2 Compliance Status of Environmental Clearance Conditions Balda Block Iron Ore Mining Project of M/s Serajuddin and Co. located in village(s) Balda, Bada Kalimati and Nayagarh, Sub-division Champua, District Keonjhar, Orissa. Sl. No i ii iii iv v vi SPECIFIC CONDITIONS Environmental clearance is subject to final order of the Honorable Supreme Court of India in the matter of Goa Foundation Vs. Union of India in writ Petition (Civil) no. 460 of 2004, as may be applicable to this project. Environmental clearance is subject to obtaining clearance under the Wild life (Protection) Act, 1972 from the competent authority. All the conditions stipulated by the State pollution Control Board in their Consent to establish should be effectively implemented. The environmental clearance is subject to grant of forestry clearance. The project proponent shall obtain requisite prior forestry clearance under the Forest (Conservation Act), 1980 for working in the forest area. The mining operations shall be restricted to above ground water table and it should not intersect groundwater table. Prior approval of the Ministry of Environment & Forests and Central Ground Water Authority shall be obtained for mining below water table. The project proponent shall ensure that no natural watercourse and/or water resources shall be obstructed due to any mining operations. PRESENT STATUS The authenticated map showing nonexistence of any ecologically sensitive area such as national park/wild life sanctuary/ biosphere reserve/elephant reserve, etc. within 10Km radius. As such the authenticated map indicating non-existence of any National sanctuaries, Biological reserves, Elephant reserves, etc. within 10Km radius buffer. Besides this site specific wild life conservation plan got submitted at authority for approval. This is under process of approval. The copy of the same is attached as annexure-1 All the conditions stipulated in the consent to establish got implemented. Presently the operations are restricted to DLC (Forest) broken-up forest & nonforest area only and will extend further in FC granted area of Ha. The copy of the same is enclosed as annexure-2. As such mining activity does not intersect ground water of the area as such the ultimate working depth 610 and ground water level is at 520 RL. We ensure that no natural water course will be obstructed due to our Mining Operations. In this regard Guard wall got provided at the Bank of Nalla maintaining the safety zone and site specific surface run off management measures like; de-silting pits, linear recharge structures, etc. are provided. The photo of the same is attached as photo # 1.

3 Sl. No vii viii ix SPECIFIC CONDITIONS The top soil should temporarily be stored at earmarked site only and should not be kept unutilized for a period more than 3 years. The topsoil should be used for land reclamation and plantation. Over burden shall be stacked at earmarked dump site(s) only and should not be kept active for long period. The maximum height of the dump should not exceed 30m having three terraces of 10 m each. The overall slope of the dump shall not exceed 27 degree. The OB dump should be scientifically vegetated with suitable native species to prevent erosion and surface run off. In critical areas, use of geo textiles shall be undertaken for stabilization of the dump. Monitoring and management of rehabilitated areas should continue until vegetation becomes self-sustaining. Compliance status should be submitted to the Ministry of Environment & Forests and its Regional office, Bhubaneswar on six monthly basis. Catch drains and siltation ponds of appropriate size should be constructed to arrest silt and sediment flows from mine working, soil, OB and mineral dumps. The water so collected should be utilized for watering the mine area, roads, green belt development etc. The drain should be regularly desilted particularly after monsoon and maintained properly. Garland drain of appropriate size, gradient and length shall be constructed for mine pit, soil, OB and mineral dumps and sump capacity should be designed keeping 50% safety margin over and above peak sudden rainfall (based on 50 years data) and maximum discharge in the area adjoining the mine site. Sump capacity should also provide adequate retention period to allow proper settling of silt material. Sedimentation pits should be constructed at the corners of the garland drains and PRESENT STATUS The top soil generated during the past, got utilized for plantation. We will follow the same in the future activity also. OB is being stacked inside ML Area and the Dump height is being maintained with terracing & proper slope. It has also developed with garlanding drain and retaining wall along with 11,000 Sq. Meter Coir Geo-textiles towards the vegetation & stabilization for critical areas of dump. Till 2010, plantation of No s saplings of different varieties of native species was carried on the safety zone, OB dump & peripheral area of ML. Proper care and survival of sapling is being carried out during upcoming season. Back-filled area will be reclaimed accordingly by plantation. Monitoring and management of rehabilitated areas will be continued until vegetation becomes self-sustaining. The photo copy of the same is attached as photo # 2 & 3. In this regard KRG RAIN WATER FOUNDATION, CHENNAI got engaged and the report got prepared in consultation with Regional Director, CGWB and Bhubaneswar. Rain Fall DATA got considered; inline to the same. Check dams, Sedimentation pit, Desilting pits and Rain water harvesting structures got implemented. The collected water is being utilized for mines haul road dust suppression, green belt etc. The photo of the same is enclosed as Photo # 4 & annexure # 3.

