3 MTSP Environmentl Assessment - Executive Summry Mv BACKGROUND AND OBJECTIVES The sewerge nd snittion progrms of the Metropolitn Wterworks nd Sewerge System (MWSS) prior to its privtiztion in August 1997 were limited. The sewerge progrm represented less thn 5% of the totl MWSS service re, other res re served by the Mnil Centrl Collection System, the Dgt-Dgtn system, the Mgllnes System, nd isolted systems in Quezon City. MWSS provided desludging services on very limited bsis for the snittion progrms. The privtiztion of MWSS leds to the division of its service re into the Est nd West Concession res. Mnil Wter Compny Inc. (MWCI) becme the concessionire for the Est service re, nd Mynild Wter Services Inc. (MWSI) for the West service re. The concessionires re responsible for mnging, operting, repiring, decommissioning nd refurbishing the fcilities owned by the MWSS for the delivery nd expnsion of wter, sewerge, nd snittion services. MWCI is responsible for providing wter, sewerge, nd snittion services in the Est concession re which is composed of prts of Quezon City nd Mnil, Mrilun, Mkti, Mndluyong, Psig, Pteros, Tguig nd the Rizl Provinces (see Figure 1 on MWCI Concession Are). In recognition of the growing need.for sewerge nd snittion services nd the wter pollution ttributed to untreted domestic wstewter, MWCI will implement the Mnil Third Sewerge Project (MTSP), follow-up project to the Mnil Second Sewerge Project (MS SP). MTSP hs two objectives: To increse the coverge nd effectiveness of sewerge service delivery in prticipting res of Metro Mnil through n integrted pproch involving septge mngement, sewge mngement, nd heightened consumer wreness of wter pollution problems nd their solutions. To estblish the finncil nd technicl vibility of new pproches for sewge mngement in Metro Mnil. 2 BRIEF PROJECT DESCRIPTION 2.1 PROJECT COMPONENTS The MTSP is estimted to cost JP,54 million (US$ 7.2 million) nd will benefit popultion of pproximtely. million (see Figure 2 for service coverge). During implementtion of five yers (25 to 21), MTSP will improve snittion nd sewer coverge in the Est Zone, from less thn % in 24 to n estimted % in 21. 2

This component will involve the construction of vrious sewge tretment plnts (STP), interceptor sewers, nd pumping sttions, repir of existing dringe nd upgrding of communl septic tnks to secondry tretment. The STPs to be constructed under this component will utilize estblished biologicl tretment processes. The component will benefit popultion of bout 1. million. A description of the sub-components is summrized below: o Tguig Sewerge System includes the construction of four STPs (Hgonoy, Tguig, Tpyn nd Lbsn), which will use the existing flood.retention ponds s secondry clrifiers during the dry seson. Treted effluent will be dischrged to Lgun de By. o Riverbnks Sewerge System includes the construction of three STPs (Poblcion, Cpitolyo, nd Ily). The Cpitolyo nd Ily STPs will be underground, nd the Poblcion STP on pltform bove flood retention pond. Treted effluent will be dischrged to the Psig River. o Quezon City-Mrikin Sewerge System includes n underground STP long the Mrikin River. The service re includes residentil brngys nd subdivisions in Quezon City nd two low-income sub-divisions in Mrikin City. Treted effluent will be dischrged to the Mrihn River. o Quezon City Snittion Upgrding includes the modifiction of two communl septic tnks in Quezon City to modern STPs. Rehbilittion of existing seprte sewerge nd extension of service res of existing STPs re lso included. The treted effluent will be dischrged to locl dringe cnls. o Snittion for Low-income Communities includes the construction of two STPs serving Pingsm, Tguig nd Est Bnk, Tyty long the Mngghn Floodwy. The plnts will serve low-income communities with poor or nonexistent snittion fcilities. Treted effluent will be dischrged to the Pingsm Creek nd the Mngghn Floodwy. Component 2: Septge Mngement (JP 2,456 million). This component will involve the provision of vehicles for pumping-out septge from septic tnks (fecl tnkers), nd the construction of septge tretment plnts. The component will benefit popultion of bout 2. million nd includes the following: o Provision of () bout seventy fecl tnkers from 5 to 1 m cpcities provided with vcuum pumping; nd (b) specilized equipment for trnsport nd ppliction of dewtered septge on soil.

