3 Phase 2 ESA: 727 & 733 King Street, Niagara on the Lake, ON E INTRODUCTION EXECUTIVE SUMMARY Hallex Environmental Ltd. was retained by Ontario Ltd. to conduct a Phase Two Soil investigation at 727 & 733 King Street, Niagara on the Lake, ON following the Phase One ESA (January 17 th, 2018) that identified the following potentially contaminating activity: 1. One (1) on-site PCA, resulting in one (1) APEC was observed. PCA-1/APEC-1: #40 Pesticides (including Herbicides, Fungicides and Anti-Fouling Agents) Manufacturing, Processing, Bulk Storage and Large-Scale Applications. The northern portion of the property was noted as a former orchard, where the potential application of herbicides and pesticides as part of the agricultural production may have occurred. This on-site use represents an onsite area of concern within this area. The objectives of the Phase Two Environmental Site Assessment were to determine the presence/absence of potential contaminants in the soil. The presence of contaminants in the soil, if detected, would determine the need for further sampling and analyses of soil to delineate the extent of impact, and to satisfy the requirements of Ontario Regulation 153/04, amended by O.Reg. 511/09. PHASE TWO ESA METHODS Six (6) test pits, TP-1 to TP-6 were advanced on January 24 th, Soil samples were collected during excavation at depth intervals of 0 to 0.6 m for each test pit. Each sample was logged for colour, texture, structure, moisture, and visual and olfactory evidence of contamination. Six (6) of the twelve (12) soil samples were chosen for laboratory analyses and were submitted to Paracel Laboratories Ltd. under chain of custody # on January 24 th, 2018 for analyses of Metals (Arsenic), OC-Pesticides and Grain Size Analysis. FINDINGS Soil laboratory analytical data from the test pits were compared with Ministry of the Environment and Climate Change (MOECC) Site Condition Standards (SCS) (2011) Table 3: for Residential Land Use in a Non-Potable Groundwater Situation, fine texture soil. All samples met applicable criteria for OCP and Arsenic. CONCLUSION The Phase Two ESA at 727 & 733 King St, Niagara-on-the-Lake, ON revealed soil collected from test pit samples met MOECC SCS 2011 Table 3 for Residential Land Use in a Non-Potable Ground Water Situation, fine texture soil. Hallex considers the site suitable for development for residential purposes with no further Environmental assessment work required as of January 24 th, i

5 Phase 2 ESA 727 & 733 King Street, Niagara on the Lake, ON E INTRODUCTION 1.1 Project Objectives Hallex Environmental Ltd. was retained by Ontario Ltd. to conduct a Phase 2 Soil investigation at 727 & 733 King Street, Niagara on the Lake, ON following the Phase 1 ESA (January 17 th, 2018) that identified the following potentially contaminating activity: 1. The site location is shown on Figure 1 and the PCA/APEC is shown on Figure Limitations and Exceptions of Assessment This report was prepared by Hallex Environmental Ltd. for the client. The material in it reflects Hallex s best judgment based on the information discovered at the time of preparation and within the scope of work. The investigative procedures, and format of this report, generally follow the guidelines established in: Ontario Regulations 511/09 per Part XV.1 of the Environmental Protection Act. Any information presented concerning materials at the site is based on information gathered at test pit locations only. There may be materials and/or subsurface soil and/or groundwater conditions on-site which are not represented by these investigations. Any use which a third party makes of this report, or any reliance on or decisions to be made based on it, are the responsibility of such third parties. 6 Phase 2 ESA 727 & 733 King Street, Niagara on the Lake, ON E Current and Proposed Future Uses The site use observed on January 24 th, 2018 was a residential plot of land. The plan is to remain residential with the development of four (4) detached single family homes. 1.5 Applicable Site Condition Standard Site sensitivity analyses determined the Soil, Groundwater, and Sediment Site Condition Standards (SGWSS) that would be applicable to the subject site as per O.Reg. 153/04, amended by O.Reg. 511/09. Site sensitivity is determined based on conformance or non-conformance with: shallow soil conditions, soil ph, proximity to an Area of Natural Significance, or the presence of a stream or water body on-site or within 30 metres of the subject property, and the site and adjacent lands groundwater conditions being either potable or non-potable. A sensitive site would require application of Full Depth Background Site Condition Standards. The Full Depth Generic standards that would apply to a non-sensitive site are further determined based on potable or non-potable groundwater conditions and coarse or fine soil texture. 727 & 733 King Street, Niagara-on-the-Lake, ON Site Sensitivity Analysis The rationale for the selection of SGWSS criteria for the subject property included: Intended Property Use: Residential Soil Texture: fine Adjacent to a designated area of natural significance: No Within 30 m of a water body: No Non-Potable groundwater condition. The subject site is within an area supplied by municipal water. Groundwater was not investigated as part of this Phase 2 ESA. Depth to bedrock: not encountered between test-pit depths of metres. Surrounding stratigraphic data suggests the depth to bedrock is 11 m. Applicable Regulatory Criteria O.Reg. 511/09 Ministry of the Environment Site Condition Standards Table 3 for Residential Land Use in a Non-Potable Ground Water Condition, fine textured soil, was applied to the subject site, based on conditions observed at the time of the site assessment. 3

