6 GETI Project No. 17-DE6098 Approximate One-Acre Lot of Land 5611 State Highway 359 Laredo, Texas 1.0 EXECUTIVE SUMMARY Geoscience Engineering & Testing, Inc. (GETI) performed a Phase I Environmental Site Assessment for an approximate one-acre lot of land located on the south side of State Highway 359 in the City of Laredo, Webb County, Texas. The physical address, as provided by the Webb County Appraisal District is: 5611 State Highway 359 The purpose of the ESA Phase I was to provide the client with information for use in evaluating any potential environmental issues that may be associated with the Study Area. The scope of work included investigation into current site conditions, site history, and a review of the regulatory databases pertaining to the Subject Property and adjoining properties. A site visit and visual assessment of the Study Area was conducted by GETI personnel on January 28, During the site visit, the following conditions were observed: The Study Area consists of an approximate one-acre lot of unimproved land, covered with heavy vegetation and grass. The eastern, southern and western boundaries are lined with trees. Based on visual observations, the overall topography of the site slopes towards east. The northern boundary of the property is depressed relative to the existing street (TX-359), however storm sewer drains located along TX-359 will minimize any potential surface water run-off to the property. Based on visual observations, the property will not be impacted from surface water run-off surrounding properties. A review of the Topographic Map of the area indicates the elevation of the Subject Property is approximately 510 feet above mean sea level. At the time of this investigation: No on-site landfills on or around the Subject Property were observed; No evidence of hazardous or solid waste(s) materials were apparent; No raw materials were observed; No evidence of illegal dumping, surface contamination, or stressed vegetation were noted No pits or sumps on or around the Subject Property were evident. Based on a review of the historic aerial photographs and city directories obtained for the area, the Subject Property has no history of previous development or land usage. GEOSCIENCE, Inc. 1 P a g e

7 Records Review GETI Project No. 17-DE6098 Approximate One-Acre Lot of Land 5611 State Highway 359 Laredo, Texas Regulatory agency databases and other sources were reviewed to identify any properties that could potentially have an adverse affect on the Study Area. As per the data received, no facilities are located on the Subject Property. Off-site properties include: One active Petroleum Storage Tank facility, (the facility has no reported incidences of leaks or spills), one previous leaking petroleum storage tank facility, (case is now closed) and two previous Corrective Action Industrial Hazardous Waste sites, (both listed at the same address, both have undergone all required clean-up activities and the sites have been issued Certificates of Completion). Based on the distance, topographical location relative to the Subject Property and/or current regulatory status, these sites/facilities do not represent REC s to the Subject Property. No other facilities or areas of interest were located on the environmental database files reviewed. GETI visually assessed the surrounding property locations and evaluated existing site conditions. No current mishandling and/or previous misusage of chemicals or other potentially harmful substances onsite were apparent. Based on visual observations, and current and previous property usage, the surrounding properties do not appear to represent RECs to the Subject Property at this time. Recognized Environmental Conditions (RECs) - are defined by the ASTM Standard Practice E as the presence or likely presence of any hazardous substances or petroleum products on a property under conditions that indicate an existing release or past release, or a material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground, groundwater, or surface water of the property. GETI s investigation has revealed no recognized environmental conditions associated with the subject property or nearby properties at this time. Historical Recognized Environmental Conditions (HRECs) are defined by the ASTM Standard Practice E as an environmental condition which in the past would have been considered a recognized environmental condition, but which may or may not be considered a recognized environmental condition currently. GETI s investigation has revealed no historical recognized environmental conditions associated with the Subject Property at this time. FINDINGS We have performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E of the property located at 5611 State Highway 359 in the City of Laredo, Webb County Texas. Any exceptions to, or deletions from, this practice are described in Section 1 - Executive Summary, Section 2 Subheading Limitations and Exceptions of Assessment, and Section GEOSCIENCE, Inc. 2 P a g e

