Application for obtaining environmental clearance under EIA notification dated for river bed mining of minor minerals(sand) in the revenue estate of Village Amir Khas, Tehsil Jalalabad, District Fazilka submitted by the General Manager-Cum- Mining Officer, Department of Industries and Commerce, Fazilka. This has reference to your application dated (received on ), for obtaining environmental clearance under EIA notification dated for carrying out river bed mining of 39,200 TPA of minor minerals(sand) in an area of 3.18 hectares located in the revenue estate of Village Amir Khas, Tehsil Jalalabad, District Fazilka. It is intimated that the Govt. of Inida, Ministry of Environment & Forests, New Delhi vide Office Memorandum No. J-13012/12/2013-IA-II(I) dated has laid down the following stipulations in respect of river sand mining projects: "(iii) No river sand mining project, with mine lease area less than 5 ha, may be considered for granting EC. The river sand mining projects with mining lease area > 5 ha but < 25 ha will be categorized as 'B2'. In addition to the requirement of documents, as brought out above under sub-para (ii) above for appraisal, such projects will be considered subject to the following stipulations: (a) (b) (c) (d) (e) (f) The mining activity shall be done manually. The depth of mining shall be restricted to 3 m/water level, whichever is less. For carrying out mining in proximity to any bridge and/or embankment, appropriate safety zone shall be worked out on case to case basis to the satisfaction of SEAC/SEIAA, taking into account the structural parameters, locational aspects, flow rate, etc. and no mining shall be carried out in the safety zone so worked out. No instream mining shall be allowed. The mining plan approved by the authorized agency of the State Government shall inter-alia include study to show that the annual replenishment of sand in the mining lease area is sufficient to sustain the mining operations at levels prescribed in the mining plan and that the transport infrastructure is adequate to transport the mines with taurpoline to minimize dust/sand particle emissions. EC will be valid for mine lease period subject to a ceiling of 5 years.

2 Provided, in case the mining lease area is likely to result in a cluster situation i.e. if the periphery of one lease area is less than 1 km from the periphery of another lease area and total lease area equals or exceeds 25 ha, the activity shall become category 'B1' project under the EIA notification, In such a case, mining operations in any of the mine lease areas in the cluster will be allowed only if the environmental clearance has been obtained in respect of cluster." The application has been perused meticulously and it has been noted that the project proponent has applied for sand mining in an area less than 5 hectares and as per aforesaid OM of MoEF, no river sand mining project, with mine lease area less than 5 hectares may be considered for granting EC. As such, the application submitted by the project proponent, is hereby, returned in original. DA: As above. Member Secretary (SEIAA)

3 Kindly peruse the NP of this file. It is submitted that the General Manager- Cum-Mining Officer, Fazilka, vide letter no. 33 dated , has resubmitted the application for obtaining environmental clearance under EIA notification dated for mining of minor minerals(sand) in the agricultural land situated in the revenue estate of Village Amir Khas, Tehsil Jalalabad, District Fazilka. The General manager-cum- Mining Officer has mentioned in the said application that as per the OM dated of the MoEF no river sand mining projects with mine lease area less than 5 hectare may be considered for grant of environment clearance. However, any area falling outside riverbed and not getting annual replenishment of sand should not be considered as river sand mining projects and such projects may be appraised under category B-2 as per condition no I(ii) of the said OM. The details of the project are as under: 1. About 39,200 Ton/year of mining of minor minerals(sand) will be carried out in an area of 3.18 Hectare from the private agricultural land outside riverbed upto a depth of 3.0 m, located in the revenue estate of Village Amir Khas, Tehsil Jalalabad, District Fazilka in H.B. no. 270, Khasra no.: 9M//19, 1M//14, 16/2, 17, 2M//10, 11, 12, 19, A letter no. 434 dated issued by Department of Forest & Wildlife, Fazilka to the effect that village Abdul Khalik alias MianiBasti, Amir Khas, Badha, Ghurka, Hasta