SUBJECT: LE SKY RANCH WASTEWATER RECLAMATION FACILITY LOCATION AND EXTENT MOLLY ORKILD-LARSON, SENIOR PLANNER JUNE 11, 2018 LOCATION: The Sky Ranch Water Supply Facility is located within the Sky Ranch development Neighborhood B; south of I-70 and west of N. Hayesmount Road. The project is also within Commissioner District No. 3. A-1 City of Aurora Sky Ranch Development City of Aurora SITE A-1 MU City of Aurora Vicinity and Zoning Map ADJACENT SUBDIVISIONS, ZONING AND LAND USES: North: Sky Ranch development, zoned MU-PUD and is agricultural land. 2 South: East: Sky Ranch development, zoned MU-PUD and is agricultural land. Sky Ranch development, zoned MU-PUD and is agricultural land. PROPOSAL: The applicant, Rangeview Metropolitan District (RMD), proposes to construct a wastewater reclamation facility to serve the proposed Sky Ranch development. The facility will produce reclaimed water to be used for landscape irrigation and other approved uses. The facility will consist of two structures: 1) Pretreat Plant (1,800 SF); and, 2) Main Plant (11,600 SF). A green roof covers over 90% of the Main Plant and will be planted with a ground cover (sedum). The facility will have an initial-phase capacity of 0.4 MGD, adequate for about 2,000 single family or equivalent units, and will be expanded in the future to accommodate the entire development of Sky Ranch. The subject property is owned by PCY Holdings, LLC and will be located on a 3.4 acre tract and identified as Tract R on the Final Plat (P17-014). Once the Final Plat is recorded, this facility will be deeded over to RMD. The site is accessed from the southern I-70 frontage road (Airport Road) to the proposed N. Monaghan Road to the roads within Neighborhood B development. RECOMMENDATION: Staff: Staff recommends the application be approved based on the findings and subject to the conditions of approval outlined herein. I. BACKGROUND The site is zoned MU-PUD and is located on property owned by PCY Holdings, LLC which will be deeded over to RMD. II. DISCUSSION Staff review of this application included a comparison of the proposal to: 1) applicable policies and goals outlined in the Comprehensive Plan; 2) review of pertinent zoning regulations; and 3) analysis of referral comments. 1. The Comprehensive Plan The Comprehensive Plan designation for this site is Heavy Industrial which includes public and quasi-public facilities such as sewage treatment plants. This application complies with the following Goals and Policies of the Comp Plan: Goal PFS 4 Ensure the Adequacy of Wastewater Treatment Facilities This facility received approval from the BOCC for a 1041 application in 2017 for wastewater treatment facility. 3 Policy PFS 4.2 Support Provision of New Wastewater Treatment Facilities in Designated Growth Areas This application proposes a new wastewater treatment facility in the growth area which will serve new development off of the I-70 corridor. Goal PFS 11- Ensure the Provision of Adequate Public Facilities and Services The applicant is ensuring that there is adequate sewage treatment for the Sky Ranch development. 2. Land Development Code (LDC) Review Chapter of the Land Development Code, covers the policy and regulatory aspects of a Location and Extent. This includes a specific review of Location and Extent, Section General Requirements and Procedure. A Location and Extent does not have specific approval criteria but may be approved upon the finding that: A No road, park, public way, ground, or space, no public building or structure, and no major facility of a public utility shall be constructed or authorized in the unincorporated areas of Arapahoe County unless and until the proposed location and extent thereof has been submitted to and approved by the Arapahoe County Planning Commission The Planning Commission and the Board of County Commissioners, when applicable, may approve the facilities as submitted, approve it with conditions, or deny the facility. The conditions to be imposed are those necessary, in the discretion of the Planning Commission and Board of County Commissioners, to mitigate or eliminate any adverse impacts of the proposed facility on the surrounding area, and may include the posting of sufficient performance guarantees with the County to guarantee the construction of any improvements. The Planning Commission is the deciding body for Location and Extent applications. SUBMITTAL REQUIREMENTS - The applicant is in compliance with Section by submitting all of the required materials. 4. In support of the application. No comments. No objections. This development doesn t appear to be a subdivision therefore adequacy of a water supply plan is not reviewed. The above statement is accurate. Adequate water supply was proven during the 1041 review (ASI16-005) for this facility. The applicant should also be aware that any detention pond for this land development must meet the requirements of a storm water detention and infiltration facility as defined in CRS Section (8) to be exempt from administration by this office. Staff shall set this as a condition of approval. Supportive of this facility. No comments. The applicant believes that the design of the facility will prevent leaks. To ensure that there are no issues, staff is setting a condition for the applicant to comply with the district s comment. However, if the applicant is able to provide documentation that this agency s concerns have been addressed then this condition shall be removed. No comments received. No objections. No apparent conflict. No comments received. No comments received. Working with applicant to address comments. Two new discharges to detention basin don t appear to have a significant impact. Three comments received; two had no concerns and the third had concerns for future residents regarding noise and views of the proposed facility. Applicant