8 GETI Project No. 17-DE6098 Approximate One-Acre Lot of Land 5611 State Highway 359 Laredo, Texas 13 Deviations This assessment has revealed no evidence of recognized environmental concern and in our opinion, the property can be accepted as is and no additional assessment is warranted. 2.0 INTRODUCTION This report presents the results of the Phase I Environmental Site Assessment (ESA) performed by Geoscience Engineering & Testing, Inc. (GETI) for the approximate one-acre lot of land located at 5611 State Highway 359 in the City of Laredo, Webb County, Texas 2.1 Purposes and Objectives The objective of this Phase I Environmental Site Assessment was to identity any Recognized Environmental Conditions (RECs) at the Subject Property location. An REC is identified as the presence or likely presence of any hazardous substances or petroleum products on a property under conditions that indicate an existing release, a past release, or a material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground, ground water, or surface water of the property. The term includes hazardous substances or petroleum products even under conditions in compliance with laws. RECs do not include de minims conditions, that being, conditions which are generally considered not to pose a significant material risk to public health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies." An example of a de minims condition might be a small, superficial spill of oil that is not anticipated to cause a significant concern. This investigation also includes evaluation of other selected environmental conditions that could result in limited use restrictions of the Subject Property. This investigation is intended to satisfy one of the requirements to quality for the innocent landowner defense to CERCLA (Comprehensive Environmental Response, Compensation and Liability Act) liability and the "all appropriate inquiry into the previous ownership and uses of the property consistent with good commercial or customary practice." The investigative method applied in this assessment was based on the ASTM Standard Practice Designation E Scope of Services The scope of services for this ESA Phase I included visual observation and assessment of the site; research of previous property ownership and site usage; interviews with private business owners; public officials and representatives with public agencies and a research of various regulatory databases pertaining to the Subject Property and immediate surrounding areas. Our findings, conclusions and recommendations for the Subject Property adjacent properties and immediate surrounding areas are included herein. GEOSCIENCE, Inc. 3 P a g e

9 2.3 Significant Assumptions GETI Project No. 17-DE6098 Approximate One-Acre Lot of Land 5611 State Highway 359 Laredo, Texas During the course of this environmental investigation, GETI relied on information obtained from personal interviews, third party sources, environmental databases and a review of the documents included in the Appendix Section of this report. We have assumed, where reasonable to do so, that the information provided is true and accurate. If information to the contrary is discovered, our conclusions and recommendations may not be valid. This ESA Report is based on the assumption that the functional utilization of the property will remain within reasonable parameters of the current usage of the site as described to our firm by the client. 2.4 Limitations and Exceptions of Assessment The information contained herein was compiled for the benefit of 7B Development and their subsidiaries and affiliates to assist in identifying and addressing environmental conditions at the referenced location for the purposes of enabling these parties to establish the innocent purchaser defense. This study was not designed for any purposes beyond those stated. The conclusions and recommendations contained herein describe conditions present at the time of our assessment, in areas that were accessible and observed. It should be noted that conditions independent of those observed during the site survey may be present in inaccessible or unobserved areas of the property. In addition, GETI is not responsible for any environmentally negative misappropriation of the Study Area occurring after this investigation. No suspect asbestos-containing materials were visually identified during the on-site survey, however, in-depth studies to identify the presence of asbestos containing materials (ACM s) were beyond the scope of this study. While radon, asbestos and lead-based paint concerns are briefly discussed in this report, other indoor air quality concerns are beyond the scope of this investigation. Such concerns may include ventilation and air exchange rates, air filtration, pollutant source evaluation, and other issues. In view of the on-going changes occurring in environmental conditions, the information provided within this report should not be relied upon as an accurate representation of conditions that might be encountered after a reasonable amount of time has elapsed. In addition, the frequency of changes that occur in environmental conditions will be affected by, among other factors, site location, increase/decrease in area development, and significant alterations to the area or regional surface conditions. All observations and findings stated herein are based on visual interpretations of the property and immediate surroundings and information obtained from a research of historical records using both EPA and Texas Commission on Environmental Quality (TCEQ) computerized databases. 10 2.5 Special Terms and Conditions GETI Project No. 17-DE6098 Approximate One-Acre Lot of Land 5611 State Highway 359 Laredo, Texas This assessment was performed in general accordance with the scope of services outlined herein. 