3 ASTM First Published in 1993, updated most recently in 2013 Offers a Standardized Assessment Format to satisfy EPA, CERCLA, Superfund, All Appropriate Inquiry, LLP Definitions Environmental Professional REC, HREC, CREC, Vapor Encroachment Minimum Search Distances

4 Recognized Environmental Condition The presence or likely presence of any hazardous substances or petroleum products in, on, or at a property: 1) due to release to the environment; 2) under conditions indicative of a release to the environment; or 3) under conditions that pose a material threat of a future release to the environment. De minimus conditions are not recognized environmental conditions.

5 Major Components of a Phase I ESA Historical Property and Adjacent Property Review Historical Aerial Photographs Historical Topographic Maps City Directory Listings Sanborn Fire Insurance Maps Local, State and Federal Regulatory Agency Review Interviews with persons familiar with the site Site Visit

6 Environmental Professional A person who possesses sufficient specific education, training, and experience necessary to exercise professional judgment to develop opinions and conclusions regarding conditions indicative of releases or threatened releases on, at, in, or to a property. P.E. or P.G. License and three years of relevant experience. A Baccalaureate degree or higher in engineering or science and five years of relevant experience. Ten years of relevant experience. Allows for Professional Discretion and Opinions.

8 How Long is a Phase I ESA Valid? 180 days prior to a real estate transaction. ESA between 180 days and 1 year may be valid if updated: Interviews Environmental Lien Search Government Records Review Site Visit Report Environmental Professional Declaration User Responsibilities

14 Phase II ESA Cases and Tools Commercial Developer wants to purchase a property with a current ten year lease agreement to a chain store to hold and eventually sell for a profit. Phase I ESA completed with recommendation for a Phase II ESA to investigate historical evidence of USTs at the property.
