1 Terms of Reference (ToR) Local Consultant for Institutional Capacity Assessment of ISKUR within the scope of Employment and Skills Development Project under UNDP Turkey Syria Crisis and Resilience Response Programme 1. Background and Context As of April 2018, Turkey hosts over 3,5 million Syrians under temporary protection 1. Syrians are mainly located in the Southeast Anatolia region bordering Syria, but as the crisis continued, the population has expanded to other regions as well. Turkey hosts the largest refugee population in the world and has demonstrated strong national ownership of the response. The Government of Turkey provides a rights-based legal framework through the Temporary Protection regulation, which offers access to education, health care, employment and social security to Syrians. According to the Government of Turkey, it spent 30 billion USD over the last 5 years on the response to the Syria crisis. Currently, out of the 3,5 million registered Syrian refugees, more than 2,6 million refugees live amongst Turkish host communities 2. 45% of the 3,5 million refugees are concentrated in 4 provinces in the South East. Within these provinces, there are four municipalities in Turkey that are particularly impacted, each hosting more than 100,000 Syrians. In these cities, the ratio of the Syrian population to that of host communities is higher than 15%, including Kilis, Hatay, Gaziantep and Şanlıurfa 3. Populations have either reached or exceeded 2023 population projections. Kilis, for instance, hosts almost as many Syrian refugees as its local population. UNDP supports the Government of Turkey to respond to this large-scale displacement through its Syria Crisis Response and Resilience Programme in Turkey to strengthen the resilience of refugees, host community members, local municipalities and relevant national institutions to cope with and recover from the impact. UNDP s resilience response strategy is to invest in existing national and local systems to ensure they can adequately serve both host and refugee communities. UNDP uses a resilience-based development approach which focuses on support to the Government of Turkey on both the supply and demand side of the labor market on the Jobs and Employment component. In terms of the labor supply side, this includes amongst others market based vocational skills training, adult language skills training business skills development. UNDP will also provide institutional capacity development to expand employment delivery for Syrians and host community members, aiming a more systematic and sustainable result. In terms of labor demand side (i.e. job creation), UNDP is works on value chain development and the establishment of SME Capability and Innovation Center for business advisory services to local entrepreneurs. Following the adoption of the Regulation on Work Permits of Foreigners under temporary protection (hereafter Work Permits Regulation) in January 2016, an estimated Work Permits have been issued by the Government of Turkey. UNDP provides support with respect to the implementation of this regulation in practice. Access to employment for both Syrians under temporary protection and host communities are challenged by increasing levels of unemployment. 2 service providers to is a key component of the long-term solution where UNDP is very well positioned through Syria Response and Resilience Programme in strengthening livelihoods for impacted communities-supporting local economies and employability of impacted communities, providing infrastructure and service delivery support in host communities and supporting initiatives to strengthen social cohesion between two societies. With funding from KfW, UNDP and Turkish Employment Agency (ISKUR) implement Employment and Skills Development Project which aims to strengthen the institutional capacity of ISKUR headquarters and provincial offices in four pilot provinces with highest amount of Syrian population to increase the quality of the active labor market services available for the impacted communities including both Syrians under temporary protection and host communities. 2. Objectives The overall objective of this assignment is to assist in preparation of the procurement documents for the tender of institutional capacity assessment activity within the coverage of aforementioned project and to conduct a market analysis along with an estimated budget for the required services and to support UNDP Turkey Country Office in evaluation processes with a special focus on active labor market services and institutional digital transformation requirements. 3. Description of Responsibilities Within the scope of the Assignment; the Individual Consultant (IC) is expected to provide consultancy services for the below listed activities. To have a preliminary analysis of ISKUR s Employment Services and contributing to project team for the preparation of the methodology of the Assessment and provide technical inputs by reflecting the Project Methodology to the Terms of Reference for the provision of the service on Institutional Capacity Assessment of ISKUR To cooperate with the other Individual Consultant who will provide input on the digital transformation systems to be incorporated into the Terms of Reference. To carry out a Market Analysis for the agreed activities in the project for the Institutional Capacity Assessment of ISKUR along with an estimated budget for each specific activity to be included in the Procurement Documents To provide technical support to UNDP Turkey CO during the evaluation of the tender. To identify the overlap of the activities currently implemented by ISKUR To conduct series of discussions and meetings with ISKUR as well as relevant stakeholders The above listed activities are subject to develop and change with consent of UNDP. If required by UNDP, the IC may provide additional consultancy services related to her/his competencies and expertise.

