3 Mdel Drught Cntingency Plan fr Irrigatin Districts Drught Cntingency Plan fr [Irrigatin Districts] 1. Objectives This drught cntingency plan is intended fr use by [irrigatin district]. The plan includes all current TCEQ requirements fr a drught cntingency plan. This drught cntingency plan serves t: Cnserve available water supplies during times f drught and emergency. Minimize adverse impacts f water supply shrtages. Minimize the adverse impacts f emergency water supply cnditins. 2. Texas Cmmissin n Envirnmental Quality Rules The TCEQ rules gverning develpment f drught cntingency plans fr irrigatin districts are cntained in Title 30, Part 1, Chapter 288, Subchapter B, Rule f the Texas Administrative Cde. 3. Prvisins t Infrm the Public and Opprtunity fr Public Input [Irrigatin district] will give custmers the pprtunity t prvide public input int the preparatin f the plan by ne f the fllwing methds: Hlding a public meeting. Prviding written ntice f the prpsed plan and the pprtunity t cmment n the plan by newspaper r psted ntice. 4. Crdinatin with the Panhandle Water Planning Grup This drught cntingency plan will be sent t the Chair f the Panhandle Water Planning Grup in rder t ensure cnsistency with the Panhandle Water Plan. 5. Initiatin and Terminatin f Drught Respnse Stages Official designees rder the implementatin f a drught respnse stage when ne r mre f the trigger cnditins fr that stage are met. Official designees may als rder the terminatin f a drught respnse stage when the terminatin criteria are met r at their wn discretin. Allcatin f Irrigatin Supplies In accrdance with TWC Sectin 11.03, If a shrtage f water in a water supply results frm drught (sic), accident, r ther cause, the water t be distributed shall be divided amng all custmers pr rata, accrding t the amunt each may be entitled t, s that preference is given t n ne and everyne suffers alike. In all drught situatins, the [Entity] will make a daily public annuncement f the water situatin and request cnservatin practices t meet the situatin. The [Entity] will mnitr its ttal system and reserves n a daily basis and will mnitr all custmer activities, practices and reserves n a daily basis by: Daily meter readings t verify cnsumptin. Visually inspecting areas f custmer cmpliance, especially large users and wasteful practices. Cnfer with custmers t evaluate effectiveness f activities t imprve water cnservatin and t decrease water cnsumptin. Keep daily inventry f water sales and water supply at the [Entity]. Implement water management measures during each stage f the Plan, including, but nt limited t, the pr rata curtailment f water deliveries as prvided in Texas Water Cde ; and utilizatin f alternative water surces with the prir apprval f the TCEQ executive directr, as apprpriate. Include prvisins in every new r renewed water supply cntract, including cntract extensins, that in case f a shrtage f water resulting frm drught r water emergency, the water t be distributed in accrdance with Texas Water Cde Include prcedures fr the enfrcement f any mandatry water use restrictins. The [Entity] shall be empwered, at their discretin, at the apprpriate time, t cause a prprtinal reductin f water available t each custmer in accrdance with Pr Rata Curtailment f water use prvided in Texas Water Cde , and based n any ther cnditins, physical, mechanical, r therwise. The custmer may appeal this decisin t the [Entity] during perids f frced cnservatin measures by the [Entity]. The custmer may appeal the decisin f the [Entity] t the TCEQ. The [Entity] may decide nt t rder the implementatin f a drught cntingency and water emergency respnse stage even thugh ne r mre f the trigger criteria fr the stage are met. Factrs which culd influence such a decisin include, but are nt limited t, the time f the year, weather cnditins, the anticipatin f replenished water supplies, r the anticipatin that additinal facilities will becme available t meet needs. 5

