The purpose of tonight s workshop is to present to your Commission information which may be utilized in preparation of the upcoming General Plan Update. Additionally, this workshop will serve as a forum for the Planning and Natural Resources Department to receive feedback from community residents and other agencies as to potential content for the General Plan Update. The topics for tonight s discussion include an overview of Kern County, including its geographic features, constituent demographics and economy, a summary of new legislative actions that need to be incorporated into the General Plan and a discussion regarding Healthy Communities, what that means and the potential possibilities for incorporating healthy community strategies into our General Plan. KERN 101 In terms of area size, Kern County is the Third (3rd) largest County in California and the twentieth (20th) largest County in the United States, consisting of eight-thousand, twohundred and two (8,202) square miles. The County has eleven (11) incorporated cities within its boundaries and sixty-five (65) unincorporated communities (2010 US Census) with a combined population estimate of 882,176. The overall population is expected to increase to over 1.2 million by (California Department of Finance E-5 estimates). The 2015 Kern County Housing Element and the California Employment Development Department indicate an average median household income of $57,900. Taking into consideration, average monthly salary, average median prices of $167,000 for existing single-family homes, and other economic indicators the Council for Community and Economic Research index shows Kern County and the City of Bakersfield continue to lead the State in cost of living affordability which contributes greatly to County resident s quality of life.

2 January 26, 2017 Page 2 Kern County s diverse industries employ over 350,000 with a projected increase to over 370,000 by Today, Kern County is the number two (2) oil-producing county in the nation, accounting for sixty-six percent (66%) of the State s total gas production and directly or indirectly providing over 45,000 jobs and contributing approximately $1.1 billion in revenue to the state and local government. Kern County consistently ranks among the top five most productive agricultural counties in the United States. In 2014, the gross value of all agricultural commodities produced in Kern County was over $7.5 billion with grapes, almonds, milk, citrus, and cattle accounting for seventy-eight percent (78%) of agriculture s value. Kern County also contributes over 20,000 aerospace jobs. In 2014, Kern County s Gross Domestic Product was a combined $39.9 billion dollars. Attached to this letter as Attachment 1 is an Economic Overview of Kern County, California prepared by KernEDC. (Kern Economic Development Corporation). This report summarizes various economic trends occurring within the County of Kern. Additionally, attached to this letter as Attachment 2 for review by your Commission and the public is a summary various census data related to Kern County that has been compiled by the Planning Department. GENERAL PLAN LEGISLATIVE UPDATES The current Kern County General Plan was originally adopted by the Kern County Board of Supervisors on June 15, Since the time of adoption, the California legislature has enacted several regulations that pertain to the general plan. Many of these actions have already been incorporated into the County s General Plan through various amendments over the years and or through the processing of proposed projects. The general plan is more than the legal underpinning for land use decisions; it is a vision about how a community will grow, reflecting community priorities and values while shaping the future. The Governor s Office of Planning & Research (OPR) was created by statute in 1970 and is part of the Office of the Governor. OPR serves the Governor and their Cabinet as staff for long-range planning and research, and constitutes the comprehensive state planning agency. To assist local governments in preparing general plans and the public in participating in the process, the OPR periodically revises guidelines for the preparation and content of local general plans per Government Code As part of their most recent draft update to the General Plan Guidelines a listing of new state legislative actions has been identified. Below, is a summary of all the more recent legislative actions that pertain to the General Plan along with a statement, shown in italics, indicating how the County is currently complying with the adopted regulation. AB 52 (Gatto, 2014) Tribal Consultation - Specifies that a project with an effect that may cause a substantial adverse change in the significance of a tribal cultural resource, as defined, is a project that may have a significant effect on the environment. Requires a lead agency to begin consultation with a California Native American tribe that is

