Watershed: NA Receiving water: NA Description of Xcel Energy Chestnut Service Center Hazardous Waste Storage Facility The Chestnut Service Center Hazardous Waste Storage Facility is both owned and operated by Northern States Power Company (NSP), doing business as Xcel Energy. The Facility is located in Hennepin County at 1518 Chestnut Avenue North, Minneapolis, Minnesota. NSP is an electric and gas utility. Hazardous wastes are consolidated and stored at the Facility from the company's electric generation stations, substations, and regional service centers prior to shipment off site for treatment, recycling or disposal. Most of the hazardous waste generated consists of polychlorinated biphenyls (PCB) contaminated equipment, solid materials, and/or oils. Additional hazardous wastes are generated through equipment and vehicle maintenance, shop activities, laboratory work, construction projects, and general building maintenance operations. These wastes include solvents, corrosives, flammables, lighting wastes, batteries and miscellaneous hazardous chemical wastes. The Facility also operates a Very Small Quantity Generator (VSQG) Collection Program at the Facility as a collection point for hazardous wastes generated by VSQGs operated by the Permittee. The purpose of this program is to ensure the safe handling of hazardous wastes generated by VSQGs by allowing them to deliver their hazardous wastes to a licensed collection facility such as the Chestnut Service Center Hazardous Waste Storage Facility. The Facility then stores the waste in a secured manner until shipment is arranged to a recycling facility or to another permitted facility for treatment or disposal. 2 Procedure for public participation As stated in Minn. R. chs and 7001, there are three formal procedures for public participation in the MPCA's consideration of this matter. Interested persons may: (1) Submit written comments on the draft permit. (2) Petition the MPCA to hold a public informational meeting. (3) Petition the MPCA to hold a contested case hearing. Submitting written comments To submit comments or petitions to the MPCA through the mail or , you must state: (1) Your interest in the permit application or the draft permit. (2) The action you wish the MPCA to take, including specific references to the section of the draft permit you believe should be changed. (3) The reasons supporting your position, stated with sufficient specificity as to allow the MPCA to investigate the merits of the position. Public informational meeting A public informational meeting is an informal meeting during which interested persons can ask questions concerning the proposed facility. MPCA staff will be present to provide information. If an interested person would like the MPCA to hold a public informational meeting, the person should include all information identified above and in addition include a statement of the reasons the person desires the MPCA to hold a public informational meeting and the issues that the person would like the agency to address at the public informational meeting. Contested Case Hearing A contested case hearing is a formal proceeding before an administrative law judge empowered to advise the MPCA regarding issues of fact. As described in Minn. R , persons who submit petitions for a contested case hearing must also state the issues they propose to address in a contested case hearing, the specific relief requested or resolution of the matter, and the reasons (which may be in the form of proposed findings) supporting an MPCA decision to hold a contested case hearing. Failure to comply with these rules exactly may result in a denial of the request. To the extent known, the petitioner may also submit a list of prospective witnesses to be called at a hearing, a proposed list of publications, references, or studies to be introduced at a hearing and the approximate time required for the petitioner to present the matter at a hearing. 3 Proposed RCRA permit reissuance Xcel Energy Chestnut Hazardous Waste Storage Facility Hazardous Waste Facility Permit The Minnesota Pollution Control Agency (MPCA) has drafted a Resource Conservation and Recovery Act (RCRA) permit reissuance for the Xcel Energy Chestnut Hazardous Waste Storage Facility (Facility) at 1518 Chestnut Avenue in Minneapolis, Minnesota. The Permittee is an electric and gas utility. Hazardous wastes are consolidated and stored at the Facility from the Permittee s electric generation stations, substations, and regional services centers prior to the shipment off site for treatment, recycling or disposal. Most of the hazardous waste received consists of equipment contaminated with polychlorinated biphenyls (PCB), solid materials, and/or oils. Additional hazardous wastes received results from equipment and vehicle maintenance, shop activities, laboratory work, construction projects, and general building maintenance operations. These wastes include non-pcb capacitors, silver plating solutions, solvents, corrosives, mercury, flammables, and batteries. The Permittee also operates a Very Small Quantity Generator (VSQG) Collection Program at the Facility as a collection point for hazardous wastes generated by VSQGs operated by the Permittee. The purpose of this program is to ensure the safe handling of hazardous wastes generated by VSQGs by allowing them to deliver their hazardous wastes to a licensed collection facility such as the Chestnut Service Center Hazardous Waste Storage Facility. The Facility then stores the waste in a secured manner until shipment is arranged to a recycling facility or to another permitted facility for treatment or disposal. When the waste collected from the VSQG Collection Program is placed into a permitted storage unit, it becomes regulated under this Permit. The MPCA recommends reissuing the RCRA permit. This draft permit is on public notice from April 27, 2018 through June 11, The facility The permit authorizes and require the facility to store hazardous waste in Department of Transportation-approved plastic/metal drums. Hazardous waste is generated on and off site; hence the Facility is considered an offsite Facility. The permit authorizes and requires the Permittee to conduct the following hazardous waste management activities: operate hazardous waste storage units and store PCB waste oil in tanks. Under state and federal regulations, these activities require a hazardous waste permit. Page 1 of 3

4 The permit This RCRA permit was originally issued on July 19, The existing permit was reissued to the Facility on August 23, The draft permit covers the following areas of the Facility s operation: Authorized waste Operating conditions Facility inspections Site security Personnel training Emergency prevention and response procedures Reporting and record keeping Closure requirements and financial assurance Liability coverage The permit process and public participation Minnesota facilities whose activities have the potential to affect the environment must obtain MPCA permits for those activities. Permit conditions require operation and maintenance of the facility in a manner protective of human health and the environment. The MPCA will accept public comments on the proposed reissuance of the draft permit until 4:30 p.m. on June 11, Under Minn. R. ch , written comments must include: 1. A statement of the writer s interest in the reissuance of the proposed permit. 2. A statement of the actions that the writer is requesting the MPCA to take. 3. The reasons supporting the writer s position, stated with sufficient specificity to allow the Commissioner to investigate the merits of the person s positions and including specific references to the draft permit language to be changed. Also, interested persons may request that the MPCA hold a public informational meeting. Finally, interested persons may request that the MPCA hold a contested-case hearing, which is a formal hearing before an administrative law judge. After the public comment period ends on June 11, 2018, all comments, petitions, and requests are reviewed.