Dimension of the retaining wall at the toe of the temporary over burden dumps and OB benches within the mine to check run-off and siltation should be based on the rain fall data. Plantation shall be raised in an area of Ha including a green of adequate width by planting the native species around the ML area, OB dumps, roads etc. in consultation with the local DFO / Agriculture Department. The density of the trees should be around 2500 plants per hectare. Regular water sprinkling should be carried out in critical areas prone to air pollution and having high levels of SPM and RPM such as haul road, loading and unloading point and transfer points. It should be ensured that the Ambient Air Quality parameters conform to the norms prescribed by the Central pollution Control board in this regard. The project proponent shall set up at least one air quality monitoring station in the South west direction during monitoring of the AAQ. The project authority should implement suitable conservation measures to augment ground resources in the area in consultation with the Regional Director, Central Ground Water Board. PRESENT STATUS Retaining wall has been constructed at the toe of the dumps with proper dimensions by considering the rain fall data. Photo of the same are enclosed as Photo# 3. 75, 000 no. of plantation has covered across the entire safety-zone, dumps and social plantation with native species as per local forest department. The Photo copy of the same is enclosed as Photo # 5. Regular water sprinkling is being carried out by engaging no. of water tankers on the haulage roads for dust suppressions. Fixed - auto water sprinkling arrangement got provided at mineral dispatch haulage roads. Monitoring of AAQ sample is being continued in the core as well as buffer zone and results are well within the norms. Photo copy of the same is enclosed as Photo# 6. One of the air quality monitoring station in the South west direction got installed, for monitoring of the AAQ. The photo of the same is enclosed as photo # 7. In this regard KRG RAIN WATER FOUNDATION, CHENNAI got engaged and the report has prepared in consultation with Regional Director, CGWB and Bhubaneswar. Check dams, De-silting pits and Rain Water Harvesting Structures got provided.

No xv xvi xvii xviii xix SPECIFIC CONDITIONS Regular monitoring of ground water level and quality should be carried out in around the mine lease by establishing a network existing wells and constructing new piezometers during the mining operation. The monitoring should be carried out four times in a year Pre monsoon (April-May), Monsoon (August), Post monsoon (November) and Winter (January) and the data thus collected may be sent regularly to Ministry of Environment and Forests and its Regional Office, Bhubaneswar, Central Ground Water Authority and Regional Director, Central Ground Water Board. Appropriate mitigate measures should be taken to prevent pollution of the Baitarani river in consultation with the State Pollution Control Board. The project proponent shall obtain prior permission of the competent Authorities for drawl of requisite quantity of water (surface water and ground water) for the project. Suitable rainwater harvesting measures on long term basis shall be planned and implemented in consultation with Regional Director, Central Ground Water Board. Vehicular emissions shall be kept under control and regularly monitored. Measures shall be taken for maintenance of vehicles used in mining operations and in transportation of mineral. The vehicles should be covered with a tarpaulin and shall not be overloaded. PRESENT STATUS Regular monitoring of ground water level and quality is being carried-out by utilizing the piezometers periodically as specified. The data being submitted to authorities regularly. The copy of the same is enclosed as Annexure-4. Site specific mitigation measures to prevent silt carried into nearby natural water bodies got implemented like; surface run off management structures, guard wall, gully plugs, check weirs etc. across the bank of the nalla. The above got developed in consultation with SPCB, Orissa. The photo of the same is enclosed as photo # 1 & 4. For the present quantity of ground water withdrawal is concern, it is very well within the norms for its exemption to get NOC from CGWA as per the approved guidelines of the authority. The guideline is enclosed as annexure # 5. In this regard KRG RAIN WATER FOUNDATION, CHENNAI got engaged and the report has prepared in consultation with Regional Director, CGWB and Bhubaneswar. Check dams, De-silting pits and Rain Water Harvesting Structures got provided. Preventive Measures are taken for maintenance of vehicles used in mining operations and transportation of mineral. The vehicles are covered with a tarpaulin and steps were initiated to ensure that the trucks should not be overloaded. Photo copy of the same is enclosed as

