This Order may be cited as the Executive Agencies (Tanzania Rural and Urban Roads Agency) Establishment Order, 2017 and shall come into effect on the date of publication in the Government Gazette. 2. There is hereby established an Executive Agency to be known as Tanzania Rural and Urban Roads Agency in its acronym TARURA to take over the operational roles and functions of rural and Urban roads networks currently performed by Local Government Authorities. 3. The governance, responsibilities, powers, accountability and other matters relating to Tanzania Rural and Urban Roads Agency shall be as specified in the Framework Document set out in the Schedule to this Order. 1

6 FOREWORD The Local Government Authorities (LGAs) have the responsibility to manage rural and urban roads network as one of their primary functions. The coordination and monitoring is laid under the President s Office, Regional Administration and Local Government (PO-RALG) through the Division of Infrastructure Development (DID). There have been complains and concerns on the performance of the LGAs relating to execution of development and maintenance of rural and urban roads network. The facts attributed to this state of affair include, interference in the road work plans; Institutional arrangements; road financial resource mobilization; mismanagement of road works fund, inadequate human resource with appropriate technical and managerial skills and inadequate funding for road works. This calls for strategic interventions to address the fore mentioned challenges. The Government establishes Tanzania Rural and Urban Roads Agency (TARURA) as part of strategic intervention to overcome the mentioned challenges. The Agency is established under the Executive Agencies Act Cap. 245 as an institution mandated to execute non- policy Government functions related to rural and urban roads network on its behalf. The Agency is required to execute its functions by providing quality services to the public by developing and maintaining rural and urban roads network. The Agency is expected to come up with all-weather passable roads, reducing vehicle operating costs, reducing travelling time, enhance the roads safety and improved environmental management. I would like to extend my sincere appreciations to the Permanent Secretary and Management of PO-RALG for their valuable contributions and inputs in the entire processes of establishing this Agency. I would like also to commend the Agency Implementation Team, stakeholders and officials from President s Office, Public Service Management who facilitated the development of the required instruments to be used by the Agency in executing its functions. I, therefore, call upon cooperation and support from Agency staff, parent Ministry, LGAs, Ministry of Works, Transport and Communication, and other 5

8 INTERPRETATION In this Framework Document, unless the context otherwise requires: Agency means Tanzania Rural and Urban Road Agency (TARURA); Board means the Board established by Section 6 of the Executive Agencies Act, CAP 245; Chief Executive means the Chief Executive Officer of Tanzania Rural and Urban Roads Agency (TARURA); Classified roads means any public road including trunk roads, Regional roads, District roads (Categorized as Collector (Rural and Urban), Feeder (Rural and Urban) and Community roads); Council means TARURA administrative area at the Council level; Development means the upgrading of a road to a new standard, including a new road or bridge, widening or rehabilitation of a road that has been left in poor condition for a long time; Local Authority means a district, town, municipality or city authority; Minister means the Minister responsible for Regional Administration and Local Government; Ministry means the Ministry responsible for Regional Administration and Local Government; Permanent Secretary means the Permanent Secretary of the Ministry responsible for Regional Administration and Local Government; Road means a collector, feeder and community road commonly used by the public or to which the public has access or route and includes; i) any bridge, causeway, culvert, dam, ditch, drain, fence, embankment, ferry, ford, pontoon or other work in line of such road; ii) the land of which the road or route consists of over which the road reserve in question extends; 7

9 iii) anything on that land forming part of, or connected with or belonging to the road or route; iv) land acquired for the construction of a connection between one road or route and another road or route; Road Maintenance means all works to preserve riding quality, road shape, drains, culverts, structures and bridges, spot improvement of bad spots to maintain accessibility, resealing, reshaping and gravelling; Rural Roads means all District roads within Councils established under the Local Government (District Authorities) Act CAP 287; Urban Roads means all District roads within Councils established under the Local Government (Urban Authorities) Act CAP 288; 8

