The imprvements are required t meet the needs f the Twn t the year 2031 and the Twn will cnsider a wide range f ptins t satisfy travel demand within the Lakeshre Rad West Crridr and within the study area. The attached Areas f Interest dcument prvides guidance regarding the ministry s interests with respect t the Class EA prcess. Please identify the areas f interest which are applicable t yur prject and ensure they are addressed. Prpnents wh address all f the applicable areas f interest can minimize ptential delays t their prject schedule. The Crwn has a legal duty t cnsult Abriginal cmmunities when it has knwledge, real r cnstructive, f the existence r ptential existence f an Abriginal r treaty right and cntemplates cnduct that may adversely impact that right. Befre authrizing this prject, the Crwn must ensure that its duty t cnsult has been fulfilled, where such a duty is triggered. Althugh the duty t cnsult with Abriginal peples is a duty f the Crwn, the Crwn may delegate prcedural aspects f this duty t prject prpnents while retaining versight f the cnsultatin prcess. Yur prpsed prject may have the ptential t affect Abriginal r treaty rights prtected under Sectin 35 f Canada s Cnstitutin Act Where the Crwn s duty t cnsult is triggered in relatin t yur prpsed prject, the MOECC is delegating the prcedural aspects f rightsbased cnsultatin t yu thrugh this letter. 8 AREAS OF INTEREST It is suggested that yu check ff each applicable area after yu have cnsidered / addressed it. Surce Water Prtectin (all prjects) The Clean Water Act, 2006 (CWA) aims t prtect existing and future surces f drinking water. T achieve this, several types f vulnerable areas have been delineated arund surface water intakes and wellheads fr every municipal residential drinking water system that is lcated in a surce prtectin area. These vulnerable areas are knwn as a Wellhead Prtectin Areas (WHPAs) and surface water Intake Prtectin Znes (IPZs). Other vulnerable areas that have been delineated under the CWA include are Highly Vulnerable Aquifers (HVAs), Significant Grundwater Recharge Areas (SGRAs), Event-based mdelling areas (EBAs), and Issues Cntributing Areas (ICAs). Surce prtectin plans have been develped that include plicies t address existing and future risks t surces f municipal drinking water within these vulnerable areas. Prjects may include activities that, if lcated in a vulnerable area, culd be a threat t surces f drinking water (i.e. have the ptential t adversely affect the quality r quantity f drinking water surces) and the activity culd therefre be subject t plicies in a surce prtectin plan. Where an activity pses a risk t drinking water, plicies in the lcal surce prtectin plan may impact hw r where that activity is undertaken. Plicies may prhibit certain activities, r they may require risk management measures fr these activities. Municipal Official Plans, planning decisins, Class EA prjects (where the prject includes an activity that is a threat t drinking water) and prescribed instruments must cnfrm with plicies that address significant risks t drinking water and must have regard fr plicies that address mderate r lw risks. As part f the prject, the prpnent shuld clearly dcument hw the prximity f the prject t surces f drinking water (municipal r ther) and any delineated vulnerable areas was cnsidered and assessed, whether there were any surce prtectin plan plicies that applied, and if s, hw they impacted the prject, as well as identify mitigating measures t address any negative envirnmental impacts t thse surces (cnsidering natural, ecnmic and scial/cultural envirnmental impacts). As yu may be aware, in Octber 2015, the MEA Parent Class EA dcument was amended t include reference t the Clean Water Act (Sectin A ) and indicates that prpnents undertaking a Municipal Class EA prject must identify early in their prcess whether a prject is r culd ptentially be ccurring with a vulnerable area. Given this requirement, the prpnent shuld include a sectin in the Prject File/ESR n surce water prtectin. While mst surce prtectin plans fcused n including plicies fr significant drinking water threats in the WHPAs and IPZs it shuld be nted that even thugh surce prtectin plan plicies may nt apply in HVAs, these are areas where aquifers are sensitive and at risk t impacts and within these areas, activities may impact the quality f surces f drinking water fr systems ther than municipal residential systems. In rder t determine if this prject is ccurring within a vulnerable area, prpnents can use this mapping tl: The mapping tl will als prvide a link t the apprpriate surce prtectin plan in rder t identify what plicies may be applicable in the vulnerable area. Fr further infrmatin n the maps r surce prtectin plan plicies which may relate t their prject, prpnents shuld cntact the Prject Manager fr Drinking Water Surce Prtectin at the lcal surce prtectin authrity (i.e., cnservatin authrity). 4

