Waterford. 1.1 Brief Description of Site Activities Lead crystal glassware was produced on-site, for sale worldwide. Approximately 300 people were employed on-site, which contained production buildings, a maintenance unit, a batch plant, wastewater treatment plant for cutting wastes and canteen facilities. During 2005 a decision was taken by Waterford Wedgewood to close the Dungarvan factory. All production activities ceased on-site on the 10 th January Environmental Policy Waterford Crystal Limited regards environmental protection as an integral part of its business and undertakes to conduct its activities in a manner which protects the environment in which it operates. Preventing pollution through a combination of substitution, elimination, engineering controls and monitoring. Complying with all regulatory and legislative requirements. Continual Improvement by setting and reviewing environmental objectives and targets. Ensuring that all personnel on site are aware of their responsibility regarding environmental procedures and requirements. Making available its environmental policy to the public

5 2.0 SUMMARY INFORMATION 2.1 AER Summary Table While the AER / PRTR excel spreadsheet has been completed it should be noted that there was no production on-site during Emissions to Sewer/Waters There were no emissions to sewer during Monthly monitoring of surface water emissions continued up to November 2007 when we received approval to cease monitoring from the EPA. However, monitoring of surface water emissions is to recommence during any site decommissioning works. Therefore, there are no results for Emissions to Atmosphere There were no emissions to atmosphere during Waste Management Small quantities of general waste (12 tonnes) and 2.8 tonnes of timber waste were removed offsite during This waste was generated from on-site security operations and additional clean-up operations following EPA site inspections. 2.5 Agency Monitoring & Enforcement Emissions to Sewer and Air According to our records the EPA did not undertake any sampling at the site during Soil & Grass Sampling for Fluorine According to our records the EPA did not undertake any sampling at Mr. Leonard Sheridan s farm during Energy Consumption There was no oil or gas consumed during

7 4.0 LICENCE SPECIFIC REPORTS 4.1 Report on List I & II Substance Reductions This is no longer relevant as the site has ceased manufacturing operations. 4.2 Noise Monitoring No noise survey was undertaken during Groundwater Monitoring The groundwater monitoring results for 2008 are provided in the table below. 8 4.6 Review of Residuals Management Plan RPS Consultants are currently preparing a revised CRAMP document for the site to take into account the requirements as laid out in the EPA Guidance document. This document will be submitted separately to the EPA shortly. 4.7 Review of Environmental Liabilities Provision / Indemnity A detailed soil and groundwater investigation was completed on-site during A copy of the full report has been sent to the EPA. Following the completion of this study, RPS Consultants are completing a revised ELRA document for the site to take into account the requirements as laid out in the EPA Guidance document. This document will be submitted separately to the EPA shortly. 4.8 Monitoring of Fluorine in Grass No monitoring of fluorine in grass was undertaken during Summary of Toxicity Testing No toxicity monitoring was undertaken during

9 5.0 EPA SITE INSPECTIONS During 2008, the EPA carried out one site inspection during September. Please find below an update against each of the issues raised by the site s EPA Inspector. a) Non-Compliance 1 The soil and groundwater investigation has been completed and has been sent to the EPA for review. RPS Consultants have been employed by the Receivers to Waterford Crystal to complete a new CRAMP & ELRA document for the site in accordance with the EPA Guidance Note. This is currently in hand and will be submitted to the EPA during April b) Observations 1 and 2 See response to item (a) above. c) Observation 3 It is intended that the financial provisions identified in the CRAMP & ELRA document will be discussed separately with the EPA. It would be intended to ensure that this discussion would form a basis for agreeing the most suitable financial provision for the site under the current circumstances. d) Observation 4 Items (i) to (iii) are in hand and a waste oil contractor will be asked to collect this waste and recover it as appropriate. Records of any waste sent offsite will be kept on file for future inspection by the EPA. Item (iv) A Type-2 asbestos survey has been completed and this report will be submitted to the EPA with the CRAMP & ELRA document. All the capacitors on-site have been checked for PCB s and we have received information back from the suppliers to indicate that all capacitors on-site are PCB free. e) Observation 5 All areas on-site are accessible. f) Observation 6 All groundwater monitoring points will be checked on a regular basis. g) Observation 7 There is currently No requirement to test on-site bund structures. It is likely that a drainage survey will be undertaken as part of CRAMP
