ORIGIN On June 6, 2014, the report PW entitled District Responsibility for Waste Management Facilities Closed Prior to the District s Assumption of Waste Management Powers was presented to the Engineering and Public Works Committee. Resolution No. R65/2014-PW, as amended, was adopted during the June 16, 2014 District Council meeting and recommended that the District assumes responsibility for the management of these closed sites. ANALYSIS A Waste Management Site Inventory was provided to The District Municipality of Muskoka (the District) by the Ministry of the Environment and Climate Change (MOECC) in 2003, and updated in 2010 following the inspection of these sites by the MOECC. The inventory contained Geographic Information System (GIS) coordinates and District staff used these coordinates to create a GIS database for the purpose of managing and sharing this information. The resulting geo-database contains one hundred and seventy waste sites; this includes both active and closed sites that are located on both public and private lands. Engineering and Public Works staff reviewed this listing of waste management sites to determine those that are located on municipally owned parcels and are deemed to be closed. There are fiftyfour closed waste sites located on municipal property, with forty-three of them located on area municipality owned parcels and nine located on District owned parcels. It should be noted that in some cases, more than one waste site is located on the same parcel, therefore the actual number of individual property parcels that will require assessment is twenty-six. 2 located on municipal road allowances for a total twenty-nine separate locations. Staff will conduct the assessments of these sites between April and July In 2011, the MOECC began conducting inspections on selected sites and issued related reports, and where required, directions to owners of these inspected properties. The MOECC has indicated that this activity will continue through their fiscal year. To date, the MOECC has conducted twelve site inspections on municipally owned properties, of which two parcels were owned by the District. These inspections have resulted in two Provincial Officer Orders to be issued to the District and six to be issued to the area municipalities. The Provincial Officer Orders will, at a minimum, require registration of the waste site on title and may contain recommended remediation activities. Staff will conduct assessments of closed waste management sites currently owned by The District Municipality of Muskoka or the Area Municipalities, and address any compliance issues identified. In order to assume legal responsibility for these sites, the title to the parcel of property the site is located on, must be transferred from the host area municipality to the District. The process of transferring the property title is currently in progress, and measures are being taken to expedite the process as quickly as possible. Priority will be given to ensure that all existing orders are complied with. Based on the results of the District staff s site assessments, plans will be developed to address any concerns and cost estimates will be developed on a site by site basis in order to budget for any significant compliance issues. Currently, the District is managing a monitoring and remediation plan for the Chaffey Landfill Site in Huntsville that may have significant cost concerns. It is hoped that this site is the only one that will have these types of issues, and that the remainder of the sites will have registration on title requirements only or simple waste removal, final cover, access and security costs to attain compliance with MOECC standards. The table of scheduled site inspections is attached as Appendix A to this report. The MOECC approval number, the common name for the site (if known), together with location information associated with the Municipal Property Assessment Corporation database, and the proposed inspection dates are provided. FINANCIAL CONSIDERATIONS The management of closed landfill sites can present significant costs to municipalities, where off site impacts are occurring and remediation activities are required. Until the nature of remediation is known, associated costs are impossible to calculate for remediation activities. During the 2014 budget year, the cost for the Chaffey Landfill Site monitoring and remediation plan development, incurred by the Town of Huntsville and the District, which assumed responsibility for this site in 2014, totalled $122,000. In addition, the assessment at the Muldrew Lake Dump located in Gravenhurst cost $7,570. In 2014, the Closed Landfill Budget was $137,560, and these additional costs, as noted above, resulted in a total of $311,900 being spent. As some of these costs were catch up in nature, the Closed Landfill operating budget in 2015 was increased to $170,560 to reflect the additional estimated costs associated with assuming responsibility for these additional waste sites. Capital Budget estimates for closed landfills in 2015 and 2016 show $500,000 allocated each year for remedial actions required at these sites. As noted above, the actual remediation costs Page 2

3 are unknown at this time, and the budget estimates represent a reasonable possible cost over that period based on the existing status of the sites. COMMUNICATIONS No further communication is applicable at this time. STRATEGIC PRIORITIES Reporting on the Municipal Closed Waste Sites supports the following strategy as outlined in the District of Muskoka s Strategic Priorities: 1.1 Through leading by example, be recognized as a model municipality for the implementation of environmentally sustainable policies and practices.
