1 WATER POLLUTION CONTROL DIRECTIVE ASMINISTRATIVE PROCEDURES DECLARATION Objective Official Gazette: Dated and No Legal Basis: Environment Law No and water pollution control directive prepared compatible with the clauses of law which makes additions and changes in the mentioned law Article 1- This declaration is prepared in order to arrange responsibility, permit conditions and relevant administrative elements and applications foreseen in the Environment Law dated 9 August 1983 and no 2872 and Water Pollution Control Directive which is prepared in compatible with the law clauses which have annexes and changes in the mentioned law. Permit Application and Permitting for Direct Wastewater Discharge to Receiving Environments Article 2- Wastewater infrastructure managements and institutions, establishments and enterprises where no sewage system is present and where it is certain that sewage system will not be constructed are permitted within the conditions set by part six of Water Pollution Control Directive. Permit application is done submitting the filled form given in Annex I* to the administration and adding it to a brief. Information regarding the removal and disposal of wastewater sludge to be formed as a result of the wastewater treatment. In case the administration permits the wastewater discharge into the receiving environment, administration prepares the document whose sample is illustrated in Annex II and gives to the applicant. Permit Application and Permitting for Wastewater Discharge through Deep Sea Discharge Article 3- For a deep sea discharge compatible with the maximum wastewater quality standards foreseen in Table 22 according to the 40 th and the 42 nd articles of Water Pollution Control Directive and compatible with the criteria illustrated in Table 23, the application form whose sample is given in Annex III along with a brief is submitted to the administration. In case the administration permits the deep sea, administration prepares the document whose sample is illustrated in Annex IV and gives to the applicant. Toxic and Hazardous Substances in Water Article 4- It is pivotal that all institutions, establishments and enterprises under significant pollutant wastewater resource document that the Toxic and hazardous materials are made harmless appropriately through filling the form in Annex V. Administration investigates the application according to Declaration on Toxic and Hazardous Materials in Water and gives a compatibility document, whose sample is illustrated in Annex VI, relevant to the Toxic and hazardous materials. In such cases, the permit documents could only be given after the administration inspecting the applications in Annex V, along with the compatibility document. Validity of Permit Documents Article 5- The permit documents are valid for three years. Administration could recall the permit if it is detected that the information given in the permit documents is changed and/or misrepresentation is followed on Toxic and hazardous substances during audits, exceptions to the rule are made during their treatment and disposal. Effective Date Article 6- This declaration becomes effective on its issue date. Law Enforcement

2 Article 7- Ministry of Government to whom the General Directorate of Environmental Protection under the Prime Ministry is tied to (*) executes the clauses of this declaration. * In the clause of Establishment and Tasks of Ministry of Environment, Law No. 443 and the Provisional 1 st article of decree is changed as Minister of Environment. Name, type and amount of raw materials, assistance substances which are in Toxic and hazardous substances class according to Toxic and Hazardous Substances in Water Declaration (will be declared according to the numbers in Annex-I of the Toxic and Hazardous Substances in Water Declaration). a. Flow scheme and transformations of these substances in the plant b. Amount in wastewater in case of mixing with the wastewater 7. Units where Toxic and hazardous substances are formed as a result of the production, name, type and amount of these wastes (will be declared according to Annex II and Annex III numbers of the Toxic and Hazardous Substances in Water Declaration). 8. Locations where formed Toxic and hazardous waste are temporarily stored in the facility 9. Precautions taken against Toxic and hazardous substances and wastes a.