INTRODUCTION The responsibility to manage rural and urban roads network has been under the Local Government Authorities (LGAs) as one of their primary functions which are carried out under the coordination and monitoring of President s Office, Regional Administration and Local Government (PO-RALG) through Division of Infrastructure Development (DID). The Division provides technical support, capacity building to 185 LGAs of Tanzania mainland and monitor implementation of rural and urban roads network. Roads inventory and conditions survey carried by LGAs in 2013 indicates that, the Councils total road network is 108,946.2 km constituting more than half of the entire national classified road network. The survey indicated also that each LGA manages roads network of different lengths, conditions, standards and structural compositions. This requires consented effort, reliable and predictable financing mechanisms, adequate human resources with right skills and robust road management systems. There have been complains and concerns on the performance of the LGAs relating to execution of development and maintenance of rural and urban roads network. Records show that only 30% of the said network is attended annually leaving a huge part of the network unattended. Some of the challenges contributing to this state of affair include limited and unpredictable financing of development and maintenance of rural and urban roads network, management of funds, and weak monitoring and evaluations systems. Other challenges include; the existing institutional arrangement and multi responsibilities of engineering works at Council level, inadequate human resources at LGAs level, inadequate technical and managerial skills in some specialized areas, conflicting priorities and the bureaucratic decision making. These challenges result into slow pace of rural and urban roads network management. To address the fore-mentioned challenges, the Government has been taking various initiatives including investing in extensive professional management and skills training of staff to the extent that there is a significant number of qualified technical and managerial staff to manage operational functions on rural and urban roads network. Technical support and capacity building to LGAs have been undertaken. Funding for road maintenance and development from Roads Fund Board (RFB) has been increasing every year including support from the Government and Development Partners. Gravel testing kits have been provided to some LGAs; the establishment of 9

11 Laboratory and Research Centre for quality control has also been done. However, these efforts have not been able to bear the desired results. To complement and sustain the said initiatives and the need to address effectively the fore-mentioned challenges, the Government decided to establish Tanzania Rural and Urban Roads Agency (TARURA). The Agency is established to take over the operational roles and functions related to development and maintenance of rural and urban roads network which currently are performed by LGAs. The Agency will also take all operational work related to rural and urban roads network performed under the PO- RALG which eventually remains with the role of policy formulation and monitoring of development and maintenance of rural and urban roads network. This document describes the framework within which TARURA will operate as a semi-autonomous Executive Agency under the Ministry responsible for Regional Administration and Local Government. It sets out the responsibilities, powers and accountability of those involved in management of the Agency. It is the first edition of the document and it is anticipated that it will be updated in future in the light of TARURA operational experience. 2. LEGAL STATUS AND GOVERNANCE 2.1 Legal Status The Tanzania Rural and Urban Roads Agency, TARURA is established under Section 3 (1) of the Executive Agencies Act, CAP 245, as a legal body that may under Section 3 (6) of the Act:- i) Enter into contracts in its own name; ii) iii) Sue or be sued; Upon approval of the Permanent Secretary of the Ministry responsible for Regional Administration and Local Government and upon such terms and conditions as he may specify either generally or in any particular case, borrow money, and acquire, hold or dispose of movable and immovable property. Provided before approving the Agency s request to borrow, he must seek approval from the Minister responsible for Finance; and 10