Component : Instittctionl Strengthening (JP 199 million). This component would enhnce the proposed project investments through () crrying out of public informtion cmpign on the environmentl benefits of sewge nd snittion services nd the best prctices of proper disposl of sewge; nd (b) ssisting in preprtion of follow-up progrms for sewge nd snittion improvements. 2.2 PROJECT LOCATION AND PHSICAL SETTING The MTSP covers the Est Concession zone of Metro Mnil, primrily the seven cities of Mndluyong, Mkti (Prt), Quezon (Prt), Psig, Sn Jun, Mrikin nd Tguig. The popultion within the MWCI concession re is predicted to increse from 5. million in 24 to.2 million in 221. There re no indictions tht the popultion growth will subside even fter this period of sustined growth. Lnd uses vry in res where project components re to be situted. Fcilities for the Riverbnks Sewerge Systems, the Quezon City-Mrilun Sewerge System, the Quezon City Snittion Upgrding nd the Snittion of Low Income Communities will be locted in low-income residentil res. The South (Tguig) Septge Tretment Fcility will be locted within the wste tretment re in controlled industril zone, while the North (Sn Mteo) Septge Tretment Fcility will be locted in predominntly rurl town where wide re is still used for griculture. The Tguig Sewerge System subcomponent will be locted in predominntly griculturl nd shorelnd re. The Lhr disposl sites situted north of Metro Mnil re sugrcne frms nd idle griculturl lnd. The project region lies on the southern portion of the Luzon Centrl Plin. The regionl lndscpe exhibits contrsting relief from the gently sloping to rugged terrin of the uplnds to centrl vlley plin. The vlley is drined by the Mrikin River, which flows southwrds to join the Psig River. The Psig River System is complex network of wterwys, which includes Mrikin, Sn Jun, vrious esteros nd cnls. The Psig River empties into Mnil By nd drins the Lgun Lke. Recent sttistics show tht domestic wstewter is the min contributor (7%) to the pollution loding into the Psig nd Mrilun Rivers, nd the Lgun Lke. There is insufficient oxygen within the wterwys to support qutic life. Fecl coliform levels exceed the stndrds of the Deprtment of Environment nd Nturl Resources (DENR) by severl orders of mgnitude most of the yer. In terms of helth impct, the 2 Philippine Environment Monitor sttes tht 1% of ll illness in 2 is wter relted which ccounts for nerly 5 million of the reported illnesses. Moreover, it is estimted 4

ENVIRONMENTAL IMPACT ASSESSMENT (EIA) An Environmentl Impct Sttement (EIS)' prepred by MWCI determines the potentil impcts tht my rise from the MTSP implementtion nd presents corresponding Environmentl Mngement Progrm (EMP) for the project. Bsed on the EIS, the MWCI obtined n Environmentl Complince Certificte (ECC) from the DENR tht describes the mitigting mesures nd institutionl nd monitoring rrngements to be pplied during the implementtion nd opertion of the project. This is in ccordnce with the Philippine environmentl ssessment legl frmework, which requires development projects to ddress environment nd socil sfegurds issues, nd is comptible with the World Bnk sfegurds nd disclosure policies. Bsed on the results of the EIS, the project will bring overll positive improvement to the region's overll environmentl qulity. Adverse environmentl impcts re minor, minly relted to the construction of fcilities. Risks re linked to the disposl of collected septge nd sludge. All impcts nd risks, nd their corresponding mitigting mesures, hve been integrted into the EMP. Disposl of septge nd sludge in Lhr res hs been pilot-tested for over yer nd hs produced cler benefits. No dverse impcts hve been noted becuse of the strict use of selection criteri for disposl sites, bd implementtion of procedures for Lhr ppliction. Considering the lck of long-term experience with sludge or septge disposl in the Lhr res in the Philippines, n extensive monitoring progrm hs been defined in the EMP. The Lnd Bnk of the Philippines (LBP) will hve the oversight responsibility of ensuring the complince of MWCI with the ECC nd EMP. Dy-to-dy implementtion nd monitoring will be crried out by the MWCI. Both gencies hve sufficient cpcity to implement nd monitor the sfegurd frmework nd hve dedicted stff responsible for complince with the environmentl nd socil sfegurd frmework.. The following is list of Environmentl nd Socil Sfegurds documents prepred by MWCI, which were submitted for disclosure to the World Bnk Infoshop nd for informtion of the vrious locl government units in the Est Concession Are lst Februry 11,25: Environmentl Impct The EIS provides n extensive overview of bseline conditions nd ssessment of impcts, nd includes n EMP which detils mesures to mitigte nd monitor the project. The EIS includes detiled Annex on the consulttions conducted with ll stkeholders for ll project components nd sites. Regionl Environmentl Assessment (REA). The MWSS nd MWCI prepred REA to strengthen