Twilight # 1 Well and both ponds were constructed in B. Twilight # 2 Well is part of an integrated water supply for a development known as Twilight Peaks Mountain Village Subdivision ( Subdivision ). Diligence on a structure and water right that have been completed and are in use inures to the benefit of other structures and conditional water rights. Only Twilight # 2 Well remains unconstructed. C. At substantial legal and engineering expense, Applicant obtained in Case No. 99CW19 an amendment to the decree that had been obtained in Case No. 93CW27, allowing the augmentation of depletions from residential units in addition to those approved in Case No. 93CW27. D. Approximately 25% of the Subdivision is now constructed. E. Twilight # 1 Well pumps at 50 gpm and the water is applied to beneficial indoor household use within the Subdivision, as permitted by the decree. WHEREFORE, this Court should (a) determine that 50 gpm of the water right decreed to Twilight # 1 Well has become absolute by reason of completion of the appropriation, and (b) determine that reasonable diligence has been demonstrated for all other water rights described in the original decree. Use: Municipal use (including domestic, commercial, industrial and incidental irrigation), irrigation and recreation, including augmentation for all such purposes. Depth (if well): 47 feet. (7) Provide a detailed outline of what has been done toward completion or for completion of the appropriation and application of water to a beneficial use as conditionally decreed, including expenditures: Well D-2 is an integral part of the overall water supply system for the Tamarron Resort. Development of the Tamarron Resort is expected to continue over a number of years, and it is Tamarron s intent to continue to develop and use Well D-2 as a part of its integrated water system for the Tamarron Resort. During the diligence period, Tamarron continued to pursue required land development approvals for additional development of the Tamarron Resort. On February 20, 1996, the Planned Unit Development Master Plan for the Tamarron Resort was extended and approved by La Plata County. On July 19, 1999 a Conceptual Development Plan similar in scope to the previously approved Planned Unit Development Master Plan was approved by La Plata County. The Conceptual Development Plan provides a conceptual illustration for the proposed future development of the Tamarron Resort, including future development of additional commercial and recreational facilities which include a major lodging facility, a golf course, restaurants, shops, and resort service and conference facilities. On September 13, 1999 Tamarron and La Plata County entered into a Development Agreement. The Development Agreement confirms Tamarron s right to develop the Resort property consistent with the Conceptual Development Plan and establishes a vested property right to undertake and complete development and use of the Resort property as provided in the Conceptual Development Plan. The total cost associated with obtaining the 1996 and 1999 County approvals and the 1999 Development Agreement was approximately $15, In addition, during the diligence period, Tamarron has replaced the pump in Well D-2 at a cost of $1, and has upgraded the pumping stations for irrigation of the golf course and increased the capacity for the pump-up capabilities for the domestic water supply system, at an approximate cost of $83, Tamarron has also spent in excess of $70, during the diligence period in legal and engineering fees in connection with various water court cases for the purpose, in part, of preventing injury to the subject conditional water rights. Tamarron s water requirements are met by operation of a single integrated water system pursuant to the plan for augmentation decreed in Case No. W , Water Division No. 7 and subsequent decrees incorporating additional water rights under that plan. The water right for Well D-2 will be used as part of the single integrated water system in order to provide a water supply to applicant s golf course development, which shall proceed in phases over an estimated 10 to 20 year period. Tamarron requests the Court to find that the subject 4

5 water right is part of Tamarron s integrated system and that Tamarron s phased development program shall be considered for purposes of all required future determinations of reasonable diligence for the subject conditional water right. (8) If claim to make absolute water applied to beneficial use: N/A. WHEREFORE, Tamarron requests the Court to enter a decree finding and determining that Tamarron has exercised reasonable diligence in the development of the remaining 170 gpm conditional water right for Well D-2, and continuing the subject conditional water right in full force and effect for an additional 6-year diligence period.
