An America First Energy Plan & New York s Response

Opinion is like a pendulum and obeys the same law. If it goes past the centre of gravity on one side, it must go a like distance on the other; and it is only after a certain time that it finds the true point at which it can remain at rest. Arthur Schopenhauer

America First Energy Plan Allow Coal Leases on Public Lands Methane Emissions Reporting elimination of the WOTUS Rule The Trump administration is committed to energy policies that lower costs for hardworking Americans and maximize the use of American resources, freeing us from dependence on foreign oil. Review of Rule Limiting Methane at Drilling Sites reevaluation of the Clean Power Plan For too long, we ve been held back by burdensome regulations on our energy industry. President Trump is committed to eliminating harmful and unnecessary policies such as the Climate Action Plan and the Waters of the U.S. rule. Review of Offshore Drilling Withdrawal of Paris Accord

"Restoring the Rule of Law, Federalism, and Economic Growth by Reviewing the 'Waters of the United States' Rule." The February Order states that it is in the national interest to ensure that the Nation's navigable waters are kept free from pollution, while at the same time promoting economic growth, minimizing regulatory uncertainty, and showing due regard for the roles of Congress and the States under the Constitution An American Farm Bureau infographic from the Ditch the Rule campaign. 7 #DitchTheRule The rule stated that man made conveyances, including ditches, are considered jurisdictional tributaries if they have a bed, bank and ordinary high water mark and flow directly or indirectly into a water of the U.S., regardless of perennial, intermittent or ephemeral flow The rule excluded certain types of upland ditches with less than perennial flow or those ditches that do not contribute flow to a water of the U.S. However key terms like uplands and contribute flow are undefined. It is unclear how currently exempt ditches will be distinguished from jurisdictional ditches, especially if they are near a water of the U.S. Source: Michigan Farm Bureau

The only people with reason to oppose the rule are polluters who threaten our clean water, Senior White House adviser Brian Deese

E.P.A. Blocks Obama Era Clean Water Rule Today, E.P.A. is taking action to reduce confusion and provide certainty to America s farmers and ranchers, Mr. Pruitt said in a statement. The 2015 WOTUS rule developed by the Obama administration will not be applicable for the next two years, while we work through the process of providing long term regulatory certainty across all 50 states about what waters are subject to federal regulation.

As the leader of the world's largest economy and the second largest [greenhouse gas] emitter... the United States of America not only recognises our role in creating this problem, we embrace our responsibility to do something about it. President Obama

Therefore, in order to fulfill my solemn duty to protect America and its citizens, the United States will withdraw from the Paris Climate Accord (applause) thank you, thank you but begin negotiations to reenter either the Paris Accord or a really entirely new transaction on terms that are fair to the United States, its businesses, its workers, its people, its taxpayers. So we re getting out. But we will start to negotiate, and we will see if we can make a deal that s fair. And if we can, that s great. And if we can t, that s fine. (Applause.) 13 "Climate change is a reality, and not to address it is gross negligence by government and irresponsible as citizens." Governor Cuomo United States Climate Alliance In response to the White House's decision to withdraw from the Paris Climate Agreement, Governor Cuomo, California Governor Brown, and Washington Governor Inslee formed a coalition to convene U.S. states committed to upholding the Paris Accord and taking aggressive action on climate change. The Alliance now includes 15 members. Implement policies that advance the goals of the Paris Agreement, aiming to reduce greenhouse gas emission by at least percent below 2005 levels by 2025 Track and report progress to the global community in appropriate settings, including when the world convenes to take stock of the Paris Agreement, and Accelerate new and existing policies to reduce carbon pollution and promote clean energy deployment at the state and federal level.

FERC Interm Chairman Neil Chatterjee said the commission will focus on pipeline approvals, transmission siting and responding to the Department of Energy s cost recovery proposal for coal and nuclear plants. Jan 8 The five member FERC voted unanimously to reject the proposed rule from Secretary of Energy Rick Perry to provide cost recovery for plants with onsite fuel supplies, writing that neither the DOE proposal nor comments in the record showed that existing market rules are unjust and unreasonable.

An America First Energy Plan Will it Save Coal? Since 2008, coal production has declined was it EPA s War on Coal? Coal generation declined primarily from lower natural gas prices Coal for generation usually about 90% of U.S. production Coal capacity retirements encouraged by EPA regulations (e.g., MATS)

DC Does not Have a Monopoly on the Disconnect Governor Cuomo s State of the State book for 2017 the State must double down by investing in the fight against dirty fossil fuels and fracked gas from neighboring states. I think in all probability you need natural gas," Cuomo told The Buffalo News, noting the fuel would be a bridge to get to the state s renewable energy goals. "I don't think you can get from here to there without using natural gas.

The United States fully intends to be the world's preeminent leader in protecting the global environment. We have been that for many years. We will remain so. We believe that environment and development, the two subjects of this Conference, can and should go hand in hand. A growing economy creates the resources necessary for environmental protection, and environmental protection makes growth sustainable over the long term. I think that recognition of that fact by leaders from around the world is the central accomplishment of this important Rio Conference. Gina McCarthy The Lautenberg Act gives EPA the tools necessary to ensure the safety of chemicals and significantly strengthen health protections for American families. Environmental Defense Fund The 'Frank R. Lautenberg Chemicals Safety for the 21st Century Act' is a watershed moment in the history of U.S. environmental legislation. This legislation demonstrates what is possible when stakeholders put their differences aside and come together to work toward a common objective. American Chemistry Council
