17 Qualified Person s Statements and Certifications As the qualified person, I certify that: A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. A phase two environmental site assessment of the RSC property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary. As of 2013/12/27, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that would interfere with the type of property use to which the RSC property will be put, as specified in the RSC. Ground water sampling has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. As of 2013/12/27, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the RSC property meets the applicable full depth generic site condition standards prescribed by section 36 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this RSC is filed, except for those contaminants (if any) specified in this RSC at Table 2, Maximum Contaminant Concentrations Compared to Standards Specified in a Risk Assessment. As of 2013/12/27, the maximum known concentration of each contaminant in soil, sediment and ground water at the RSC property for which sampling and analysis has been performed is specified in this RSC at Table 1, Maximum Contaminant Concentrations Compared to Applicable Site Condition Standards. I am a qualified person and have the qualifications required by section 5 of the regulation. I have in place an insurance policy that satisfies the requirements of section 7 of the regulation. I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry. The opinions expressed in this RSC are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location. PHYSICAL SETTING OF THE SUBJECT PROPERTY The phase two property originally consisted of one whole property and parts of two other properties. The municipal address for the larger whole property is 350 Dundas Street South, Cambridge, Ontario. The phase two property also includes portions of the properties at 95 Morning Calm Drive and 360 Dundas Street South. All three properties are collectively referred to as the phase two property. Figure 1 shows the phase two property. The property fronts on Dundas Street South and is located about 80 m southeast of the intersection of Franklin Boulevard and Dundas Street South. The 350 Dundas Street South property is approximately 1.1 ha in size, the portion of 95 Morning Calm Drive is approximately 0.1 ha in size, and the portion of 360 Dundas is approximately 0.03 ha in size, for a total area of 1.2 ha. The phase two property is located in an urban area. The property generally slopes in a southwesterly direction from a high of 293 m above sea level (asl) in the northeast corner to a low of 284 m asl in the southwest corner. There are no permanent water bodies on the property. 1

The nearest body of water is Moffat Creek located 180 m south of the southwest corner of the phase two property. 2. The groundwater flow direction confirmed in the Phase Two ESA confirms that these properties and associated PCAs are cross gradient and therefore there are no APECs associated with the offsite PCAs Nos. 10, 2

PCA No. 52, potential maintenance of equipment is considered to be an area of potential environmental concern. 2.3 AREAS OF POTENTIAL ENVIRONMENTAL CONCERN Areas of potential environmental concern identified at the phase two property are illustrated in Figure 2. Potentially Impacted Media Soil and ground water Soil and Ground water Soil Contaminants of Potential Concern PHC, PAHs, metals PHC, PAHs PHCs, PAHs 2.4 SUBSURFACE STRUCTURES AND UTILITIES ON PHASE TWO PROPERTY A single family residence was located on the property adjacent to Dundas Street South. This residence was demolished in October Underground utilities were limited to a water line and gas line connecting the residence to utilities on Dundas Street. Sanitary wastes were discharged to a concrete holding tank and this tank was removed in January No other subsurface structures or utilities were located on the phase two property. 2.5 STRATIGRAPHY The stratigraphy was investigated by the installation of boreholes, monitoring wells and test pits. A preliminary phase two environmental investigation included the installation of four boreholes with three of these completed as monitoring wells and the excavation of nine test pits. Additional phase two investigation involved the installation of three additional boreholes with one of these completed as a monitoring well and the excavation of 18 test pits. Five boreholes were advanced for geotechnical investigation. The locations of all boreholes, monitoring wells and test pits are shown on Figure 3. The surficial geology in this part of Cambridge largely consists of sand and gravel outwash deposits along the eastern side of the Grand River. The stratigraphy encountered during the subsurface investigation was generally consistent across the property, with an unconfined sand or sand and silt unit extending from ground surface to the maximum depth investigated 3