6 Sl. No xx xxi xxii xxiii xxiv SPECIFIC CONDITIONS Blasting operation should be carried out only during daytime. Controlled blasting shall be practiced. The mitigate measures for control of ground vibrations and to arrest fly rocks and boulders should be implemented. Drills shall either be operated with dust extractors or equipped with water injection system. Consent to operate should be obtained from State Pollution Control Board prior to start of enhanced production from the mine. Sewage treatment plant should be installed for the colony. ETP should also be provided for workshop and waste water generated during mining operation. The project proponent shall take all precautionary measures during mining operation for conservation and protection of endangered fauna namely elephant, sloth bear, etc. spotted in the study area. Action plan for conservation of flora and fauna shall be prepared and implemented in consultation with the State Forest and Wildlife Department. The proponent shall contribute towards the cost of implementation of the plan and /or Regional Wild life Management Plan for Conservation of schedule-i fauna reported in the study area prepared by the State Government. The amount so contributed shall be included in the project cost. A Photo # 8. PRESENT STATUS Presently the Controlled blasting is being done by using the Nonel technology. It is being followed in day time only. Ground vibrations are being monitored and the results are well within the norms. Presently we are using the Minimate to record the Vibration and also detailed study was carried from IIT, Kharagpur. As on date No records reveals any figure beyond the permissible Limit. The copy of the same is enclosed as annexure # 6. Latest technology drilling machine with inbuilt dust extraction system is being utilized. Photo copy of the same is enclosed as Photo # 9. Consent to operate has been obtained from the State Pollution Control Board, Orissa. The copy of the same is submitted. Not-applicable, as there is no workshop or colony for the mine operation. Site specific STP got provided for the treatment of domestic effluents. And ETP cum Service centre along with work-shop also provided. Photo copy of the same is enclosed as Photo - 10 The desired amount in this regard got deposited before the authorities. The site-specific wild life conservation plan got submitted for approval. The copy of the same is attached as annexure # 1.

7 Sl. No xxv SPECIFIC CONDITIONS copy of action plan may be submitted to the Ministry and its Regional Office, Bhubaneswar within 3 months. A Final Mine Closure Plan along with details of Corpus Fund should be submitted to the Ministry of Environment & Forests 5 years in advance of final mine closure for approval. Will be followed. 8 S. No GENERAL CONDITIONS PRESENT STATUS 01 No change in mining technology and scope of working should be made without prior approval of the Ministry of Environment & Forest. We abide by the said instruction. 02 No change in the calendar plan including excavation, quantum of mineral iron ore and waste should be made. We abide by the said instruction. 03 Four Ambient Air Quality Monitoring stations should be established in the core zone as well as in the buffer zone for RPM, SPM, SO 2 & NO X monitoring. Location of the stations should be decided based on the metrological data, topographical features and environmentally and ecologically Sensitive targets and frequency of monitoring should be undertaken in consultation with the State Pollution Control Board. Total six no. of AAQ monitoring stations got established covering the core as well as buffer zone and monitoring is being carried frequently for the parameters in consultation with RO-SPCB, Orissa. The map indicating the same is enclosed as annexure Data on ambient air quality (RPM, SPM SO 2 & NO x ) should be regularly submitted to the Ministry including its Regional office located at Bhubaneswar and the State Pollution Control Board / Central pollution Control Board once in six months. Fugitive dust emissions from all the sources should be controlled regularly. Water spraying arrangement on haul roads, loading and unloading and transfer points should be provided and properly maintained. Measures should be taken for control of noise levels below 85 db (A) in the work environment. Workers engaged in operations of HEMM, etc. should be provided with ear plugs / muffs. Data is being submitted to authorities regularly. Copy of the same is enclosed as annexure -9. No. of water tankers along with fixed type water sprinkling arrangements got provided for water spraying in all areas, dry fog system at crushing & Screening Plant are also provided. Photocopy of the same is enclosed as Photo 11 & 12. Workers engaged in Operations are provided with earplugs / muffs. Besides having acoustic enclosures for all machine operating cabins are provided. It is being monitored by Noise Level Meter; the results are well within norms. Copy of the same is enclosed as Annexure-10.

