This addendum forms an integral part of the above referenced Request for Tender. Such addenda may contain important information, including significant changes to the above referenced Request for Tender. In the Form of Tender (Appendix B), bidders should confirm their receipt of all addenda by setting out the number of each addendum in the space provided. Addendum No. 2 Questions and Answers Q1: Please provide the bidders and their pricing of the current contract. A1: 2012-T-31 bids received are as follows: Fay Farms Ltd 663,060.00; Future Waste Systems (Niagara) Inc. 770,046.58; Modern Landfill Inc. 801,404.36; Halton Recycling Ltd. dba Emterra Environmental 999,696.06, excluding taxes. Q2: Is there an agreement between the landfill facility and the STP? What is the treatment capacity of the STP to ensure there is adequate design capacity remaining for the STP? A2: This is not a requirement of this RFT. Q3: Can we get discharges information to natural environment, such as previous sample data to Forty Mile Creek, etc.? A3: This is not a requirement of this RFT.

2 Page 2 of 4 Q4: With regards to groundwater monitoring data, which needs to be reviewed to ensure compliance, how close is it to the established limits? A4: This is not a requirement of this RFT. Q5: What is the source and trucking distance for the cover material and who is responsible for ordering cover material? A5: All cover material required is on site. Refer to Appendix D RFT Particulars, Deliverables and Addenda. Q6: Have there been any public complaints, significant or otherwise? A6: No. Q7: What is the collection design for leachate and who is responsible for managing the system? A7: This is not a requirement of this RFT. Q8: Where is leachate going? Who looks after it and who has responsibility for cost? A8: Niagara Region is responsible for leachate management. Q9: Does the Region consider an escape window as an exit? A9: Niagara Region views an escape window as an exit. Refer to Appendix D RFT Particulars, Deliverables and Addenda. Q10: Is the Compost Operator required to be a full time and separate employee? Or may those somewhat seasonal duties by fulfilled by the two Operators and the Laborer, if properly certified? A10: The Compost Operator is one of the Two (2) equipment operators identified in the Tender and Addenda, Appendix D RFT Particulars, Deliverables, SPECIAL PROVISIONS, 4. Successful Bidder s Staff, a) Permanent full-time employees. Q11: Is the Roll-off Truck Driver(s) expected to be a full time site dedicated employee, or may those duties be subcontracted and/or done by other site staff, such as the two Operators and/or the Laborer, as long as the waste stream is uninterrupted? A11: The roll-off truck driver cannot be any of the full time employees and shall be on site as required to fulfill the Deliverables. Refer to the Tender and Addenda, Appendix D RFT Particulars, Deliverables, SPECIAL PROVISIONS, 4. Successful Bidder s Staff, a) Permanent full-time employees.

3 Page 3 of 4 Q12: Is the compaction test referenced on page 62 of 86 a short term test? Or is this a long term test to determine compaction on the fill since the previous compaction review? In the case that the compaction test did not produce the required level of compaction, who determines this and how is the retest time determined? A12: The compaction test is conducted over a two week period at the discretion of Niagara Region. If the successful bidder fails to achieve the required compaction rate, Events of Defaults and Remedies, as outlined in the Tender and Addenda Appendix D RFT Particulars, Deliverables, will apply. Q13: Would a GPS cab mounted compaction system be an acceptable demonstration? A13: Niagara Region would review this as Alternate Equipment, however Niagara Region would continue to undertake compaction tests as outlined in tender. Bidders are advised to refer to the Appendix D RFT Particulars, Deliverables contained in the Tender and Addenda. Q14: Could the Region of Niagara grant a one week extension on the RFT submission? We believe this will give bidders sufficient time to review the Region s responses, allowing for more fulsome and appropriate proposals from bidders, which will ultimately be for the Region s and its taxpayers benefit. A14: An extension to the Submission Deadline will not be granted. Q15: Who completes groundwater testing? A15: Niagara Region is responsible for this activity. Q16: Will the site accept spray on cover? A16: Niagara Region would review this as Alternate Equipment. Bidders are advised to refer to the Appendix D RFT Particulars, Deliverables contained in the Tender and Addenda. Q17: What does the site do with bagged compost? A17: Bagged compost is provided to residents free of charge. Q18: Who is responsible for product liability? A18: Niagara Region. Q23: Who is responsible for compliance and reporting? A23: Niagara Region.
