Yes No This Training Agreement is a commitment between an employer and an employee (trainee) for training and assessment towards approved primary industry training programmes. It also serves as an application for Government and industry subsidised training. I, the Trainee agree To participate in off job training as required by the training programme being undertaken. To the best of their ability learn the skills required as taught to them by their employer. To undertake or request on job assessment to meet the requirements of the programme. By signing this Training Agreement, I acknowledge that I have agreed to participate in training programmes arranged by Primary ITO and delivered by a registered Training Provider and the Employer entirely at my own risk. Accordingly neither Primary ITO, the Training Provider or the Employer will in anyway be liable to me for any damage that occurs to my property in undertaking the training activities and if Primary ITO, the Training Provider or the Employer is found liable for any such damage then I fully indemnify Primary ITO, the Training Provider and the Employer in respect of any loss that they may suffer as a result. I, the Employer agree To allow the trainee to attend off job training or to study by distance as required by the programme. To provide training to the trainee that applies to the programme. To allow the trainee access to assessment by a Primary ITO assessor for the unit standards which are part of the programme. That our workplace has adequate health and safety procedures and policies in place, and the trainee has been informed of these. Termination of this Training Agreement This Training Agreement will cease when The trainee ceases to be employed by the employer named in this Training Agreement. The training ceases or is completed. The opportunity for training no longer exists due to the actions of either party. Legal entitlement to work in New Zealand ceases. Fees Fonterra has agreed to pay any training fees for the DAIRYCRAFT programme as per their contract with Primary ITO. General Nothing in this agreement shall affect the operation of the provisions of the Employment Relations Act 2000 or any subsequent amendments relating to personal grievances or the enforcement of the employment agreement generally. The Trainee agrees that the Primary ITO may give information about their progress to the employer named in this Training Agreement. The Trainee and Employer agree that information gathered as a result of this Training Agreement may be disclosed to outside organisations including TEC for statistical and reporting purposes, NZQA for recording achievement, Industry Good Bodies supporting training, and research companies acting on Primary ITO s behalf. The Trainee agrees that Primary ITO may access information contained in government databases, including RealMe and VisaView, for the purposes of checking study entitlements. The Employer and Trainee do not know of any other government benefit they may be receiving that could preclude the trainee from receiving subsidised training. The Employer and Trainee agree to inform the Primary ITO of any proposed changes to the training or employment arrangement that this Training Agreement applies to. This Training agreement is a commitment between the Employer, Employee and Primary ITO for training and assessment towards approved industry training programmes. It also serves as an application for Government and industry subsidised training. The trainee agrees that the Primary ITO may use their personal details in external publications as applicable e.g. celebrating success and other graduation publications. Employment agreements. The employer and trainee confirm they have a valid, written employment agreement. If the trainee is a self-employed contractor, the trainee confirms s/he is working in New Zealand under an arrangement with an organisation in the nature of employment (eg, an exclusive contract of service). If the trainee is a volunteer, s/he confirms an arrangement in the nature of employment with the host organisation.