42 Phase Two Conceptual Site Model 350 Dundas Street South, Cambridge, Ontario (15.2 m below ground surface (bgs) at MW11-2). The sand unit contained layers of sand and silt and layers of sand and gravel. A layer of fill was identified in the central portion of the property. Figures 4 and 5 are cross sections showing the stratigraphy of the subject property from the ground surface to the deepest aquifer investigated. The orientations of the cross-sections are shown in Figure HYDROGEOLOGICAL CHARACTERISTICS OF HYDROSTRATIGRAPHIC UNITS No contamination was identified in the surfical aquifer at the property; therefore only the surficial aquifer was investigated. The surficial water table is located at about 278 masl, which varies from 7 m bgs to 14 m bgs due to the topography. The sand and gravel overburden extends to a depth of about 35 m bgs based on the available literature and well records for the area. The phase two property is located in the well head protection area (WHPA) for both the Elgin Street Well Field and the Middleton Street Well Field. Both of these well fields obtain water from the bedrock aquifer. 2.7 DEPTH TO BEDROCK The dolostone of the Guelph formation is located at a depth of about 35 m below ground surface. 2.8 DEPTH TO WATER TABLE The ground water contours for April 30, 2013 are shown in Figure 6. The depth to water varied from about 7 m bgs at MW11-4 and MW1-12 to about 14 m bgs at MW11-2. MW11-4 and MW1-12 were located in the lowest areas of the property. The ground water flow direction is inferred to be towards the southwest. The horizontal gradient was approximately m/m on July 11, 2012 and approximately m/m on April 30, WITH RESPECT TO SECTION 41 OR 43.1 OF O. REG. 153 The phase two property is not considered to be environmentally sensitive as per the definitions provided in Section 41 of O.Reg.153/04. The phase two property is not part of or adjacent to an area of natural significance and the soil ph is within the permitted ranges of 5 to 11 for subsurface soils and 5 to 9 for surface soils. The property is not a shallow soil property and does not include or is within 30 m of a water body and therefore is not considered environmentally sensitive under Section 43.1 of O.Reg.153/ FILL MATERIAL Fill material was identified on the phase two property and is identified as APEC 1 and described below. 4

43 Phase Two Conceptual Site Model 350 Dundas Street South, Cambridge, Ontario 2.11 LOCATIONS OF PROPOSED BUILDINGS AND OTHER STRUCTURES The subject property will be redeveloped for residential use. Buildings (town homes) and their associated driveways and parking areas will cover a majority of the site. A total of 53 units in eight blocks are proposed. 3. CONTAMINANTS PRESENT ON PHASE TWO PROPERTY 3.1 AREAS OF POTENTIAL ENVIRONMENTAL CONCERN APEC 1 Imported Fill of Unknown Origin Fill material was identified in the central portion of the property. A total of 19 test pits and four boreholes / monitoring wells were completed in the area of the fill material to confirm the quality of the fill material and to delineate the fill material. The limits of the waste fill layer were delineated during the excavation of additional test pits by extending the test pit until the visual edge of the waste fill was encountered. Figure 7 shows the locations of the test pits and boreholes / monitoring wells completed and Figures 8 and 9 provide cross sections identifying the sample locations. Two distinct types of fill material were identified. The overlying fill material was a sand and gravel material. Based on the type of material, evidence from a 1993 aerial photograph, and anecdotal evidence it is believed this overlying fill material originated from the property immediately to the south (95 Morning Calm Drive). The fill material beneath the overlying fill material contained various waste materials (household waste, construction waste and potentially foundry sand, etc.). The waste fill material was visually identifiable in that it had a distinctive dark colouring. The limits of the waste fill layer were confirmed both visually and through analytical testing. Soil samples were analyzed for petroleum hydrocarbons (PHC), metals, polycyclic aromatic hydrocarbons (PAHs), and volatile organic compounds (VOCs). The contaminants of concern (COC) were PHC F3, metals and PAHs. All of the samples where concentrations of compounds exceeded the SCS were associated with the waste fill material. Concentrations of PAHs were found to exceed the SCS on all samples from the waste fill layer and occasionally concentrations of metals and PHC exceeded the SCS in these samples. Figure 7 shows the concentrations of COCs in soil that exceeded Table 2 SCS. It appears that either there was an existing depression on the property or excavation of the property occurred at some point in the past. Waste fill material consisting of various materials including household garbage, construction debris, fill and potentially foundry sand was placed in this depression/excavation. This material was then covered with a sand and gravel material that was likely moved from the town home development to the south of the property. There were no subsurface structures or utilities in the area of the waste fill material (APEC 1) hence there was no potential to affect contaminant transportation and transport. The COCs in soil (PHC F3, metals and PAHs) have limited mobility and leaching to groundwater is not expected. MW11-3 was installed within the area of the fill. The groundwater was sampled and 5