9 Mre Infrmatin Fr mre infrmatin n the Clean Water Act, surce prtectin areas and plans, including specific infrmatin n the vulnerable areas and drinking water threats, please refer t Cnservatin Ontari s website where yu will als find links t the lcal surce prtectin plan/assessment reprt. A list f the prescribed drinking water threats can be fund in sectin 1.1 f Ontari Regulatin 287/07 made under the Clean Water Act. In additin t prescribed drinking water threats, sme surce prtectin plans may include plicies t address additinal lcal threat activities, as apprved by the MOECC. Ecsystem Prtectin and Restratin Any impacts t ecsystem frm and functin must be avided where pssible. The Prject File/ESR shuld describe any prpsed mitigatin measures and hw prject planning will prtect and enhance the lcal ecsystem. All natural heritage features shuld be identified and described in detail t assess ptential impacts and t develp apprpriate mitigatin measures. The fllwing sensitive envirnmental features may be lcated within r adjacent t the study area: Areas f Natural and Scientific Interest (ANSIs) Rare Species f flra r fauna Watercurses Wetlands Wdlts We recmmend cnsulting with the Ministry f Natural Resurces and Frestry (MNRF), Fisheries and Oceans Canada (DFO) and yur lcal cnservatin authrity t determine if special measures r additinal studies will be necessary t preserve and prtect these sensitive features. In additin, yu may cnsider the prvisins f the Ruge Park Management Plan if applicable. Surface Water The ESR must include a sufficient level f infrmatin t demnstrate that there will be n negative impacts n the natural features r eclgical functins f any watercurses within the study area. Measures shuld be included in the planning and design prcess t ensure that any impacts t watercurses frm cnstructin r peratinal activities (e.g. spills, ersin, pllutin) are mitigated as part f the prpsed undertaking. Additinal strmwater runff frm new pavement can impact receiving watercurses and fld cnditins. Quality and quantity cntrl measures t treat strmwater runff shuld be cnsidered fr all new impervius areas and, where pssible, existing surfaces. The ministry s Strmwater Management Planning and Design Manual (2003) shuld be referenced in the Prject File/ESR and utilized when designing strmwater cntrl methds. We recmmend that a Strmwater Management Plan shuld be prepared as part f the Class EA prcess that includes: Strategies t address ptential water quantity and ersin impacts related t strmwater draining int streams r ther sensitive envirnmental features, and t ensure that adequate (enhanced) water quality is maintained Watershed infrmatin, drainage cnditins, and ther relevant backgrund infrmatin Future drainage cnditins, strmwater management ptins, infrmatin n ersin and sediment cntrl during cnstructin, and ther details f the prpsed wrks Infrmatin n maintenance and mnitring cmmitments. 5

10 Ontari Regulatin 60/08 under the Ontari Water Resurces Act (OWRA) applies t the Lake Simce Basin, which encmpasses Lake Simce and the lands frm which surface water drains int Lake Simce. If the prpsed sewage treatment plant is listed in Table 1 f the regulatin, the Prject File/ESR shuld describe hw the prpsed prject and its mitigatin measures are cnsistent with the requirements f this regulatin and the OWRA. Grundwater The status f, and ptential impacts t any well water supplies shuld be addressed. If the prject invlves grundwater takings r changes t drainage patterns, the quantity and quality f grundwater may be affected due t drawdwn effects r the redirectin f existing cntaminatin flws. In additin, prject activities may infringe n existing wells such that they must be recnstructed r sealed and abandned. Apprpriate infrmatin t define existing grundwater cnditins shuld be included in the ESR. If the ptential cnstructin r decmmissining f water wells is identified as an issue, the Prject File/ESR shuld refer t Ontari Regulatin 903, Wells, under the OWRA. Ptential impacts t grundwater-dependent natural features shuld be addressed. Any changes t grundwater flw r quality frm grundwater taking may interfere with the eclgical prcesses f streams, wetlands r ther surficial features. In additin, discharging cntaminated r high vlumes f grundwater t these features may have direct impacts n their functin. Any ptential effects shuld be identified, and apprpriate mitigatin measures shuld be recmmended. The level f detail required will be dependent n the significance f the ptential impacts. Any ptential apprval requirements fr grundwater taking r discharge shuld be identified in the ESR. In particular, a Permit t Take Water (PTTW) under the OWRA will be required fr any water takings that exceed 50,000 litres per day. Air Quality, Dust and Nise If there are sensitive receptrs in the surrunding area f this prject, an air quality/dur impact assessment will be useful t evaluate alternatives, determine impacts and identify apprpriate mitigatin measures. The scpe f the assessment can be determined based n the ptential effects f the prpsed alternatives, and typically includes surce and receptr characterizatin, a quantificatin f air quality impacts by determining emissin rates and cnducting dispersin mdelling, and an assessment f effects. The assessment will cmpare t all available standards fr any cntaminants f cncern. Please cntact this ffice during the scping prcess t cnfirm the apprpriate level f assessment. Dust and nise cntrl measures shuld be addressed and included in the cnstructin plans t ensure that nearby residential and ther sensitive land uses within the study area are nt adversely affected during cnstructin activities. The ESR shuld cnsider the ptential impacts f increased nise levels during the peratin f the undertaking due t ptentially higher traffic vlumes resulting frm this prject. The prpnent shuld explre all ptential measures t mitigate significant nise impacts during the assessment f alternatives. 6

