1 REGULATION ON PROCEDURE OF ASBESTOS-CONTAINING WASTE ("Official Gazette of the Republic of Serbia", No. 75/2010) Article 1 This Regulation shall set forth the manner in which asbestos-containing waste will be packaged, criteria, conditions and manner of disposal of waste as well as other measures preventing the distribution of asbestos fibres and particles into the environment. Article 2 This Regulation shall refer to raw asbestos waste, i.e. asbestos-containing waste. A list of asbestos-containing waste has been printed and attached to this Regulation, making up its inseparable part. Article 3 Terms used in this Regulation shall have the following meaning: 1) asbestos includes the following silicate fibers: - Crocidolite (blue asbestos), - Actinolite - Anthophyllite - Chrysotile, (white asbestos), - Amosite (brown asbestos), - Tremolite 2) asbestos-containing waste (herein referred to as: asbestos waste) is raw asbestos waste and any material or object that contains asbestos and asbestos fibers, as well as asbestos particles emitted into the air during the handling of asbestos or any substance,, material or product that contains asbestos, whose owner is disposing of, plans to dispose or shall dispose of.

2 3) surface hardening (case hardening) is the action of asbestos fibers adhering to the surface of another material and create a layer of hard asbestos waste or a binding layer that stops the emission of asbestos fibers into the environment from loosely-bound asbestos waste; 4) working with/handling products that contain asbestos includes actions from which it is possible that asbestos will be released into the environment, other than the actions stated in point 3 of this article; 5) raw asbestos is the substance attained from grinding the mineral asbestos; 6) loosely-bound asbestos waste is asbestos waste matter with less than 1000 kg/m 3 mass; 7) solidification of asbestos waste is the action in which asbestos particles, raw asbestos waste or loosely-bound asbestos waste are homogenously mixed with cement or another hydraulic binding material and binds with it to create a compressive strength of at least 10 N/mm² and stops the emission of asbestos fibers in the environment; 8) asbestos use includes actions which include the handling of more than 100 kg of raw asbestos per year and which refers to: (1) production of raw asbestos mineral, except the processes which are in direct correlation to mining the mineral, and/or (2) production of products that contain asbestos, including: - asbestos cement or products made from asbestos cement - asbestos friction products, - asbestos filters, - asbestos textiles, - asbestos paper and cardboard, - asbestos gaskets, - asbestos packaging materials, - asbestos strengthening materials, - asbestos flooring, - asbestos fillers;

3 9) destruction of asbestos fibers is the chemical, thermal or mechanical treatment of asbestos waste wherein different compositions or minerals are created from the asbestos or wherein the asbestos looses its fibrous structure; 10) firmly-bound asbestos waste is asbestos waste matter with more than 1000 kg/m 3 mass. Article 4 Products which contain asbestos shall be subject to frequent air emission testing, i.e. liquid emissions from facilities in compliance with law. In facilities where asbestos is used during production, measures and limit values determined by special regulations on air emission limit values and water discharge shall be applied by the best available techniques (BAT), determined by permit in compliance with the law. Article 5 In the production of products containing asbestos, treatment shall be provided for liquid waste which occurs as a result of the production process for products containing an asbestos concentration lower than the maximum specification allowed to be released into the recipient. If the liquid waste released, occurring during cleaning or maintenance of the facility, contains asbestos in a concentration lower than the maximum specification allowed, their release into the recipient shall be allowed in compliance with special regulations. Article 6 In activities preformed with products containing asbestos all required measures shall be taken in the prevention of contamination of the environment with asbestos fibers or particles which are occurred as a result of performing such activities. Production of products which contain asbestos and treatment of products which contain asbestos shall be done in compliance with the plan to remove asbestos or materials containing asbestos from buildings, construction or equipment, which specifically contain: 1) activities which require maximum removal of asbestos or materials which contain asbestos before the removal of buildings, construction or equipment; 2) health safety measures and employee safety, as well as the obligation to use specific safety equipment in compliance with work safety regulations. Article 7

