2 COMOX VALLEY REGIONAL DISTRICT BYLAW NO. 397 A bylaw to amend the Comox Strathcona waste management (CSWM) fees and charges bylaw to reflect operation requirements f the wood waste and drywall / gypsum programs WHEREAS the Comox Valley Regional District adopted Bylaw No. 170 being the Solid Waste Fees and Charges Bylaw No. 170, 2011 on November 3, 2011; AND WHEREAS the board desires to update the bylaw to reflect operational requirements f the wood waste and drywall/gypsum programs; NOW THEREFORE the board of the Comox Valley Regional District in open meeting assembled enacts as follows: Amendment 1. Bylaw No. 170 being Solid Waste Fees and Charges Bylaw No. 170, 2011 is hereby amended by (a) Replacing the definition in section 1 f clean fill, which reads: Clean fill means soil turf suitable f immediate use as landfill cover requiring no remediation other processing. Quantities greater than 2000kg must have pri approval and be accompanied by suppting analytical data; with the following new definition f clean fill: Clean fill means, uncontaminated material such as soil, rock, sand, gravel, concrete, asphalt, cinder/building blocks, brick, sawdust mulch/ground wood waste. All material must be 30 cm less in diameter and free from any metal, rebar, mesh and oil fuel contamination. Quantities greater than 2000kg must have pri approval and be accompanied by suppting analytical data; (b) Deleting the definition in section 1 f clean wood waste, which reads: Clean wood waste means raw wood waste from construction and/ demolition activities that is separated from other construction and demolition waste and includes pallets and other dimensional lumber, none of which is painted, stained, contains glue has large metal and/ plastic fasteners; (c) Deleting the definition in section 1 f coated wood waste, which reads: Coated wood waste means any wood waste that is painted, stained, laminated, engineered, coated, pressure treated, composite, veneer, fibre/particle board and plywood wood that contains glue, large metal and/ plastic fasteners; (d) Deleting the definition in section 1 f commercial recycling, which reads: Commercial recycling means a person whose business includes the collection receiving of recyclable material f its customers f disposal at the waste management centres recycling areas; (e) Inserting a new definition in section 1 f commercial cardboard as follows: Commercial cardboard means clean crugated cardboard waste from commercial, institutional industrial sources. Cardboard is to be free of contamination, which would render it unrecyclable; (f) Replacing the definition in section 1 f construction and demolition debris, which reads: Construction and demolition debris means waste produced f the construction, renovation and demolition of buildings, and other structures, but does not include

3 Bylaw No. 397 being Solid Waste Fees and Charges Bylaw No. 170, 2011, Amendment No. 9 Page 2 of 6 (g) (h) (i) (j) waste containing contaminated with asbestos, creosote, PCB treatments any special waste (loads containing demolition deconstruction material must be free from asbestos and be accompanied by suppting documentation); with the following definition f construction and demolition debris: Construction and demolition debris means mixed waste loads produced as a result of the construction, renovation and demolition of buildings, and other structures, and includes wood waste and gypsum coated with material that renders it unsuitable f recycling, but does not include waste containing/contaminated with asbestos, creosote, PCB treatments, loads mixed with recyclables any special waste. Loads containing demolition deconstruction material must be free from asbestos and be accompanied by suppting documentation; Replacing the definition in section 1 f controlled waste, which reads: Controlled waste means solid waste requiring special handling at the waste management centre, and includes but is not limited to: i. Creosote pilings timbers. ii. Large dead animals; iii. Animals that have been euthanized; and iv. Steel cables; with the following definition f controlled waste: Controlled waste means solid waste requiring special handling at the waste management centre, and includes but is not limited to: i. Creosote pilings timbers. ii. Large dead animals; iii. Animals that have been euthanized; iv. Steel cables; v. Emergency and disaster debris; and vi. Low density/bulky waste including Styrofoam floats, fish coolers and similar items that are of significant bulk but of low density; Inserting a new definition in section 1 f divertible wood waste as follows: Divertible wood waste means any wood waste product that is capable from being diverted from the landfill, and includes but is not limited to: wood waste that is painted stained, pallets, fiber/particle board, iented strand board and plywood, raw dimension lumber and scraps cut-offs; Replacing the definition in section 1 f gypsum, which reads: Gypsum means off-cuts scraps from new construction and pre-1990 gypsum board drywall that has been painted is coated with wall paper, but does not include gypsum drywall coated with material that renders it unsuitable as a recyclable material; with the following definition f divertible gypsum: Divertible gypsum means off-cuts scraps from new construction and post gypsum board drywall that has been painted is coated with wall paper, but does not include gypsum drywall coated with material that renders it unsuitable as a recyclable material. Advance approval and suppting asbestos testing analytical data is required f pre-1990 gypsum; Deleting the definition in section 1 f low density/bulky waste, which reads: Low density/bulky waste means styrofoam floats, fish coolers and similar items that are of significant bulk but of low density;

5 Bylaw No. 397 being Solid Waste Fees and Charges Bylaw No. 170, 2011, Amendment No. 9 Page 4 of 6 Schedule A-7 Effective January 1, 2016 Scale of Charges f Waste Disposal at the Comox Valley and Campbell River Waste Management Centres All solid waste iginating within the boundaries of the Comox Valley and Strathcona Regional Districts will be accepted at the Comox Valley and Campbell River waste management centres at the rates shown below. All prices are per metric tonne and will be pro-rated f a ption thereof and subject to a minimum charge. The charges f depositing solid waste, controlled wastes and recyclable materials at the disposal facility as of January 1, 2016 are: Item Description In-Area Out-of-Area Site access fee Municipal solid waste (MSW) Commercial cardboard Co-mingled food and yard waste Construction and demolition debris Controlled waste advance approval and suppting analytical data required Divertible wood waste Each vehicle entering the landfill to dispose of waste will be charged a site access fee. Loads of MSW containing recyclables loads containing a higher volume of mixed materials, will be charged the higher rate, at the discretion of the attendant.

7 Bylaw No. 397 being Solid Waste Fees and Charges Bylaw No. 170, 2011, Amendment No. 9 Page 6 of 6 Schedule B Prohibited Waste The following gaseous liquids and municipal solid wastes are not acceptable f disposal at a waste management centre and include, but are not limited to: - Asbestos - Biomedical waste; - Crugated cardboard; - Divertible gypsum; - Divertible wood waste; - Drums; - Garden/yard waste; - Commercial and household hazardous waste; - Ignitable wastes; - Liquids; - Metal; - Mot vehicle bodies and farm implements; - Municipal solid waste that is on fire smoldering; - Radioactive waste; - Reactive wastes; - Recyclable paper; - Special waste, as defined in the Special Waste Regulation (British Columbia) including asbestos; - Stewardship materials; - Tires;
