CRITERIA Offers evaluation criteria: From the correct offers, Purchaser will choose the most advantageous offer based on two criteria price (max. 90 points to get) warranty period (max. 10 points to get) Price (C) max. 90 points, the result is calculated according the formula: Result of the offer being considered (C)= (Cn/Cb) x 90, where: Cn- price of the cheapest offer (PLN) Cb- price of offer being evaluated (PLN) The offer price is the net value given in Polish zlotys or in EURO, for which the Bidder undertakes to perform the entire subject of the order. The offer price should be determined with an accuracy of 2 decimal places. If the quotation price will be placed in EURO it will be calculated on the base of average exchange rate of National Polish Bank in to the day of validation of quotation Warranty period (G) max. 10 points, result for the particular offer is calculated according the formula: result for the offer being considered (G) (G B /G N ) x 10,where: G B warranty period of offer being evaluated (in months)

2 G N the best offered warranty period (in months) Warranty period- voluntary certification of the quality of goods submitted by the Bidder. The content of the guarantee should be formulated in a clear and legible manner in Polish. The duration of the warranty will be specified in the guarantee document - warranty card. The most advantageous will be the offer with the highest sum of points received from C and G O = C+G SUBMITTED OFFER EVALUATION -Purchaser will eveluate the prices of the offers in terms of formal and compliance with this inquiry -the offer will be rejected if: its content does not correspond to the content of the inquiry; its submission is an act of unfair competition within the meaning of the provisions on combating unfair competition and is inconsistent with applicable law, it is incomplete (eg. no attachments, no signatures on attachments) it was submitted after the deadline indicated in the request -due to the rejection of the offer, Bidders are not entitled to any claims against the Purchaser -no information regarding the evaluation process and selection of offers will be disclosed to Contractors or other persons who are not officially involved in the evaluation and selection process of the offer. The Purchaser may, in the course of examining and evaluating offers, request explanations from the Bidders regarding the content of submitted offers. EXCLUSIONS Participation in the proceedings excludes Bidders related by capital or personally with Bud-Expert Sp. z o.o. a)capital or personal ties mean the relationship between the Purchaser or the persons authorized to incur liabilities on behalf of the Purchaser or persons performing on behalf of the Purchaser the activities related to the preparation and conduct of the procedure for selecting the Bidder and the Bidder consisting in particular of: a) participating in a company as a partner in a civil partnership or private limited company b) holding at least 10% of shares or stocks c) acting as a member of a supervisory or management body, proxy, attorney, d) staying married, kinship or affinity in a straight line, second degree affinity or second degree affinity in a lateral line or in relation of adoption, care or guardianship. 3 full name of the Bidder and the address or registered office of the Bidder and the telephone number, the price of the offer presented net and gross - it is important that the price includes the total cost of the device together with additional equipment and includes all other costs related to the implementation of the order, expiration date - the minimum period of the offer is 30 days from the date of receiving the offer, The offer should be in writing and prepared in Polish or in English on the offer form constituting Annex 2 to the inquiry The offer must be signed by a person / persons authorized to act in the legal course, on behalf of the Bidder (the signature must be legible or be stamped with a personal stamp) and be stamped with the company stamp, Each Bidder is obliged to submit with the offer a statement on the lack of personal or capital ties, constituting Annex 3 to the request for proposals and a statement on the ability to perform the contract - Annex No. 4. TERMS OF CHANGING THE AGREEMENT The Purchaser provides for the possibility of making changes to the provisions of the contract in relation to the content of the offer, based on which the contractor was selected, primarily when it is beneficial to the Purchaser and was not foreseeable at the signing stage. Admissible changes will be in particular: 1. Changes in the deadline for the completion of the subject of the contract at the request of the Purchaser or for reasons independent or justified by the Contractor, 2. Update of the data of the Contractor and the Purchaser by: changing the name of the Contractor, changing the address of the registered office, changing the legal form, etc. 3. There will be a change in the generally applicable provisions of law in the scope affecting the implementation of the subject of the contract, 4. There are circumstances caused by external factors such as force majeure, unpredictable weather conditions and other external circumstances that may affect the implementation of the provisions of the contract, 5. Objective reasons independent of the Purchaser or Contractor, Conditions for making changes: any changes and additions to the contract concluded with the selected Contractor must be made in the form of written annexes to the contract signed by the parties, under pain of nullity FINAL PROVISIONS The Purchaser reserves the right to close the offer procedure without choosing the offer or canceling the Procedure without giving reasons. In such a case, the Bidders are not entitled to any claims against the Purchaser if he uses any of the aforementioned entitlements.