4 Measures in preventing the spreading of asbestos fibers and particles into the environment shall be taken while collecting, transporting, storing, treating or disposal of asbestos waste. Collecting, transporting, storing, treating and final disposal of asbestos waste shall be done in compliance with the laws referring to waste management. Moving asbestos waste shall follow regulations set in the Moving Harmful Waste document, in compliance with special regulations. Article 8 Asbestos waste shall be packed before transportation to prevent the emission of asbestos fibers and particles into the environment. Before the disposal, asbestos waste shall be treated by means of surface hardening (case hardening) or solidification or destruction of asbestos fibers, to prevent the emission of asbestos fibers and particles into the environment. Transporting asbestos waste to the disposal location shall be done directly without reloading. Containers or packaging materials of asbestos waste shall be visibly marked, in compliance with regulations set for the transport of harmful substances. Loosely-bound asbestos waste shall be packaged in the appropriate impermeable packaging. Asbestos waste disposal shall be done in a way that prevents the emission of asbestos fibers and particles into the environment. Article 9 Before the disposal, asbestos waste shall be packed and covered in such a way that prevents the emission of asbestos fibers and particles into the air or the spilling of liquid that contains asbestos fibers. Final disposal of asbestos-containing waste shall be done under controlled conditions (underground storing in mines, waste disposal sites or other), in compliance with special regulations. Article 10 Asbestos waste taken to waste disposal sites shall be done under the following conditions: 1) it shall be disposed of in special containers, visibly marked and intended for the disposal of asbestos waste, separated from other waste at the waste disposal site;

5 2) daily covering shall be done in a way that does not emit asbestos fibers into the environment; 3) after closing the container that contains asbestos waste, all other activities (opening the container, digging, drilling or other) shall be forbidden so as to prevent the emission of asbestos fibers and particles into the environment. Asbestos waste may be stored at the dumpsite or landfill without prior eluat analysis in compliance with the law which refers to waste management and special regulations, if: 1) it does not contain any other harmful substance other than firmly-bound asbestos; 2) includes construction waste which contains firmly-bound asbestos and other firmlybound asbestos waste. If the waste disposal sites do not have specially made containers for disposal of asbestos waste, storage of asbestos waste shall be done in the operational section of the dumpsite or landfill until its final disposal so as to prevent the emission of asbestos fibers into the environment. Article 11 This Regulation shall enter into force on the eighth day from the day of its publication in the "Official Gazette of the Republic of Serbia". Attachment LIST OF ASBESTOS-CONTAINING WASTE 1. Firmly-bound asbestos waste construction asbestos-containing waste and mostly non-organic substances: 1) Asbestos cement products: a) large flat or undulating panels, b) small facade or roof panels, v) asbestos cement items (vessels for vegetables etc.) g) pipes used in high-rise or low-rise construction, d) pipes used in the distribution and removal of water, i.e. plumbing; 2) Asbestos cement particles and asbestos cement sludge particles and sludge from the processing of asbestos cement; 3) Brake liners and pads which contain asbestos and firmly-bound non-organic waste which contains asbestos: a) Brake liners and pads for vehicles and industrial use,

6 b) liners for assembly lines; 4) waste which contains asbestos processed by hardening means: a) asbestos which has been injected and/or by catching a hardening nonorganic binder, b) processed light construction panels, fireproof panels and fire retardant panels, v) processed asbestos paper and cardboard, g) other processed loosely-bound waste which contains asbestos such as asbestos tape and fabric. 2. Firmly-bound asbestos waste construction waste which contains mostly organic substances and has occurred in the processing of asbestos: 1) Materials polluted by asbestos fibers: a) construction elements and equipment that is used in the removal of looselybound asbestos, b) flooring, textiles, curtains, v) foils, g) insulation materials, d) safety work clothes; 2) chemical construction products that contain asbestos: a) adhesive putty, surface putty, b) fillers and encapsulating mass, v) sealers, g) plastics and glue, d) dyes; 3) Other asbestos-containing waste with mostly organic substances: a) flooring, b) acid proof containers,

7 4) Asbestos waste hardened by non-organic binders; 3. Loosely-bound asbestos waste insulation materials that contain asbestos: : 1) Asbestos-containing waste occurring during reconstruction or maintenance of buildings or building equipment; 2) Dust which contains asbestos, asbestos particle or asbestos sludge: a) dust particles from filters, b) raw asbestos occurring during the processing of asbestos, v) loosely-bound material that contains asbestos from construction elements or equipment, g) asbestos sludge occurring during waste water cleaning or building demolition and equipment that contains loosely-bound asbestos; 3) Light panels containing asbestos: a) light construction panels, b) fireproof panels, v) fire retardant panels; 4) Textiles and filters containing asbestos: a) tape, bendable pipes, fabrics, protective clothing for high temperatures, b) asbestos panels and gaskets, v) asbestos paper and cardboard.
