Augustine ext. 315 Action Necessary: No SUMMARY A request for a text amendment to the Stormwater Element of the Future of Hillsborough Comprehensive Plan for Unincorporated Hillsborough County is currently under review. The Planning Commission, pursuant to Florida Statutes, is required to make a recommendation to the Board of County Commissioners on all proposed changes to the Comprehensive Plan. This amendment is part of the first cycle of amendments for BACKGROUND This is a publicly initiated Text Amendment to the Stormwater Element. Chapter 163, Florida Statutes outlines the Growth Management Act and the comprehensive planning process for local governments in the state of Florida. The Florida Legislators made substantial changes to this Chapter during the 2011 legislative session. House Bill 7207 modified the required content of the Comprehensive Plan. The text amendment is proposed to update the Stormwater Element to more concisely address local issues and to streamline the document by removing implemented policies, and redundant or obsolete language. 2 Planning Commission Workshop November 14, st Cycle 2012 Amendment Summary CPA Stormwater Element Text change. Stormwater Element Update I. PROPOSED COMPREHENSIVE PLAN AMENDMENT A. Description of Request Request: This is a publicly-initiated text amendment to the Stormwater Element. Background: Chapter 163, Florida Statutes outlines the Growth Management Act and the comprehensive planning process for local governments in the state of Florida. The Florida Legislators made substantial changes to this Chapter during the 2011 legislative session. House Bill 7207 modified the required content of the Comprehensive Plan. This has provided an opportunity to update the plan to more concisely address local issues and to streamline the document by removing implemented policies, and redundant or obsolete language in each Element. Summary of Changes: The following changes are proposed to the Stormwater Element. 1. Revise Stormwater Goals, Objectives and Policies (GOP) Introduction to clarify and remove superfluous language. 2. Revise Stormwater Policy 1.2 to include clarifying policy language.

GOALS, OBJECTIVS AND POLICIES A single goal statement was developed which states the philosophy of the Stormwater Management Element and the mission of the comprehensive Stormwater Management Program. Individual objectives were created to address identification and evaluation of problems/concerns, implementation of solutions to the problems/concerns, and maintenance of facilities to ensure provision of the adopted level of service standards. Finally, specific policies were produced as the means by which the goal and objectives could be put into practice. The following goal, objectives, and policies have been developed specifically for unincorporated Hillsborough County. Thus, an individual reference to unincorporated Hillsborough County may not be provided, but is implied, in each statement. Also, the use of the term "County" implies "unincorporated Hillsborough County". Revise Stormwater Policy 1.2 to include clarifying policy language. Policy 1.2: Unless regional areawide stormwater facilities are provided, Aall nonresidential and nonagricultural redevelopment and expansions of existing nonresidential and nonagricultural development shall construct or contribute to a stormwater management system for the entire site which, at a minimum: a. treats stormwater runoff to state and water management district water quality standards, and b. has a runoff rate and duration which is substantially similar to that for predevelopment conditions. For purposes of this level of service, redevelopment or an expansion of a development is subject to these standards if the redevelopment or expansion is the greater of: a. a cumulative alteration area of 5,000 square feet or for sites greater than 50,000 square feet, a cumulative alteration area of 10% of the site, or b. a cumulative alteration of 50% of the remaining pervious area of the site.

The adopted level of service for solid waste in Hillsborough County is 2 years of permitted landfill space, with 10 years of raw land under the control of the County available. 2. The County currently has years of permitted landfill space and additional area available to permit. 3. There is no initial capital investment required to maintain an adequate Level of Service with the projected impacts from the changes in the Land Use classifications. 4. Any annual operating costs resulting from the projected impacts will be recovered through the rates established for the Solid Waste Management System. 5. The Public Utilities Department has an extensive CIP program, which includes maintaining and expanding its Solid Waste Management System. 17 Hassan Halabi October 26, 20 I I Page 3 Is it necessary to include a definition for Adult Care Facility as proposed? If not, we believe the definition should reside in the Land Development Code. However, if inclusion of the definition in the Comprehensive Plan is deemed necessary, it appears there is a typographical error that must be corrected. As proposed, the definition includes the acronym "ACLF." This acronym is commonly used for adult care living facility, which is a distinctly separate use, and in fact this acronym is included in the Plan's definition of Adult Care Living Facility which is proposed for deletion.