7 Phase 2 ESA 727 & 733 King Street, Niagara on the Lake, ON E BACKGROUND INFORMATION 2.1 Physical Setting Water Bodies and Areas of Natural Significance No water bodies and/or areas of natural significance are located on, adjacent to or within the study area. Lake Ontario is located approximately 2 km north and the Niagara River is approximately 2 km east Topography, Hydrology, Geology Topography: The site elevation was documented as approximately 90 meters above sea level and was relatively flat throughout the site. Hydrology: The local groundwater flow was interpreted as North towards Lake Ontario, although surface water would be directed towards municipal services along King Street. Geology: Review of maps: Quaternary Geology of Niagara-Welland (Ontario Geological Survey Map 2556), and Bedrock Geology of Ontario (Ontario Geological Survey Map 2544), indicated that the native overburden underlying the subject site was: sand and clay plains. 2.2 Previous Environmental Reports No environmental documents were provided to Hallex Environmental Ltd. for review pertaining to the study site. 4

8 Phase 2 ESA 727 & 733 King Street, Niagara on the Lake, ON E PHASE ONE CONCEPTUAL SITE MODEL The conceptual site model qualitatively considers the potential interaction of primary sources of environmental concern, with suspected contaminants of concern, and the pathway(s) and exposure route(s) to the receptors. Target contaminants of Organo-chlorine Pesticides (OCP) and Metals (Arsenic) were identified with potential migration pathways to human and/or biota receptors. 9 Phase 2 ESA 727 & 733 King Street, Niagara on the Lake, ON E INVESTIGATION METHODS 4.1 Test Pit Excavation Anthony s Excavating utilized a mini excavator for test pit sampling. Preparation for test pit sampling was initiated via requests for demarcation of underground utilities by Ontario One Call: for Bell, Cable, Hydro, and Natural Gas; and the Town of Niagara on the Lake and Regional Municipality of Niagara for Water and Sewer. All services were indicated as clear for the designated work area. 4.2 Soil: Sampling Six (6) test pits, TP-1 to TP-6 were advanced on January 24 th, Test pit locations are shown in Figure 2 and test pit logs are contained in Appendix A. Soil samples were collected during excavation at depth intervals of 0 to 0.6 m for each test pit. Each sample was logged for colour, texture, structure, moisture, and visual and olfactory evidence of contamination. Additionally, textural identification of soil, through hand soil textural techniques, including the squeeze test and ribbon test were conducted during all soil logging and sampling events. 4.3 Field Screening Measurements There were no field screening measurements taken onsite to determine which samples were to be sent to the lab. 6

10 Phase 2 ESA 727 & 733 King Street, Niagara on the Lake, ON E REVIEW AND EVALUATION 5.1 Soil: Field Screening Six (6) of the twelve (12) soil samples were chosen for laboratory analyses and were submitted to Paracel Laboratories Ltd. under chain of custody # on January 24 th, 2018 for analyses of Metals (Arsenic), OC-Pesticides and Grain Size Analysis. All samples met applicable criteria for OCP and Arsenic. Complete laboratory analytical reports are contained in Appendix B. 5.4 Quality Assurance and Quality Control Results Hallex conducted Quality Assurance/Quality Control (QA/QC) measures throughout all stages of the assessment and remediation process. Laboratory QA/QC measures adhering to the Ministry of the Environment s Protocol for Analytical Methods Used in the Assessment of Properties under Part XV.1 7

11 Phase 2 ESA 727 & 733 King Street, Niagara on the Lake, ON E of the Environmental Protection Act, March 2010 are standard procedure for Paracel Laboratories (accredited to the ISO/IEC Standard by CALA) in order to ensure that the standards of quality were met within the expected level of confidence. Laboratory Analytical QA/QC results are conducted within the laboratory reports located in Appendix B. 8

Jade Anema - Ms. Jade Anema, B. Eng, E.I.T, was the Junior Project Coordinator for the project. Ms. Anema conducted the soil sampling for this report. Jade Anema recently graduated with a Bachelor of Environmental Engineering and has 1+ year of environmental project experience including work on Phase One & Two Environmental Site Assessments, Records of Site Condition Filing, Environmental Compliance Approvals, Designated Substances and Hazardous Materials Surveys, Site Investigations, and Remediation Studies. Jodie Glasier - Mrs. Jodie Glasier, B.A. (Hons), PD-EMA, M.MM, was the project manager for the Phase Two ESA. Jodie Glasier has nine + years of diverse environmental project experience including work on Phase One & Two Environmental Site Assessments, Records of Site Condition Filing, Environmental Compliance Approvals, Designated Substances and Hazardous Materials Surveys, Site Investigations, Remediation Studies, and Environmental Planning. Kevin Christian - Mr. Kevin Christian, M.Sc., P.Geo., a Professional Geoscientist (#0387) registered with the Association of Professional Geoscientists of Ontario, and a Qualified Person (Environmental Site Assessment & Risk Assessment) as per Ontario Regulations 153/04 and 511/09, has twenty-eight years of experience in the environmental geoscience consulting industry conducting Phase One and Two ESA s, remedial planning, and site remediation supervision. 10