2.6 User Reliance This report was prepared to aid 7B Development and their subsidiaries and affiliates to assist these parties in identifying and addressing environmental site conditions at the Study Area. GETI acknowledges that the aforementioned parties will be relying on the information contained within this ESA to assess whether or not it will acquire or develop the Study Area. This report was prepared for the benefit of the aforementioned entities and may not be relied upon in whole or in part by any other person or entity without the written authorization of Geoscience Engineering & Testing, Inc. Use of this report for any purposes beyond those originally conveyed to our Firm by the client will be done so at the sole risk of the user. This report is addressed to 7B Development and such other persons as may be designated by 7B Development and their expressive successors and assignees. Special conditions include: (i) the report may be relied upon by Fitness International National Retail Properties, Inc, National Retail Properties, LP in determining whether to make a loan evidenced by a note ("the Property Note") secured by the Property, (ii) the Report may be relied upon by any purchaser in determining whether to purchase the Property Note from Fitness International National Retail Properties, Inc, National Retail Properties, LP and any rating agency rating securities issued by or representing an interest in the Mortgage Note, (iii) the Report may be referred to in and included with materials offering for sale the Property Note or an interest in the Property Note, (iv) persons who acquire the Property Note or an interest in the Property Note may rely on the Report, (v) the Report speaks only as of its date in the absence of a specific written update of the Report signed and delivered by Geoscience Engineering & Testing, Inc. 2.7 Report Organization This report is organized into sections that discuss and present a site description, results of our on-site visit and corresponding personal interviews, site history and records reviews. Conclusions and recommendations based on our findings are provided with additional plates following the text. 3.0 SITE DESCRIPTION 3.1 Introduction The site was visually and physically inspected by representatives from Geoscience Engineering & Testing, Inc. on January 28, 2017 by walking the following areas: accessible perimeters of the property, grid pattern across accessible areas and perimeter of drainage ways and ditches. All accessible paths on the site were GEOSCIENCE, Inc. 5 P a g e

The subject site and neighboring sites were viewed from all adjacent public thoroughfares. No obstructions were encountered on-site. 3.2 Location and Legal Description of the Site The Study Area consists of an approximate one-acre lot of land legally identified as follows: LOS ALPES, BLOCK 1, LOT 26 Physical address, as provided by the Webb County Appraisal District is: 5611 State Highway 359 Additional property information is provided in the Appendix section of this report. 3.3 Site Vicinity General Characteristics Areas in and around the vicinity of the Subject Property consists of residential to the north, south and west, retail to the northwest and northeast and commercial warehouse s to the east. 3.4 Current Uses of Property None. 3.5 Descriptions of Structures, Streets or Other Improvements On-Site None Exterior reviews All exterior areas were characterized as good. No visible spills, noxious odors, or leaks were observed within the property exterior Vapor Intrusion Migration of petroleum hydrocarbon or volatile organic compound (VOC) contamination is generally via groundwater. Therefore, only those contaminant release sites located hydrologically up-gradient relative to the subject property are expected to represent a potential environmental concern to the subject property. Contaminated sites located hydrologically down-gradient of the subject property are not expected to represent a potential threat to the groundwater quality beneath the subject property. Sites that are situated hydrologically cross-gradient relative to the Subject Property are not expected to represent a concern unless close proximity allows for the potential of lateral migration. Based on visual assessments of the property and surrounding areas, in our opinion, possible vapor intrusion from adjacent properties does not appear to an environmental concern at this time. The standard explicitly states however that an ASTM E2600 (a separate, more comprehensive assessment of vapor migration) is not a requirement of a Phase I ESA (E ) and is beyond the scope of this Study. 12 3.5.3 Asbestos-Containing Materials (ACMs) GETI Project No. 17-DE6098 Approximate One-Acre Lot of Land 5611 State Highway 359 Laredo, Texas Non-applicable Lead Based Paint As above. 3.6 Previous Use(s) of Property Based on a review of the historic aerial photographs and information obtained from the Webb County Appraisal District, the Subject Property has no history of previous development and/or significant land usage. 