3 MS4, TMDL, and VSMP Municipal Separate Storm Sewer System (MS4) Requirement of the federal Clean Water Act Regulates discharges from the Town s storm sewer outfalls Six Minimum Control Measures (MCMs) Shifting from Maximum Extent Practicable (MEP) standard to specific reduction requirements Total Maximum Daily Load (TMDL) Required for impaired streams Is the maximum amount of a pollutant in a water body without violating quality standards Virginia DEQ develops the TMDL The MS4 permit requires the Town to develop and implement an action plan 3

4 MS4, TMDL, and VSMP Virginia Stormwater Management Program (VSMP) State mandate; implemented through local ordinances New development must be Chesapeake Bay neutral Redevelopment must reduce pollutants Focus on infiltration rather than detention Herndon s updated stormwater ordinance effective July 1,

6 Overview Focus on nitrogen, sediment, and phosphorus Strategy established in Virginia s Watershed Implementation Plan and enforced through the MS4 permit Reductions based on impervious surface cover and extent of the regulated storm drain system Excludes Fairfax County Public Schools properties Excludes areas that drain directly to local streams Schedule for compliance 5% in the current permit cycle (by June 30, 2018) 40% in the second permit cycle (by June 30, 2023) 100% in the third permit cycle (by June 30, 2028) 5% plan due no later than June 30,

12 Cooperative Agreement Signed with Fairfax County and the Town of Vienna Will eventually result in development of a Joint Chesapeake Bay TMDL Action Plan Credits Herndon with a proportion of all projects regardless of location in Fairfax County Herndon s share is 2.9% based on relative pollutant loads Timing requires stand-alone plan for two years Agreement will need to be modified Written to apply only to projects after agreement (2014) Meant to apply to all projects starting from 2009 As an interim measure, plan takes 2.9% credit for projects within the Town boundary 12

22 This Year s Efforts Implement New Education and Outreach Plan Messages on Water Bills Outreach to Dog License Holders Outreach to Targeted Commercial Properties Screen 50 Outfalls for Potential Illicit Discharges Determine Impervious Area Served by Stormwater Facilities Pollution Prevention New standard operating procedures for road and parking lot maintenance, equipment maintenance, etc. Expanded training, to include golf course, cemetery, and parks and recreation Update and certify nutrient management plan for golf course Strategy to provide refresher spill response training to emergency response personnel 22
