1 Lighting Distributor Instant Rebate Program Program Year 2016 (July 1, 2016 June 30, 2017) The Hawaii Public Utilities Commission has contracted with Leidos Engineering, LLC to administer the Hawaii Energy Program. The Hawaii Energy program is the ratepayer-funded conservation and efficiency program serving the islands of Hawaii, Lanai, Maui, Molokai and Oahu. Throughout this application and all appendices any reference to Hawaii Energy shall mean Leidos Engineering, LLC as an administrator to the Hawaii Public Utilities Commission. INSTRUCTIONS: If you would like to participate in the Lighting Distributor Instant Rebate Program, you first must register as a Clean Energy Ally at HawaiiEnergy.com/CleanEnergyAllies. If you would like to become a participant in the Lighting Distributor Instant Rebate Program, please complete this application and submit a signed copy to: Hawaii Energy, 1132 Bishop St., Suite 1800, Honolulu, Hawaii or to: lisa.m.harmon@leidos.com or Keith.T.Block@leidos.com. Upon acceptance, Hawaii Energy will provide written notification that you have been approved as a Hawaii Energy Clean Energy Ally in our Lighting Distributor Instant Rebate Program. 3 APPENDIX A HAWAI I ENERGY LIGHTING DISTRIBUTOR INSTANT RULES PROGRAM YEAR 2016 (July 1, 2016 June 30, 2017) 1. Enrollment as a Hawaii Energy Clean Energy Ally: Lighting distributors interested in participating in Hawaii Energy s commercial Lighting Distributor Instant Rebate Program ( Instant Rebates ) must create a Hawaii Energy account and submit a completed Clean Energy Ally Application online, found here at 2. Lighting Program Subject to Modification: Hawaii Energy reserves the right to modify the Lighting Program and Rules at any time. Hawaii Energy will provide Clean Energy Ally with advance written notice to the extent possible. 3. Technical Requirements, Qualifying Products & Rebate Values: All lamps must meet Hawaii Energy technical requirement of listing either: ENERGY STAR, Lighting Facts, or Design Lights Consortium (DLC). At the discretion of the program, Lighting Design Lab products may be accepted, on a case-by-case basis. Prior to selling lamps listed by Lighting Design Labs, distributor must ask for lamp approval from Hawaii Energy. Reduced wattage 4 ft. lamps must be listed by CEE at All energy-efficient lighting products and incentive amounts that qualify for rebates under the Lighting Program are set forth in Appendix B, Qualifying Products and Incentives. 4. Eligible Participants: Eligible Participants are commercial electric ratepayers on Hawaii, Lanai, Maui, Molokai and/or Oahu as defined by zip code. Incentives will not be paid to participants outside of eligible territory. 5. Rebate Transaction: The rebate transaction must be conducted in such a way as to allow for the collection of information about the participant name, participant address, qualifying product material description, quantity purchased, the rebate amount, the location of the transaction and the purchaser. Mail-in rebate promotions will not be accepted. 6. Reimbursement Process: With the exception of Lighting Design Labs lamps, prior approval on qualified lamps under this program is not required. Distributor is responsible for ensuring the lamps they sell meet Hawaii Energy technical requirements (see note 1). If distributor submits for reimbursement on a lamp not found on one of the qualifying product lists (ENERGY STAR, Lighting Facts, or Design Lights Consortium (DLC), Hawaii Energy shall not provide reimbursement. 7. Sales Forecast: Upon acceptance into the Lighting Program, the Clean Energy Ally must submit a sales forecast to Hawaii Energy based upon product mix and rebate level. The Clean Energy Ally will be required to submit this forecast monthly, along with the previous month s reimbursement request. 8. Rebate Reimbursement: Clean Energy Ally will invoice Hawaii Energy by the 10 th day of each month for all rebates issued during the previous month via the PY16 Hawaii Energy Midstream Rebate Submittal Template. Actual invoices do not need to be submitted with the reimbursement request, but must be kept on file and submitted to Hawaii Energy upon request. Hawaii Energy will reimburse the Clean Energy Ally within thirty (30) days from receipt of the invoice. Submit reimbursement requests to lisa.m.harmon@leidos.com and Keith.T.Block@leidos.com. 9. On-Site Inspections: Projects may be inspected by Hawaii Energy to verify installation of measures no earlier than 30 days after the Billing Date as reported by the Clean Energy Ally. 3

