposal submitted to the Department, unless your firm is submitting a bid using a computer print out. The computer print out must be changed to reflect the new bid item information. Contractors and material suppliers, etc. who have previously been furnished informational proposals are not being furnished a copy of the addendum. If you have a subcontractor on the above project, please advise them of this addendum. Acknowledgment of this addendum is not requested if your company has been issued a proposal stamped This Proposal Issued for Informational Purposes. You are required to acknowledge receipt of this addendum by entering the date, which appears at the top of this letter on the Addendum Acknowledgement Form, contained in your bid proposal. 3 GENERAL NOTES: The Maintenance Supervisor listed below will be the Engineer's Representative in charge of the inspection of all work in this Contract. A pre-work conference will be held at this location and all requests for payment will be certified by this office. Matias Galvan MS V 6550 Walzem Road San Antonio, TX (210) Before beginning operations, a conference between the Contractor and the State will be arranged. In this meeting, the Contractor will outline proposed work procedures, sequence of work to be followed, estimated progress schedules and furnish plans for performing the work. In accordance with the Underground Facility Damage Prevention Act (One Call Bill), the phone number for a utility locator is It is the Contractor's responsibility to make arrangements for utility locators as needed. General Requirements This project consists of landscape maintenance activities on PA 1502 (Wurzbach Parkway) from ½ mile west of Wetmore Road to Independence Ave. as shown on the plan sheets. Work will be allowed only between the hours of 8:00 A.M. and 5:00 P.M. Monday through Friday, unless otherwise approved. No work will be allowed on Saturdays, Sundays, or State observed holidays without approval of the Engineer. Notify the Engineer's office by telephone each morning that work is scheduled and provide the planned work location, time of arrival, or reason for not working that day. Begin a cycle of Plant Maintenance, including irrigation when required, on the second Monday of each month and complete the cycle within 10 consecutive working days. Item 1 Your attention is called to Item 1.72 of the General Requirements and Covenants, the definition of a "working day". Should the working days per cycle of work be exceeded, liquidated damages become effective for each working day that the cycle of work remains uncompleted. These liquidated damages will cease at the start of the next scheduled cycle. A

4 Item 8 Between April 1st and October 31st the Texas Natural Resource Conservation Commission (TNRCC) is monitoring weather conditions on a daily basis in the San Antonio area to forecast the probability of ozone formation. In the event weather conditions indicate that excessive ozone may occur, the National Weather Service, working with the TNRCC will issue an Air Quality Health Alert Day for the following day. TNRCC estimates that approximately 25 Air Quality Health Alert Days might be issued during the ozone formation season. The ozone readings taken during these days are very critical to future funding for the San Antonio area; therefore any operations that adversely affect the readings need to be reduced. On Air Quality Health Alert Days, mowing operations and the use of small gasoline engines will not be allowed until after 12 noon on all highways inside Loop The State will notify the Contractor by 4:00 P.M. of the day before the Air Quality Health Alert Day to inform them of the restrictions for the following day and to request their assistance in reducing any other operations that may contribute to an increase in the ozone readings. If these restrictions affect the critical items of work previously scheduled by the Contractor, a working day will not be charged. Time charges on these days will be as determined by the Engineer for each day. Item 193 Plant locations as shown on the Landscaping Layouts are approximate. Pruning Remove dead, dying, diseased, or interfering branches as needed during the contract period or as required by the Engineer. Debris from pruning operations may be chipped and returned to the area as mulch if it meets the requirements for mulch as specified in Item 193.2(2) Mulch. Mulching, Plant Basin and Bed Maintenance Mulch all plants within the area of landscape maintenance. Mulch an area 5 feet in diameter around each tree or shrub. Mulch the entire bed areas. Replenish mulch each cycle, if necessary, to maintain a minimum depth of 3 inches. Place mulch as shown on the Staking and Mulching detail sheet. Remove all weeds and grass from the planting beds and from all plant basins each cycle. If directed, remove volunteer trees that have grown within these areas and treat the stumps with an approved herbicide to prevent re-growth from occurring. B