11 Servicing and Facilities Any facility that releases emissins t the atmsphere, discharges cntaminants t grund r surface water, prvides ptable water supplies, r stres, transprts r dispses f waste must have an Envirnmental Cmpliance Apprval (ECA) befre it can perate lawfully. Please cnsult with the Envirnmental Apprvals Access and Service Integratin Branch (EAASIB) t determine whether a new r amended ECA will be required fr any prpsed infrastructure. We recmmend referring t the ministry s D-Series guidelines Land Use Cmpatibility t ensure that any ptential land use cnflicts are cnsidered when planning fr any infrastructure r facilities related t wastewater, pipelines, landfills r industrial uses. Cntaminated Sils Since the remval r mvement f sils may be required, apprpriate tests t determine cntaminant levels frm previus land uses r dumping shuld be undertaken. If the sils are cntaminated, yu must determine hw and where they are t be dispsed f, cnsistent with Part XV.1 f the Envirnmental Prtectin Act (EPA) and Ontari Regulatin 153/04, Recrds f Site Cnditin, which details the new requirements related t site assessment and clean up. Please cntact the ministry s District Offices fr further cnsultatin if cntaminated sites are present. Any current r histrical waste dispsal sites shuld be identified in the ESR. The status f these sites shuld be determined t cnfirm whether apprval pursuant t Sectin 46 f the EPA may be required fr land uses n frmer dispsal sites. The lcatin f any undergrund strage tanks shuld be investigated in the ESR. Measures shuld be identified t ensure the integrity f these tanks and t ensure an apprpriate respnse in the event f a spill. The ministry s Spills Actin Centre must be cntacted in such an event. The ESR shuld identify any undergrund transmissin lines in the study area. The wners shuld be cnsulted t avid impacts t this infrastructure, including ptential spills. Mitigatin and Mnitring Design and cnstructin reprts and plans shuld be based n a best management apprach that centres n the preventin f impacts, prtectin f the existing envirnment, and pprtunities fr rehabilitatin and enhancement f any impacted areas. All waste generated during cnstructin must be dispsed f in accrdance with ministry requirements. Cntractrs must be made aware f all envirnmental cnsideratins s that all envirnmental standards and cmmitments fr bth cnstructin and peratin are met. Mitigatin measures shuld be clearly referenced in the ESR and regularly mnitred during the cnstructin stage f the prject. In additin, we encurage prpnents t cnduct pst-cnstructin mnitring t ensure all mitigatin measures have been effective and are functining prperly. The prpnent s cnstructin and pst-cnstructin mnitring plans shuld be dcumented in the ESR. 7

12 Planning and Plicy Parts f the study area may be subject t the Oak Ridges Mraine Cnservatin Plan, Niagara Escarpment Plan, Greenbelt Plan, Lake Simce Prtectin Plan, r Grwth Plan fr the Greater Glden Hrseshe. The ESR shuld demnstrate hw the prpsed study adheres t the relevant plicies in these plans. The Prvincial Plicy Statement (2014) cntains plicies that prtect Ontari s natural heritage and water resurces, including designated vulnerable areas mapped in surce water prtectin assessment reprts under the Clean Water Act (CWA). Applicable plicies shuld be referenced in the ESR, and the prpnent shuld demnstrate hw this prpsed prject is cnsistent with these plicies. Assessment reprts can be fund n the Cnservatin Ontari website at: Class EA Prcess If this prject is a Master Plan: there are several different appraches that can be used t cnduct a Master Plan, examples f which are utlined in Appendix 4 f the Class EA. The Master Plan shuld clearly indicate the selected apprach fr cnducting the plan, in particular by identifying whether the levels f assessment, cnsultatin and dcumentatin are sufficient t fulfill the requirements fr Schedule B r C prjects. Please nte that any Schedule B r C prjects identified in the plan wuld be subject t Part II Order Requests under the Envirnmental Assessment Act (EAA), althugh the plan itself wuld nt be. The ESR shuld prvide clear and cmplete dcumentatin f the planning prcess in rder t allw fr transparency in decisin-making. The ESR must als demnstrate hw the cnsultatin prvisins f the Class EA have been fulfilled, including dcumentatin f all public cnsultatin effrts undertaken during the planning prcess. Additinally, the ESR shuld identify all cncerns that were raised and hw they have been addressed thrughut the planning prcess. The Class EA als directs prpnents t include cpies f cmments submitted n the prject by interested stakehlders, and the prpnent s respnses t these cmments. The Class EA requires the cnsideratin f the effects f each alternative n all aspects f the envirnment. The ESR shuld include a level f detail (e.g. hydrgelgical investigatins, terrestrial and aquatic assessments) such that all ptential impacts can be identified and apprpriate mitigatin measures can be develped. Any supprting studies cnducted during the Class EA prcess shuld be referenced and included as part f the Prject File. Please include in the ESR a list f all subsequent permits r apprvals that may be required fr the implementatin f the preferred alternative, including MOECC s PTTW and ECAs, cnservatin authrity permits, and apprval under the Canadian Envirnmental Assessment Act (CEAA). Ministry guidelines and ther infrmatin related t the issues abve are available at under the publicatins link. We encurage yu t review all the available guides and t reference any relevant infrmatin in the ESR. 8