Kalan, RukhnaQasim, GaaganKe, Shikarpur alias KanwaanwaliPatan and Mohan Singh Hidhardo not fall under forest area. 3. As per point 1(vi) of the pre-feasibility report no Reserve Forests/Wildlife Sanctuary/ National Park are existing within a radius of 10km of the project site. 4. A certificate duly signed by the General Manager-cum-Mining Officer to the effect that there is no other existing/proposed mining site within a radius of 500 m from the periphery of this project site, so as to ascertain as to whether General Condition is applicable to the project or not in compliance to Notification no. 2731(E) dated Contours plotted in a proper manner of the project site including a stretch of at least 500m outside the periphery of project site. 4. Transportation route map showing various habitations through which it passes. May if approved, the case be placed in the 91 st meeting of the SEAC to be held on A.E.E.(SEAC) E.E.(SEAC)

6 It is submitted that the General Manager-cum-Mining Officer was requested by the SEAC vide letter no. 288 dated 24/1/2014 to attend the 91 st meeting of SEAC on 25/1/2014. Ltd., Hyderabad The Environmental Consultant presented the details of the project proposal before the SEAC as under : i) About 39,200 Ton/year of mining of minor minerals(sand) will be carried out in an area of 3.18 Hectares from the private agricultural land outside riverbed upto a depth of 3.0 m, located in the revenue estate of Village Amir Khas, Tehsil Jalalabad, District Fazilka in H.B. no. 270, Khasra no.: 9M//19, 1M//14, 16/2, 17, 2M//10, 11, 12, 19, 20. ii) The soil in the area is alluvium with layers of sand and silt and de-siltation of agriculture land is required to remove the infertile sand layer present below the top soil cover to improve the fertility of the land. iii) The removal of sand layer also helps in improving the soil moisture in the agriculture land. iv) The sand removed in the de-siltation process, rather than going as waste, will have economic value. v) Based on the site geography, it is estimated that the sand deposit in the quarry area is more than years old. vi) Sutlej River is located at a distance about 5.7 km NW from the mine lease area. vii) The Flood Protection Embankment along the river was erected in the year 1950 and the sand deposition in the quarry was prior to that.

7 viii) No forest area falls in the proposed mining site and a letter bearing no. 434 dated has been issued by Department of Forest & Wildlife, Fazilka in this regard. ix) No mining activity has been started at site, so far. x) Mining will be carried out by manual opencast method by hand tools without drilling and blasting. xi) Top soil of m thickness will be scrapped and stored in mining lease area and used for rehabilitation of exhausted mine pits. xii) Sand will be excavated in benches upto a depth of 3.0 m from surface. xiii) The mineral extraction will be done for a period of 225 days in a year excluding monsoon season. xiv) Mining will be carried out only during day time. xv) A safety barrier of 7.5m width will be maintained xvi) Plantation will be carried out on safety barrier to develop a green belt. xvii) No waste will be generated as the entire sand is saleable and will be utilized. xviii) About 18 trips per day of 10 tonne capacity tippers will be required for sand transportation. The sand will be transported by village road via Shamsuddin chisti village (about 2 km) upto Fazilka Ferozepur Road (SH-20) and from there to the buyers location. xix) Only 3 Kl of water will be used for various purposes which will be taken from nearby village through tanker. xx) xxi) Water table of the area is at meter below ground level. Environmental Management Plan (EMP) has been prepared containing the following components and about Rs. 60,000 per annum will be incurred for implementation of EMP. Air Environment : Water sprinkling for dust suppression along the unpaved transport roads Transportation of sand with trucks covered with tarpaulin. Regular maintenance of transport vehicles Periodic health check up for the workers. Plantation along approach roads. Provision of dust mask, if required Water Environment: A 7.5 m wide safety barrier will be left around the mine lease to protect the pit slope. Thick plantation will be carried out on this barrier to control soil erosion. Mining will be closed during the monsoon season. Surface run-off from the mine lease area will be collected in mine pit and will be allowed to percolate into ground.