3 January 26, 2017 Page 3 traditionally and culturally affiliated with the geographic area of the proposed project, if the tribe requested consultation to the lead agency in writing. As part of the case processing management by Planning Staff, any project that requires preparation of an Environmental Document is required to go through an AB 52 consultation process. At this time, two (2) tribes have notified the County of Kern requesting to be on our AB 52 list. Those tribes include the San Manuel Band of Mission Indians and the Twenty-Nine Palms Band of Mission Indians. Staff also received a request from the Torres Martinez Desert Cahuilla Indians, however, the request did not include a notification map as required by AB 52. At this time, Staff is waiting to receive the requested notification map before including the tribe as part of our forma AB 52 consultation process. AB 1505 (Ducheny, 1999) Farmworker Housing - Requires the housing element to identify adequate sites for farmworker housing. Amends Sections 51238, , 65580, 65583, and of, and adds Section to, the Government Code. Adequate sites for farmworker housing have been included within the adopted Housing Element, including the most recent update to the Housing Element, which was adopted by the Kern County Board of Supervisors in April 26, Staff has received written confirmation from the state Housing and Community Development Department that our adopted Housing Element has met the statutory requirements of State housing element law (GC 65585(h). AB 2838 (Hertzberg, 2000) Local Agency Formation Commissions (LAFCO) - Provides that a LAFCO require as a condition to annexation that a city pre-zone the territory to be annexed, and requires that approval of the annexation be consistent with planned and probable use based upon review of the general plan and pre-zoning designations. Also authorizes the LAFCO to review the consistency of a proposal within a city s general plan when a proposed action would require the extension of critical services. Amends and adds several sections of multiple state codes. It is customary for all incorporated cities within Kern County to pre-zone properties within their adopted Sphere of Influence. Given the fact that the underlying property is still under the jurisdiction of the County, these pre-zoned designations are not applicable pertaining to any development until such time as a property is annexed into the incorporated city boundaries. While this provision does not specifically apply to the County, it is the intent of Staff to work with incorporated cities, specifically the City of Bakersfield to ensure some level of consistency regarding development standards to provide consistency to the development community regarding properties that may be annexed in the future. AB 2292 (Dutra, 2002) General Plans: Residential Density - Prohibits a city or county from reducing the residential density for any parcel to a density that is below the density that was utilized by the Department of Housing and Community Development in

4 January 26, 2017 Page 4 determining compliance with housing element law. Adds Section to the Government Code. The existing General Plan is currently in compliance with this provision. Any proposed project that might reduce overall density is required to evaluate how such actions would impact the adopted Housing Element. If a reduction of residential density is approved, specific Findings must be made stating that such action will not impact the County s ability to provide affordable housing and is still consistent with the adopted Housing Element. SB 1468 (Knight, 2002) General Plans: Military Facilities - Requires specified elements (land use, open space, and circulation) to incorporate consideration of military facilities and readiness activities. Also requires that, in counties with a military airport, the county s general plan and any applicable specific plans be consistent with safety and noise standards in the Air Installation Compatible Use Zone prepared for that military airport. Amends Sections , 65302, , 65560, and of, and adds Section to, the Government Code, amends Section of the Public Utilities Code. The adopted General Plan is currently in compliance with this regulation. Staff is proposing this update include a Military Readiness Element. Further discussion regarding Military readiness is scheduled to be discussed on May 25, AB 1108 (Pavley, 2002) Environmental Quality: Scoping Meetings: Military Areas. - Requires a CEQA lead agency to submit notices to the military service if a project includes a general plan amendment and is within specific boundaries of a low-level flight path, military impact zone, or special use airport. Amends Section of, and adds Sections and to, the Public Resources Code. The County is currently in compliance with this provision. As part of the case processing management by Planning Staff, any project that is located within the vicinity of our military installations is submitted to appropriate military staff for review and comment. Further, as part of the Kern County Zoning Ordinance, the County has adopted Figure which further identifies when Military Review is required. This figure is often referred to by Staff as the Red/Yellow/Green map. SB 18 (Burton, 2004) Traditional Tribal Cultural Places - Requires agencies to consult with California Native American tribes, and provide opportunities for involvement to tribes, during the preparation or amendment of the general plan. Amends Section of the Civil Code, amends Sections , 65092, 65351, 65352, and of, adds Sections , , and to the Government Code. As part of the case processing management by Planning Staff, any project that proposes an amendment to the General Plan is required to go through an SB 18 consultation process. This process includes coordination with the Native American

