2 Work Plan Proposal Regulatory Reform FotC Group Economic Committee Presented by MEXICO Copyright 2015 APEC Secretariat Economic Committee Priorities The 2015 Structural Reform Ministerial Meeting, instructed EC to: a) Increase efforts to promote international regulatory cooperation. b) Hold a GRP Conference on building high level support for reform. c) Facilitate stakeholders participation in public consultation processes. d) Promote awareness and wider use of international legal instruments to strengthen the legal infrastructure of APEC economies. e) Encourage economies to undertake a self-assessment of barriers to competition, including a review of current competition laws and policies. Further advance work on GRP (tools for structural reform) is a must. 1

3 Economic Committee Priorities The Renewed APEC Agenda for Structural Reform (RAASR), seeks to consolidate and streamline structural reform lined with the following pillars: i. More open, well-functioning, transparent and competitive markets. ii. iii. Deeper participation in those markets by all segments of society, including MSMEs, women, youth, older workers and people with disabilities. Sustainable social policies that promote the above mentioned objectives, enhance economic resiliency, and are well-targeted, effective and nondiscriminatory. In 2016, each economy will develop an individual action plan (structural reform priorities, objectives and policies). Thus, capacity building becomes paramount to reach the 2020 goal. FotC Purpose After the reduction of trade tariffs, the focus mainly has turned to: 1. Regulatory barriers to trade and investment. 2. RAASR implementation (the aim is to reduce inequality, based on balanced and sustainable growth). Demands member economies to endorse regulatory cooperation as a mechanism for facilitating market opening and reducing the costs of regulatory heterogeneity for firms and investors. FotC Members: Indonesia, Japan, Korea, Malaysia, Mexico, New Zealand, China Taipei, Thailand, the U.S. and Vietnam. All the APEC economies are welcomed to join the group 2

4 FotC: Work plan proposal Promote the effective implementation of Good Regulatory Practices (GRPs) Continue developing efforts in International Regulatory Cooperation Apply GRPs in Services Sector 4 5 Boost Micro, Small and Medium Enterprises (MSMEs) participation Promote efforts on simplifying the regulatory burden in fields such as business regulation, entrepreneurship, competitiveness and foreign trade Promote studies that show the real benefits (impacts) of Regulatory Reform Promote Inclusive Growth through Regulatory Reform Enhance the usage of ITs for Transparency purposes The aim is to support EC developing activities on Regulatory Reform and GRPs, such as capacity building, conferences, seminars, workshops, guidelines, disclosure documents, joint work and even generating synergies with other groups inside APEC. Next steps and other activities 1. Approve Work plan objectives 2. Prioritize activities and objetives in the short, medium and long terms 3. Elaborate proposals for EC with the aim to work derivables according to plan 4. Implementation and monitoring (periodical reports) Follow up the work plan Participate in workshops and conferences Organize the 9TH Conference on GRPs Provide inputs for Leaders and Ministerial Meetings 3

MSMEs Participation MAIN ACTIVITIES FOR MEMBER ECONOMIES Coordinate regulatory activities to avoid duplicity Promote public consultation focused on publication for comments Publish regulatory plans with GRPs per action (transparency and participation) Training of public servants in the use of RIA Workshops, manuals and online courses to enhance national regulatory agendas Peer review and benchmarking (international experience and best practices) Formalize relations and activities Regulatory alignment without compromising public health and safety or environment Develop initiatives that promote GRPs Explore GRP in trade services topics Address services and investment restrictions that limit market access Achieve balance between objectives and regulatory design Map regulatory differences (institutional design and social priorities), in order to identify elements that affect the cost of services, trade and investment Mitigate regulatory externalities (or set accountability for its impacts) Explore GRPs focused on MSMEs Review competition legislation to identify opportunities and abuses on MSMEs Build an inclusive public consultation covering MSMEs (in or out the RIA) Connectivity strategies for linking markets, regulators and decision makers Construct regulatory environments that link MSMEs with those related to Regulatory Reform Annex OBJECTIVES 5. Enhance the usage of ITs for Transparency purposes MAIN ACTIVITIES FOR MEMBER ECONOMIES Explore GRPs in topics of business regulation, entrepreneurship and competitiveness Identify hazards on governmental rules, taxation, environmental regulations, lending requirements and licensing, all barriers of entry Continue with workshops and seminars using training or disclosure tools Select projects based on free duplication efforts, so resources are maximized New implementation and documentation mechanisms on GRPs tools Develop a framework for regulatory policy evaluation Set indicators on cost-effectiveness (compliance assessment), net benefits/efficiency (impact assessment) and equity/distributional fairness (IG assessment) to measure performance of agendas, work plans of APEC and the effectiveness of international cooperation Drive regulatory reform on management by results Share knowledge and experiences relating to structural reforms that affect IG Set requirements to evaluate specific impacts on disadvantaged groups (in/out RIA) Develop a toolkit for evaluating the inclusiveness of structural reform policies Select reforms, based on GRPs, that improve access to regional economic markets and IG Set consultation rules on regulatory information (stock and proposals), based on GRPs Promote the Internet and digital economy as potential enablers of IG Increase collaboration with other APEC working groups (TELWG, ECSG and SMEWG) Have regulatory information readily accessible on-line and organized in ways that enables it to be easily found by stakeholders 4