12 iv) Do all other things that are necessary or desirable for the efficient and effective discharge of its functions. TARURA shall come into operation on the date of publication of its Establishment Order in the Government Gazette. TARURA shall act in the capacity as a Road Agency in respect of the rural and urban roads network in Mainland Tanzania. 2.2 Governance The Chief Executive, appointed by the Minister in consultation with the President's Office, Recruitment Secretariat and the President s Office Public Service Management, shall hold the office for a term not exceeding five years or for such shorter period as may be specified in the instrument of appointment and shall be eligible for re-appointment based on performance. The Chief Executive Officer is responsible for management of TARURA and shall be directly answerable to the Permanent Secretary. The Permanent Secretary will oversee the interest of the Ministry and the Government in general. There shall be Ministerial Advisory Board (MAB) that will advise the Minister on the performance of TARURA. 2.3 Organization Structure TARURA will be headed by Chief Executive Officer assisted by three (3) functional Directorates, seven (7) Sections and five (5) Units. Also there will be Regional Coordination Offices and Council Offices as indicated in Annex 1. The number and responsibilities of Directors and the Head of Units may be reviewed as need arises. The Chief Executive, the Directors and Head of Units shall constitute the Management Team of the Agency. The broad functions of each Directorate, Units, Regional Coordination Offices and Council Offices are summarized below; Directorate of Urban Roads The Directorate is responsible for overall coordination of technical plans, development and maintenance of urban roads. Furthermore, the Directorate will be responsible for ensuring adherence to national policies. The Directorate will be led by the Director and will have two Sections headed by Managers as follows; 11

13 i) Urban Roads Development Section; and ii) Urban Roads Maintenance Section Directorate of Rural Roads The Directorate is responsible for overall coordination of technical plans, development and maintenance of rural roads. The Directorate will also be involved with implementation of other interventions related to rural roads. The Directorate will be led by the Director and will have two Sections headed by Managers as follows; i) Rural Roads Development Section; and ii) Rural Roads Maintenance Section Directorate of Business Support Services: The Directorate will be responsible for provision of TARURA expertise on Administration and Human Resources Management, Planning, monitoring and Evaluation, Information, Communication and Technology (ICT). The Directorate will be led by the Director and will have three Sections led by Managers as follows; i) Administration and Human Resource Management; ii) Planning; and iii) Information and Communication Technology Internal Audit Unit The overall responsibility of the Unit is to provide expertise and advice in prudent use of Agency s resources. This Unit will be led by a Chief Internal Auditor Finance and Accounts Unit This Unit will be responsible for Finance and Accounts matters of the Agency. The Unit will be headed by Chief Accountant. 12

14 2.3.6 Legal Services Unit The function of the Unit is to provide legal expertise services to the Agency. The Unit will be led by Head of Legal Services Procurement Unit The main function of the Unit is to provide procurement services to the Agency. The Unit will be led by Head of Procurement Quality Control and Research Unit The main function of the Unit shall be responsible for development of quality assurance systems, planning and carry out research and development activities. This Unit will be led by Chief Materials Engineer Regional Roads Boards The Regional Road Board established under the Road Act, 2007 among others has the function of receiving and consider annual work plans, midyear and annual Progress reports of all roads Construction and Maintenance works from Road Authorities within the Region Regional Coordination Office The main function of the Regional Coordination Office will be to provide technical backstopping, coordinate, monitor and evaluate implementation of rural and urban road works to LGAs within the Region. Each Regional Coordination Office will be led by Regional Coordinator Council Office The main function of Council Office will be planning and implementation of road works within the Council. The Council Office will be led by Council Manager. This is the level where a big volume of road works will be managed and performed. 2.4 Review of the Organization Structure The Agency s Organization structure may be reviewed when need arises. The Chief Executive through the Permanent Secretary and the Ministerial Advisory Board shall advise the Minister on the changes required. The 13

15 proposed structure shall be submitted to the Ministry responsible for Public Service Management for approval. 2.5 Staffing The Chief Executive shall recruit a number of employees as he/she may consider necessary as desirable for the efficient and effective discharge of the functions of the Agency and on such terms and conditions of service as he may determine in accordance with any direction issued by the Ministry responsible for Public Service Management. 3. AIM, VISION, MISSION, OBJECTIVES, OUTPUTS AND FUNCTIONS OF THE AGENCY 3.1 Aim The aim of TARURA is to provide sustainable and cost effective maintenance and development of Rural and Urban Roads Network to support the social economic development of Tanzania. 3.2 Vision To be a leading institution in the management of rural and urban roads network 3.3 Mission To plan, design, construct and maintain rural and urban roads network in a cost effective manner for sustainable social economic development 3.4 Objectives With regard to the aim, vision and mission, the main objectives of TARURA towards rural and urban roads Network shall be to:- i) Reduce HIV/AIDS infections and improve supporting services; ii) iii) Enhance and sustain National Anti-Corruption Policy and Strategies; Improve Rural and Urban roads network; 14