5 January 26, 2017 Page 5 Heritage Commission (NAHC) to obtain a listing of tribal contacts and certified mailings to such tribes asking whether or not consultation is requested for the proposed project. Tribes have 90 days to request consultation and not project requesting a General Plan Amendment can be approved until such time as the 90 notification period has expired or a shorter time agreed to by the tribes. AB 3065 (Kehoe, 2004) General Plan: Safety Element See also SB 1241 (Kehoe, 2012) - Revises safety element requirements for state responsibility areas and very high fire hazard severity zones. Also requires that the safety element be submitted to the State Board of Forestry and Fire Protection and to local agencies that provide fire protection to territory in the city or county. Amends Section of, and repeals and adds Section of, the Government Code, and repeals Section of the Public Resources Code. County Staff utilize existing fire hazard maps obtained from the Kern County Fire Department as part of our case processing review and analysis. As part of this update, it is Staff s intent to consult with CalFire and Fire Department Staff and incorporate any updated fire hazard zones and or policies within the General Plan Update. The Safety Element is scheduled to be discussed on June 22, SB 926 (Knight, 2004) Economic Development Makes several changes to planning and general plan law, including changes to procedure for military consultation and requires consultation with WOC and OES prior to preparation of safety element. Amends and adds several sections of multiple state codes. The County is currently in compliance with this provision. As part of the case processing management by Planning Staff, any project that is located within the vicinity of our military installations is submitted to appropriate military staff for review and comment. The Military Readiness Element is scheduled to be discussed on May 25, SB 1462 (Kuehl, 2004) Military Readiness Activities: Special Use Airspace - Requires the planning agency, during preparations to adopt or substantially amend a general plan, to refer the proposed action to branches of the US Armed Forces when the proposed action lies within 1,000 feet of a military installation, within special use airspace, or beneath a low-level flight path. Amends Sections 65352, 65404, 65940, and of the Government Code. The County is currently in compliance with this provision. As part of the case processing management by Planning Staff, any project that is located within the vicinity of our military installations is submitted to appropriate military staff for review and comment. Further, as part of the Kern County Zoning Ordinance, the County has adopted Figure which further identifies when Military Review is required. This figure is often referred to by Staff as the Red/Yellow/Green map. The Military Readiness Element is scheduled to be discussed on May 25, 2017.

6 January 26, 2017 Page 6 AB 1268 (Wiggins, 2004) Land Use - Authorizes the text and diagrams in the land use element that address the location and extent of land uses and the zoning ordinances that implement these provisions to express community intentions regarding urban form and design. Adds Section to the Government Code. The General Plan is currently in compliance. Staff will ensure that any update to the General Plan is structured in such a format that will ensure on-going compliance with this provision. AB 2140 (Hancock, 2006) General Plans: Safety Element - Authorizes a city or county to adopt with its safety element a federally specified local hazard mitigation plan, and limits the state share for projects eligible under the CA Disaster Assistance Act unless a local jurisdiction has adopted a local hazard mitigation plan in accordance with the federal Disaster Mitigation Act as part of its safety element. Adds Sections and to the Government Code. The County of Kern has a locally adopted hazard mitigation plan. As part of this General Plan Update, Staff will review that plan to ensure consistency, The Safety Element is scheduled to be discussed on June 22, AB 1019 (Blakeslee, 2007) Land Use: Annexation: Housing - Authorizes an agreement on a revised determination of regional housing needs if an annexation of unincorporated land to a city occurs after the council of governments, or the department for areas with no council of governments, has made its final allocation. Amends Section of the Government Code. County Staff is aware of such provision and will coordinate with Kern Council of Governments should a situation arise that would warrant a revised determination of regional housing needs due to annexation activities. AB 162 (Wolk, 2007) Land Use: Water Supply - Requires specified elements to address flood hazards and identify areas that may accommodate floodwater for purposes of groundwater recharge and storm water management. Requires safety element to address flood hazards as specified. Amends Sections 65302, , 65352, , and of, and adds Sections and to, the Government Code. As part of the update process, Staff will further evaluate the provision of AB 162 to ensure consistency. AB 1358 (Leno, 2008) Planning: Circulation Element: Transportation - Requires a city or county, upon any substantive revision of the circulation element, to modify the circulation element to plan for a balanced, multimodal transportation network that meets the needs of all users of streets, roads, and highways, in a manner that is suitable to the rural, suburban, or urban context of the general plan. Amends Sections and of the Government Code.