overll wstewter mngement in the Metro Mnil re s described bove. The REA forms principl bckground document for the preprtion of GEF funded Mnil By Costl Mngement Strtegy, ddressing regionl pollution reduction in the Metro Mnil re. The project is joint inititive by principl Governmentl gencies (Le. DENR, MWSS/ MWSU MWCI, LLDA, LBP, nd PPRC). %A for Sludge/Septge-use s soil conditioner for Sugr Cne growth in Lhr-lden res (referred to s Lhr study) (2 Volumes). The specil study ws lunched prtly s reply to experiences in the Mnil Second Sewerge Project (MSSP). The findings nd recommendtions of the report hve been incorported into the EIS nd EMP for the MTSP. Bioslids Mngement Strtegy prepred by MWCI to ssess the quntity nd qulity of ll biosolids to be generted from MWCI s current nd future tretment plnts, including the plnts proposed under MTSP. The report detils mngement strtegies to del with the biosolids genertion from short-term to long-term. Environmentl nd Socil Assessment Frmework (ESAF). The ESAF describes the sfegurd policies nd procedures (environment ssessment, resettlement, lnd cquisition) to be pplied for future complince work for ll possible dditionl project ctivities. 2.4 ASSESSMENT OF ALTERNATIVES The strtegy to ddress snittion nd sewerge in the Est Zone of Metro Mnil ws generlly defined in 2 mster pln designed to meet the originl sewerge trgets in the 1997 MWSS-MWCI Concession Agreement. The mster pln envisged centrlized sewerge system nd the phsing out of the use of septic tnks. However, mjor difficulties in implementing the mster pln included the low willingness-to-py of the public for sewerge services, lck of vilble lnd for the proposed tretment fcilities, nd low tolernce by the public nd locl governments to the immense rod disruption tht would be required to implement such scheme. In 2, new sewerge nd snittion trgets were greed between MWSS nd MWCI s prt of the first rte rebsing period. The trgets were bsed on decentrlized sewerge strtegy which involves the construction of smll sewge tretment plnts in certin res in the concession, nd the shift in focus to the regulr mintennce of existing septic tnks. Hence, sewerge trgets were downscled while snittion trgets were substntilly incresed. 6

8 MTSP Environmentl Assessment - Executive Summry Mv While the 2 trgets re not idel from the perspective of environmentl improvement, there is merit, t lest in the initil stges, of implementing projects throughout the city to rise wreness nd build constituency for the sector. In the second rte rebsing period in 2, new sewerge nd snittion trgets my be estblished to closely lign the concession trgets with environmentl gols. An updted sewerge mster pln prepred in 24 cn be used s bsis for the setting of new sewerge trgets. The new mster pln focuses on combined sewge-dringe tretment systems. The components of the MTSP were identified by MWCI in considertion of environmentl nd socio-economic impcts, technicl constrints, nd limits set by the Concession Agreement between MWSS nd MWCI. Upon identifiction of the individul project sites by MWCI in coordintion with the MWSS, Fesibility Study (FS) ws conducted to determine the vibility nd to optimize efficiency of the MTSP components in terms of costs, coverge nd beneficil impcts. Conceptuliztion of the MTSP took into ccount the limittions nd lessons lerned from implementing pst projects on sewerge nd snittion tht re listed below: Lnd vilbility: Recognizing lnd s mjor limittion in project implementtion, MWCI closely investigted lnd vilbility in the res where the MWSS set sewerge trgets. The elected representtives of the LGUs, s dministrtors of cities nd municiplities, plyed lrge role in identifying possible sites for sewerge fcilities. Possible use of existent nd future flood retention ponds s secondry sewge tretment fcilities were lso explored, including projects under government gencies such s the Ntionl Housing Authority, the Deprtment of Public Works nd Highwys, the LLDA nd the PRRC. Applicble concepts: The previous mster plns pointed to the use of combined sewerge systems s the mens to expnd sewer coverge t the lest cost nd minimum disruption. This ws hevily considered in conceptulizing the MTSP. Also, progrms to ddress the snittion requirements of low-income groups, nd the portion of the popultion tht hs no ccess to bsic snittion fcilities, were explored. Socil cceptbility: Projects tht re techniclly nd finncilly fesible do not get implemented if they re socilly uncceptble. Hence, socil indictors will be obtined prior to implementtion of projects conceived for MTSP. Helth nd Environmentl Impcts: The MTSP ws initilly formulted to rrest direct dischrges of untreted wstewter to wter bodies. Hence, n immedite response ws the survey of dringe outflls to the Psig nd Mrihn Rivers. However, the results of survey conducted in lte 2 on some MTSP project res, show tht designing the components should 7