3.7 Current and Previous Use(s) of Adjoining Property GETI conducted a reconnaissance of the adjacent Properties to determine the nature of the land usage; visually identify possible environmentally negative activities; and to assess the likelihood of current and/or future potential negative environmental impact to the Subject Property. During the site reconnaissance, the following adjacent properties/features were observed: North The Subject Property is bound to the north TX-359/State Highway 359. Farther north is vacant land followed by residences. Across TX-359 to the northeast is an All Season Meat Market, across TX-359 to the northwest is retail. South The Subject Property is bound to the south by residences. East West The Subject Property is bound to the east by commercial warehouses. Farther east is Ward Ave. The Subject Property is bound to the west by a small strip of unimproved land. Farther west area residences followed by Las Misiones Blvd. Our Firm visually assessed the remainder of the surrounding properties and evaluated existing site conditions current at the time of our assessment. Generally, the properties were relatively clean and no evidence of surface contamination, superficial discolored soil or stressed vegetation (indicative of possible hazardous spills) was observed. No current mishandling or misusage of chemicals or other potentially harmful substances was apparent and, in our opinion, the businesses practices and property usage of the remaining sites are not areas of concern to the Subject Property at this time. 13 4.0 USER PROVIDER INFORMATION GETI Project No. 17-DE6098 Approximate One-Acre Lot of Land 5611 State Highway 359 Laredo, Texas 4.1 Summation of Title Records GETI conducted a research of public records and contacted various public and regulatory agencies to obtain information regarding current and previous property ownership, possible liens on the property and current tax status balance. According to information obtained from the Webb County Appraisal District, legal ownership of the Subject Property is held by Anew Investments, LTD. This chain of ownership has not been verified by a professional title company for accuracy or completeness, and is not represented as a final determination of prior ownership. Considering other information obtained in the assessment, the ownership data is believed sufficient to the objective of this investigation. 4.2 Environmental Liens or Activities and Use Limitations Based on information obtained from the Webb County Appraisal District, there are no environmental liens and/or previous activities or use limitations associated with the Subject Property that would impede and/or restrict the current proposed development of the property as described to our Firm by the client. Environmental liens on the subject property were not reported to the Environmental Professional conducting this investigation. Additionally, specialized knowledge or experience of the Client material to any recognized environmental conditions on the site were not reported to the Environmental Professional. As per the Webb County Tax Assessors Office, there are no outstanding back taxes owed on the property. 4.3 Specialized Knowledge of the Site None. 4.4 Valuation Reduction for Environmental Issues Based on the results of our investigation, no environmental factors are currently associated with the Study Area that would affect the purchase/sale price or result in a significant depreciation in the property value when compared to other analogous properties located within the same area. 4.5 Property Owner, Manager and/or Occupant Information None. 4.6 Reasons for Performing the Phase I It is our understanding that 7B Development and their subsidiaries and affiliates are purchasing the property for proposed development of a Family Dollar Store. GEOSCIENCE, Inc. 5.0 RECORDS REVIEWED 5.1 Standard Environmental Record Sources, (Federal and State) The American Society for Testing and Materials (ASTM) ASTM E-1527 suggests minimum search distance criteria to safeguard innocent buyers of commercial properties. A search of the site and adjoining properties was conducted using EPA databases for hazardous waste generators and extending the search for any facilities listed by the State of Texas that had hazardous chemical spills (CERCLIS) and/or registered petroleum storage tanks (PST). The suggested search distance for facilities that have reported spills of hazardous waste materials, (in accordance with specifications outlined by EPA-CERCLIS and the State of Texas Landfills and Solid Waste Disposal) are sites up to one-half mile from the subject site. ASTM extends the criteria of the search to one mile for identifying Federal, State Superfund Sites, and abandoned hazardous waste sites (RCRA- CORR). Geoscience Engineering & Testing, Inc. obtained environmental information from MapPro Environmental; the U.S. Environmental Protection Agency and the Texas Commission on Environmental Quality (TCEQ) databases. The information obtained from these sources was reviewed to determine if any notifications, registrations, and/or documented environmental incidents have been recorded for the Subject Property location or immediate surrounding areas. The following sections summarize our findings: 5.2 Superfund Sites Federal Superfund - According to the EPA s National Priorities List (NPL), sites (commonly referred to as Superfund Sites) no Federal Superfund Site was located on or within a one-mile radius of the Subject Property State Superfund - The Texas Commission On Environmental Quality (TCEQ) through its State Superfund Unit also maintains a list of hazardous sites. An examination of the State Superfund List indicates no sites located on or within an approximate one-mile radius of the Subject Property. 5.3 Comprehensive Environmental Response, Compensation & Liability Information System (CERCLA) Each region of the EPA produces a Comprehensive Environmental Response, Compensation and Liability Information System (CERCLIS) list. CERCLIS is a list of all potentially hazardous waste sites identified by the EPA. A site listed as CERCLA indicates that the site is in the screening and assessment phase for possible 9 P a g e

