Box 39 Mayflower, AR Re: Complaint Investigation of former construction site AFIN: NPDES Permit No.: ARR Dear Mr. Satterfield: On April 21, 2009, I performed an investigation of your construction site in response to a complaint. The complaint alleged that the site s storm water controls have repeatedly failed, and when it rains, three other properties are suffering the affects of the runoff. The Department records show this permit was terminated on August 26, However, the investigation revealed that you are in violation of the Arkansas Water and Air Pollution Control Act, the federal Clean Water Act and the regulations promulgated thereunder. Specifically I found the following violation: The northwest corner of the site is not stable violating Part I, Section B. 16 of the Permit. (Notice of Termination) of the general stormwater permit ARR This appears to be an area of concentrated storm flow. The currently installed sediment controls (silt fence, hay bales, and sand bags) have not been maintained and are not effective. Immediate efforts are needed to stabilize this area of the site. The above item requires your immediate attention. The site is just less than 5 acres and has been cleared for future sale. According to Mr. Rossini, all stormwater controls have repeatedly failed and when it rains, three other properties are suffering the affects of the runoff. Also, clearing the property has greatly increased the amount of stormwater runoff to the road ditch. LOCATION (IN DETAIL) From Hwy 365 in Mayflower turn east onto Hwy 89. Turn left on Franklin T. 3 FOLLOW UP ON COMPLAINT COMPLAINT #: AFIN #: INSPECTOR: Amy Beck DATE: April 21, 2009 ACTION TAKEN: PHOTOS TAKEN: Yes Arriving at the site I observed that vegetation had been established and is approximately 80% covered. Silt fence is installed on the north side of the site. I observed the silt fence is effective for sediment control except in the northwest corner of the site. This corner receives additional stormwater from up the hill via a culvert that crosses Wheeler St. All stormwater flow is directed to the site s northwest corner, and this area not stabilized. The installed stormwater controls in this area do not have the capacity to treat the volume of stormwater runoff produced and are not effective. I spoke with Mr. Jack Brown, Project Manager for Mr. Satterfield, about the issues at the site. Mr. Brown informed me that since my inspection, the silt fence has been replaced and the site has been reseeded. I suggested he concentrate on stabilizing the northwest corner of the site, where the problem is occurring.
