Advisory Assistance Programme MSFD Programme of Measures German approach and experience Andrea Weiß Federal Environment Agency FG II 2.3 / Marine Protection Unit This presentation was developed in the context of a project that is financed by the German Federal Ministry for the Environment, Nature Conservation, Building and Nuclear Safety with means of the Advisory Assistance Programme for Environmental Protection and that is supervised by the German Federal Environment Agency (Umweltbundesamt, UBA). The responsibility for the content of this presentation lies with the authors.
Contents 1 RESPONSIBILITIES IN GERMANY 2 STARTING POINT 3 PROGRAMME OF MEASURES 4 ENVIRONMENTAL TARGETS 5 NEW MEASURES 6 ECONOMIC CONSIDERATIONS 7 REGIONAL COOPERATION 8 PROCEDURAL STEPS IN GERMANY 9 MAIN CHALLENGES / Stakeholder Workshop Varna 2
Responsibilities North Sea Baltic Sea Two coasts - two marine regions Joint responsibility < 12 nm: 5 coastal State (Länder) Governments > 12 nm: Federal Government Schleswig- Holstein Bremen Hamburg Lower Saxony Mecklenburg- Vorpommern Lead authority: Federal Ministry of the Environment, supported by - Federal Environment Agency - Federal Nature Conservation Agency / Stakeholder Workshop Varna 3
Starting point MSFD reports Initial assessment - Good Environmental Status (GES) - Environmental targets EU COM assessment (Art. 12 MSFD) - Improve regional cooperation and coherence - Close identified knowledge and information gaps - Improve and quantify GES description - Quantify assessment of impacts of main pressures - Make environmental targets SMART and ambitious - Improve cohesion between North and Baltic Sea / Stakeholder Workshop Varna 4
Programme of Measures Planning instrument between target setting and realisation of measures Contents - Overview of existing measures - Contribution of measures to achieving targets - New measures needed to achieve or maintain GES - Spatial protection measures - Justification for exceptions (Art. 14) - Reporting information (methodologies including on cost-effectiveness and cost-benefit analysis) Procedures for the PoM - Strategic Environmental Assessment - Transboundary effects - Public consultation - Reporting (31 March 2016) - Operationalisation (31 December 2016) - Interim report implementation (2018) Art. 10 Targets Art. 13 Measures Art.1 Art. 9 GES Art. 14 Exception Art. 8 Assessment Art. 11 Monitoring Regional coordination / Stakeholder Workshop Varna 5
Environmental targets Overarching environmental targets Operational targets Example target 1: Indicators Target 1: Seas unaffected by eutrophication Target 2: Seas not polluted by contanimants 1.1 Reduce riverine inputs of nutrients - Nutrient concentrations at the limnic marine transition point of rivers discharging to the North and Baltic Sea Target 3: Seas with marine species and habitats unaffected by impacts of human activities Target 4: Seas with sustainable and environmentally sound use of resources Target 5: Seas without pressures from litter 1.2 Reduce transboundary transport of nutrients 1.3 Reduce atmospheric inputs of nutrients - Import of N and P - Spatial distribution of N and P in sea water - Emissions of N-compounds - Deposition of N-compounds on the sea surface Target 6: Seas not impacted by the introduction of anthropogenic energy Target 7: Seas with natural hydromorphological characteristics Environmental targets 7 overarching environmental targets with 30 operational targets and associated indicators Bridge the gap between the actual state and GES Action-orientated targets for the reduction of pressures and protection of biodiversity Basis for measures / Stakeholder Workshop Varna 6
New measures Pool of new measures Inventory of existing measures Contribution of existing measures to achieving the targets: identify the gap Identify necessary new measures Water Framework Directive considered to cover landbased waterborne nutrient and contaminant pressures not part of MSFD PoM 10 9 New measures Measures which - Category 2a: build on existing Community legislation and international agreements but go beyond what is already required under these (Category 2a) - Category 2b: do not build on existing Community legislation and international agreements (Category 2b) Categroy 2b Category 2a Prioritisation for PoM (31 measures on 1 April 2015) Feasibility (legal, technical, political, temporal, financial) of a measure Potential level of effectiveness of measures to achieve target Coverage of operational targets, main pressures and main pathways Non-prioritised measures remain in the pool for the second cycle T1 Eutrophication T2 Contaminants T3 Biodiversity T4 Resources T5 Marine Litter T6 Energy input T7 Hydromorphology / Stakeholder Workshop Varna 7
