3 Affirmative Procurement-- What Is It??? The purchase and use of materials containing recycled content in the greatest amount practical, given resource constraints and performance requirements. The process of purchasing environmentally preferable products, especially products manufactured from recycled and reclaimed materials

4 Environmentally Preferable Purchasing (EPP) An EPA program to enhance purchase of products with positive environmental attributes Environmental attributes include things like: -- Recycled content -- Made from renewable resources -- Energy or water efficient -- Less toxic, lower emissions

5 Comparing APP and EPP Affirmative Procurement Program Recycled content only EPA lists specific products in the CPG Legally required Supported by EPA s RMAN recommendations Environmentally Preferable Purchasing Multiple attributes No specific lists (except for biobased products) No legal hammer (except for CPG items) Supported by EPA s EPP Final Guidance, 8/99 This is where we ve been This is where we re going

6 Why Affirmative Procurement? The Federal government spends about $200 Billion every year and has put this buying power behind the country s recycling programs As stewards of federal dollars, we are obligated to purchase designated items containing recycled materials

8 Why Do It?? RCRA CFR requires purchase of recycled content products at Federal facilities. Each procuring agency purchasing EPA designated items must establish an Affirmative Procurement Program (APP).

9 EO Greening the Government Through Waste Prevention, Recycling, and Federal Acquisition (14 Sep 98) Implement APP within 90 days of EO signing date 100% of purchases of all EPA guideline items will meet or exceed minimum recycled content unless written justification of exemption is provided (1 year to incorporate future, additional items as they are added)

10 Air Force Instruction MAJCOM s establish affirmative procurement programs (installations implement) EPA guideline recommended minimum content are required in the AF GOAL: 100% of guideline items purchased will meet minimum content standards Local purchase items shall have a written determination if it is decided not to procure EPA designated items

11 What are the Comprehensive Procurement Guidelines (CPGs) and Recovered Materials Advisory Notices (RMANs)? CPGs designate the products that must contain recovered material RMANs provide recycled-content recommendations and guidance on buying recycled-content products CPG RMAN

24 Applicability All Federal Agencies All AF Installations CONUS and overseas All EPA Guideline Items that DoD purchases $10,000 or more worth in a fiscal year (whether or not appropriated funds are used)

25 What About the Mandated Sources of Supply? First define your product needs; for example, folders made with recycled content paper Second, go to your mandatory sources If they don t supply the item, let them know you require recycled content! Check with them often to see if they supply the item Small Businesses

26 How Will Purchases of EPA- Designated Items be Monitored? EPA RCRA Inspections EPA Facility Questionnaires Reporting of Purchases ECAMP Findings IG Inspections

27 Conditions for exemption (Local Purchases) Not available within reasonable time Performance Availability Fail to meet performance standards in specs or other reasonable performance standards Not available at a reasonable price (unreasonable price = when cost of recycled content product exceeds price of nonrecycled content product) Price Competition-Not required to sole source

28 More on conditions for exemption from EPA content requirements Must provide written determination Approved by General Officer or SES of requiring activity or Commander (typically SQDN/CC) of the activity for those without a General Officer or SES. Include with purchase request and maintain in contract file Maintained by requiring activity for IMPAC purchases Note: Written determination not required when purchase is under micropurchase threshold

29 What Should You Do? Keep the list of CPG items handy refer to it when making purchases Maximize your purchases of recycledcontent items by Searching for recycled-content products in catalogs and online sources Requesting recycled-content items from your vendors Document noncompliant purchases (those not meeting recycled-content requirements) over $2,500 (for reasons of price, performance, or availability)

30 Dollar Thresholds Greater than $100,000--must insert proper clauses into contract (Vendor estimates and certifications) Greater than $2,500--must justify in contract file Less than $2,500--no formal tracking required but must follow affirmative procurement guidelines

31 Reporting Requirements Formal reporting to DoD is limited to contracts having a value greater than $100,000 which include the purchases of any amount of EPA guideline items. MAJCOMs and bases have the freedom and responsibility to develop tracking procedures for the entire program.
