Box 3243 Telephone: / / Ext 2558 Web site: INDIVIDUAL CONSULTANT REQUEST FOR EXPRESSION OF INTEREST CONSULTANCY SERVICE TO ENAHNCE HUMAN RIGHT CODE OF CONDUCT AND DISCIPLINE COMPLIANCE IN AFRICAN UNION PEACE SUPPORT OPERATIONS 1. BACKGROUND Reference No.: AUC/PSD/268 The African Union (AU) is committed to ensuring that all of its missions, are compliant with international human rights and humanitarian law, as well as accepted international and regional norms on protection of civilians and conduct and discipline. The Report by AU High Representative for the Peace Fund s on Predictable and Sustainable Financing for Peace in Africa was endorsed by the AU Assembly decision [Assembly/AU/Dec.d05 (XXVII)], during its 27th ordinary session, held in Kigali in July This Report sets out steps to be taken by the AU to enhance its existing Human Rights and Conduct and Discipline Compliance Framework, including strengthening of mechanisms on prevention, monitoring and responding to violations and abuses of human rights law and international humanitarian law, as well as conduct and discipline violations and abuses. Moreover, in the recent UN Security Council resolution 2320 adopted on 18 November 2016 (S/2016/977), the Security Council encourages the AU to finalize its human rights and Conduct and Discipline Compliance frameworks for AU peace support operations, to achieve greater accountability, transparency, and compliance with international human rights law and international humanitarian law, as applicable, and with UN conduct and discipline standards. As part of this process a comprehensive assessment of AU mandated and authorized peace support operations (PSOs) human rights and humanitarian law compliance and conduct and discipline mechanisms approaches was undertaken. This assessment along with other policy documents and reports provide the basis for developing options for the establishment of headquarter and mission level compliance and accountability structures. 2. OBJECTIVE OF THE CONSULTANCY The overall aim of this assignment is to enhance African Union Peace support operations compliance to Human rights code of conduct that it is informed by AU practices of mandating/authorizing, deploying and managing peace support operations. The outputs from this will help strengthen AU s regime on compliance with conduct and discipline standards in peace support operations. The study will be informed by: 1

2 The operational context in which past and current AU mandated and authorized peace support operations have been deployed and identify the specific conduct and discipline challenges that these deployments raise. The AU experiences and practices in addressing prevention, monitoring and responding to conduct and discipline violations and abuses, in past and current AU-led and AUauthorized peace support operations. 3. SCOPE OF THE SERVICE The scope of the consultancy service includes, but not limited to the following; Conduct a mapping and make proposals for review of AU Polices and institutional structure on addressing conduct and discipline issues relating to all categories of personnel involved in AU peace initiatives and missions. Benchmark other international conduct and discipline structures and policies, (e.g United Nations) Contribute in strengthening the work being undertaken by the Inter-Departmental Task Force on establishing measures to prevent misconduct, enforce appropriate standards of conduct and ensure remedial action where misconduct has occurred. Contribute in AU s ability to receive, assess and refer allegations of misconduct involving all categories of personnel involved in its missions/operations for appropriate action. Provide technical recommendations on how best the AU can improve/generate rules and procedures relating to misconduct cases involving all categories personnel in its missions. Provide recommendations on how best AU policies, procedures or guidelines on addressing misconduct are adequately disseminated to the personnel in the mission and how best to monitor compliance. Evaluate the effectiveness of ad hoc or systematic mechanisms established in past and current PSOs in order to prevent and address such violations and abuses ( compliance practices ). 4. METHODOLOGY The Consultant is expected to hold an inception meeting with the Inter-departmental task force to finalize the work plan and agree on the specific outputs from each phase of work. The Consultant work will consist of desk research, conducting interviews and supporting an in-house workshop. The Consultants may also conduct field visits to the African Union Mission in Somalia (AMISOM) HQs in Mogadishu, the Multinational Joint Taskforce (MNJTF) HQ in N Djamena, the African Union Mission for Mali and the Sahel (MISAHEL) in Bamako/Mali and the G5-Sahel Joint Force HQ in Sévaré/Mali and undertake consultations with Troop Contributing Countries. The 2

3 Consultant s briefing and orientation will take place at the start of the assignment. S/he will work under the supervision of the AU Taskforce on the Peace Fund. The AUC will cover cost of round trip Economy class ticket and applicable Daily substance allowance using UN Rate. 5. KEY DELIVERABLES AND SCHEDULE The Consultant shall provide a background paper (20 pages with a 5-10 page executive summary) that clearly identifies following issues: An inception report (background paper) 20 pages with a 5-10 page executive summary) that clearly identifies points described under scope of the assignment. This should be finalized by 5 September 2018 Draft report with clear outcome and recommendation. This should be finalized by October Organize workshop in Addis Ababa, where the draft report shall be presented to stakeholders and inputs are collected Final report incorporating feedback from stakeholders Progress report on support for the validation of the final document by the appropriate authority of the AU. The Consultant will also provide support, as requested, to the AU inter-departmental taskforce on the AU-UN partnership. 6. REPORTING AND COMMUNICATION: The consultant will report to the AU Taskforce on the Peace Fund 7. QUALIFICATIONS AND EXPERIENCE: 7.1 EDUCATION An advanced degree (Master or PhD) in international relations, law or similar 7.2 EXPERIENCE A minimum of 10 year experience of rule of law and their application within a peace support operations contexts. A Law Enforcement background/experience would be a strong advantage. Substantive knowledge and experience on the developing and reviewing generic Rules of Engagement (RoE), Use of Force (UoF) and Standard Operating Procedures (SoPs) for the military or police component in AU mandated/authorized missions; 3

4 Participation in the planning and deployment of recent peace enforcement missions mandated by the African Union and in the transition process from to the follow-on United Nations missions; Substantive knowledge of AU peace and security policies, operations and initiatives. Proven ability to research and prepare reports of a similar nature and work independently to tight timelines. The African Union Commission now invites eligible Individual Consultants to indicate their interest in providing the Services. Interested candidate must provide information demonstrating that he/she has the required qualifications and relevant experience to perform the Services. 8. Duration of the Consultancy The consultancy services is required for a period of 6 months 9. Consultancy fee The consultant shall be issued with a time-based Contract. The consultancy fee will be USD 8, per month which will be calculated on the basis of days worked. 10.