All sites identified are assessed by the EPA, or an appropriate state agency, to determine what action, if any, should be taken. A review of the CERCLIS database indicates no CERCLIS sites on or within an approximate one-mile radius of the Subject Property. 5.4 Resource Conservation Recovery Act (RCRA) In an effort to federally regulate and monitor hazardous waste activities, the Resource Conservation and Recovery Act (RCRA) was implemented in Under the RCRA, facilities that generator, transport, treat, store, and/or dispose of hazardous waste materials are required to register with the EPA or appropriate State mandated agency. The EPA has jurisdiction over RCRA sites and maintains a list of facilities notified by the EPA to register as an RCRA facility. According to the database information, no RCRA facilities are located on or within the indicated search distance criteria of the Subject property. 5.5 Facility Registration System (FRS) The Facility Registry Service (FRS) identifies and geospatially locates facilities, sites, or places of environmental interest that are subject to regulation. The purpose of the FRS is to integrate all accumulated data from EPA s national program systems, other federal agencies, and state and tribal master facility records for each facility/site listed into a centralized research location. The listing of a site or facility on the FRS does not mean an environmental liability is present, but rather that the environmental status of the site or facility is being regulated or that a registration for one or more programs has been issued (ie: storm water permits, air monitoring, etc.) As per the information obtained, no FRS facilities are listed as being located or within the indicated search distance criteria of the Subject Property. 5.6 Petroleum Storage Tank Site List The Texas Commission of Environmental Quality (TCEQ) Petroleum Storage Tank Division has compiled a list of registered petroleum storage tanks (PST s) from a statewide registration program. As per the information obtained, one Petroleum Storage Tank facility is located within the required search distance criteria of the property. (PST ID #71082) Chief s Food Mart & Restaurant at 5908 State Highway 359 is located approximately 0.10-miles northwest of the Subject Property (across TX-359). As per the information obtained, this facility currently has (1) 10,000 gallon capacity tank used for the storage of diesel and (1) 12,000 gallon capacity underground petroleum storage tank used for the storage of gasoline. The tanks were installed in December 1997 and are single-walled, constructed of composite materials fiberglass reinforced plastic GEOSCIENCE, Inc. 10 P a g e

16 GETI Project No. 17-DE6098 Approximate One-Acre Lot of Land 5611 State Highway 359 Laredo, Texas (FRP), with Corrosion Protection, auto tank and gauge inventory release detection and tight fill fitting, factory built spill containment/bucket/sump and delivery shut-off valve spill containment and overflow prevention. Pipe materials are constructed of pressurized FRP and are equipped with FRP corrosion protection, and Release Detection includes: monthly piping tightness, annual pipe tightness and auto line leak detector. Information regarding any type Vapour Recovery System was not reported. As per the TCEQ, the facility was issued a Formal Enforcement Order based on an on-site inspection conducted on April 7, 2016 whereby an investigator documented that the facility (Respondent/owner) failed to provide release detection for the pressurized piping associated with the underground storage tank system, (moderate in severity). In September 2016, a second on-site inspection was performed and at that time, the facility received an 0 Rating and a Classification of High indicating that as per the TCEQ, the facility Complies with environmental regulations extremely well. This facility is not listed on the Leaking Petroleum Storage Tank Database and in our opinion, poses no area of concern to the Subject Property at this time. 5.7 Leaking Petroleum Storage Tanks (LPST s) The LPST Division of the TCEQ maintains records of leaking underground storage tanks (LPSTs) and recommends a search distance criteria of one-half mile. According to the information obtained, one LPST facility was located within the required search distance of the Subject Property; however, the case is now closed. 5.8 Emergency and Hazardous Materials Incidents GETI interviewed knowledgeable persons regarding on-site emergency response incidents. In addition, pertinent regulatory databases were reviewed. The following sections summarize our findings Spills - The TCEQ spill response list was reviewed to identify reported spill incidents on or adjacent to the Subject Property. As per the information obtained, no ERNS incidences are listed as being located on or within the indicated search distance criteria of the Subject Property National Response Center (previously Emergency Response Notification Center (ERNS) GETI reviewed the Coast Guard s National Response Center database for information pertaining to oil and/or hazardous substances releases. According to a 10-year research inquiry of the NRC Records, no NRC incidences were reported as occurring on or within an approximate one-mile radius of the Subject Property Toxic Release Inventory - The Toxic Release Inventory (TRI) was established under the Emergency Planning and Community Right to Know Act of 1986 as a resource system whereby the GEOSCIENCE, Inc. 11 P a g e