5 Fertilization Apply Soil Food Organic Fertilizer with a analysis as manufactured by GardenVille Fertilizer Co., San Antonio, TX or an approved equal. Apply at the highest rate recommended by the manufacturer to all plants in both Areas during the second plant maintenance cycle and again 12 months later. Distribute fertilizer uniformly over the bed or under the drip-line of the tree branches. Incorporation of fertilizer into the soil or mulch is not required. Irrigation to wet the fertilizer is not required. Mowing and Trimming Mow and trim each cycle unless directed otherwise. Mow an area extending a minimum of 3 feet beyond the edge of all mulched areas except for areas shown on the Mowing and Trimming detail sheets. Mow according to the detail sheets for those areas. Mow at a height of approximately 4 inches. Use mowers with a maximum cutting width of 3 feet unless otherwise approved by the Engineer. Limit the use of string trimmers to areas outside of the mulched beds to prevent damage to plants. Irrigation This contract requires the use of reclaimed water or water from other, non-aquifer sources approved by the Engineer. Reclaimed water is defined as domestic or municipal wastewater which has been treated to a quality suitable for a beneficial use, pursuant to the provisions of Chapter 210 and other applicable chapters of the Texas Administrative Code. Reclaimed water is available from the San Antonio Water System (SAWS) at the following locations: Salado Creek Water Recycling Center Blue Wing Road Elmendorf, TX Dos Rios Water Recycling Center 3225 Valley Road San Antonio, TX The point-of-contact for obtaining information on permits and using reclaimed water from SAWS can be reached at If reclaimed water is used, obtain and maintain user and hauler permits, records, and other documents required by local, State, and Federal regulations. 6 The use of reclaimed water is dependent upon the issuance of a permit from SAWS or other reclaimed water producer or purveyor. Although it is anticipated that a permit will allow application on this location, the permit may be denied because of conditions not controlled by the Contractor. All costs associated with obtaining water, permits, documentation, and hauling of water are considered subsidiary to this Item. If water (not pumped from an aquifer) other than reclaimed water is used, provide documentation of the source and a water quality analysis (if requested) to the Engineer and obtain approval before use. Water must meet the requirements of Item 168.2, Materials. In response to mandated water use restrictions, the Engineer reserves the right to significantly alter or eliminate any vegetative watering required by this contract. Apply water at the designated rate and frequency. Use watering equipment with accurate measuring devices. Provide meter readings on each load (before and after application) of water hauled to the project. Irrigate the plants from Nacogdoches Road to O Connor Road during each Plant Maintenance cycle from March through September. Other plants do not require irrigation. If the Engineer determines that there is sufficient moisture available to the plants due to natural rainfall, a cycle of vegetative watering may be canceled, delayed or re-scheduled. Irrigate at the following rates: Plant Name Quantity Approx. Trees include Lacey Oak, Cedar Elm, Mexican Live Oak, Chinkapin Oak, Desert Willow, Texas Redbud, and Mexican Sycamore. Shrubs include Mexican Buckeye, Evergreen Sumac, and Mountain Laurel. Plant Replacement Repair or replace plant materials damaged or destroyed from maintenance activities at the direction of the Engineer and at no expense to the State. Begin and complete plant replacement D

7 within the next plant maintenance cycle following notification to begin the replacement process. Furnish and install plant replacements in accordance with Item 192, Roadside Planting and Establishment. Use plant materials of the same species and size as those being replaced. Maintain and irrigate replacement plants until established and to the satisfaction of the Engineer. Litter Removal Remove and dispose of litter from the areas of maintenance before mowing. Litter removal and disposal is subsidiary to the various bid items. Pesticide Applications Use of pre-emergent herbicides and a glyphosate type herbicide for maintenance of mulched areas is encouraged. If used, apply these materials at rates recommended by the manufacturer and approved by the Engineer. Apply Logic Fire Ant Bait or an approved equal at the full label rate to the mulched areas on an as needed basis. Schedule this application with the Engineer. Staking and Guying When directed by the Engineer, stake and guy trees and shrubs, which must be reset or straightened for any reason. Stake and guy according to the Staking and Mulching detail sheet. Item 502 Provide for the passage of traffic through the project with signs, lights and barricades in accordance with the Texas Manual on Uniform Traffic Control and to the satisfaction of the Engineer. If lane closures are necessary, coordinate through the district contact person for this contract. Lane closures will adhere to the dates and times as approved and/or directed by the Engineer. Workers exposed to traffic should be attired in bright, high visible clothing at all times. A highly visible reflective vest is acceptable. Traffic control required for this contract will not be paid for directly, but will be considered subsidiary to work pertaining to the various bid items of the contract. Item 5519 E

8 Provide to the Engineer, one (1) transportable cellular phone for use by State inspection personnel. Obtain approval for the cellular phone monthly service plan before establishing the connection. Submit an itemized breakdown of phone calls made using this cellular phone each month before reimbursement. The Contractor shall retain ownership of the phone and take possession of the phone upon completion of the contract. F