8 Socio Economic Environment : About 30 persons will get direct employment and more than 40 persons will get indirect employment opportunities. Donation to village panchayat for social welfare activities. Land Environment : Top m thick layer of soil will be separately scrapped and stored for restoration of the mined pits. Mining will be restricted to maximum 3m depth. Slopes of the mine pits will be maintained below 30 Mined pits will be spread with top soil mixed with manure and will be restored for agriculture use. Plantation will be carried out on the safety barrier left along the mine lease boundary. Fencing will be made around the pit During presentation, the representative of Deptt. of Industries and Commerce submitted the following documents and the same were carefully looked into by the Committee and thereafter, the same were taken on record by the Committee :- Mining plan duly approved by the State Geologist. A certificate duly signed by the General Manager-cum-Mining Officer to the effect that there is no other existing/proposed mining site within a radius of 500 m from the periphery of this project site, so as to ascertain as to whether General Condition is applicable to the project or not in compliance to Notification no. 2731(E) dated Contours plotted in a proper manner of the project site including a stretch of at least 500m outside the periphery of project site. The Committee looked into notification no. 2731(E) dated 9/9/2013 vide which the MoEF has made amendments in the EIA Notification dated 14/9/2006 and noted that the general condition is not applicable to the mining project of minor minerals having area less than 5 Hectares. Since, the area of this project is less than 5 Hectares and there is no other mining site within 500 meters from the periphery of this mining site, as such, general condition does not apply to this project. The Committee also perused the Office Memorandum dated 24/12/2013 of the MoEF in which in para no. I (ii), it has been mentioned that all other minor mineral mining projects with mining lease area less than 25 Hectares, except for river sand mining projects, will be appraised as category B-2 projects and contents of para no. I (iii) of the said office memorandum were perused carefully and noted that no river sand mining project, with mine lease area less than 5 Hectares, may be considered for granting Environmental Clearance. After detailed discussions on the contents of said paras of Office Memorandum dated 24/12/2013, the Committee noted that in this case, the mining of minor minerals is to be done from agricultural land, as such, the project

9 proposal does not relate to river sand mining. Therefore, this project may be appraised as category B-2 project for environmental clearance under EIA Notification as per para I (ii) of OM dated 24/12/2013. Sh. R.K. Kakkar, Prof. (Retd.), Deptt. of Geology, Punjab University, Chandigarh informed that the project proposal for mining of sand from a private land other than river sand may be carried out, but the project proponent is required to maintain the level of the area by refilling the same with some suitable material in consultation with experts in the area of soil science before laying down the overburden removed prior to excavation of sand, so that there should be no significant depression which may cause accumulation of water during rainy season. The project proponent agreed to the same. Accordingly, the expert informed that since the project proponent agrees to the proposal to refill the mining site after excavation of sand with suitable material, as such, the proposal for mining of sand at this site may be considered for environmental clearance. The Representative of the Deptt. of Irrigation (Drainage) categorically informed that the mining site does not fall in any riverine / any natural drainage system and the site will have no impact on the natural drainage pattern of the area and it has been looked at from this angle. After detailed deliberations, the Committee observed that the project proponent has provided adequate and satisfactory clarifications of the observations raised by it. Therefore, keeping in view the stipulations of Office Memorandum dated 24/12/2013 of the MoEF, the Committee decided to forward the case to the SEIAA with the recommendation to grant Environmental Clearance to project promoter for carrying out mining of minor minerals 39,200 Ton/year in an area of 3.18 Hectares from the private agricultural land outside riverbed in the revenue estate of Village Amir Khas, Tehsil Jalalabad, District Fazilka in above said hadbast/khasra numbers, subject to the conditions as mentioned in the extract placed below. If approved the following actions be taken; 1. The extract of the proceedings of 91 st meeting of SEAC held on 25/1/2014 is placed below for signature please. 2. 