44 Phase Two Conceptual Site Model 350 Dundas Street South, Cambridge, Ontario analyzed for PHCs, PAHs and VOCs on three occasions with all results less than Table 2 SCS confirming leaching from the soil COCs had not occurred. Figure 11 provides a conceptual exposure model for the COCs identified in soil (PHC F3, metals and PAHs). The COCs are not volatile so the distribution mechanisms would be direct contact, particles becoming airborne, and possibly leaching to groundwater. The potential receptors would be residents, workers and visitors for human health, and mammals and birds for ecological receptors. Plants could be exposed if the root system extended to the depth of the COCs and soil organisms could be exposed if they were present at depth. APEC 2 Fuel Oil Storage Associated With Heating System for Former House The former house had a natural gas furnace at the time of the phase two investigation but had historically used fuel oil as a heating source. A fuel oil aboveground storage tank (AST) was located in the house prior to demolition. BH1 was advanced at the exterior fill pipe for the former heating oil AST. No staining was observed and results for soil analytical testing for PHCs, metals and PAHs were below Table 2 SCS. There are no COCs associated with APEC 2. As well, there were no subsurface structures or utilities in APEC 2 hence there is no potential to affect contaminant transportation and transport. APEC 3 Possible Maintenance of Vehicles on Adjacent Property A trucking facility is located adjacent site to the north of phase two property. It is possible that vehicle maintenance has occurred in the past. There are no indications that there are underground storage tanks located on the property to the north. The environmental concern is limited to near surface contamination by oil and greases on the north property boundary at the west (rear) corner of the off-site building. Test pits were excavated adjacent to the property to the north which indicated that the fill material associated with APEC 1 extended to the northern property boundary. The remedial excavation for APEC 1 extended to the north property boundary in this area eliminating APEC 3 as an environmental concern. There were no subsurface structures or utilities at the property boundary at APEC 3 hence there is no potential to affect contaminant transportation and transport. As all contaminants are associated with soil, any climatic or meteorological conditions would not have influenced the distribution and migration of the contaminants. 4. REMEDIATION PROGRAM Figures 8, 9 and 10 show the extent of the soil excavation and locations of confirmatory soil sampling. Remediation involved the removal and stockpiling of the overlying fill material. The total volume of this fill material was 2,550 m 3. Sampling according to Section 36 of Schedule E of 6

45 Phase Two Conceptual Site Model 350 Dundas Street South, Cambridge, Ontario O.Reg. 153/04 and analysis of this material was completed. A total of 17 samples were analyzed for the COCs and were confirmed to meet Table 2 SCS. The material will be used as part of the overall site grading. No fill will be required to be imported for the proposed development. The waste fill material was excavated and stockpiled within the limits of the excavation. The limits of the waste fill material were visually evident. Samples were collected to confirm that the material had concentrations of COCs that exceed Table 2 SCS. A total of 6,780 m 3 (14, tonnes) of waste material were disposed at an approved facility. All impacted soil was excavated and removed from the site. No soil treatment occurred on site. The area of the excavation was approximately 3,600 m 2. Confirmatory floor and wall samples were collected and analyzed for COCs according to Section 39.7 of Schedule E of O.Reg. 153/04. A total of 33 confirmatory soil samples were collected from the floor of the excavation. The sample density was about one sample per 110 m 2 which exceeds the requirements. Samples were analyzed for PHC, PAHs and metals. Concentrations of PAHs in one confirmatory soil sample (F-12-5) were above the SCS. The excavation was deepened by 1 m in this area and the confirmation sample confirmed that all contaminated material had been removed. A total of 9 confirmatory samples were collected along the walls of the excavation. There were no walls of the excavation in some areas and the excavation extended to the property line on the northwest and southeast extents. The excavation and removal of the waste fill material confirmed that the waste fill material was placed in a depression and/or excavation on the property and subsequently covered with a layer of sand and gravel material which was likely native material from the property to the south. 7