No GENERAL CONDITIONS PRESENT STATUS 07 Industrial waste water (workshop and waste water from the mine) should be properly collected, treated so as to conform to the standards prescribed under GSR 422 (E) dated 19 th May, 1993 and 31 th December, 1993 or as amended from time to time. Oil and grease trap should be installed before discharge of workshop effluents. As such we do not have any township or colony, further no wastewater generates during mining operation, as it is open-cast mining only. Still, we have provided, site specific ETP cum Service centre along with work-shop for treatment of work shop effluents. The photo of the same is enclosed as photo # Personnel working in dusty areas should wear protective respiratory devices and they should also be provided with adequate training and information on safety and health aspects. Occupational health surveillance program of the workers should be undertaken periodically to observe any contractions due to exposure to dust and take corrective measures, if needed. Workers are provided with protective respiratory devices & time to time training on safety & health aspects is being provided. Occupational Health Surveillance Program of the workers is being undertaken periodically (annually once) along with the pre-medical examination of persons employed, who are engaged in the process of mining & are likely exposed to dust to observe any contractions due to exposure to dust and take corrective measures, if needed. This is being carried as per in compliance to Mines Act 1952 & rules 1956 and amendments there to. The above is being carried including all the tests as per FORM P. And medical certificate as per FORM-O is being issued and submitted to respected authorities. The report is already submitted for the year A separate environmental management cell with suitable qualified personnel should be setup under the control of a senior executive, who will report directly to the head of the organization. A separate environmental cell got established under the control of Project head. 10 The funds earmarked for environmental protection measures should be kept in separate account and should not diverted or other purpose. Year wise expenditure should be reported to the Ministry and Regional Office located at Bhubaneswar. The fund earmarked for environmental protection is being utilized for the said purpose only. The year wise expenditure is enclosed as annexure-11.

No GENERAL CONDITIONS PRESENT STATUS 11 The project authorities should inform to the Regional Office located at Bhubaneswar regarding date of financial closures and final approval of the project by the concerned authorized and the date of start of land development work. We will abide by the conditions. 12 The Regional Office of the Ministry located at Bhubaneswar shall monitor compliance of the stipulated conditions. The project authorities should extend full corporation to the officer (S) of the regional office by furnishing the requisite data / information/ monitoring reports. We will extend all our cooperation during any such inspections by the Authority. 13 The project proponent shall submit six monthly report on the status of the implementation of the stipulated environmental safeguards to the ministry of Environment and Forests, its Regional Office, Bhubaneswar, Central pollution Control Board and State pollution Control Board. It is being followed. 14 A copy of clearance latter shall be marked to concerned Panchayat/ Local NGO, if any, from whom suggestions / representations, has been received while processing the proposal. Complied. 15 State Pollution Control Board should display a copy of the clearance letter at the Regional office, District Industry Centre and Collector s office/ Tehsildar s Office for 30 days. Complied from SPCB, Bhubaneswar. 17 The project authorities should advertise at least in two local newspapers widely circulated, one of which shall be in the vernacular language of the locality concerned, within 7 days of the issue of the clearance letter informing that the project has been accorded environmental clearance and a copy of the clearance letter is available with the State Pollution Control Board and also at web site of the Ministry of Environment and Forests at http: / / envfor.nic.in and a copy of the same should be forwarded to the Regional Office of this Complied.