7 January 26, 2017 Page 7 The County is currently in compliance with this provision. All requests to amend the circulation element are reviewed by the County Public Works Department to ensure consistency. Staff will be comprehensively reviewing the transportation network to ensure that the updated Circulation Element is in compliance with AB 1358 SB 375 (Steinberg, 2008) Transportation Planning: Travel Demand Models: Sustainable Communities Strategy: Environmental Review - Requires regional transportation plans to include a sustainable communities strategy. Also makes various changes to timing for review and revision of housing elements. Amends and adds several sections of multiple state codes. The County is currently in compliance. Kern Council of Governments has an adopted Sustainable Communities Strategy. AB 45 (Blakeslee, 2009) Distributed Generation: Small Wind Energy Systems - Authorizes a county to adopt an ordinance that provides for the installation of small wind energy systems outside an urbanized area, and to establish a process for the issuance of conditional use permits for these systems. Adds and repeals Article 2.11 (commencing with Section 65893) of, and repeals the heading of Article 2.11 (commencing with Section ) of, Chapter 4 of Division 1 of Title 7 of the Government Code. The County is in compliance with this provision. The adopted Kern County Zoning Ordinance specifically addresses small wind energy systems, SB 575 (Steinberg, 2009) Local Planning: Housing Element - Requires a local government to review its housing element as frequently as appropriate, but no less often than required by a specified schedule. Amends Sections 65080, 65583, and of the Government Code, and amends Section of the Public Resources Code. The most recent update to the Housing Element was adopted by the Kern County Board of Supervisors in April 26, Staff has received written confirmation from the state Housing and Community Development Department that our adopted Housing Element has met the statutory requirements of State housing element law (GC 65585(h). SB 812 (Ashburn, 2010) Developmental Services: Housing Requires a local government to include needs of individuals with a developmental disability in the housing element s analysis of special housing needs. Amends Section of the Government Code. The most recent update to the Housing Element was adopted by the Kern County Board of Supervisors in April 26, Staff has received written confirmation from the state Housing and Community Development Department that our adopted

8 January 26, 2017 Page 8 Housing Element has met the statutory requirements of State housing element law (GC 65585(h). SB 226 (Simitian, 2011) Environmental Quality - Limits the application of CEQA in the case of the approval of an infill project that satisfies specified standards if an EIR was certified for a planning level decision, including the enactment or amendment of a general plan, community plan, specific plan, or zoning code. Also authorizes the referral of a proposed action to adopt or substantially amend a general plan to a city or county bordering the city or county within which the project is located to be conducted concurrently with the CEQA scoping meeting. Amends Section of the Government Code, and amends Sections and of, and adds Sections , , , and to, the Public Resources Code. County Staff is aware of this provision and utilizes it when the situation warrants. SB 244 (Wolk, 2011) Local government: Land Use: General Plan: Disadvantaged Unincorporated Communities - Requires the land use element to include analysis of the presence of island, fringe, or legacy unincorporated communities. Subsequently amended by SB 1090 (2012). Amends Sections 56375, 56425, and of, and adds Sections , , and to, the Government Code, and adds Section to the Water Code. The most recent update to the Housing Element was adopted by the Kern County Board of Supervisors in April 26, Staff has received written confirmation from the state Housing and Community Development Department that our adopted Housing Element has met the statutory requirements of State housing element law (GC 65585(h). It is Staff s intent as part of this update process to further expand on the analysis within the adopted housing element along with the identification of policies and measures that will help to facilitate the development of infrastructure within these identified disadvantaged unincorporated communities. SB 1090 (Comm. On Governance and Finance, 2012) Local Government: Omnibus Bill -Amends statutory language added by SB 244 (2011). Requires the update of the land use element to be based on specified available data and to include identification of each island or fringe community that is a disadvantaged unincorporated community. Amends and adds several sections of multiple state codes. The most recent update to the Housing Element was adopted by the Kern County Board of Supervisors in April 26, Staff has received written confirmation from the state Housing and Community Development Department that our adopted Housing Element has met the statutory requirements of State housing element law (GC 65585(h). It is Staff s intent as part of this update process to further expand on the analysis within the adopted housing element along with the identification of policies and measures that will help to facilitate the development of infrastructure within these identified disadvantaged unincorporated communities