As per the Superfund Amendment and Reauthorization Act (SARA) Title III, Section 302, facilities are required to report TRI information annually to the EPA and their State of Residency. A review of the database records identified no TRI facilities on or within an approximate one-mile mile radius of the Subject Property. 5.9 Industrial Hazardous Waste/Solid Waste Registration Facilities The TCEQ Solid Waste Registration Listing Report and Permit Database serves to track permits and registrations for landfills, transfer stations, sludge application sites, illegal dump sites, recycling facilities, and medical waste generators and transporters. According to the database information, two Corrective Action Industrial Hazardous Waste facilities (both listed at the same address) are listed within the required search distance criteria of the Subject Property, however both facilities have been issued Certificates of Completion and the cases are now closed. 6.0 PHYSICAL SETTING RESOURCES This section describes localized external environmental settings such as topography, hydrogeology and surface geological conditions. Support data using USGS Topographic Maps and U.S. Soil Service Maps aided in better defining the surface and sub-surface land features and overall environmental characteristics of the area. 6.1 Location and Topographical Characteristics The City of Laredo is located on Interstate Loop 410 and is approximately 10-miles north of downtown Laredo in the northern quadrant of Webb County, Texas. The Subject Property is located at the northwest intersection of NW Military Hwy and S Manton, at 1916 Bartlett. According to the United States Geological Survey (USGS), 7.5 minute Topographic Quadrangle Map, the Subject Property is located approximately north of the equator and west of the prime meridian. A review of the Topographic Map of the area indicates the elevation of the Subject Property is approximately 510 feet above mean sea level. Based on visual observations, the overall topography of the site slopes towards east. The northern boundary of the property is depressed relative to the existing street (TX-359), however storm sewer drains located along TX-359 will minimize any potential surface water run-off to the property. Sanborn Maps for the Subject Property were not reviewed Flood Plain According to the Federal Emergency Management Agency Flood Insurance Rate Map, Webb County Map No C1385C (dated April 2, 2008), the Subject property is not located within a 500 year flood zone area. A copy of the FEMA Map, provided by MapPro Environmental is included in the Appendix section of this report Oil Wells, Gas Wells and Pipelines USGS topographic maps often indicate oil/gas wells and underground pipelines. Petroleum hydrocarbon exploration and underground transport pipelines can be a source of surface or subsurface environmental contamination. GETI reviewed the USGS Webb County, Texas topographic quadrangle map and Texas Railroad Commission Map, which includes the Subject Property. As per the maps reviewed, no oil, gas well(s) or underground pipelines are located on site, however one underground natural gas pipeline registered as belonging to Kinder Morgan Pipeline, LLC is located to the north of the site, along State Highway 359. One underground natural gas pipeline registered as belonging to Enterprise Products Operating, LLC is located to the far north, one natural gas pipeline registered as belonging to DCP Enterprises is located to the far south and far northwest and one pipeline carrying nitrogen registered as belonging to Enterprise Operating Products, LLC is also located to the far northwest. Dry hole wells are located to the far northwest and far northeast. Copies of the USGS Topo and TRRC Maps are included in the Appendix section of this report General Characteristics The map showed the nearest major highway as State Highway 359/TX-359 located to the north of the site. Secondary roads are Las Misiones to the far west and Ward Ave to the far east. Railroad tracks registered as belonging to Kansas City Southern (Laredo) are located approximately miles northeast of the property. GEOSCIENCE, Inc. 13 P a g e

