2 History of WMD Stormwater Rule Florida passed the first rule requiring treatment of stormwater from new development. Set performance standard of 80% average annual load reduction of TSS. Delegated to Water Management Districts to enforce in 1980s. Focused more on water quantity.

3 Issues With Current Rules Many permitted systems are not properly maintained. Stormwater ponds only reduce nitrogen by 30%. Sustainability Post Development Water Quality/Quantity <= Pre Development Water Quality/Quantity Waterbodies are continuing to degrade resulting in a loss of designated use.

7 Higher Levels of Stormwater Treatment Why? Nutrient impaired surface waters (TMDLs) Elevated nitrates in springs Harmful algal blooms Continuing high growth rate reduce cumulative effects/promote smart growth

8 Current Regulations In Process Caloosahatchee River FDEP has set a total maximum daily load for the Caloosahatchee River for tidal portion. Basin Management Action Plan (BMAP) currently in process of being developed. EPA and FDEP are currently working on drafting new permits for MS4 permit holders with stricter requirements.

9 Overview of TMDL for Caloosahatchee River TMDL based on nutrient loadings, which was identified as the pollutant source to the river. Loadings to the river are estimated to be: 9,736,039 lb/yr upstream of Franklin Lock 2,063,723 lb/yr downstream of Franklin Lock Only 6.6% of loadings were estimated from AWWTP discharges, remaining is from non-point sources.

10 Overview of TMDL for Caloosahatchee River Total loading estimated by FDEP to be reduced from non-point sources to restore waterbody is: 1,374,568 lb/yr of total nitrogen. Permitted authorities, or stakeholders, shall be responsible for meeting loading reduction. Current Stakeholders for Tidal Caloosahatchee River: Lee County Cape Coral City of Fort Myers East County Water Control District

11 Overview of BMAP Process Local stakeholders are currently in the process of attending meeting to determine how they will obtain loading reduction. Loading reduction may be obtained in the following methods: Capital Improvement Projects Public Education and Outreach Fertilizer Ordinances Land Development Ordinances

12 Projected Impact to Fort Myers The City is responsible for removing 25,757 lb/yr. A total of 20,577 acres, or 45% of the land area contained within the City discharges to the Caloosahatchee River. If the City constructed all the projects in the current Stormwater Master Plan, a reduction of 9,773 lb/yr of total nitrogen would result. 15,984 lb/yr would need to be further reduced.

13 Projected Impact to Fort Myers Cost of implementing all proposed CIP projects: $3,750,000. Cost of TN removal: $383 per pound (Excludes maintenance and some land acquisition costs, which could triple number). TMDL must be met within five years.

14 Regulations of Land Development Land Development and stormwater management regulations set by local government and WMDs. Permitting entities rules do not always coincide. Some local entities allow for LID technology and recognize the reduced impact, current WMDs rules do not provide guidance or standards.

15 Florida Statewide Stormwater Rule Currently all WMD have different rules that complicate permitting when developers are regional. New rule proposes treatment train, as opposed to one BMP to meet load reductions. Better defines pre-construction condition. Recognizes low-impact development. Proposed to be adopted in late 2010.

16 Statewide Stormwater Rule Concepts One storm does not fit all BMP treatment train required Credits for nonstructural BMPs Green roofs Pervious concrete Florida Friendly Landscaping Disconnect Impervious Areas Higher CN for cleared areas (compaction) Compensating treatment (WQ Banking) Retrofit section

17 Anticipated Improvements to SWMS Higher removal of total phosphorus and total nitrogen. Systems will be able to comply with current water quality standards. Allows for greater flexibility in site design and use of modern technology. Incorporates building as part of the system through green roofs.

18 Potential Changes to Local Land Development Codes In the future local governments will be evaluating the benefit of requiring LID to meet TMDLs. Local governments could begin to play a more active role in ensuring compliance of existing SWMS. Stricter requirements for land management could be implemented: xeriscaping, vegetative buffers, irrigation, pesticide and fertilizers.