9 January 26, 2017 Page 9 SB 1241 (Kehoe, 2012) Land Use: General Plan: Safety Element: Fire Hazard Impacts See also AB 3065 (Kehoe, 2004) - Revises safety element requirements for state responsibility areas and very high fire hazard severity zones and requires the safety element to take into account specified considerations, including the most recent version of the Office of Planning and Research s Fire Hazard Planning document. Amends Sections and of, and adds Sections and to, the Government Code, and adds Section to the Public Resources Code. County Staff utilize existing fire hazard maps obtained from the Kern County Fire Department as part of our case processing review and analysis. As part of this update, it is Staff s intent to consult with CalFire and Fire Department Staff and incorporate any updated fire hazard zones and or policies within the General Plan Update. The Safety Element is scheduled to be discussed on June 22, SB 743 (Steinberg, 2013) Environmental Quality Creates a process to change the way that transportation impacts are analyzed under CEQA. Specifically, SB 743 requires the Governor s Office of Planning and Research (OPR) to amend the CEQA Guidelines to provide an alternative to LOS for evaluating transportation impacts. Particularly within areas served by transit, those alternatives criteria must promote the reduction of greenhouse gas emissions, the development of multimodal transportation networks, and a diversity of land uses Planning and Natural Resources Staff is aware of this provision and will coordinate with appropriate Staff to ensure that any CEQA document prepared by the County is in compliance with SB 743. SB 1462 (Comm. On Governance and Finance, 2014) Local Government: Omnibus Bill - Eliminates the requirement that the noise element recognize the guidelines established by the Office of Noise Control. Amends and adds several sections of multiple state codes. As part of the update to the Noise Element, Staff will further review SB 1462 to ensure compliance. The Nosie Element is scheduled to be discussed on June 22, AB 1739 (Dickinson, 2014) Groundwater Management - Requires, prior to the adoption or any substantial amendment of a general plan, the planning agency to review and consider certain specified groundwater plans and refer a proposed action to certain specified groundwater management agencies. Amends and adds several sections of multiple state codes. The County is proposing to include a Water Element as part of our update. The Water Element is scheduled to be discussed on April 28, 2017.

10 January 26, 2017 Page 10 HEALTHY COMMUNITIES What is a Heathy Community? According to the U.S. Department of Health and Human Services Department s Healthy People 2010 Project, a healthy community is one that continuously creates and improves both its physical and social environments, helping people support one another in aspects of daily life and to develop their fullest potential It is the intent of the Planning and Natural Resources Department to include a Healthy Communities Element within the Kern County General Plan. During tonight s workshop, the Kern County Public Health Department will be making a presentation outlining various items for consideration as part of the Healthy Communities Element. JANUARY NEWSLETTER Attached to this Staff Report as Attachment 3 is the January 2017 Newsletter that was distributed prior to tonight s workshop. Staff is seeking feedback regarding the following questions which were included within the newsletter. As of the date of this writing, Staff has not yet received any written responses to these questions. 1. What type of data gathering or analysis do you think should be done by Staff to develop potential healthy community goals and policies for the General Plan Update? 2. What is the best part about living in Kern County? 3. What is the worst part about living in Kern County? 4. What does the term healthy community mean to you? 5. Is your neighborhood a healthy community? If so, why? If not, why not? 6. What amenities do you look for in a community? WAYS TO STAY INFORMED For the General Plan Update process, the Planning Department has created a website: This site contains an interactive timeline for community members to see newsletters, fliers and other documents. On the Community Input page, community members can submit comments and/or concerns regarding specific topics, i.e. Healthy Communities, Land Use and general Outreach. These comments are reviewed daily. The site also contains maps, links to outside sources that correspond to the process. An address can also be added to our list-serve data base so you can receive newsletters and other documents as they are available.

Any questions, concerns, or a wish to be added to the list-serve can be sent directly to that address: GeneralPlanUpdate@co.kern.ca.us DIRECTION REGARDING HEALTHY COMMUNITY Based on the materials presented at tonight s workshop, along with any information between now and February 23, 2017, Staff will be bringing back to your Commission an overview of potential components to be included within the Healthy Communities Element. At this time, Staff is requesting comments from your Commission regarding the following: 1. Are there any other recent legislative updates pertaining to the General Plan that Staff needs to evaluate that were not included in the above list? 2. What type of data gathering or analysis do you think should be done by Staff to develop potential healthy community goals and policies for the General Plan Update? 3. What types of goals, policies or strategies would you like Staff to evaluate for potential inclusion within the Healthy Communities Element? 4. Other Commissioner and public suggestions?