New measures Programmatic measures High level of abstraction: specification and allocation in space and time subject to the operationalisation of the programme by end of 2016 Example Proposed measure UZ1-03: Promoting measures to reduce NO x inputs from shipping - Introduction and/or support of refit programmes for ships (e.g. for LNG-/dual-fuel-machines, selective catalytic reduction systems) - Support for the development of landbased and mobile LNG infrastructure in ports - External electricy supply for seagoing ships in ports (e.g. support for the development of landbased power connection or power barges) - Examine possibility to introduce a European NO x fund (example Norway) - Support and further develop existing concepts to link port fees to ship emissions (e.g. by including other emissions into the assessment) Encompass several individual measures, measure combinations and different implementation modes Legal Technical Policy Economic Include parallel or succeeding measures 1) to directly steer human behaviour, 2) to prepare for measures steering human behavious and 3) to promote measures at EU, regional and international level T1 Eutrophication T2 Contaminants T3 Biodiversity T4 Resources T5 Marine Litter T6 Energy input T7 Hydromorphology / Stakeholder Workshop Varna 8
Economic considerations Initial assessment Economic and social analysis of marine uses and costs of degradation of the marine environment Socioeconomic assessment scheme (MSFD) Assessment of new measures Cost-effectiveness analysis (CEA) Impact assessment, including Cost-benefit analysis (CBA) Requirements for assessment Measure is selected Detailed and quantified specification of the measure and its contribution to the target Information and data on effects and their interrelations in the ecosystem Cost-effectiveness analysis Economic and social analysis Impact assessment Data as basis for calculations Cost-benefit analysis / Stakeholder Workshop Varna 9
Regional coordination Coordination of programmes of measures includes Exchange of information and aligbnment of measures that are primarily of national concern and responsibility. This includes coordination of existing and new measures Development of measures at regional level (e.g. HELCOM recommendations) with a focus on transboundary issues) Development of joint proposals for measures that are required to achieve good environmental status but are in the competence of the EU, international authorities (e.g. IMO, river commissions) or third countries outside the EU and RSC cooperation (e.g. upstream countries), and agreement of concerted actions of Contracting Parties to approach those bodies/authorities through HELCOM Joint documentation for reporting (2015) Overview of regional acquis, state of its implementation and ist contribution to achieving GES at regional level Proposal of themes requiring regional action or warranting a coordinated regional approach Medium term planning Explore concrete actions and activities on the cooperation and coordination of environmental targets and measures (good practice: HELCOM cooperation on nutrient reduction schemes (MAI/CART) and regionally agreed actions to reduce the pressure) / Stakeholder Workshop Varna 10
Example: Regional Action Plan on Marine Litter OSPAR 2014 adopted a RAP for the North-East Atlantic HELCOM 2015 adopted a RAP for the Baltic Sea in principle (operational Annex is expected to be adopted in June 2015 ) Actions include Regional actions - they are specified and time bound through an implementation plan and lead country approach List of voluntary national actions Example: Proposed measures in German draft PoM / Stakeholder Workshop Varna 11
Procedural steps in Germany - Strategic Environmental Assessment (SEA) - Consideration of transboundary effects of the PoM - Public consultation (1 April 30 September 2015) - Additional interactions with stakeholders (including civil society) scoping process for the SEA (July/August 2014) dialogue on planned measures (October 2014) Federal and state governments plan individual diologues during summer 2015 Next steps /2015: Finalisation of the draft PoM /2016: Formal government consultations at federal and state level - March 2016: Reporting to EU Commission / 2016: Specification of measures, spatial and temporal allocation of implementing measures - 12/2016: Programme of measures is operational Public consultation: Outline Draft Programme of Measures Part 1: Summary Part 2: PoM and environmental report North Sea Part 3: PoM and environmental report Baltic Sea Attachment 1: Draft fact sheets for proposed new measures Attachment 2: Background document on socioeconomic assessment / Stakeholder Workshop Varna 12
Main challenges Process Complexity of MSFD and administrative processes Number of players and level of action: streamlining Regional coordination Timing of MSFD implementation steps Timing of the procedural steps in developing the PoM Communication of MSFD Contents Foundation for measures: GES and targets are work in progress Coordination with existing policies Cost-effectiveness / cost-benefit analysis Level of abstraction vs specification needs for implementation / Stakeholder Workshop Varna 13