No evidence of large above ground storage tanks, sewage lagoons or excavated areas were noted. 6.3 Hydrographic and Surface Water Characteristics The property is located within the San Ambrosia-Santa Isabel Watershed in the Rio Grande River Basin. The major aquifers and sources of ground water are the Gulf Coast aquifer in southeastern Webb County, the Laredo aquifer in central Webb County, and the Carrizo aquifer throughout much of Webb County. Minor aquifers are the Jackson and Yegua aquifers in eastern Webb County and the Queen City-Bigford aquifer in central Webb County. Recharge to the local aquifers occurs primarily by infiltration of precipitation on the aquifer outcrops and by channel losses where streams intersect or cross the aquifer outcrops. The regional flow direction of water in the Laredo aquifer generally is downdip to the east. The depth to water in the Laredo aquifer from water-level measurements ranged from about 12 to 252 ft below land surface. Ground-water flow through the Laredo aquifer is partly dependent on the interconnection between the interbedded sand units within the aquifer. The major body of surface water in the Laredo area is the Rio Grande River which is located approximately 3.3-miles west of the Subject property. Surface water run-off of the property is generally directed towards east. Based on visual observations; the property will not be impacted by surface water run-off from surrounding properties. 6.4 Regional Geological & Soil Conditions According to the Bureau of Economic Geology, Geologic Atlas of Texas, Laredo Sheet, the Subject Property lies upon the Laredo (El) geological formation. Typically, this formation consist of: Sandstone and clay; thick sandstone members in upper and lower part, very fine to fine grained, in part glauconitic, micaceous, ferruginous, crossbedded, dominantly red and brown; clay in middle, weathers orange-yellow; dark-gray limestone concretions common, some fossiliferous; marine megafossils abundant; thickness about 620 feet 6.5 Radon Radon is an invisible, radioactive gas created from natural deposits of uranium and radium in the soil. Exposure to elevated levels of accumulated concentrations of radon gases can result in long-term health issues. As per the EPA Indoor Quality Control and Texas Department of Health, Webb County is located within an area defined as "Zone 3". This Zone is defined as Low Potential radon concerns with predicted GEOSCIENCE, Inc. 14 P a g e

As such, exposures to radon gases in structures built within the Subject Property area are considered unlikely to occur. 7.1 Historical Use Information 7.0 SITE HISTORY AND HISTORICAL USE INFORMATION GETI reviewed aerial photographs, USGS topographic maps and conducted personal interviews to establish historical uses of the Study Area and properties within the area for the purposes of evaluating potential environmental concerns with respect to current or previous property usage. 7.2 City Directories City directories, which identify businesses by address, were reviewed to identify past occupants located at the Subject Property address. Historical City Directories for the Subject property and surrounding areas are included in the Appendix Section of this report. 7.3 Review of Historical Aerial Photographs Aerial photographs were reviewed to assess historical land use and surface features relative to environmental concerns. GETI secured aerial photographs from MapPro Environmental for the years 1955, 1964, 1974, 1989, 1995, 2004, 2005, 2006, 2008, 2010, 2012, 2014 and Based on the photographs reviewed, the Subject Property appears as unimproved in the earliest aerial obtained dated 1955 until the most recent aerial dated A small creek/pond is noted to the south and southeast of the property as of the 1955 aerial. As of the 1974 aerial, the pond area is most predominate to the east of the site, however a small tributary of the pond is visible towards the southern boundary of the site and extends towards southwest. In the 1989 aerial, the pond/creek is noted to the east and south of the property and branches across the property from the southwest towards northeast. In the 2004 aerial, the property is covered with heavy vegetation, however by the 2006, the property surface appears scarified and relatively clear and the creek area(s) appear to have been filled in. Surrounding areas also appear as unimproved until the 1989 aerial, at which time, the currently existing commercial warehouses are visible to the east, the currently existing All Seasons Meat Market is visible to the northeast (across TX-359) followed by the Southwest Oil and Gas Industrial Park, (providing assorted support services for the oil and gas industry). Residential is visible to the northwest, scattered residential is visible to the far southeast and light industrial/retail is visible to the far southwest. In the 2004 aerial, areas to the west/southwest are scarified and under construction for future residential, marked residential and associated aerial roads are visible to the northwest, expansions to the Southwest Oil and Gas Industrial Park located to the northeast are visible, additional industrial is visible to the southeast, increased residential is visible to the far southeast. In the 2005 aerial, areas to the west/southwest are residentially improved with associated arterial roads. From 2008 to 2015, increased residential is visible to the south, southwest, west, northwest and north. The 2015 aerial depicts no changes to the Subject Property and property conditions and surrounding area properties are relatively consistent with existing site conditions noted at the time of the site survey conducted by our Firm. As per required by ASTM , based on a review of the map showing the locations of Indian Tribal Sites, the Subject Property does not fall into this category. The ASTM Guideline E includes directives regarding time-gap period of 5 years or greater. Although the aerial photographs are not continuous, we believe that time-gaps in the aerial photographs have been verified via other sources such as on-site interviews and information obtained from the WCAD. 8.0 SITE RECONNAISSANCE An area reconnaissance was conducted to identify localized surface characteristics such as area topography, surface geology, and any existing or potential negative environmental impact to the Study Area stemming from neighboring residential settings; industrial or other related commercial sectors. The surrounding areas were reviewed for the purposes of identifying any industrial sites, commercial sectors and/or businesses such as gasoline stations, plant nurseries, etc. located within the vicinity of the Study Area and possible environmental impacts from said properties. 