1 The LAUSD Project Stabilization Agreement (PSA)

2 What is the Project Stabilization Agreement? The PSA is a collective bargaining agreement between the Los Angeles Unified School District s Board of Education and the Los Angeles/Orange Counties Building and Construction Trades Council The Los Angeles/Orange Counties Building and Construction Trades Council and the signatory craft unions Establishes labor relations policies and procedures for the District and for the craft employees represented by the Unions

3 Goals and Objectives Prevention of work stoppages or slowdowns throughout the project construction period To provide efficient and effective procedures for construction, including assurances of a sufficient supply of skilled craft persons and a standardized grievance procedure when matters do arise To encourage contracting with small businesses that reflect the diversity of Los Angeles To provide workers and hire from the local geographical labor pool when possible

4 What work is covered by the PSA? All projects funded or partially funded by Proposition BB and/or Measure K Any projects funded by future bond money All project work that meets the above criteria and is not expressly excluded in the PSA

5 What is NOT covered by the PSA? All construction work pursuant to prime multi-trade construction contracts that do not exceed $175, All prime specialty contracts that do not exceed $20, and all subcontracts flowing from these prime contracts Work of non-manual employees: superintendents, supervisors, staff engineers, quality control, time keepers, mail carriers, clerks, office workers, safety personnel, emergency medical and first aid technicians, management employees Equipment and machinery owned or controlled and operated by the District

6 All off-site manufacture and handling of materials, equipment or machinery All employees of the district, Project Labor Coordinator, consultants for the District Off-site maintenance of leased equipment and onsite supervision of such work Work by employees of a manufacturer or vendor necessary to maintain such manufacturer s or vendor s warranties or guaranty Non-construction support services contracted by the District, Project Labor Coordinator, or contractor in connection with this project Laboratory work for testing

7 Parsons Constructors Inc. (PCI) The District has designated a contractor (PCI) as the Project Stabilization Agreement Coordinator to monitor compliance with this Agreement Assist the District in developing and implementing the programs referenced herein, and to otherwise implement and administer the Agreement for the duration of the Project.

8 Project Stabilization Agreements (Administration) Administer & Interpret the Project Stabilization Agreement Develop / Implement Labor Relations Guidelines for Contractors Mediator / Facilitator for Labor & Contractors Document All Grievances, Disputes, and Resolutions That Occur Encourage and Assist the Participation of Local Small Businesses in Project Work Encourage the participation of local residents in project work» We Build Program» Local Hire» Apprenticeship / Training Establish Monthly Labor / Management Meetings Provide Effective Team to Minimize Contractor Misunderstanding and Change Orders Communicate With Los Angeles Unified School District s Representatives on Labor Relations Issues

9 Local Hire LAUSD goal is 50 percent of workers will be District residents Unions and contractors will work with the District and PCI to obtain this goal Additional programs and apprenticeship

10 Apprentices The parties recognize the need to maintain continuing support of the programs designed to develop adequate numbers of competent workers the parties will facilitate, encourage, and assist local residents to commence and progress in Labor/Management Apprenticeship and/or training Programs Meet with and tour local apprenticeship and training facilities (building trades, adult education, occupational skill centers, community programs) We Build Program and community outreach Apprentices may comprise up to thirty percent of each craft s work force at any time When possible, 40 percent of apprentice work force shall consist of 1 st year apprentices

11 What will all workers be paid? Prevailing wages as determined by the State of California

12 Standardized Dispute Resolution Strikes, work stoppages, slowdowns, or other disruptive activity arising out of any dispute or negotiation of local collective bargaining agreements are not allowed Expedited procedures are established to enforce the no strike/no lockout commitment Regular monthly labor-management meetings are established to resolve potential disputes Standardized grievance/jurisdictional procedures are in place for all contractors and unions (communication, correspondence, meetings, immediate arbitration) The Plan (Union jurisdictional disputes)

13 Impact on Small Contractor Union and non-union contractors will be able to compete for work on the Project. All contractors must sign a Letter of Assent, which covers only the specified Project. No contractor is or will be required to sign any other Agreement with a signatory union as the condition of performing work within the scope of this Agreement. Fringe benefits and subscription agreements (only job specific) A specialty or sub-contractor may employ, as needed, first, a member of his core workforce, then an employee through a referral from the appropriate union hiring hall, and so on until a maximum of five core employees are employed, after which all further employees shall be employed pursuant to the other provisions of this Article, starting with Section 3.3. (Through union hiring hall)

14 A general and/or multi-trade contractor (not engaged in specialty work) may first employ his core workforce prior to utilizing the referral procedures. The core work force is comprised of those employees whose names appeared on the contractor s active payroll for fifty of the one hundred working days before award of Project Work to the contractor Who possess any license required by state or federal law for the Project Work to be performed Who have the ability to safely perform the basic functions of the applicable trade Who are residents of the District on the effective date of this Agreement

15 Union Involvement The provisions of the PSA, including the Schedule A s (which are the local collective bargaining agreements of the signatory unions) shall apply to work covered by this agreement Where a subject covered by the provisions of the PSA are also covered Where a subject is covered by a provision of a Schedule A and not covered by the PSA, the provisions of the Schedule A shall prevail Coordinate with the contractor and PSA Coordinator to maintain an adequate supply of qualified workers and a stable labor relations environment
