2 Pollution Incident Response Management Plan Purpose & Scope This Pollution Incident Response Plan (PIRP) has been developed to describe Trinity Point Marina s response to any pollution incident during the construction of the marina. This is a requirement under Part 5.7A of the Protection of the Environment Operations Act 1997 (POEO Act). This PIRMP relates to the Phase 1 construction of the Trinity Point Marina facility. Refer to Environmental Protection Licence (EPL) The objectives of these plans are to: Ensure comprehensive and timely communication about a pollution incident to staff at the premises, the Environment Protection Authority (EPA), other relevant authorities specified in the Act (such as local councils, NSW Ministry of Health, WorkCover NSW, and Fire and Rescue NSW) and people outside the facility who may be affected by the impacts of the pollution incident. Minimise and control the risk of a pollution incident at the facility by requiring identification of risks and the development of planned actions to minimise and manage those risks. Ensure that the plan is properly implemented by trained staff, identifying persons responsible for implementing it, and ensuring that the plan is regularly tested for accuracy, currency and suitability. The plan covers description of potential hazards, actions to be taken to prevent additional environmental harm and details of communication required in the event of an incident. 1. Process In the event of a pollution incident: Step 1: Emergency Response: Ensure personnel are safe. Step 2: Emergency Response: Contain the incident where possible. Step 3: Notify the Emergency Response Controller. Step 4: Emergency Response Controller and Marina Management to complete the notification required in section if the pollution incident meets the definition in section 2. Step 5. Review and retrain The remainder of this document is set out to meet the requirements of the legislation. Definition of Pollution Incident A pollution incident means an incident or set of circumstances during or as a consequence of which there is or is likely to be a leak, spill or other escape or deposit of a substance, as a result of which pollution has occurred, is occurring or is likely to occur. It includes an incident or set of circumstances in which a substance has been placed or disposed of on premises, but it does not include an incident or set of circumstances involving only the emission of any noise. A pollution incident is required to be notified if there is a risk of material harm to the environment, which is defined in section 147 of the POEO Act as: (a) Harm to the environment is material if: (i) it involves actual or potential harm to the health or safety of human beings or to ecosystems that is not trivial, or (ii) it results in actual or potential loss or property damage of an amount, or amounts in aggregate, exceeding $10,000 (or such other amount as is prescribed by the regulations), and (b) Loss includes the reasonable costs and expenses that would be incurred in taking all reasonable and practicable measures to prevent, mitigate or make good harm to the environment. Industry is now required to report pollution incidents immediately to the EPA, NSW Health, Fire and Rescue NSW, WorkCover NSW and the local council. Immediately has its ordinary dictionary meaning of promptly and without delay. 3. Description and Likelihood of hazards Potential pollution incidents identified include: Air Pollution Incident: Escape of significant dust or smoke to atmosphere. Water pollution incident: Escape of significant fuel or unclean bilge water from construction vessels or equipment. Sinking of a vessel. Noise Pollution Incident: Noise pollution from construction activities. Land Pollution Incident: No land based construction is taking place under this Construction Certificate. The area covered by this PIRMP has been assessed in individual risk assessments from the individual contractors involved. No chemicals are stored in reportable quantities. Possible risks are tabulated below. 4 4. Pre-emptive actions to be taken The most likely form of pollution incident during construction would result from a fire on a vessel, fuel leakage from a vessel or sinking of a vessel. The individual contractors have provided Work Health and Safety packages that deal with these possible outcomes. All storm water runoff is controlled through sediment control barriers. No major construction is taking place from the land in this phase of the construction. Any run off from land is to be checked regularly and monitored via the EPL monitoring requirement. All fuelling of vessels, plant and equipment is carried out off site in accordance with the relevant work method statements. 5. Inventory of Pollutants There are no reportable quantities of pollutants involved in the construction of the floating marina. The piling barge carries enough fuel for the duration of the piling job and therefore will not need to be refuelled. There are no chemicals involved in marina piling. A hydrocarbon spill kit is aboard all vessels and on the land site. 6. Safety Equipment Spill kits and containment materials are available on the land and on the construction vessels. Emergency response and fire equipment is readily available. Training in emergency response and fire incident has been completed. All contractors provide the relevant protective gear for staff. 7. In the event of a notifiable incident neighbouring properties will be door knocked to be advised of the situation. The Environmental Consultants for the project will be engaged if a major event occurs and remedial action is required. 10. Minimising Harm to Persons Refer to the emergency response plan for the site. At all times minimising harm to persons shall be a priority. Construction are is not open to the general public. 11. Training, Testing and Review. There is a very low risk of a pollution incident occurring. Trinity Point will review the PIRMP after the on water construction phase has completed and prior to any on land works commencing. This is expected to be no longer than 8 months. Testing the plan will be carried out at the time of review. The Site staff are trained in Emergency Response and Fire Response at least annually. Staff will be trained in the PIRMP and records maintained in the corporate training system. A copy of this PIRMP will be available for viewing upon request at the Trinity Point Sales Office at Trinity Point Drive, Morisett Park NSW.