Annexure-1: Consent Order Compliance: COMPLIANCE STATUS REPORT OF THE CONDITIONS STIPULATED UNDER CONSENT ORDER TO OPERATE FOR BALDA BLOCK IRON ORE MINES, OF M/S SERAJUDDIN AND CO., JODA, DIST: KEONJHAR, ORISSA. F - Special Conditions: Sl. No Conditions stipulated in the Consent Conditions. The annual production of ore shall not exceed the consented quantity. Any increase in production beyond the consented quantity shall be in accordance with approved mining plan and with prior environmental clearance. A copy of the annual return (annual return submitted to IBM) shall be submitted every year. The environmental statement report shall be submitted to the Board in proper format every year. A copy of the surface plan of the mine shall also be submitted every year. To control fugitive dust at source wet drilling shall be practiced or suitably designed dust extractor shall be provided for dry drilling. Pre-wetting of blasting site shall be practiced. Blasting shall be alone in such a manner that generation of flay rock is minimum. The haulage roads shall always be in wet condition to prevent generation of dust and for this water sprinkling through tankers shall be done at required intervals. Spillage of material during transportation shall be avoided. Compliances We will abide by the condition. A copy of the annual return (annual return submitted to IBM) is being submitted every year after submission at IBM. The environmental statement report is being submitted to the Board in proper format every year. The copy of the same is enclosed as annexure # 12. A copy of the surface plan of the mine is being submitted every year. Latest technology drilling machine with inbuilt dust extraction system is being utilized to control fugitive dust at source. No. of Water tankers along with auto fixed water sprinkling arrangement are provided on the haulage roads to suppress the dust generation. The photo of the same is attached photo # 6 &12.

12 Regular collection of spillage over material if any from haul roads shall be practiced to prevent the generation of dust due to movement of dumpers/tippers/trucks etc. All haulage roads shall be maintained properly to avoid creation of ruts and potholes. During transportation of ore by covered trucks through public roads, care shall be taken to prevent spillages. Over loading of trucks shall be avoided. Transportation of ore shall be done through covered trucks. Dust suppression on active OB/Waste dumps and mine working benches shall be done by spraying water at frequent intervals. Instant water shower system shall also be provided at the approach roads from quarry face to dump site, ore stack yard and crusher to prevent the generation of dust be air borne. Fixed type water sprinklers shall be provided at ore stockpile areas, loading points and other strategic dust generating areas. Adequate dust extraction or suppression system (dry fog system) and enclosures shall be provided for ore crushing, screening transfer points to control fugitive dust emission from these sources. The emission from the dust extraction system shall not exceed 150 mg/nm 3. The conveyor system shall be a closed one. Adequate measures shall be taken for control of noise levels below the prescribed standards. Care has been taken to prevent spillage. However, in case of occurrence, it is being cleaned regularly. Regular maintenance of haul road is being carried out by engaging the grader periodically. The photo of the same is attached photo # 13. Preventive Measures are taken for maintenance of vehicles used in mining operations and transportation of mineral. The vehicles are covered with tarpaulins and steps were initiated to ensure that the trucks should not be overloaded. The photo copy of the same is attached as photo # 8. We have provided the water tankers and fixed water sprinklers to keep the haulage roads from quarry face to dump site in wet condition to prevent generation of dust. The photo of the same is enclosed as photo # 6 Numbers of mobile water sprinklers have been provided at ore stockpile areas, loading points and other strategic dust generating areas. Dust suppression system (dry fog system) and enclosures have been provided for ore crushing, screening, transfer points to control fugitive dust emission from these sources. The belt conveyor systems hooded with GI sheets. The photo copy of the same is attached as photo # 11. Necessary steps have been taken for control of noise levels. We ensure that, the noise levels are below the prescribed standards as mentioned by having the latest technology HEMM s with acoustic enclosures for operating cabins. Besides having timely preventive maintenance of all the crushers, screen plants and HEMM s. Controlled blasting is being done to minimize noise level. Copy of the same is enclosed as annexure- 10. All the workers engaged in high noise prone areas have been provided with approved type of earplugs.