11 Kindly perused the NP- of this file It is submitted that the General Manager-cum-Mining Officer, Fazilka was requested by the SEIAA vide letter no. 354 dated 28/1/2014 to attend its 60 th meeting on 29/1/2014. Ltd., Hyderabad The Environmental Consultant presented the details of the project proposal before the SEIAA. During discussions, the General Manager-cum-Mining Officer agreed to comply fully with all the conditions as mentioned by SEAC. The SEIAA noticed that the project proponent has not proposed appropriate species of trees to be planted in the green belt and as such, the project proponent will plant only those species of plants as mentioned in the 'Guidelines for Plantation of Trees in Green Belt' for different zones of the State, which are available on the website of SEIAA i.e. seiaapunjab.co.in. The Authority observed that the case stands recommended by SEAC and the Authority looked into all the aspects of the project proposal in detail and was satisfied with the same. Therefore, the Authority decided to grant Environmental Clearance to General Manager-cum-Mining Officer for carrying out mining of minor minerals 39,200 Ton/year in an area of 3.18 Hectares from the private agricultural land outside riverbed in the revenue estate of Village Amir Khas, Tehsil Jalalabad, District Fazilka in above mentioned hadbast/khasra numbers, subject to the conditions as proposed by the SEAC and following additional condition in the 'General Conditions'. Additional Condition no. (xxvi) of 'General Conditions':

12 " The project proponent will plant only those species of plants as mentioned in the 'Guidelines for Plantation of Trees in Green Belt' for different zones of the State, which are available on the website of SEIAA i.e. seiaapunjab.co.in." If approved the following actions be taken: 1) Extract of the proceedings of 60 th meeting of SEIAA is placed below for signature. 2) The Environment Clearance be issued to the project proponent as per FD placed below for signature please. Dated Subject: Environmental clearance under EIA notification dated for mining of minor minerals in the revenue estate of Village Amir Khas, Tehsil Jalalabad, District Fazilka. This has reference to your application for obtaining Environmental Clearance under EIA notification dated for mining of minor minerals in the revenue estate of Village Amir Khas, Tehsil Jalalabad, District Fazilka and subsequent presentation given before the State Level Expert Appraisal Committee (SEAC) seeking prior environmental clearance for subject cited project as required under the EIA Notification, The proposal has been appraised as category B-2 in light of Office Memorandum dated 24/12/2013 of the MoEF and as per procedure prescribed under the provisions of EIA Notification, 2006 on the basis of the mandatory documents enclosed with the application viz., Form-1, pre-feasibility report, approved mining plan and the additional clarifications furnished in response to the observations of the SEAC. It is inter-alia noted that the proposal involves mining of 39,200 Ton/year of minor minerals from the private land in the revenue estate of Village Amir Khas, Tehsil Jalalabad, District Fazilka in H.B. no. 270, Khasra no.: 9M//19, 1M//14, 16/2, 17, 2M//10, 11, 12, 19, 20. After detailed deliberations the Committee decided to forward the case to the SEIAA with the recommendation to grant Environmental Clearance to project promoter for carrying out mining of minor minerals 39,200 Ton/year in an area 3.18 Hectares from the private land in the revenue estate of Village Amir Khas, Tehsil Jalalabad, District Ferozepur in above said hadbast/ khasra numbers, subject to the suitable conditions in addition to the proposed measures. Thereafter, the case was considered by the SEIAA in its 60 th meeting held on and observed that the case stands recommended by SEAC. The Authority looked into all the aspects of the project proposal in detail and was satisfied with the same. Therefore, the Authority decided to grant Environmental Clearance to General Manager-cum-Mining for carrying out mining of minor minerals 39,200 Ton/year in an area 3.18 Hectares from the private land (outside river bed) in the revenue estate of Village Amir Khas, Tehsil Jalalabad, District Ferozepur in above mentioned hadbast/khasra numbers, subject to the following conditions in addition to the proposed measures:

Specific conditions: (i) (ii) (iii) (iv) (v) (vi) (vii) (viii) (ix) (x) (xi) (xii) The environmental clearance will be valid for a period of five years from the date of issuance, as per the provisions of the EIA Notification, 2006 as amended subsequently, for mining of minor minerals in the above said location and khasra numbers. Mining shall be as per the approved Development/Mining Plan prepared for this project and as per the Mines & Mineral (Development & Regulation) Act, 1957 / other Acts/rules related with mining of minor minerals. The Mining Officer shall obtain Consent to Establish and Consent to Operate from the Punjab Pollution Control Board and effectively implement all the conditions stipulated therein. The Mining Officer shall observe the mining site after every 15 days and in case, a Schedule-I or Schedule-II species as per Wildlife Act or any rare or endangered species are reported, the Mining Officer will get a conservation plan prepared in consultation with Department of Wildlife and ensure its implementation. The mining of minor mineral (sand) shall be carried out only upto a depth for which the sand strata is available, but not more than 3 meter below the natural ground level in any case or above the ground water table, whichever is less. The depression in the natural level caused due to mining of sand shall be refilled with suitable material in consultation with expert in thea rea of soil science and at the top the over burden removed prior to starting the mining, shall be placed so that no significant depression is created and the area after mining, shall remain fertile for agricultural purpose. The Mining Officer shall ensure that the mining shall be carried out by the contractor/lessor as per the EMP prepared and development / mining plan prepared as per the Mines & Mineral (Development & Regulation) Act, 1957 / other Acts/Rules related with mining of minor minerals. It shall be ensured that no mining shall be carried out during the monsoon season. Effective safeguard measures shall be taken by Mining Officer to ensure that the AAQ levels at various locations are within permissible limit as prescribed by MoEF/PPCB. The Mining Officer shall ensure that wherever deployment of labour attracts the Mines Act, the provision thereof shall be strictly followed. The Mining Officer shall undertake plantation/afforestation work by planting the native species in the nearby area adjacent to mine lease. The Mining Officer shall ensure that effective safeguard measures, such as regular water sprinkling shall be carried out in critical areas prone to air pollution and having high levels of particulate matter such as loading and unloading point and all transfer points. Extensive water sprinkling shall be carried out on haul roads. It should be ensured that the Ambient Air Quality parameters conform to the norms prescribed by the Ministry of Environment & Forests/Punjab Pollution Control Board in this regard. The Mining Officer shall undertake adequate safeguard measures during extraction of sand and ensure that due to this activity the hydro-geological and ecological regime of the surrounding area shall not be affected. Regular monitoring of ground water level and quality shall be carried out around the mine lease area by establishing a network of existing wells and installing new piezometers during the mining operation. The periodic monitoring [(at least four times in a year- pre-monsoon (April May), monsoon (August), post-monsoon (November) and winter (January);

17 (xiii) (xiv) (xv) (xvi) (xvii) (xviii) (xix) (xx) (xxi) (xxii) once in each season)] shall be carried out in consultation with the State Ground Water Board/Central Ground Water Authority and the data thus collected may be sent regularly to the Ministry of Environment and Forests and its Regional Office at Chandigarh, the Central Ground Water Authority, the Regional Director, Central Ground Water Board and Punjab Pollution Control Board. If at any stage, it is observed that the groundwater table is getting depleted or rising due to the mining activity, necessary corrective measures shall be carried out. The Mining Officer shall obtain necessary prior permission of the competent authorities for drawl of requisite quantity of water (surface water and groundwater), if any, required for the project. Appropriate mitigative measures shall be taken by the Mining Officer to prevent pollution at the mining site in consultation with the State Pollution Control Board. It shall be ensured that there is no leakage of oil and grease at the mining site from the vehicles/mining equipments used for transportation. Vehicular emissions shall be kept under control and regularly monitored. The project proponent shall ensure that, as far as possible, the transportation route will be away from the habitatin area. The mineral transportation shall be carried out through the covered trucks only and the vehicles carrying the mineral shall not be overloaded. No drilling and blasting operation shall be carried out. Mineral handling area shall be provided with the adequate number dust suppression system. Loading and unloading areas including all the transfer points should also have efficient dust control arrangements. These should be properly maintained and operated. Periodical medical examination of the workers engaged in the project