1 Waste Control Regulation Project Alberta Environmental and Sustainable Resource Development March 5, 2015

2 Project Objective Waste Control Regulation (WCR) addresses: Hazardous Waste and Hazardous Recyclables Non-hazardous waste Financial security requirements General provisions for waste management and waste management facilities Many aspects of the Waste Control Regulation are outdated. This project will review and update the WCR.

4 Phase I Administrative Changes Phase I expected to be complete by December 31 st, 2015 Add expiry date, as required Make administrative changes Can include updating definitions or clarify wording. This does not include anything that changes the intent of the regulation.

5 Phase II Internal Review ESRD staff will complete research and policy analysis of outstanding issues. Previous work included in the review: Recommendations made by the Hazardous Waste Technical Committee (2006) Recommendations from 2008 consultation The goal is to ensure previous recommendations remain valid and harmonized with current standards.

6 Phase II Issues List The issues that will be reviewed in the WCR project have been grouped under 6 categories for simplification purposes: Waste Management Facilities Waste Classification/Hazardous Waste Beneficial Use of Waste Reporting & Manifesting Treatment & Importation Other Issues

7 Waste Management Facilities Composting Facilities - replace Code of Practice for Compost Facilities with Standards for Composting Facilities in Alberta Landfills Hazardous Waste and Chemical Storage Financial Security Solid Waste Operator Certification Programs Waste Management Facility Definition Offensive Odours

8 Standards for Composting Facilities Key changes from Code to Standards if adopted as currently written: New classifications for composting facilities More details on Operations Plan requirements List of acceptable feedstock Harmonized liner requirements with manure storage requirements under the Agricultural Operations Practices Act Requirements for an Odour Management Plan and responding to odour complaints

9 Will updates to the Standards for Landfills in Alberta and Standards for Composting Facilities in Alberta be included in this review? There currently is no review planned for these two Standards under this project. However, there may be recommended updates to the Standards based on the regulation review.

10 Phase III Talking with Stakeholders Conduct targeted stakeholder engagement on outstanding issues identified in Phase II. Staff anticipate this will occur in 2016.

11 Phase IV Update Regulation Staff anticipate that regulatory amendment work to be completed and the new Regulation to be registered by the end of 2017 Changes to be effective by 2018

12 How Can I Get Involved? Policy staff within ESRD will connect with stakeholders in 2016 to have one-on-one conversations or workshops related to the waste management issues being reviewed. An has been set up to take questions specifically related to this project: ESRD.WasteRegulation@gov.ab.ca

19 Other Issues Storage Containers review and revise Section 41 of the WCR Litter Clarification and improvement of litter control provisions