Finncil nd Economic considertions: MTSP-ffected communities re in the low- to middle-income brckets. The impct of the sewer chrges tht the sewered communities will py once the STPs operte ws considered in finlizing the list of project components especilly for the Snittion for Low- Income Communities component. The list hs been nrrowed down to two from more thn twenty communities originlly considered due to issues on willingness nd cpcity to py for wter nd sewer chrges. 2.5 REGIONAL WASTEWATER MANAGEMENT STRATEG IN METRO MANILA A Regionl Environmentl Assessment (REA) ws conducted to study the cumultive impcts of development options to complement the trditionl EIA of wstewter mngement in Metro Mnil. The REA focused on wstewter mngement, sludge nd septge mngement nd regionl plnning integrtion. The REA supports the decentrlized MTSP pproch, considering the existing constrints (e.g. concession greements, lnd vilbility nd socil cceptbility). The REA findings lso show tht the existing wstewter, environment, nd helth mngement legisltion is too complex, overlpping nd uncler, not just in terms of bsic lws, but lso in terms of the devolution sttus. A number of obligtions hve been devolved from one gency to nother nd eventully to the LGU in some cses, but without cler mndte or opertionl guidelines. For exmple, provisions in the Snittion Code relting to wstewter mngement, in prticulr the provision on mndtory sewer connections, hve been devolved from the Deprtment of Helth (DOH) to the LGUs, without cler guidnce on penlties. As such, the lterntive to noncomplince with this provision is lengthy legl process. Provisions of the Locl Government Code hve resulted to the devolution of the responsibility for providing wstewter services. However, locl wter districts re lso empowered to provide such services. The Clen Wter Act pssed in 24, ims to strengthen government s role in wstewter mngement, but fils to ddress the existing institutionl gps. As result, the government s cpcity nd institutionl frmework to mnge nd improve snittion nd sewerge in the region is very wek. This is ggrvted by the lck of public wreness on helth nd socio-economic impcts of poor sewge, nd sludge mngement. The REA recommends mong others Regionl Mngement System imed to strengthen the institutionl nd mngement cpbility of the government nd its concessionires in implementing the snittion nd sewerge strtegy for Metro Mnil.

The re will be the direct beneficiries of the snittion improvement s well s the recipients of effluents, disturbnce of hbitt, genertion of dusts, etc. The Secondry impct res refer to the MWCI concession re of the Ntionl Cpitl Region consisting of prts of Quezon City nd Mkti City, Psig City, Mrikin City, Tguig, Mndluyong, Sn Jun nd Pteros plus the municiplities of Tyty, Cint, nd Sn Mteo in the Province of Rizl. Specific environmentl impcts re ssessed nd evluted using the impct mtrix shown below in Tble 1: Tble 1. Bsed on the FS, EIS, nd REA, the MTSP will bring overll positive environmentl impcts which include contribution in the reduction of domestic pollution of surfce wters. The EMF is comprised of: Environmentl Mitigtion Pln (Section 4.2), Environmentl Monitoring Pln (Section 4.), nd Orgniztionl nd Institutionl rrngements (Section 4.4). It complies with the environmentl nd socil sfegurd requirements nd procedures of the Philippines, s described by the DENR Administrtive Order No. 2- (DAO 2-), nd with relevnt World Bnk Sfegurds Policies. The EMP covers the pre-construction, construction, nd opertiodmintennce phse. Emphsis hs been given to sludge nd septge mngement. A detiled EMP ws prepred for the use of septgehludge s soil conditioner in Lhr res, which incorportes the guidelines of the US EPA for septge lnd ppliction. 12

Criticl impcts nd risks: A number of criticl issues nd risks relted to the implementtion of the MTSP hve been identified. Appliction hs been piloted in the re for over 12 months using 12 tons/h of sludge, which hs incresed production of sugrcne by 2 %. No dverse impcts hve been noted nd re foreseen becuse of the strict use of proper selection criteri for disposl sites s well s strict lnd ppliction procedures (bsed on US-EPA stndrds). However, considering the lck of long-term experience with sludge/septge disposl in the Lhr res in the Philippines, n extensive monitoring progrm hs been defined in the EMP. Resettlement. A totl of 14 households will hve to be resettled ( frnilies in Rod 5, Quezon City nd 11 fmilies in Sn Mteo) s result of the project. For these two sites, bbrevited RAPS hve been prepred nd compenstion nd reloction procedures will be pplied s specified in the MTSP Lnd Acquisition, Resettlement nd Rehbilittion Policy Frmework. DPWH project: The MTSP is expected to use four flood retention ponds included in the DPWH Project s secondry sewge tretment fcilities. This DPWH project obtined DENR clernce on June 1, 199. A due diligence ssessment ws conducted by the Bnk, with respect to the pplied socil nd environmentl sfegurds