shall be carried out and records maintained. For the purpose, schedule of health examination of the workers should be drawn and followed accordingly. Provision shall be made for the housing of construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, safe drinking water, medical health care, crèche etc. The housing may be in the form of temporary structures to be removed after the completion of the project. The critical parameters such as RSPM (Particulate matter with size less than 10micron i.e., PM10) and NO in the ambient air within the impact zone shall be monitored periodically. Further, quality of discharged water shall also be monitored [(TDS, DO, PH, Faecal Coliform and Total Suspended Solids (TSS)]. The monitored data shall be uploaded on the website of the company as well as displayed on a display board at the project site at a suitable location near the main gate of the Company in public domain. The Circular No. J-20012/1/2006-IA.II(M) dated issued by Ministry of Environment and Forests, which is available on the website of the Ministry shall also be referred in this regard for its compliance. The Mining Officer shall take all precautionary measures during mining operation for conservation and protection of rare and endangered flora & fauna found in the study area. Action plan for conservation of flora and fauna shall be prepared in consultation with the State Forest and Wildlife Department. All the safeguard measures brought out in the Wildlife Conservation Plan so prepared specific to this project site shall be effectively implemented. Necessary allocation of funds for implementation

18 (xxiii) (xxiv) (xxv) (xxvi) (xxvii) (xxviii) (xxix) of the conservation plan shall be made and the funds so allocated shall be included in the project cost. A copy of action plan shall be submitted to the Regional Office of the Ministry of Environment and Forests, Chandigarh. The Mining Officer shall submit within 3 months their policy towards Corporate Environment Responsibility which should inter-alia address (i) Standard operating process/ procedure to bring into focus any infringement/deviation/violation of environmental or forest norms/ conditions, (ii) Hierarchical system or Administrative order of the company to deal with environmental issues and ensuring compliance of EC conditions and (iii) System of reporting of non compliance/violation of environmental norms to the Board of Directors of the company and/or stakeholders or shareholders. Vehicles hired to be used for transportation of mined material should be in good condition and should conform to applicable air and noise emission standards. Ambient noise levels should conform to prescribed standards both during day and night. Incremental pollution loads on the ambient air and noise quality should be closely monitored. The Risk assessment and disaster management plan should be prepared. The Mining Officer shall submit the site plan showing the earmarked area for storage of mined material. The Mining Officer shall ensure that the compensation to the private land owner (s) for the mined area shall be made as per the prevalent policy of the State Govt. The mining activity shall be done only manually. B. General Conditions: (i) (ii) (iii) (iv) (v) (vi) No change in mining technology and scope of working should be made without prior approval of the Ministry of Environment & Forests. No change in the calendar plan including excavation, quantum of mineral sand, bajri and boulders (minor mineral) and waste should be made. Four ambient air quality-monitoring stations should be established in the core zone as well as in the buffer zone for RSPM (Particulate matter with size less than 10micron i.e., PM) and NOx monitoring. Location of the stations should be decided based on the meteorological data, topographical features and environmentally and ecologically sensitive targets and frequency of monitoring should be undertaken in consultation with the State Pollution Control Board. Data on ambient air quality RSPM (Particulate matter with size less than 10micron i.e., PM) & NOx should be regularly submitted to the Ministry of Environment and Forests including its Regional office located at Chandigarh and the Punjab Pollution Control Board / Central Pollution Control Board once in six months. Fugitive dust emissions from all the sources should be controlled regularly. Water spraying arrangement on haul roads, loading and unloading and at transfer points should be provided and properly maintained. Personnel working in dusty areas should wear protective respiratory devices and they should also be provided with adequate training and information on safety and health aspects. Occupational health surveillance program of the workers should be undertaken periodically to observe any contractions due to exposure to dust and take corrective measures, if needed.