16 iv) Improve Financial Resources management; v) Improve Human resource management; and vi) Improve Institutional capacity in carrying out mandated functions 3.5 Outputs The Agency have six (6) objectives in its five years Strategic Plan (2016/ /2021) upon which when effectively implemented, are expected to result into outputs related to core and support functions of development and maintenance of rural and urban roads network. 3.6 Functions The main functions of TARURA shall be to:- i) Develop and maintain rural and urban roads network; ii) iii) iv) Carry out engineering traffic and economic studies for the maintenance and improvement of the road network; Establish, maintain and update road management systems; Undertake procurement and management of contracts for design, maintenance, emergency repairs, spot improvements, rehabilitation, upgrading and construction of roads; v) Improve road safety and manage environmental impact in the road network, vi) vii) Establish and maintain appropriate rural and urban road databank; Establish and operate weighbridges and enforce axle load control in the rural and urban roads network; viii) Provide technical support, supervision, quality assurance and control; 15

17 ix) Negotiate agreement with private sector entities to facilitate financing and development of selected roads in accordance with guidelines prescribed by Minister; x) Adopt harmonized approach on technical standards for the promotion of the sustainable rural and urban roads network; xi) xii) Undertake research or collaborate with any research organization with a view to facilitate the Agency s plan, development and maintenance activities; Demarcate and protect road reserve; and xiii) Advise the Ministry responsible for Regional Administration and Local Government on matters relating to rural and urban roads. 4. PERFORMANCE CRITERIA Performance criteria are the general areas in which TARURA performance will be measured. Specific performance targets will be set each year and clearly stated in the Performance Agreements for maintenance and development works. The performance criteria shall be based on quality of service provided; financial performance; and operational efficiency. i) Quality of Services Provided. The Agency is expected to provide high quality service in achieving its objectives. The quality of services shall be as per agreed standards, specifications and customer needs. ii) Financial Performance (improved management systems) For accountability purposes, the Agency is expected to develop systems which will comply with the best financial management practices. There will be timely preparation and submission of accurate financial reports and sound trend of Agency s financial position. iii) Operational Efficiency. The Agency is expected to develop planning and management tools to achieve high quality of maintained and developed road 16

18 network. There will be compliance to the specified standards and use of transparent internal processes and procedures in the service delivery. 5. ROLES, RESPONSIBILITIES AND ACCOUNTABILITY 5.1 The Minister The Minister is responsible for determining and maintaining the policy framework for the Agency, general direction and functional boundaries within which TARURA operates. Specifically, the Minister is responsible for:- i) Establishing the Agency; ii) Ensuring that the Government and the public derive maximum benefit from the creation of the Agency; iii) Appointing the Chief Executive of the Agency; and iv) Appointing Chairperson and other members of the Ministerial Advisory Board. Furthermore, the Minister shall meet the Management of TARURA in person at least once in a year to discuss Agency s strategies, its performance and how risks can best be managed. The Minister shall also work to safeguard the interest of TARURA to ensure its maximum contribution to the national economic growth and keep the Agency aware of high level Government strategic thinking. 5.2 The Permanent Secretary The Permanent Secretary, as the Accounting Officer of the Ministry, is responsible for voted fund disbursed to the Agency and the principal policy adviser to the Minister on matters related to the rural and urban roads network and the Agency. The Permanent Secretary, in discharging his duties, shall at all-time uphold the autonomy of the Agency in the day to day management of its affairs and also respect the delegation of powers in respect of financial accountability as delegated to the Chief Executive and the Board. 17

