17 Qualified Person s Statements and Certifications As the qualified person, I certify that: A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. A phase two environmental site assessment of the RSC property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary. As of 2015/03/09, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that would interfere with the type of property use to which the RSC property will be put, as specified in the RSC. Ground water sampling has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. I have, within the six months immediately before the submission of this record of site condition, given written notice of intention to apply non-potable ground water site condition standards to the clerk of the local municipality in which the property is located and the clerk of any upper-tier municipality in which the property is located. As of 2015/03/09, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the RSC property meets the applicable full depth generic site condition standards prescribed by section 37 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this RSC is filed, except for those contaminants (if any) specified in this RSC at Table 2, Maximum Contaminant Concentrations Compared to Standards Specified in a Risk Assessment. As of 2015/03/09, the maximum known concentration of each contaminant in soil, sediment and ground water at the RSC property for which sampling and analysis has been performed is specified in this RSC at Table 1, Maximum Contaminant Concentrations Compared to Applicable Site Condition Standards. I am a qualified person and have the qualifications required by section 5 of the regulation. I have in place an insurance policy that satisfies the requirements of section 7 of the regulation. I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry. The opinions expressed in this RSC are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location. I do not hold and have not held and my employer QP ENVIRONMENTAL CONSULTANTS INC. does not hold and has not held a direct or indirect interest in the RSC property or any property which includes the RSC property and was the subject of a phase one or two environmental site assessment or risk assessment upon which this record of site condition is based To the best of my knowledge, the certifications and statements in this part of the RSC are true as of 2015/03/09. The RSC Property is comprised of two contiguous legal parcels of land having the following legal descriptions: Part of Block C, Plan 8834 being Part 1, Plan 66R-27738, City of Toronto Part of 1 foot reserve Z on Plan 8834 being Part 2, Plan 66R-27738, City of Toronto The following figures have been prepared as part of the Phase Two CSM: Figure 1 Site Location Figure 2 Locations of Potentially Contaminating Activities Figure 3 Site Plan and Areas of Potential Environmental Concern Figure 4 Ground Water Contours Figure 5 Location of Cross Sections Figure 6 Cross Sections The format for the Phase Two CSM is based on that outlined in Table 1 of Schedule E to Ontario Regulation 153/04 and as presented in the Update Phase Two ESA report PHASE TWO CONCEPTUAL SITE MODEL Areas of Potentially Contaminating Activities Based on the findings of the Update Phase One ESA, the following potentially contaminating activities (PCAs) were identified on the Phase Two Property (Note: PCA number and description sourced from Table 2 of Schedule D to O.Reg. 153/04): PCA No. 30: Importation of Fill Material of Unknown Quality (contaminants of concern would include petroleum hydrocarbons (PHCs), polycyclic aromatic hydrocarbons (PAHs), volatile organic compounds (VOCs) and metals) The following are the PCAs that were identified within the Phase One Study Area that, in QP Environmental s opinion, would have the potential to impact the environmental condition of the Phase Two Property: PCA No. 28: Gasoline and Associated Product Storage in Fixed Tanks (contaminants of concern would include PHCs and VOCs) Figure 2 identifies the locations of the PCAs noted above.

34 PHASE TWO CONCEPTUAL SITE MODEL 4780 Eglinton Avenue West, Toronto, ON Areas of Potential Environmental Concern As a result of the above-noted PCAs, the following areas of potential concern (APECs) were identified on the Phase Two Property: APEC No. 1 the presence of fill material of unknown quality across the entire Phase Two Property APEC No. 2 the potential for impacts to the soil and/or ground water in the southwest portion of the Phase Two Property from the presence of a gasoline station approximately 50 m southwest of the property. This is an inferred down gradient direction to the Phase Two Property (Figure 4) Figure 3 identifies the locations of the APECs noted above Subsurface Structures and Utilities There are no known underground utility services present across the Phase Two Property. Future development will include the installation of utilities beneath the property, however, details of these plans are not known at this time. Based on the depth of ground water at the Phase Two Property, the nature of the overlying soils, the fact that no contaminants above the applicable standards were identified and the planned future residential land use, it is QP Environmental s opinion that the future utilities are unlikely to be a concern in regards to potential preferentially pathways for contaminants Physical Setting In general, a fill interval appears to be present across most, if not all, of the Phase Two property. The thickness of the fill was observed to range from less than 0.5 metres (m) to as much as approximately 3 m. The thicker fill intervals were encountered in the western portion of the Phase Two Property. The fill material was observed to be generally comprised of silty sand with varying percentages of gravel and clay. In boreholes BH and BH2-2015, trace fragments of apparent concrete were encountered at depths ranging from approximately 1.5 to 3.0 metres below ground surface (mbgs). The native soil encountered in the boreholes below the fill was observed to be silty clay / clayey silt with trace silty sand and/or granular material to the maximum depth sampled of approximately 4.57 mbgs. Bedrock was not encountered to the maximum depth drilled of approximately 12 mbgs. Based on MNDM mapping, bedrock in the area of the Phase Two Property is described as consisting of shale, limestone, dolostone and siltstone of the Georgian Bay Formation and is anticipated to be at a depth of approximately 25 mbgs. Figures 5 and 6 present two cross-sections through the Phase Two Property. Three ground water monitoring wells were installed on the Phase Two Property and all were screened within the native soils. The depth to the water table ranged from approximately 8 to

Based on the recorded water level elevations, the inferred ground water flow direction across the Phase Two Property appears to be towards the southwest (Figure 4). The average hydraulic conductivity was not recorded at the time the wells were present on the Phase Two Property, however, given the nature of the native soils (i.e., silty clays), the hydraulic conductivity is anticipated to be relatively low. The horizontal hydraulic gradient for the Phase Two Property was calculated at As nested monitoring wells were not installed, it is not possible to calculate a vertical hydraulic gradient. However, based on the recorded water elevations and the stratigraphy encountered, it is QP Environmental s opinion that the vertical hydraulic gradients at the Phase Two Property are likely downwards. Based on the conditions observed on the Phase Two Property and within the Phase One Study Area, Sections 41 and 43.1 of O.Reg. 153/04 would not apply to the RSC Property. As noted previously, fill material from unknown sources has been deposited on the Phase Two Property over the years and is the main PCA of concern to the property. In addition to this historical in-filling activity, some more recent soil material has been stockpiled in the central portion of the Phase Two Property. This stockpiled soil originates from a development project across Widdicombe Hill Boulevard to the west of the Phase Two Property. Analytical data collected on the stockpiled soil has reported it to meet the Table 1 standards. All of this material is planned to be removed within the next few months and to be used as fill at the site it was originally generated. The owner of the Phase Two Property is the same owner of the property where the soil originated, a site that was previously undeveloped. The Phase Two Property is planned for redevelopment in the future as a townhouse residential development. This will include the construction of a new municipal road. The exact locations of the proposed structures associated with the development were not confirmed at the time of preparation of the Phase Two CSM Areas of Contamination on the Property There were no exceedances of the Table 3 residential / parkland / institutional property use standards in any of the soil or ground water samples analyzed from the Phase Two Property. Based on these findings, no areas of contamination are anticipated to be present. Given the fact that no contaminants above the applicable standards have been identified in soil or ground water at the Phase Two Property, there are no known concerns for potential exposure to human or ecological receptors.
