1 Report #ERM REPORT TO ENVIRONMENTAL SUSTAINABILITY COMMITTEE MEETING OF WEDNESDAY 22 SEPTEMBER 2010 SUBJECT REQUEST BY THE TOWNSHIP OF ESQUIMALT FOR A MODEL BYLAW TO BAN PLASTIC SHOPPING BAGS ISSUE The Township of Esquimalt has sent a letter to the Capital Regional District (CRD) with a request to revisit the issue of plastic shopping bags and to develop a model bylaw banning plastic shopping bags which can be adopted by municipalities (Appendix A). BACKGROUND The issue of banning plastic bags has been discussed several times by the Environmental Sustainability Committee. The last staff report on the topic went to the committee on 27 February Environment Committee members changed the recommendations made by the Solid Waste Advisory Committee (SWAC), including SWAC s request to refer the issue to the Roundtable on the Environment to explore the formulation of a model bylaw similar to the model Pesticide Use Control Bylaw. The full list of recommendations by both committees is presented in Appendix B. All of the recommendations made by the Environment Committee in 2008 have since been implemented. Since the February 2008 meeting, several other initiatives have also taken place: In September 2008, the Canadian Plastics Industry Association announced an industry initiative by four of Canada s leading retail associations to reduce the use of plastic bags by 50% in five years. In July 2009, a major grocery store chain in the region discontinued the use of plastic bags in its stores. In summer 2010, Ministry of Environment staff released information outlining new proposed packaging legislation under the BC Recycling Regulation, expected to start in 2015 that would include extended producer responsibility for plastic bags. Plastic bags were also included in the most recent request for proposals (RFP). ALTERNATIVES That the Environmental Sustainability Committee direct staff to: 1. develop a model bylaw banning plastic shopping bags which can be adopted by municipalities; or 2. continue with education on alternatives to plastic bags. ENVIRONMENTAL IMPLICATIONS The waste stream analysis showed that plastic retail and grocery bags make up 0.79% of the waste disposed at Hartland landfill. Most of these bags are being reused as garbage bags.

2 Environmental Sustainability Committee 22 September 2010 Re: Request by Esquimalt for a Model Bylaw to Ban Plastic Shopping Bags Page 2 SOCIAL IMPLICATIONS Since the decision by a local grocery store chain to discontinue the use of plastic bags, the practice of taking reusable bags to stores seems to have become more prevalent. Many stores in the region will accept plastic bags for recycling as a convenience service for their customers. INTERGOVERNMENTAL IMPLICATIONS Federal: The Canadian Council of Ministers of the Environment (CCME) has made a commitment as part of its Canada Action Plan for Extended Producer Responsibility to include packaging (including plastic bags) as an industry product stewardship program by Provincial: The Ministry of Environment Service Plan includes a commitment to the CCME plan and aims to add packaging to the BC Recycling Regulation. Regional: Regional governments in British Columbia do not have the jurisdiction to ban plastic bags. Municipal: Banning plastic bags at the municipal level has not yet been tested in the Canadian court system. Some municipalities have imposed voluntary restrictions; others have focused on social media efforts to reduce the use of plastic bags. CONCLUSION The CRD has increased the level of education on alternatives to plastic bags. The RFP currently under review regarding recyclables and organics management includes an option for plastic bag collection and processing and will be reviewed later in the year by the Environmental Sustainability Committee. In the meantime, staff will continue to monitor the progress of the Ministry of Environment's proposed addition to the BC Recycling Regulation regarding packaging, which includes plastic bags, and will report progress to the committee on a regular basis. RECOMMENDATION That the CRD continue with education outreach on alternatives to plastic bags, subject to changes resulting from the RFP process and/or BC Recycling Regulation changes. 5 APPENDIX B PLASTIC SHOPPING BAGS COMMITTEE RECOMMENDATIONS Solid Waste Advisory Committee Recommendation At its meeting of 13 December 2007, the Solid Waste Advisory Committee (SWAC) was advised that the CRD does not have the authority to ban the sale of plastic bags. SWAC recommended that the Environment Committee: 1. refer this issue to the Roundtable on the Environment to explore the formulation of a model bylaw similar to the model Pesticide Use Control Bylaw; 2. endorse an increase in education about alternatives to plastic bags; and 3. endorse writing a letter to the minister of environment regarding inclusion of plastic bags in the BC Recycling Regulation. Environment Committee Recommendation At its meeting of 27 February 2008, the Environment Committee received a staff report outlining SWAC's recommendations and adopted a motion that: 1. the Roundtable on the Environment be requested to include plastic bag use as an environmental indicator, and staff be requested to do further research on reducing plastic bag use; 2. an increase in education about alternatives to plastic bags be endorsed in cooperation with industry stakeholders; 3. a letter be written to the minister of environment regarding inclusion of plastic bags and Styrofoam in the BC Recycling Regulation; 4. staff be requested to do further research on the inclusion of plastic bags in the blue box program; and 5. letters be written to the federal and provincial governments asking that the Canadian Council of Ministers of the Environment, National Task Force on Packaging be re-constituted to set new guidelines for the reduction of packaging.
