7 Monitoring and Reporting requirements In the event of a discharge of 1,000 gallons or more of waste to surface waters or wetlands, the Permittee must issue a press release to all print and electronic news media that provide general coverage in the county in which the discharge occurred setting out the details of the discharge: Description of the discharge; Time of the discharge; Cause of the discharge; Analysis of the waste. The press release must be issued within fortyeight (48) hours after it is determined that the discharge has reached the surface waters. In the event of a discharge of 15,000 gallons or more of animal waste to surface waters or wetlands, a public notice is required in addition to the press release. The public notice must be placed in a newspaper having general circulation in the county in which the discharge occurred and the county immediately downstream within ten days of discharge.

8 Example Notification of Wastewater Spill in Sampson County House Bill 1160, which the General Assembly enacted in July 1999, requires that municipalities, animal operations, industries and others who operate waste handling systems issue news releases when a waste spill of 1,000 gallons or more reaches surface waters. In accordance with that regulation, the following news release has been prepared and issued to media in the affected county (ies): The John Doe Animal Farm of Springfield had a wastewater spill October 1, 1999 of an estimated 1,000 gallons from a spray field near the intersection of State Road 1445 and Big Curve Road. The untreated wastewater spilled into an unnamed tributary that flows to Big Creek in the Cape Fear River Basin. The Division of Water Quality was notified of the event on October 1, 1999 and is reviewing the matter. For information contact the John Doe Animal Farm at (457)

10 In the Red! Facilities must be designed, constructed and operated to contain all waste plus the runoff from a 25-year, 24hour rainfall event for the location of the facility. Most designed freeboard levels are 19 inches, but some range from 20 to 30 inches. Make sure you know your designed freeboard level and maintain your lagoon accordingly.

11 Not only is this unappealing to the eye but it attracts rodents and flies which are disease carriers.

12 Homemade equipment can often times be effective at improving operation of equipment. This PVC fence is used to prevent trash from collecting around the pump. Thus helping to insure a properly operating waste management system.

13 Lagoon Closure Information Any containment basin, such as a lagoon or a storage pond, used for management shall continue to be subject to the conditions and requirements of this permit until properly closed. When the containment basin is properly closed in accordance with the Natural Resource Conservation Service (NRCS) North Carolina Standard for Closure of Waste Impoundments, March 2002 or any subsequent amendment, the containment basin shall not be subject to the requirements of this permit or the Act. The Permittee must submit a letter to the Division to request inactivation of the NPDES/General permit COC by providing documentation describing the procedures taken to close any containment basin. Closure shall also include pre-notification of the Division and submittal of the Animal Waste Storage Pond and Lagoon Closure Report Form to the Water Quality Section, Non-discharge Compliance and Enforcement Unit within fifteen (15) days of completion of closure.

14 Even though sludge may have been removed to close out a lagoon, use of the remaining hole must still comply with all regulatory requirements.

18 Preventive maintenance can prevent long term problems. Neatly managed pump site. When the line is charged the leaking wastewater is contained in a plastic catch basin.

19 Bad days do happen! What we choose to do about them is what really matters. Please contact your DWQ office immediately and proceed with the clean up phase. Also careful preventive maintenance and daily inspections of operation can help prevent spills and ensure problems are identified in a timely fashion..

20 Excessive Ponding means any area of the application field where visible liquid waste is ponded on the surface of the land application site more than four (4) hours following the application of waste. Excessive ponding also means any area where the ponding of waste has resulted in crop failure.

21 Regional Notification: The permittee shall report by telephone to the appropriate Division Regional Office as soon as possible, but in not case more than twenty-four (24) hours following first knowledge of the occurrence of any of the following events: A. Failure of any component of the animal waste collection, treatment, storage and land application system resulting in a discharge to surface waters or wetlands. B. Any failure of the waste treatment and disposal system that renders the facility incapable of adequately receiving, treating or storing the waste and/or sludge. C. A spill or discharge from a vehicle transporting waste or sludge to the land application field which results in, a discharge to surface waters or wetlands or an event that poses a serious threat to surface waters or wetlands. D. Any deterioration or leak in a lagoon/storage pond that poses an immediate threat to the environment or human safety or health. E. Failure to maintain storage capacity in a lagoon/storage pond greater than or equal to that of a 25-year, 24 hour storm event plus and additional one foot of structural freeboard. F. Over applying waste either in excess of the limits set out in the CAWMP or where runoff enters surface waters or wetlands. G. Any discharge to surface waters or wetlands and/or that poses a serious threat to the environment.