8.1 Methodology and Limiting Conditions A site reconnaissance was conducted on January 28, 2017, by Geoscience Engineering & Testing, Inc staff. The objectives of the site reconnaissance were to assess and identify any recognized environmental conditions in connection with the Subject Property. 8.2 General Site Setting Areas in and around the vicinity of the Subject Property consists of residential to the north, south and west, retail to the northwest and northeast and commercial warehouse s to the east. 8.3 Exterior Observations The following conditions were specifically assessed for their potential to create recognized environmental concerns: Pits, Ponds, Lagoons and Surface Waters None. A copy of the responses received are included in the Appendix Section of this report SITE UTILITIES 10.1 Municipal Water Supply & Sewer Treatment The City of Laredo has been designated a Superior Water Supply by the State of Texas. Water is distributed through large transmission lines which branch out to services lines. The Utilities Department maintains over 590 miles of main lines throughout the city. The City has two Water Plants, Jefferson and Colombia with a capacity of 66 millions gallons per day. The main source of water for the City of Laredo is the Rio Grande River. The City of Laredo Utilities Department pumps from the Rio Grande River an average of 45 millions gallons of water per day, and complies with specific and strict treatment guidelines to produce drinking water with the highest standards in water quality. The City of Laredo Water and Wastewater Utilities are in full compliance with the State of Texas and the EPA national primary drinking water regulations Water Lines, Sanitary Sewer and Storm Drain Lines Available to the Subject Property Electric and Natural Gas Services The City of Laredo is part of the deregulated electricity market in Texas. There are multiple electrical plans available for consumers in the zip code area. CenterPoint Energy provides natural gas services to the area. Overhead high voltage transmission lines (typical tower supported or multi-pole supported lines) and overhead distribution lines (typical single-pole supported lines) were observed along State Highway 359. Possible contaminant migration along soil-conduit interface or within sand/gravel backfill traditionally used as backfill in utility excavations can increase the risk of contaminant migration from onsite or off-site GEOSCIENCE, Inc. 18 P a g e

No adverse conditions were noted at the site with regards to utilities and no further investigation of environmental conditions associated with utilities at the Subject Property is recommended at this time OPINIONS Based on the results of this study, in our opinion, there are no indications of past or present uses of the Subject Property that would limit and/or restrict the current proposed development of the property as described to our Firm by the client. In our opinion, the Subject Property overall is environmentally sound and can be accepted as is with no further environmental assessment warranted FINDINGS & CONCLUSIONS GETI has performed a Phase I ESA in conformance with the scope and limitations of ASTM Practice E for the approximate One-acre lot of undeveloped land located at 5611 State Highway 359 in the Laredo, Webb County, Texas. Any exceptions to, or deletions from, this practice is described in the appropriate sections of this report. GETI reviewed historical information to identify possible environmental concerns. Based on a review of the historic aerial photographs and City Directories, the property has no history of previous development or land usage. Off-site properties include: One active Petroleum Storage Tank facility, (the facility has no reported incidences of leaks or spills), one previous leaking petroleum storage tank facility, (case is now closed) and two previous Corrective Action Industrial Hazardous Waste sites, (both listed at the same address, both have undergone all required clean-up activities and the sites have been issued Certificates of Completion). Based on the distance, topographical location relative to the Subject Property and/or current regulatory status, these sites/facilities do not represent REC s to the Subject Property. No other facilities or areas of interest were located on the environmental database files reviewed. GETI visually assessed the surrounding property locations and evaluated existing site conditions. No current mishandling and/or previous misusage of chemicals or other potentially harmful substances onsite were apparent. Based on visual observations, and current and previous property usage, the surrounding properties do not appear to represent RECs to the Subject Property at this time.