stndrds, in prticulr to the lnd cquisition process. The ssessment reveled tht while there re differences in the methodologies nd procedures in deling with lnd cquisition nd resettlement between the DPWH project nd Bnk-ssisted projects, these spects re being covered (vrious types of losses re compensted nd resettlement ssistnce is being provided) to the stisfction of the Bnk. The outcomes for the people who were resettled for the completed prts re comprble to wht they would hve been under Bnk policies. There re outstnding nd unresolved clims regrding lnd titling, but systems re in-plce to ddress grievnces. Also, there is strong support from the concerned LGUs to ssist displced persons in seeking redress to their concerns regrding the relignment of the dike, nd commitment on the prt of DPWH to ensure tht the new resettlements re dequtely ddressed in the project. 15

17 4. ENVIRONMENTAL MONITORING PLAN The Environmentl Monitoring Pln (EMoP) detils the environmentl monitoring to be done for the MTSP Project Components (Tble 6). An integrl prt of environmentl protection is the continuous monitoring of the conditions of the receiving environment to determine if ny undesirble chnges re occurring s result of the project. Since the effects on living receptors re received minly through surfce wter, ir, nd surrounding soil, environmentl monitoring principlly requires quntittive mesurements of the mount of pollutnts present in these environmentl medi. 4.4 ORGANIZATIONAL AND INSTITUTIONAL ARRANGEMENTS Implementtion rrngements: MWCI hs obtined from the DENR n Environmentl Complince Certificte (ECC) for the Project in April 25. The MWCI is primrily responsible for securing proper implementtion of the ECC, EMP nd RAPS. All reports to be submitted to the DENR relted to MTSP shll be prepred nd directly forwrded by MWCI to DENR, copy furnished to LBP. MWCI nd fcilittors responsible for the supervision will provide supervision reports for the identified indictors for monitoring s required by regultory bodies. Additionlly, the proponents will provide supervision for projects with mjor environmentl nd socil issues or for those projects where unnticipted issues my rise. MWCULBP will provide project-ffected groups nd the generl public with mens of filing complints on environmentl issues (including noise nd other nuisnce effects). The project proponent should respond to the complint nd provide records of complints nd responses to the fund mnger s prt of the supervision reports. The LBP, s the borrower of the lon from the World Bnk, shll be responsible for ensuring the completeness nd ccurcy of ll MTSP environmentl reports. The LBP, through its environmentllsocil unit will perform n oversight function to ensure tht environmentl lon covennts re complied with, nd tht the EMP is properly incorported into the contrcts used by the MWCI to implement the project. 19 MTSP Environmentl Assessment - Executive Summry My 76, The EIS process, which requires extensive consulttions, is strted with scoping meetings with the EMB-NCR, EMB, EIA Review Committee (EIARC) representtives nd vrious stkeholders from both the locl nd ntionl levels. Meetings were held nd scoping workshops were conducted to elicit issues nd concerns from the stkeholders including Non-Government Orgniztions (NGOs) nd Locl Government Units (LGUs). Subsequently, surveys nd interviews, public consulttions for concerned brngys nd communities, nd focus group discussions with locl government officils (Brngy nd municipl level) were conducted in ll project sites. The findings, issues nd concerns were included in the scope of the EIS. In ddition to these EA-relted consulttions, series of project presenttions/ discussions were held with the city/municipl councils of concerned LGUdgencies by MWCI with the objective of firming up the usufruct greements for the vrious sites for the riverbnks WWTPs, snittion for low-income communities nd upgrde of existing snittion fcilities. These consulttions with the LGUs will continue until the greements hve been finlized nd become executory. Consulttions with the 14 ffected households hve been initited s prt of the RAP preprtion nd will continue until the RAP hs been fully implemented nd evluted. Disclosure: All environmentl documents prepred by MWCI were publicly disclosed on Februry 11, 25 t the InfoShop in Wshington nd in the Knowledge for Development Center (KDC) of the World Bnk Philippine Office. At tht time two sets of reports were lso sent to every City in the Concession zone Metro Mnil nd concerned municiplities in the Lhr res with request to mke one set vilble to the public in the public librry, with notices posted in prominent plces. These documents hve likewise been submitted to nd reviewed by the Regionl Sfegurds Committee for review. The documents were posted in LBP nd MWCI public librry nd dvertisements in the newspper were posted on Februry 16, 25, informing the vilbility of the documents for public consulttion.