This estimation is provided merely to facilitate guidance to the Consultant. The number of days presented as estimated number of man/days to be invested is indicative. The IC may invest less/more than the expected number of days to finalize each deliverable/output. The amount to be paid to the Consultant for each deliverable/output cannot exceed the respective amount of man/days stipulated in the above table. The amount paid shall be gross and inclusive of all associated costs such as social security, pension and income tax. 5. Institutional Arrangement UNDP will provide all relevant background documentation. UNDP is not required to provide any physical facility for the work of the IC. UNDP will cover pre-approved intra-city travel costs of the IC, when traveling to places where relevant meetings and discussions take place, upon submission of relevant documentation. The respective UNDP Project Manager will directly supervise the IC in close cooperation with the Senior Resilience Advisor and the Assistant Resident Representative (Programme). The IC will be directly responsible of, reporting to and seeking approval/acceptance of deliverables from the Project Manager of Employment and Skills Development Project. All reports should be submitted in English.

4 6. Place of Work and Guidance for Price Proposal Place of work for the assignment is Ankara. No travel is foreseen for the assignment but if needed, the cost and terms of reimbursement of any travel authorized by UNDP for Individual Contractor must be negotiated prior to travel. In case of need of a travel that are unforeseen in the ToR, the respective travels of the consultant may either be; Arranged and covered by UNDP CO from the respective project budget without making any reimbursements to the IC or Reimbursed to the consultant upon the submission of the receipts/invoices of the expenses by the consultant and approval of the UNDP. The reimbursement of each cost item subject to following constraints/conditions provided in below table; covered by the combination of the above options The following guidance on travel compensation is provided per UNDP practice. Minimum Qualification Requirements Education: - S/he shall have a bachelor s degree in Business Administration, Public Administration, Economics, Political Sciences, Social Sciences, or other related fields is required - Advanced degree (master s or higher) on a relevant field will be considered an asset General Professional Experience: - At least ten (10) years of general professional experience on capacity assessment of public institutions and/or international organizations and preparation of project methodologies, related project documents and Terms of References for project activities are required - Minimum five (5) years of working experience in active labor market services is required Specific Professional Experience: - Minimum of ten (10) years of relevant experience in the Capacity Development/Assessment Activities for Public Sector and and/or international organizations and conducting Market Analysis - Proven experience in working with ISKUR and/or familiarity with ISKUR services is considered as an asset - Knowledge on active labor market services within the local context and in international level is considered as an asset - Experience in drafting ToRs for tenders and evaluation of tenders is considered as an asset - Experience and/or familiarity with UNDP and/other UN agencies is considered as an asset - Proven research and report drafting skills, Language Requirements: Notes: - Full proficiency in English and Turkish - Internships (paid/unpaid) are not considered professional experience. - Obligatory military service is not considered professional experience. - Professional experience gained in an international setting is considered international experience. - Experience gained prior to completion of undergraduate studies is not considered professional experience. - To prevent any conflict of interest, the IC who will be employed in the position advertised as per the current Terms of Reference to aid in the creation of the methodology of the

6 procurement documents, cannot work for the firms who will place bids to undertake the assessment. 8. Payments The consultant shall be paid in US$ if he/she resides in a country different than Turkey. If he/she resides in Turkey, the payment shall be realized in TRY. The amount paid to the consultant shall be gross and inclusive of all associated costs such as social security, pension and income tax etc. Payments will be made within 30 days upon the approval of the corresponding deliverable and UNDP Certificate of Payment Form (COP) based on the actual number of days invested by the consultant for this particular deliverable without exceeding the estimated number of man/days stipulated by UNDP for the respective deliverable. If the deliverables are not produced and delivered by the consultant to the satisfaction of UNDP, no payment will be made even if the consultant has invested man/days to produce and deliver such deliverables. Tax Obligations: The IC is solely responsible for all taxation or other assessments on any income derived from UNDP. UNDP will not make any withholding from payments for the purposes of income tax. UNDP is exempt from any liabilities regarding taxation and will not reimburse any such taxation to the IC.