has indicated that the noise and views will be mitigated by a six foot fence and landscaping. The equipment for this facility will also be located within the building and within enclosures within the building to mitigate noise generated from this facility. CDPHE approved the Site Location application last year. The Process Design Report, Plan and Specifications for this facility is under review and a final approval letter should be sent out in June Prior to commencement of discharge from this new facility, a CDPS discharge permit, permit amendment or Notice of Authorization for the use of reclaimed water is required. Staff has set a condition that all CDPHE approvals and permits be obtained for this facility. STAFF FINDINGS: Staff has visited the site and reviewed the plans, supporting documentation, referral comments, and citizen input in response to this application. 6 applicable policies and goals, as set forth in the Comprehensive Plan, review of the development regulations, and analysis of referral comments, our findings include: 1. The submitted Location and Extent application is in conformance with the Arapahoe County Comprehensive Plan. 2. The submitted Location and Extent application is in conformance with submittal and processing requirements of the Arapahoe County Land Development Code. 3. Staff finds that the request for approval of a Location and Extent for a new wastewater reclamation facility is in conformance with policies and goals outlined in the Land Development Code for a Location and Extent. RECOMMENDATION: Considering the findings and other information provided herein, staff recommends approval of Case No. LE18-002, Sky Ranch Wastewater Reclamation Facility Location and Extent, with conditions recommended in this report. DRAFT MOTIONS: In the case LE18-002, Sky Ranch Wastewater Reclamation Facility Location and Extent, I have reviewed the staff report, including all exhibits and attachments and have listened to the applicant s presentation and any public comment as presented at the hearing and hereby move to approve this application based on the findings in the staff report, subject to the following conditions: 1. Prior to signature of the final copy of these plans, the applicant must address Public Works Staff comments and concerns. 2. The applicant shall comply with fire district s recommendations. 3. The detention pond and infiltration facility shall meet all applicable State regulations and statues. 4. The applicant shall receive approval and permits from the Colorado Department of Public Health and Environment for the proposed facility. 5. The applicant shall comply with Arapahoe County Conservation District s comment by installing a ground and surface water quality monitoring station downstream of the facility. If the applicant is able to provide documentation that the District s concerns have been satisfied, this condition shall be removed. State new or amended findings in support of denial as part of the motion. b. CONTINUE TO DATE CERTAIN: In the case of LE18-002, Sky Ranch Wastewater Reclamation Facility Location and Extent, I move to continue the decision on this request to [DATE], 2018, date certain, at 6:30 p.m., in the Arapahoe Room at 6954 S Lima Street, Centennial, Colorado 80112, to receive additional information and to further consider information presented. 9 March 5, 2018 Arapahoe County Public Works & Development Planning Division 6924 S Lima St. Centennial, CO Attn: Ms. Molly Orkild-Larson, Senior Planner Re: Sky Ranch Wastewater Reclamation Facility, Location and Extent, Letter of Intent Dear Ms. Orkild-Larson, Rangeview Metropolitan District (Rangeview) is planning to construct the Sky Ranch Wastewater Reclamation Facility (WWRF) to serve the proposed Sky Ranch PUD in unincorporated Arapahoe County. The WWRF was included in the Water and Wastewater 1041 Permit application (Case No. ASI16-005, approved by the Board of Commissioners on October 3, 2017) and the subject of the Site Location Approval (Case No. LRl 7-001, approved by the Board of Commissioners as the 208 Management Agency on August 1, 2017). Site Location Approval was also obtained from the Water Quality Control Division of the Colorado Depaiiment of Public Health and Enviromnent on August 29, This Letter oflntent accompanies our application for Location and Extent approval which includes the GESC plan for the project. A presubmittal meeting for the WWRF L&E was held concurrently with that for the Sky Ranch Water Supply Facilities on June 8, The Sky Ranch WWRF will provide wastewater treatment for the proposed Sky Ranch development; producing reclaimed water to be used for landscape irrigation and other approved uses consistent with Colorado's Control Regulation No. 84 for Reclaimed Water. The WWRF will have an initial-phase capacity of 0.4 MGD, adequate for about 2,000 single family or equivalent units, and can be expanded in the future to accommodate development at the Sky Ranch PUD. The WWRF site is in the SE ¼, Section 4, Township 4 South, Range 65 West of the 6 th Principal Meridian; which is more generally known as Sky Ranch "Neighborhood B". You are familiar with the various land use planning and entitlement cases for this property. The WWRF will be constructed on a acre tract that is currently owned by PCY Holdings, LLC, a wholly owned subsidiary of Pure Cycle Corporation. The WWRF site, which is designated as Tract R on the Final Plat (Case No. Pl 7-014), will be deeded to Rangeview Metropolitan District following recordation of the Final Plat. Property to the north, east, and south of the WWRF site is part of the Sky Ranch PUD; with current agricultural land use and future residential lots, drainage facilities, and master planned parks, trails and open space consistent with the Neighborhood B Specific Development Plan (Case No. Pl 7-013).