19 The Permanent Secretary shall be responsible for approving TARURA Strategic Plans, Business Plans and its annual budget. The Permanent Secretary shall mobilize and coordinate funding for maintenance and development works and advice on the overall financial resources to be made available to TARURA for such works. In addition, the Permanent Secretary shall enter into performance contract with the Chief Executive and shall meet the Management of the Agency in person at least twice a year to discuss TARURA s plans, its performance and how risks can best be managed. 5.3 The Ministerial Advisory Board The responsibilities of the Ministerial Advisory Board, as provided for under the Executive Agencies Act, CAP 245, shall include to provide advice on:- i) Development and maintenance of a strategic framework; ii) iii) iv) Objectives of TARURA; Agency s plans and budgets; Setting priorities and annual performance targets for TARURA; v) TARURA s annual reports and accounts; vi) Evaluation of TARURA s performance; vii) Salaries, wages and allowances of employees of the Agency; and viii) Any other matter in the promotion and furtherance of the objectives and function of the Act. 5.4 The Chief Executive The Chief Executive is responsible for managing the Agency within the terms of this Framework Document and the Executive Agency Act, CAP 245. He is the Agency s Accounting Officer responsible for day to-day operations of the Agency. He is accountable to the Permanent Secretary. The Chief executive is specifically responsible for:- i) Preparation and submission of Strategic Plans, Business Plans and associated budgets to the Permanent Secretary for approval; ii) Implementation of the approved plans, including the achievement of performance targets; 18

20 iii) iv) Concluding procurement contracts in accordance with Public Procurement Act, CAP 410 and its Regulations; Organizations and management of assets and resources allocated to him in an efficient and cost effective manner; v) Human resource management, organization, control and discipline of the Agency s employees; vi) vii) Managing the procurement and control of supplies for the Agency; Ensuring that all aspects of the management and organization are kept under review and that they enable best possible performance of the Agency; viii) Providing performance report to the Ministry and other relevant institutions; and ix) Preparation of Annual Reports and Audited Financial Statement for submission to the relevant authorities. 6. POWERS OF THE CHIEF EXECUTIVE 6.1 Personnel Management The powers of the Chief Executive in relation to personnel and related matters are prescribed in the Executive Agencies Act, CAP 245, the Public Service Act, CAP 298 and other relevant legislations. 6.2 Financial and Related Matters The powers of the Chief Executive in relation to financial and related matters are prescribed in the Executive Agencies Act, CAP 245, the Finance Act and other relevant legislations. The Chief Executive may in writing delegate any powers given to him to an employee of TARURA, but is not thereby relieved of a duty or responsibility to him in terms of this Framework Document or any other legislation. 7. PUBLIC ACCOUNTS COMMITTEE AND PUBLIC INQUIRIES The Chief Executive may be required to appear before the Public Accounts Committee (PAC) to represent the Agency at hearing related to the Agency. The Chief Executive may also be required to prepare the response to the 19

21 Parliamentary questions and inquiries that fall under the responsibility of TARURA. 8. FINANCE, PLANNING AND STRATEGIC CONTROL 8.1 Funding, Expenditures and Accounting The source of funds of TARURA shall consist of:- i) Monies received by TARURA for goods or services provided under the authority of the Executive Agencies Act, CAP 245; ii) iii) iv) Government Subventions; Road Fund Board (RFB); Loans and Grants from Development Partners; v) Public Private Partnership; vi) vii) Parking fees on roads reserve; Passenger levy; viii) Fees on utilization of Road reserve; and ix) Any such other monies legally acquired for the purpose of promoting and furtherance of TARURA objectives and functions. Expenditures incurred by TARURA shall be in accordance with the Business Plan approved by the Permanent Secretary and shall be accounted for in such a manner that it shall be possible to link all expenditure to the source of funding and for which purposes the money has been spent. The Chief Executive shall therefore ensure that the Agency s Financial Management System can meet these requirements. The Chief Executive shall prepare and submit quarterly reports to the relevant authorities/bodies. 8.2 Strategic Plan The Chief Executive shall prepare a Strategic Plan covering a period of five years, which will be updated whenever there are big changes that affect the Agency s performance. The purpose of the Strategic Plan is to state the objectives of TARURA over the next five years, outlining the actions to be taken by TARURA in delivering the services. 20