19 (vii) (viii) (ix) (x) (xi) (xii) (xiii) (xiv) (xv) (xvi) A separate environmental management cell with suitable qualified personnel should be set-up under the control of a Senior Executive, who will report directly to the Head of the Organization. The funds earmarked for environmental protection measures should be kept in separate account and should not be diverted for other purpose. Year wise expenditure should be reported to the Ministry of Environment and Forests and its Regional Office located at Chandigarh. The Mining Officer should inform to the Regional Office of the Ministry of Environment & Forests located at Chandigarh regarding date of financial closures and final approval of the project by the concerned authorities and the date of start of land development work. The Regional Office of Ministry of Environment & Forests located at Chandigarh shall monitor compliance of the stipulated conditions. The project authorities should extend full cooperation to the officer (s) of the Regional Office by furnishing the requisite data / information / monitoring reports. The Mining Officer shall submit six monthly reports on the status of compliance of the stipulated environmental clearance conditions including results of monitored data (both in hard copies as well as by ) to the Ministry of Environment and Forests, its Regional Office Chandigarh, the respective Zonal Office of Central Pollution Control Board and the State Pollution Control Board. The proponent shall upload the status of compliance of the environmental clearance conditions, including results of monitored data on their website and shall update the same periodically. It shall simultaneously be sent to the Regional Office of the Ministry of Environment and Forests, Chandigarh, the respective Zonal Office of Central Pollution Control Board and the State Pollution Control Board. A copy of the clearance letter shall be sent by the proponent to concerned Panchayat, Zila Parisad/ Municipal Corporation, Urban Local Body and the Local NGO, if any, from whom suggestions/ representations, if any, were received while processing the proposal. The clearance letter shall also be put on the website of the Company by the proponent. The State Pollution Control Board should display a copy of the clearance letter at the Regional office, District Industries Centre and the Collector s office/ Tehsildar s office. The environmental statement for each financial year ending 31 March in Form-V as is mandated to be submitted by the project proponent to the concerned State Pollution Control Board as prescribed under the Environment (Protection) Rules, 1986, as amended subsequently, shall also be put on the website of the company along with the status of compliance of environmental clearance conditions and shall also be sent to the Regional Office of the Ministry of Environment and Forests, Chandigarh by . The Mining Officer shall adhere to the commitments made in the Environment Management Plan and Corporate Social Responsibility. The Mining Officer should advertise at least in two local newspapers widely circulated, one of which shall be in the vernacular language of the locality concerned, within 7 days of the issue of the clearance letter informing that the project has been accorded environmental clearance and a copy of the clearance letter is available with the State Pollution Control Board and also at web site of the Ministry of Environment and Forests at and a copy of the same should be forwarded to the Regional Office of Ministry of Environment & Forests at Chandigarh.

20 (xvii) (xviii) (xix) (xx) (xxi) (xxii) (xxiii) (xxiv) (xxv) (xxvi) The MoEF/SEIAA or any other competent authority may alter/modify the above conditions or stipulate any further condition in the interest of environment protection. The SEIAA may cancel the environmental clearance granted to this project under the provisions of EIA Notification, 2006, if, at any stage of the validity of this environmental clearance, it is found/ come to the knowledge of the SEIAA that the project proponent has deliberately concealed and/or submitted false or misleading information or inadequate data for obtaining the environmental clearance. The Mining Officer shall demarcate the mining lease area in the presence of revenue authorities and concerned Village Panchayat or their representatives. The Mining Officer shall get the micro chemical analysis of the mined material done from an approved laboratory once in a year and shall submit the analysis results to the Ministry of Environment & Forests/Punjab Pollution Control Board. The Mining Officer shall ensure that the contractor shall engage people of local area for mining purpose as far as possible, so as to have opportunities of employment for them. The Mining Officer may apply for transfer of environmental clearance under EIA notification dated to the contractor finalized by the Department of Industries & Commerce to SEIAA, Punjab. However, no activity shall be undertaken by the contractor till the environmental clearance is transferred in his name and he is lawfully bound to comply with the conditions of the environmental clearance. The monitoring of the mining project in respect of Environment Management shall be carried out by the State/District Level Environment Management Cells constituted by the Govt. of Punjab vide notifications dated This environmental clearance will be valid for carrying out mining of minor minerals (sand) only and not for river sand mining. Any appeal against this environmental clearance shall lie with the National Green Tribunal, if preferred, within a period of 30 days as prescribed under Section 16 of the National Green Tribunal Act, The project proponent will plant only those species of plants as mentioned in the 'Guidelines for Plantation of Trees in Green Belt' for different zones of the State, which are available on the website of SEIAA i.e. seiaapunjab.co.in.