Factrs which culd influence such a decisin include, but are nt limited t, the time f the year, weather cnditins, r the anticipatin f ptential changed cnditins that warrant the cntinuatin f the drught cntingency and water emergency respnse stage. 9. Penalty fr Vilatin f Water Use Restrictin Mandatry water use restrictins are implemented in Stages [1, 2, 3, r 4]. These restrictins will be strictly enfrced with the fllwing penalties: Ptential penalties include: Written warning that they have vilated the mandatry water use restrictin. Issue a citatin. Minimum and maximum fines are established by rdinance r ther rder. Discntinue water service t the user. 10. Review and Update f Drught Cntingency Plan This drught cntingency plan will be updated at least every 5 years as required by TCEQ regulatins. 6

12 Texas Administrative Cde Page 1 f 2 4/29/2015 <<Prev Rule Texas Administrative Cde Next Rule>> TITLE 30 PART 1 CHAPTER 288 SUBCHAPTER B RULE ENVIRONMENTAL QUALITY TEXAS COMMISSION ON ENVIRONMENTAL QUALITY WATER CONSERVATION PLANS, DROUGHT CONTINGENCY PLANS, GUIDELINES AND REQUIREMENTS DROUGHT CONTINGENCY PLANS Drught Cntingency Plans fr Irrigatin Use (a) A drught cntingency plan fr an irrigatin use, where applicable, must include the fllwing minimum elements. (1) Minimum requirements. Drught cntingency plans fr irrigatin water suppliers must include plicies and prcedures fr the equitable and efficient allcatin f water n a pr rata basis during times f shrtage in accrdance with Texas Water Cde, Such plans shall include the fllwing elements as a minimum. (A) Preparatin f the plan shall include prvisins t actively infrm and t affirmatively prvide pprtunity fr users f water frm the irrigatin system t prvide input int the preparatin f the plan and t remain infrmed f the plan. Such acts may include, but are nt limited t, having a public meeting at a time and lcatin cnvenient t the water users and prviding written ntice t the water users cncerning the prpsed plan and meeting. (B) The drught cntingency plan must dcument crdinatin with the reginal water planning grups t ensure cnsistency with the apprpriate apprved reginal water plans. (C) The drught cntingency plan must include water supply criteria and ther cnsideratins fr determining when t initiate r terminate water allcatin prcedures, accmpanied by an explanatin f the ratinale r basis fr such triggering criteria. (D) The drught cntingency plan must include specific, quantified targets fr water use reductins t be achieved during perids f water shrtage and drught. The entity preparing the plan shall establish the targets. The gals established by the entity under this subparagraph are nt enfrceable. (E) The drught cntingency plan must include methds fr determining the allcatin f irrigatin supplies t individual users. (F) The drught cntingency plan must include a descriptin f the infrmatin t be mnitred by the water supplier and the prcedures t be fllwed fr the initiatin r terminatin f water allcatin plicies. (G) The drught cntingency plan must include prcedures fr use accunting during the implementatin f water allcatin plicies.

(I) The drught cntingency plan must include prcedures fr the enfrcement f water allcatin plicies, including specificatin f penalties fr vilatins f such plicies and fr wasteful r excessive use f water. (2) Whlesale water custmers. Any irrigatin water supplier that receives all r a prtin f its water supply frm anther water supplier shall cnsult with that supplier and shall include in the drught cntingency plan, apprpriate prvisins fr respnding t reductins in that water supply. (3) Prtectin f public water supplies. Any irrigatin water supplier that als prvides r delivers water t a public water supplier(s) shall cnsult with that public water supplier(s) and shall include in the plan, mutually agreeable and apprpriate prvisins t ensure an uninterrupted supply f water necessary fr essential uses relating t public health and safety. Nthing in this prvisin shall be cnstrued as requiring the irrigatin water supplier t transfer irrigatin water supplies t nnirrigatin use n a cmpulsry basis r withut just cmpensatin. (b) Irrigatin water users shall review and update, as apprpriate, the drught cntingency plan, at least every five years, based n new r updated infrmatin, such as adptin r revisin f the reginal water plan.