22 8.3 Business Plan The Chief Executive shall prepare and submit to the Permanent Secretary for his approval a Business Plan that includes the estimates of the income and expenditure for the next ensuing year. He may, at any time before the end of a financial year, prepare and submit to the Permanent Secretary for approval any estimates supplementary to estimates of a current year. The Business Plan shall give details of operations based on the approved Strategic Plan and the annual resource allocations. 8.4 Performance Agreement Chief Executive Officer shall enter into Performance Agreement with Permanent Secretary at the commencement of each financial year. 8.5 Procurement Procedures Procurement procedures for goods and services shall be in accordance with Public Procurement Act and its regulations. 8.6 TARURA Tender Board TARURA shall have its own Tender Board. The composition of Tender Board shall be as provided in Public Procurement Act and its Regulations. 8.7 Reports and Accounts Within two months after the end of each financial year, the Chief Executive shall submit Annual Reports and audited statements of accounts to the Ministry. Subsequently the Annual Reports and statements of accounts will be published and made available to the public. The Annual Report shall contain:- i) a copy of the audited accounts of TARURA together with the auditor s comments and recommendations; ii) iii) iv) a report on performance against targets and other related information; a report on the operations of TARURA during that financial year; and such other information that the Permanent Secretary may require. 21

23 8.8 Internal Audit The Chief Executive shall be responsible for ensuring that adequate arrangements exist for the provision of an internal audit services that accords with the standards set by the Ministry responsible for finance and in accordance with the TARURA Accounting Manual. 8.9 External Audit The audits shall be carried out by the Controller and Auditor General or such other person registered as an auditor under the Auditors and Accountants (Registration) Act, 1972 subject to approval by the Controller and Auditor General on such terms and conditions as the Controller and Auditor General may determine. 9. HUMAN RESOURCE 9.1 Status and Conditions of Service TARURA staff shall be public servants charged with the responsibilities for delivering public services more effectively and efficiently within the available resources. Their terms of conditions of service will be approved by the Ministry responsible for the Public Service in accordance with the Executive Agencies Act, CAP 245. Remuneration levels will be set in accordance with policy guidance issued by the Ministry responsible for Public Service Management, and will take into account the need to attract and retain staff of the required caliber. 9.2 Human Resource Management The Chief Executive is responsible for the human resource management of the Agency as set out in this Framework Document. He is responsible for ensuring that an Equal Opportunity Policy is formulated and implemented. Within these parameters he may introduce such changes as necessary to maximize the efficiency and effectiveness of TARURA. The Chief Executive shall be responsible for fostering positive attitudes towards responsibility, accountability and productivity. There must be effective channels of communication throughout the organization and a willingness to work as a team to achieve the Agency s Objectives. The Chief Executive is required to set up training schemes and Human Resource 22

24 Development programs that improve the technical ability of Agency s staff and familiarize them with new working practices. As part of his responsibility to manage the affairs of the Agency in an efficient and effective manner, the Chief Executive must establish and keep up to date the Staff Complement of TARURA. 9.3 Staff Relations The Chief Executive is responsible for staff relations within the Agency. He is required to foster good staff relations as an important aid to the achievement of the Agency s objectives and ensure effective communications and consultation with staff and with their recognized Trade Unions. 9.4 Health and Safety The Chief Executive is responsible for health and safety of TARURA s staff in the work place and for complying with all relevant legislations. 10. AMENDMENTS, REVIEW AND PUBLICATION 10.1 Review and Amendment Any proposed amendment to this document shall be made by the Minister in consultation and advice from the Permanent Secretary and Chief Executive. Any proposed changes shall be subject to Ministry responsible for Public Service Management before being effected by the Ministry Publications The Order establishing TARURA including Framework Document shall be published in Government Gazette, uploaded in the Agency s website and will be readily available to anybody in accordance with the existing practices.
