1 HAZARDOUS WASTE The Hazardous Waste (Management and Handling) Rules were enacted first in the year These rules classified hazardous waste into 18 categories in its Schedule I based on the constituents present. The Government of India amended the Rules in the year 2000 (principally to bring them in compliance with the Basel Convention) and further in the year 2003 (to include Environmentally Sound Technologies for recycling of Hazardous Waste). In exercise of the powers conferred by sections 6, 8 and 25 of the Environment (Protection) Act, 1986 (29 of 1986), and in supersession of the Hazardous Wastes (Management and Handling) Rules, 1989, except in respect of things done or omitted to be done before such supersession, the Central Government notified the Hazardous Wastes (Management, Handling and Transboundary Movement) Rules, 2008 with Amendments of 2009 and Hazardous Waste means any waste which by reason of any of its physical, chemical, toxic, reactive, flammable, explosive or corrosive characteristics causes danger or is likely to cause danger to health or environment, whether alone or when in contact with other waste or substances, and shall include:- Waste substances, which are generated in the process indicated in Column-2 of Schedule-I and consists of wholly or partly of the waste substances, referred to in Column-3 of the same Schedule. Waste substances, which consists of wholly or partly of substances indicated in Schedule-II, unless the concentration of the substances is less than the limit indicated in the same Schedule. Waste substances, specified in Part A or Part B of Schedule-III in respect of import or export of such wastes in accordance with rules 12, 13 and 14 or the waste other than those specified in Part A or Part B if they possess any of the hazardous characteristics specified in Part C of that Schedule. 3 At present there is no Treatment, Storage and Disposal Facility (TSDF) operational in J&K. However J&K State Industrial Corporation (SIDCO), as per notification issued, has notified 80 kanals of land for setting up of Treatment, Storage and Disposal Facility (TSDF) at industrial growth Centre (IGC), Samba. An Integrated Common Hazardous Waste Treatment, Storage, Disposal and Recycling facility (ICHWTSDRF) is proposed to be set up at Phase-II, IGC, Samba. Public Hearing for the said facility has been conducted by J&K SPCB on AUTHORISATION UNDER HAZARDOUS WASTE (MANAGEMENT, HANDLING AND TRANSBOUNDARY MOVEMENT) RULES, 2008 with Amendments thereof. Authorization means permission for generation, handling, collection, reception, treatment, transport, storage, recycling, reprocessing, recovery, reuse and disposal of hazardous wastes granted under sub-rule (4) of rule 5. Every person engaged in generation, processing, treatment, package, storage, transportation, use, collection, destruction, conversion, offering for sale, transfer or the like of the hazardous waste or occupier of the facility, shall make an application in Form 1 to the State Pollution Control Board, for authorization. All the authorization cases, whether fresh or renewal must be accompanied with:- a) Photographic proof of properly labeled/packed hazardous waste as per provisions of Hazardous Wastes (Management, Handling and Transboundary Movement) Rules, 2008 and properly installed/maintained and permanently marked display board (02 nos.-one inside and one outside the unit premises), as prescribed by the Board. b) On-site emergency plan, safety report, safety audit report and other relevant documents (which ever is applicable) under Manufacture, Storage and import of Hazardous Chemical (Amendment) Rules, c) Explosive License, License to manufacture insecticides, Public Liability Insurance, Fire Hydrant Layout Plan, etc., (whichever is applicable).. d) Form 4 for filing annual returns by the occupier or operator of facility and Form 6 for filing annual returns and records on recyclable hazardous waste by the recyclers, every year for the preceding period April to March.

4 e) Copy 1 (white) and Copy 5 (green) of Form 13 (Hazardous Waste Manifest) in case of transportation of hazardous waste for treatment and disposal. f) In case of renewal of authorization, previous conditions prescribed by J&KSPCB duly observed by the occupier, to be enclosed. g) For registration of recyclers for recycling or reprocessing the hazardous waste specified in Schedule-IV, an application in Form 5 accompanied with a copy each of the following documents for the grant or renewal of the registration:- 1) Consent to Establish granted by the State Pollution Control Board under the Water (Prevention and Control of Pollution) Act, 1974 (25 of 1974) and the Air (Prevention and Control of Pollution) Act, 1981 (21 of 1981); 2) Certificate of registration issued by the District Industries Centre or any other government agency authorized in this regard; 3) Proof of installed capacity of plant and machinery issued by the District Industries Centre or any other government agency authorized in this behalf; and 4) In case of renewal, certificate of compliance of effluent, emission standards and treatment and disposal of hazardous wastes, as applicable, from the State Pollution Control Board. h) For other relevant forms (Form 1-16) (FOLLOW LINK)

5 PUBLIC INFORMATION ATTENTION OCCUPIER /OPERATOR GENERATING HAZARDOUS WASTE J&K SPCB invites attention of every OCCUPIER /OPERATOR, generating / handling / collecting/receiving/treating/transporting storing/ recycling/ reprocessing/ recovering/ reusing and disposing Hazardous Waste (Refer Schedule-1-List of Hazardous Waste), under Hazardous Waste (Management, Handling & Transboundary Movement) Rules, 2008 with Amendments of 2009 and 2010, to file returns as per details mentioned below: FORMS TO BE FILLED UP BY TO BE SUBMITTED TO RULE FORM-4 Form For Filing Annual Returns By The Occupier/Operator of Facility SPCB by 30 th June 2011, for the preceding period April 2010 to March (6)& 22(2) FORM-6 Form For Filing Annual Returns and Records on Recyclable Hazardous Waste By The Recyclers SPCB by 30 th June 2011, for the preceding period April 2010 to March (7) The filled up forms should reach the office of the Regional Director, SPCB Jammu latest by 30 th June, 2011 or else legal action under Environment (Protection) Act 1986, will be initiated against the defaulters.