13 Green belt shall be developed around the mine boundary, townships, both sides of the haul roads, and around the crushing and screening plant areas. The plantation details shall be furnished every year to the Board. Ambient air quality of the mine shall meet the prescribed standards of the Board. Regular monitoring of the ambient air quality of the mine for SPM, RPM, SO 2, NO x & CO shall be done at the appropriate places and data shall be furnished to the State Pollution Control Board once in six months. The permanent monitoring station shall be fixed in consultation with the Regional Officer of the Board. Check dams and sedimentation ponds shall be constructed at strategic points in order to guide all surface run-off water containing sediments for settlement of suspended solids before discharge of water in to land, natural stream / water courses during monsoon after meeting the prescribed standard. The mine drainage water if any shall be adequately treated before disposal to outside environment. The top soil shall be removed separately and stored in separate heaps for future use duly covered with grass and vegetation cover or utilized for restoration of rehabilitation of land. Overburden/waste rock shall be properly stacked in the earmarked areas approved by IBM and shall be suitably terraced and stabilized through vegetative cover or otherwise. Restoration and rehabilitation of the mine shall be done in accordance with approved mine closure plan. A copy of the approved mine closure plan About 75, 000 no. of native species sapling were planted across the dumps, roads and ML area during the previous monsoons and planned for about 30, 000 for coming monsoon. The photo copy of the same is attached as photo # 5. We are enclosing herewith the analysis report for reference Annexure 9. Regular monitoring of the ambient air quality of the mine for SPM, RPM, SO 2 & NO x are being carried out. The data on analysis Report is enclosed as Annexure-9. The permanent monitoring station got fixed in consultation with the Regional Officer of the Board. Copy of details is enclosed as Annexure-8. Check dams and De-silting pits structures got provided, in order to guide all surface run-off water containing sediments for settlement of suspended solids before discharge of water into surrounding body during monsoon, after meeting the prescribed standard. Photo copy of the same got enclosed as Photo # 1 & 4. The mine drainage water (run-off) is adequately treated in sedimentation tank before disposal to outside environment. The top soil generated during the mining, got utilized for plantation & dump slope vegetation. We will follow the same in the future activity also. OB is being stacked inside ML Area and the dump height is being maintained with proper sloping, terracing. It has also developed with garland drain and retaining wall along with application of mixed grass & plantation towards the vegetation of dump. Photo copy of the same got enclosed as Photo # 2 & 3. Restoration and rehabilitation of the mine will be done in accordance with approved mine closure plan.

14 shall be submitted to the Board. To prevent fine particles from the top soil /OB/Waste dumps being washed off during rains, deep garland type trenches all around the dump shall be made to arrest the fine particles. The accumulated water in the garland drains shall be passed through settling pond to allow the silt to be settled before final discharge to surrounding environment. The treated waste water shall meet the prescribed standards. The slope of the OB/Waste dumps shall not exceed 28 0 to avoid erosion. Domestic effluents of the colony shall be treated in suitable and well designed sewage treatment plant or shall be discharged to soak pit via septic tank constructed as BIS specifications. Service centers i.e. auto shops, HEMM shops and other areas, wherein, water pollution due to wash outs of oil and grease and suspended solid are expected, effluent treatment plant shall be provided. The treated effluent shall be reused or shall be discharged to outside after meeting the prescribed standards. Rain water harvesting technique shall be practiced as a measure of conservation of water. Oil contaminated wastes generated from workshop, garages and other areas shall be disposed in a secured landfills specially designed for disposal of hazardous wastes. Ground water shall not be used for mining operations without obtaining prior permission from the concerned authority. Mining shall not intersect ground water of the area. Prior permission from CGWB and MoEF, Government of India shall be obtained for mining below the ground water table. Presently OB is being stacked inside ML Area and the dump height is being maintained with proper sloping, terracing. To prevent fine particles from the OB/Waste dumps being washed off during rains, garland drains around the dump has been made and the silt carrying run-off is being treated at checkdams before discharge to nearby water body. Site specific limited quantity of used Oil and oil contaminated cotton wastes are being collected & stored in leak-proof closed containers on the impervious floor under the shed and later will be disposed to authorized reprocessor/recycler. For the present quantity of ground water withdrawal is concern, it is very well within the norms for its exemption to get NOC from CGWA as per the approved guidelines of the authority. The approved guidelines is enclosed as annexure # 5. As such mining activity does not intersect ground water of the area and we will abide by the condition.

15 Mine shall abide by the environment (protection) Act, 1986 and rules framed there under. The mine shall submit a declaration by 30 th of April every year that all pollution control system are in good condition, operated and ambient air quality as well as waste water quality conforms to the prescribed standards. Failure to comply with any of the conditions mentioned above may result withdrawal of this consent to operate order. We will abide by the Rules. It is being submitted as above. We will abide by the condition. Regarding compliances to the conditions stipulated in Section A, B, C, D & E we will abide by the rules and regulations.