Branding Guidelines for Point-of-Purchase (POP) and Public-Facing Materials: If Clean Energy Ally produces Point-of-Purchase ( POP ) or other public-facing materials referencing or incorporating Hawaii Energy s name and logo, it must conform to Hawaii Energy s Branding Guidelines. Proposals offered by Clean Energy Ally: Clean Energy Ally may submit proposals (i.e., new measures, modified rebate levels, marketing, etc.) to Hawaii Energy for consideration at any time, provided they include specific activities, timeline and cost (i.e., start/end date, milestones, etc.). Hawaii Energy may accept or decline proposals at its sole discretion. 12. Term: The term of participation will start on the date of Hawaii Energy s acceptance of Clean Energy Ally into the Lighting Program and end on the Program Year end-date on the Clean Energy Ally Application. Hawaii Energy in its sole discretion may extend the term to the next program year by providing written notice to the Clean Energy Ally prior to expiration of the term. 13. Termination or Suspension of Clean Energy Ally: Hawaii Energy may terminate or suspend the Clean Energy Ally s participation with the Lighting Program, with or without cause, by providing a fifteen (15)-day advance written notice to the Clean Energy Ally. In that event, Hawaii Energy will process rebate reimbursement requests for thirty (30) days following the date of notice. 14. Clean Energy Ally Withdrawal from the Lighting Program: Clean Energy Ally may withdraw from the Lighting Program, with or without cause, by providing a thirty (30)-day advance written notice. 15. Indemnification: Clean Energy Ally will indemnify, defend and hold harmless Hawaii Energy, the Program Administrator, the State of Hawaii and its directors, officers, employees, contractors and agents (collectively, Indemnified Parties ) from and against claims of any kind or legal suits arising out of or related to the Clean Energy Ally s participation in this program, unless the claims or suits are caused solely by the action or inaction of the Indemnified Parties. 16. Limitation of Liability: In no event shall any party be liable for any special, indirect, incidental, consequential, punitive, or exemplary damages. 17. No Hawaii Energy Warranties: Clean Energy Ally understands and agrees that Hawaii Energy makes no warranties concerning Ally s products and Hawaii Energy is not responsible for damages, injuries and expenses of any kind alleged or incurred by Ally or any third-parties, including but not limited to purchasers and end-users of Ally s products, arising from or related to Clean Energy Ally s product performance, materials and/ or installation, express or implied, including warranties of merchantability or fitness for a particular purpose. Ally shall make no statements, representations or claims to any third-parties inconsistent with the above. 4

6 NOTES: 1) LED Lighting Technical Requirements a) All lamps and fixtures must be listed by ENERGY STAR, Design Lights Consortium (DLC) or Lighting Facts. b) At the discretion of the program, Lighting Design Lab products may be accepted on a case-bycase basis. c) Any products sold in a multi-pack may have an incentive level less than shown above. Contact lisa.m.harmon@leidos.com or keith.t.block@leidos.com for pre-approval and verification of incentive level. 2) Occupancy Sensors a) Must not have a manual On override switch. 3) Fluorescent T8 Lamps with Electronic Ballast a) T8 Fluorescent Lamps: i. Both T8 lamps and electronic ballasts must be installed. ii. Lamp efficacy must be greater than or equal to 82 lumens per watt. iii. 20,000-hour lamp life (3 hours per start). iv. Color Rendering Index: 75 CRI minimum. b) T8 Electronic Ballasts: i. Operate at 20 khz or greater. ii. Rated a Class P thermal protection. iii. Rated a Class A sound level. iv. Have a minimum power factor of 90%. v. Have a maximum of 1.7 crest factor. vi. Have a total harmonic distortion (THD) not to exceed 20% (equal to magnetic ballasts). vii. Comply with FCC Rules and Regulations, Part 18 for both EMI and RFI. viii. Have a reduced lamp flicker maximum of 10%. 4) Fluorescent Reduced Wattage (RW) T8 Lamps with High Performance Electronic Ballast a) LW T8 Fluorescent Lamps: i. Lamps must be qualified under CEE Specifications (see Commercial Lighting Qualifying Product Lists). ii. RW T8 must be a 25 watt or 28 watt T8. iii. Initial lamp efficacy must be equal to or greater than 93 lumens per watt. b) Corresponding LW T8 High Performance Electronic Ballasts must be sold in conjunction with RW T8 lamps. 5) Reflector Kits for De-Lamping Linear Fluorescent T8 Fixtures a) Reflective efficiency of reflector > 90%. 6
